For all the guff that Nintendo gets for their practices, they're the ones doing the best. You may not like the crackdowns on fanbase, but they're the ones who prepped for this generation and are succeeding while all other companies and their bad practices are causing the next gaming crash. I don't know, maybe Nintendo has reasons for why they're doing what they're doing.
The DMCAs are Warnings from Nintendo. If they issue a DMCA Takedown they’re legally warning you to remove the copyrighted thing, which in this case is a mod, while threatening to take legal action if the mod isn’t taken down.
I did some research for a school project on copyright on games and DMCA claims, and there is a precedent made in a court case that modding counts as derivative work of a piece, and only the original author of the work has the right to make those derivative works, like sequels, updates, or DLCs. A lot of companies waive those rights by allowing mods because it helps with game sales, but Nintendo want's to protect their IPs and doesn't want people figuring out how they make their games because its a trade secret. They especially want their physics engines in Breath of the Wild and Tears of the Kingdom kept out of the public eye.
Nintendo's attitude towards copyright and takedown notices comes from their copyright claim laws in Japan. "Fair use" doesn't mean the same to them as it does to us which is why they're so eager to go after even non-profit projects and "letters of love"
It's almost like the more they protect their IPs, the more beloved and desired they are by fans. But I don't get it. I mean, dragonball, marvel, DC, Star Wars, etc all went to fortnite, but it's like they were all just cheap cash-ins with no character, nothing fleshed out, and they're all just a shell of the characters they are.

You don’t get to become the most important company in japan with over a century of doing business by being not protective of their IP’s. They survive this long because they know what to do to keep it going. The truth is that we can’t have nice things because there is always someone there that ruins it for everyone. Once they grow lax and give a inch, people would dare to take a yard. They have a image to uphold. And their IP is their most valuable asset.

PS was new, cool, and had the graphics and technical arsenal to lay waste to Nintendo. Fast forward round 30 years and all their advantages go out the window. All of Nintendo's quirks, their choice of art style, they're philosophy in terms of development, along with their strong armed tactics of keeping fans in their place, have garnered them with best spot in gaming, today. Where they are expanding into movies and theme parks with their coveted IPs, acquiring new studios with long terms plans prior to buying them, hiring new employees to get ready for their next long awaited console, Playstation and Xbox are scrabbling to get their affairs in order. All their acquired studios are being emptied out just so they have bought IPs that no longer have the talent behind them. With all that in today's gaming infrastructure, I can't be mad at Nintendo for modding take downs and other fan related takedowns. It's the same reason why Nintendo games continue to sell their games at $60 retail even after 6 years in the market and the fan base is there. As a greedy giant company, I see Nintendo's business acumen today and the path they're setting for, I have faith it will be just as strong in the next 20 years.

Bethesda hasn’t lost Skyrim, valve still owns half life, and if someone could steal either of those by putting a Mario hat on a khajiit and start earning millions, they would have done so. This is how you know it's not a tribute or a fan. Someone had once created a pokemon game, did it in 3 years, it was good, got taken down almost as soon as they uploaded it. They were mad, cursed at, and disavowed Nintendo for it. But they knew the climate, they knew of the strikes. Modding also keeps old games from dying. Emulators keep GBA, GBC and DS games alive but it seems like Nintendo doesn't want people to play games they aren't selling anymore.
Yeah, I know. Whereas Nintendo would rather use in house employees with better track records and are well paid for what they applied to. Not only that, but Nintendo would rather employ studios like Capcom or Bandai Namco to help them develop their games instead of fans who are most likely not in the same degree of experience as the ones that are already in the industry. As long as you use emulation for games that you do own and it’s of an old system that does not get much attention anymore. Now Switch emulation I would understand needs to be taken down because that is a present system that Nintendo is still supporting and getting money from. Same thing goes with Sony and PS5.

This subject, while nothing new was brought up by Mutahar aka, SomeOrdinaryGamers around a month ago along with other TH-camrs. The thing that confuses me about this whole situation is why they decided to take action at that very moment? Garry's Mod has had these Nintendo-related addons up for years and Nintendo didn't do anything about it. I highly doubt that they didn't know about Garry's Mod all this time and if they somehow didn't know, then what age is Nintendo living in? They went from being okay about it, to taking action. Like, the timing of this was really strange. Nintendo may succeed in certain aspects, but this is not one of those aspects, unfortunately. Not like this is all that surprising though. But there's still the possibility that these DMCA strikes aren't from someone affiliated with Nintendo.

The last nintendo machine I had was the wii. I learned quickly that they do not want me to buy the games I want to play, so I refuse to pay for a machine they want me to buy. I think they have made 2 games in the last 2 generation I wanted to play, but buying a switch for 2 games is not worth it.

