      Sir, nabili ko po na lupa katabi ng creek , pagbakod po namin umatras po kami ng 1 meter para po sa gagawing riprap ng gobyerno. Ngayon po start na ng construction , at ayon sa engineer di daw po aabot sa bakod namin ang riprap.
      Ang tanong ko po, pagkatapos ng construction pwede ko po ba makuha ulit yung portion sa labas sa pagitan ng riprap at ng bakod namin. Sa right side po ito ng lote at creek na po ang katabi.

    Gandang araw, Atty. Ang tanong ko po about road right of way or easement... dahil ito po ay usually ginagawad ng owner ng lupa/property by executing the Deed of Donation para sa mga pribadong mga tao na nakabili ng portions ng said property for residential purposes, pwede parin bang mapawalang bisa ang deed of Donation na ito at mabawi ng owner pagdating ng araw na kakailanganin nya ang nasabing portion ng lupa?

    Atty my problema po kami sa right of way dito sa amin,dati kasi nakakaderetsyo kami dito hanggang bahay ng naka 4 wheels pero eventually nung nkakain n ng ilog yung daanan pinagbawalan n kami mgpasok ng sasakyan ng may ari ng lupa n dating dinadaanan nmin papasok dito aa property nmin,ngayong naaayos n po yung gilid ng ilog ayaw prin po kami payagan n mg pasok ng 4 wheels nmin.na try na namin kausapin yung my ari if pwedi kami makabili ng right nmin kahit yung saktong maipapasok lang yung sasakyan hanggang dito smin pero hindi pumayag. Ano po kaya magandang gawin kasi mula pa nung tumira kami dito ayun na yung daanan nmin palabas sa main road? Both senior na kasi parents ko at buntis pa asawa ko kaya mejo pinupush ko sana n mgkarun tlga ng matinong daanan palabas at papasok dito sa amin

    As per the Building Code 1096 As it is situated outside of private property limit, the easement is public land i.e public domain, that should be equally enjoyed by all members of the community.

      Correct. Public or legal easement over certain property is always subject to public use and purpose at not for the exclusive use or domain of certain individual or persons but for the benefit of the community at large.

Yung haft portion po kasi ng property ng Father ko ay naibenta pero declaration of rights lng po meron kami at binigyan po sila ng daanan para po sa Tenant nila na makadaan ang its almost 20 years na po and ngayon po nagkakagulo yung mga anak ng nakabili ng haft portion ng Lupa Thru transfer of rights at gusto po nmin na alisin na po yung daanan para di na po kami madamay sa gulo nila. Pwede po ba yun?

    Nakatira kami sa tabing ilog at may 3 m easement po kami, yung po easement dati ay binahayan ng mga squatter at nabiyan napo sila nang relocation ngunit may isang pamilya nag squat uli pero may relocation napo sila at sa property namin sila dumadaan, may karapatan po ba sila dumaan sa property namin? ano ang dapat naming gawin?

    Hi Atty, may i ask the law you have cited in this lecture pls? specifically mandatory row (easement in water bodies) and if road is being used as road for 10 yrs or more owners have no right over the property there after. Thank you po.

      Under Executive order No.621- Dated September 18,180- "National roads shall have a right of way of not less than twenty (20) meters, provided, that such minimum width may be reduced at the discretion of the Minister of Public Highways to fifteen (15) meters in highly urbanized areas and that a right of way of at least sixty (60) meters shall be reserved for roads constructed through unpatented public land and at least one hundred twenty (120) meters reserved through naturally forested areas of aesthetic or scientific value."
      Article 51(P.D. No.1067): The banks of rivers and streams and the shores of the seas and lakes throughout their entire length and within a zone of three (3) meters in urban areas, twenty (20) meters in agricultural areas and forty (40) meters in forest areas, along their margins are subject to the easement of public use in the interest of recreation, navigation, floatage, fishing and salvage. No person shall be allowed to stay in this zone longer than what is necessary for recreation, navigation, floatage, fishing or salvage or to build structures of any kind.

      As regards the easemen/right of way subject to acquisitive prescription of 10 years , take note of the provsions of the Civil Code of the Philippines, to wit:
      Art. 620. Continuous and apparent easement are acquired either by a title or by prescription of 10 years.
      Art. 621. In order to acquire by prescription the easements referred to in the preceding article, the time of possession shall be computed thus: in positive easements, from the day on which the owner of the dominant estate, or the person who may have made use of the easement, commenced to exercise it upon the servient estate; and in negative easements, from the day on which the owner of the dominant estate forbade, by an instrument acknowledged before a notary public, the owner of the servient estate, from executing an act which would be lawful without the easement.

