DFV Specialist here with 10 years experience. It’s important to look at a number of factors when determining primary perpetrations vs response violence. The most basic area of self defence is looking at parities and disparities. If an 80+ year old frail woman slaps my shoulder, I as a 6 foot tall 30yo male am not at risk for that and should not respond by laying her out. Now is it okay for her to hit me? No. It isn’t. But that isn’t free rein to respond with violence. Secondly, especially in relationship, we look at what we call “the rights paddock”. Who in the relationship has the most number of rights. Are the rights equal (not necessarily the same, but equal - for example if he has a job and she’s a stay at home Mum then their rights such as “going to work” and “spending more time with the kids” are going to be different in some respects). The person who has more rights is usually the person using primary perpetrations. But we still need to dig deeper. We then examine core beliefs. Perpetrators of DFV have one or more core beliefs which fall into - Superiority, Entitlement, and Adversity. The idea they are better than their partner, that they show entitlement for their partner’s time, resources, body etc., and that in order for them to win their partner must lose. When it comes to what we call ‘Mutual Conflict’ (some refer to this as mutual abuse but I disagree with the term), what we’re really looking at is a destructive conflict resolution style. Now this can include everything up to severe physical abuse. It’s two people who lack communication skills, and aren’t able to express their needs. This is still an issue and requires addressing, but isn’t the same as abuse. It’s usually characterised by people who have equal rights but aren’t attempting to control each other. Relationship counselling can work for mutual conflict. It cannot work for abuse. In fact it’s very VERY dangerous to use in abuse situations.
Sometimes, both players are toxic. They should not be beating on each other and nobody should use "they started it" as an excuse for abuse to escalate.

Where I live women get up to 3 hits before a man can claim self defense if he hits her back. I was appalled to hear that. I may be a woman and I def dont do any work outs or strength training but if I am slapping or hitting a man intentionally trying to harm them, then I think hitting me back to get space immediately for their own safety should 100% be legal. My boyfriend is a foot taller than me works a physical labour job and it 100% wouldnt be a fair fight because he can hold me down with one hand quite literally if he wanted to. If I ever attacked him, and abuse him physically I believe he should 100% have the right to hit me back so he can get to safety. Of course I think self defense ends when it enters retaliation/the threat is clearly subdued or fleeing, but if I went after someone and they had to let me keep swinging before they can physically stop me if there are no other options to safely get out seems like it is just punishing male victims. My first relationship was very emotionally abusive with so many threats of violence and death and still have trauma responses to certain things even though my current partner is one of the only people I feel truly safe with now. That shit sticks with you and the fact men got belittled and even villainized for being victimized by an abuser because their abuser is a woman is disgusting. They deserve support and to be believed just as much as I deserved to be believed and supported. Sorry. I just feel heated about these topics. Like I hate how normalized it is for a woman to be allowed to slap a man that its even in our media and its never self defense but a reaction anger or disgust to something. Like thats assault. 100%, everyone has the right to defend themselves. I was in a shelter from late 2022 - early 2023. I saw a woman burst out from the shelter and start brutalizing a man who was very obviously under the influence. He was sat on a bench, bopping around to whatever music he heard and talking to whoever he saw. All because he allegedly told folks in the shelter not to trust her... I won't get into specifics of what she did, but if the roles were reversed... the other folks with me in the courtyard would've jumped him to protect her. But the MOMENT he grabbed her arm to STOP HER ASSAULT AND HOLD HER AWAY FROM HIM AT ARMS LENGTH. IMMEDIATELY, the crowd started cussing him off, joins in on brutalizing him, and kicked him out of the smoke pit. The way folks are so brainwashed by the patriarchal notion that "men (and boys) can't be victims of ___ assault" is disgustingly mind-boggling. The only silver lining from situations like this is the truth that anyone (unfortunately) can be a victim of abuse, and anyone can be an abuser. Hopefully, we, as a society, can improve the ways we recognize abuse and support victims, regardless of sex/gender

When this first happened, everyone who reported it had to spend a few minutes explaining how we *might* have heard of her. I sort of chalked it up to "oh, so she was to Howard Stern what Alison Rosen was to Adam Carolla." Which is certainly a cool credit and all, but not enough to warrant the "don't you know who I am" vibe that Elisa seems to have.