As someone who is currently working on a Fire Emblem fan project, I am terrified of word getting out to Nintendo about it. I’ve been working on it for almost two years now, and started casting back in October. If Nintendo DMCA’s it, I honestly don’t know what I’d do, because it’s a project I’ve been putting my heart and soul into. 😰

It’s still in the final planning stages, and casting is almost done, but I still don’t know if it’s going to be a fully fledged game, or just cutscenes dubbed over. Plus, the concept of the project is a bit similar to Engage (even though I’ve been working on it since before Engage was even announced), but ever since I knew Engage was a thing, I’ve been trying to differentiate it from the game, which is easier said than done. I’ve been trying everything I know to try to not get it DMCA’d, but it’s very hard to just make it different from the official game. (Sorry for the long reply, I just have been thinking about this for a while. 😅)

Dude, you can't have it both ways. Either you're a fan, or you're using FE as a jumping off platform. You can be a fan and make a game, keep it to yourself and just be a fan. Or are you doing it to backpack off their IP to get yourself in a certain position. Because if you're just a fan, be a fan and show it to your friends without the world knowing about your project. That's not even to say that you can't just make an original game? If you make it an original game, then that's fine. But don't come here telling people about a fan game you've been working on for 3 years and not expect it to get DCMA'ed. You know that's Nintendo's modus operandi when it comes to fan games. Just redo everything as an original.
Actually I think it is illegal now in Japan to mod and emulate games without a creator's/company's consent (as of 2018? I don't remember the date). The ruling basically implies it's illegal to use/have a piece of software on anything or in any way that wasn't originally intended by the creator. So you can't change/add/remove code (even for an unofficial game patch), you can't "port" and play it on another device, you can't even have it in your possession if you got it from someone else. If you are found guilty, you can face fines and even jail time.
I so heavily agree with this. Nintendo is being way... WAY too strict about mods and related fan-made stuff involving their IP's. IMO they just don't get the very people who like their games. They don't get, that because of their recent obsession with ports and remakes, and overall dwindling quality of their own products and games, fans are taking matters into their own hands and show their passion by innovating in new ways using familiar setpieces. Nintendo is hurting their own viability and marketing right here, and they are hurting their own fanbase, too.

Sadly this is the case with a LOT of major Japanese companies. They are extremely strict with this kind of stuff. Nintendo stands out a ton though just due to their mainstream nature.
Sometimes I genuinely can't tell if Japanese copyright laws are just THAT f&(!ed, or if it's just Nintendo whose copyright policies are more f&(!ed than others (wouldn't surprise me if it was both)
I do wonder why they do this, if it is somehow because of marketing then how does that even make sense? Obviously, those could encourage people to buy the game if they want to mod their switch but how would mods have a negative influence on someone's decision to get a game? You have to go out of your way and already be interested in a game to look into mods, I mean name a scenario where mods could negatively influence the decision to buy a game. The best thing I could think of is someone looking at external downloads and having a modded switch could get them interested in pirating, but that feels like a bit of a stretch.

I never loved the "it's free advertising" argument. Unlike most other game companies, Nintendo is very concerned about its brand. And right now, they'd probably prefer their brand to be presented exactly as it is over getting uncontrolled branding associated with their products and IPs. I'm pretty sure a lot of other games would take any press, because they're not concerned about branding for their one game or their much smaller series with little to no potential for merchandising. Disney and Nintendo benefit from having their IP be pretty pristine. Sonic, a massive IP in itself, _does_ benefit more than any hit its brand might take. And most people who play Nintendo games: my roommate, my friend, my mother, do not care if Nintendo takes down mods.

Modding also keeps old games from dying. Emulators keep GBA, GBC and DS games alive but it seems like Nintendo doesn't want people to play games they aren't selling anymore.

Yeah, I know. Whereas Nintendo would rather use in house employees with better track records and are well paid for what they applied to. Not only that, but Nintendo would rather employ studios like Capcom or Bandai Namco to help them develop their games instead of fans who are most likely not in the same degree of experience as the ones that are already in the industry. It's almost like Nintendo has the aversion of placing their trust in people who use their IP without permission.

@@lordlopes2424 Emulation is okay to an extent. It isn’t illegal in the US but it could still be considered piracy. As long as you use emulation for games that you do own and it’s of an old system that does not get much attention anymore. Now Switch emulation I would understand needs to be taken down because that is a present system that Nintendo is still supporting and getting money from. Same thing goes with Sony and PS5.

@@PikachuLover0927 Yuzu deserves to be taken down. Citra came out the same as 3ds and Yuzu starting emulating Switch games as soon as it came out. Emulation is supposed to be preserved games but i saw Citra back in 2013 competiting with 3ds.