    Sir, bumili ako ng lupa sa tabi ng ilog at may dalawang lot bago marating ang main road way, ngayon nag lagay ng diversion hiway and bridge that they constructed 100 meters from my lot , is there a way I can request an access to the new hiway which is a 100 meters away compare to 650 meter walk to the public road?

      @@leonardorioflorido8683 Yung lupa ko ay nasa ilog ang 20 percent ng 1 hectar, ay under water pa, tapos nilagyan na ng riprap at yun din ang ginamit na daanan ng mga construction equipments, Excavator/ Dump truck, pero sa opposite side ng bagong tulay ang dinaanan nila, gusto ko sana dito sa side namin kasi maraming taniman na gulay , mero silang hiway widening project ang balak ko ay mag pa pirma ng mga petition on all farmland involve to have access to the public highways

    Mai-kwento ko lang po; ang lot po namin at surrounded by our relatives' lots on three sides with public lot on the front. Ang government lot at puro na bahay, pero iniwan kami ng daanan ng tao lang ang makadaan na hindi nga pweding may beseklitang dala. Sinabihan namin sila, at humingi ng madaanan ng sasakyan, pero kinaso pa rin kami nila. Natalo sila at pinapaalis silang lahat sa harap ng lot namin or pinapaatras ng at least 4 meters, clearing the whole length of that side. Binigyan lang kami ng "mga squatters" ng 4 meters perpendicular to our lot (Iyong una naming hiningi), para maka daan ang sasakyan kung papasok sa lupa namin. Para yata sa mga "squatters" na ito ang lupa ng gobyerno para sa kanila lang, hindi para sa lahat.

      Kung base sa inyong kasulatang bilihan ay maliwanag na ung may-ari ay nagkaloob sa inyo na right of way/easement o gamitin ang ito bilang maging access into sa paglabas at pagpapasok ng mga tao sa property ang maari mong gawin ay magpadala ka ng letter sa may-ari na dapat matanggap niya ito, na nag demand na nilisin na at fully buksan ang kalsasa para inyong magamit. At nakalagay din sa inyong sulat, na pag walang gagawing kaakibat na hakbang at i-comply ang inyong demand, ay nangangahugan nito ang pagpapayag ng may-ari na kayo na mismo ang mag bukas ng daan at ito at maraming puno ang matatamaan dito. May sagot man o hindi ung may-ari ay huwag ninyo basta na lang putulin ang mga puno, ng walang permit na galing sa DENR upang hindi kayo makakasohan. May pag ka kulong ang penalty rito. Another option is mag file kayo ng reklamo sa Barangay laban sa may-ari sa hindi pag tupad sa inyong bilihan. Kung walang kasunduang maganap ay kumuha kayo ng certificate to file action, upang makapag file kayo ng kaso sa korte for specific performance with damages and attorney's fees laban sa may-ari ng lupa.

    Sa ngayong yung kapitbahay namin humihingi ng right of way, pero sila naman po talaga ay may maluwag na daanan at lupa nila kaya medyo hindi shortcut, yung daanan nila kaya gusto nila doon sa lupa namin, kasi shortcut. Hindi naman po kami nagbenta ng lupa sa kanila

    Looking forward po sa part 2. Gusto ko po malaman sana pano po kaya magkaron ng right of way katulad namin na napalibutan ng private lot. Ang daan lang po namin ay maliit na eskinita private property din, more than 50 years na rin kami dumadaan dun. At sa kabila ng bakod namin may malaking daan naman. Kaso sa bakod na yun may linya ng kuryente. Pano po kaya namin mapasama sa titulo ng lupa namin ang right of way both sides?

    Kung gagawa ka ng daanan para sa land development, kailangan paba mag paalam sa nag rerenta ng lupa, my nag rerenta po sa lupa, pero amin paren ito.. yung pag renta ay 25, 75.. hnd naman mag bawas ng lapad ng lupa nirerenta dahil kung gusto ng nag rerenta ay puedi dn nia kunin sa tabi ng lupa na nererenta nia kasi amin parin itong lupa na ito..

    Atty.yung lote mg mga mgulang nmin at 150 square m. Tpos ibinenta Yun 50 square m bandang likod..tpos Yung right of way nila at 1 meter Ang lapad ..Mula sa Kanika palabas mg kalsada..
    Ngayon inaangkin nila na Yung right at pag aari raw nila..
    Walang ngbabawal n dumaan Sila duon kahit ilang henerasyon pa mg pamilya nila Ang umiral..