This subject, while nothing new was brought up by Mutahar aka, SomeOrdinaryGamers around a month ago along with other TH-camrs. The thing that confuses me about this whole situation is why they decided to take action at that very moment? Garry's Mod has had these Nintendo-related addons up for years and Nintendo didn't do anything about it. I highly doubt that they didn't know about Garry's Mod all this time and if they somehow didn't know, then what age is Nintendo living in? They went from being okay about it, to taking action. Like, the timing of this was really strange. Nintendo may succeed in certain aspects, but this is not one of those aspects, unfortunately. Not like this is all that surprising though. But there's still the possibility that these DMCA strikes aren't from someone affiliated with Nintendo.

The last nintendo machine I had was the wii. I learned quickly that they do not want me to buy the games I want to play, so I refuse to pay for a machine they want me to buy. I think they have made 2 games in the last 2 generation I wanted to play, but buying a switch for 2 games is not worth it.

As someone who is currently working on a Fire Emblem fan project, I am terrified of word getting out to Nintendo about it. I’ve been working on it for almost two years now, and started casting back in October. If Nintendo DMCA’s it, I honestly don’t know what I’d do, because it’s a project I’ve been putting my heart and soul into. 😰

@@danie8944 I’m currently running cutscene concepts on Sacred Stones’s engine, but I want it to be fully voice acted, so I don’t know if the final version will be on GBA. It’s still in the final planning stages, and casting is almost done, but I still don’t know if it’s going to be a fully fledged game, or just cutscenes dubbed over.
Plus, the concept of the project is a bit similar to Engage (even though I’ve been working on it since before Engage was even announced), but ever since I knew Engage was a thing, I’ve been trying to differentiate it from the game, which is easier said than done. I’ve been trying everything I know to try to not get it DMCA’d, but it’s very hard to just make it different from the official game.
(Sorry for the long reply, I just have been thinking about this for a while. 😅)

From what you've described, though, I wouldn't worry about Nintendo coming for you. (Saying this as someone who has both played and helped create fe fan games on the SS engine with varying levels of intricacy)
Just make sure that if you're not using a GBA engine or assets to not use post 3ds stuff (ideally father back) and you'll be fine
Dude, you can't have it both ways. Either you're a fan, or you're using FE as a jumping off platform. You can be a fan and make a game, keep it to yourself and just be a fan. Or are you doing it to backpack off their IP to get yourself in a certain position. Because if you're just a fan, be a fan and show it to your friends without the world knowing about your project.
That's not even to say that you can't just make an original game? If you make it an original game, then that's fine. But don't come here telling people about a fan game you've been working on for 3 years and not expect it to get DCMA'ed. You know that's Nintendo's modus operandi when it comes to fan games. Just redo everything as an original.

Actually I think it is illegal now in Japan to mod and emulate games without a creator's/company's consent (as of 2018? I don't remember the date). The ruling basically implies it's illegal to use/have a piece of software on anything or in any way that wasn't originally intended by the creator. So you can't change/add/remove code (even for an unofficial game patch), you can't "port" and play it on another device, you can't even have it in your possession if you got it from someone else. If you are found guilty, you can face fines and even jail time.

I so heavily agree with this. Nintendo is being way... WAY too strict about mods and related fan-made stuff involving their IP's. IMO they just don't get the very people who like their games. They don't get, that because of their recent obsession with ports and remakes, and overall dwindling quality of their own products and games, fans are taking matters into their own hands and show their passion by innovating in new ways using familiar setpieces. Nintendo is hurting their own viability and marketing right here, and they are hurting their own fanbase, too.

I do wonder why they do this, if it is somehow because of marketing then how does that even make sense? Obviously, those could encourage people to buy the game if they want to mod their switch but how would mods have a negative influence on someone's decision to get a game? You have to go out of your way and already be interested in a game to look into mods, I mean name a scenario where mods could negatively influence the decision to buy a game. The best thing I could think of is someone looking at external downloads and having a modded switch could get them interested in pirating, but that feels like a bit of a stretch.

I never loved the "it's free advertising" argument.
Unlike most other game companies, Nintendo is very concerned about its brand. And right now, they'd probably prefer their brand to be presented exactly as it is over getting uncontrolled branding associated with their products and IPs.
I'm pretty sure a lot of other games would take any press, because they're not concerned about branding for their one game or their much smaller series with little to no potential for merchandising.
Disney and Nintendo benefit from having their IP be pretty pristine. Sonic, a massive IP in itself, _does_ benefit more than any hit its brand might take.
And most people who play Nintendo games: my roommate, my friend, my mother, do not care if Nintendo takes down mods.