Every time I'm about to see cops on camera handle DV/SA I clench so hard. Because I know some BS is coming. My own experience where a neighbour called the cops when I was being assaulted by a partner and they treated me like I was crazy because I was sobbing and shaking, and my partner was calm and collected. And then I got told not to waste police time. Girl my NEIGHBOUR called you.
Yep, my ex assaulted me but I ended up getting arrested because HE was the one that called the cops! Not a mark on him, but I had a black eye and giant chunks of my hair were all over the place. Luckily the judge dropped the charges against me after spending the night in jail 🤦♀️
I got lucky and ended up with pretty lovely officers when the same thing happened to me.. I was shocked frankly because I wasn’t expecting anything great. At least there are still some pretty good ones out there -but I’m so sorry you had to deal with such shitty ones 🥺

While yeah, most of B cluster ones can be pushed into questionable behaviors by their disorders, histrionics are (by my biased unprofessional opinion, but still) the ones who win the least from choosing to behave like… THAT. NPDs fear of not being perceived as the best, so pressuring the outliers into compliance is an easy way out; BPDs fear of abandonment, so poking everyone around to relieve the stress is an easy way out. Asocials are asocial. HPDs fear of being unnoticed; being an a-hole to remedy that is not easier than other options, it’s a personal choice. Basically, if “histrionic” in “histrionic a-hole” was treatable, the result would be an a-hole with lackluster performance. P. S. By mutual agreement with my therapist we’re not tackling the HPD traits cause (in my case) they don’t cause distress to anyone. But I can see how *in combination* with something else such traits may result in a feast.

Obviously with every disorder there are people who have other issues or are just sucky people who can further stigmatize those disorders. Cluster B personality disorders being very very negatively stigmatized. So I apologize if my comment came off in a way that adds to that stigma. But my thought process was more separating HPD as a whole and more looking at her traits, which the way she acts to get the attention she's looking for is bad. I'm not saying that as a whole for all people with HPD. As you said if you treat the HPD she will still be an ahole underneath, but that doesn't reflect all people with HPD. I'm also not diagnosing anything, just noticing tendencies. She is absolutely choosing to be an ahole to get what she wants and I agree there are easier ways. I'm glad your traits aren't causing distress and you have a good therapist who seems to fit your needs and goals.

Can someone please remind people like this that self defense is when you defend yourself from someone attacking you physically. Saying facts about you that you dont like doesn't make punching/slapping/kicking that person self defense. That makes it aggravated assault.
Yes!!! Also, when it comes to self defense, while every state is a bit different, the common legal theme is that you can defend yourself with reasonable force to do so. For example, someone hits you and comes to hit you again so you shove them away and they trip/ fall and get hurt. Justified because you shoved them away to prevent you from getting assaulted again. However, for example, your partner hit you, you both go to bed, and then you shoot your sleeping partner. Highly likely it will not be justified because even though yes you were assaulted previously you were not in immediate harm when you shot them. Now, especially in intimate relationships, there's usually so much more to situations than the simple examples I gave. But just as you said you can't physically harm someone just because they said something you didn't like you also just can't go assault someone and call it self defense when they are not currently in the process of harming you or are about to harm you (i.e. have their hand in a fist starting to swing at you). Again, so much grey area but I am so sick of people claiming self defense for their violent behavior when that level of force is blatantly not necessary.

I worked as an SA crisis advocate in FL and had to sit in on a lot of police interviews with victims. The types of off handed comments and suggestions of victim blaming was shocking. It was rare to come in contact with a responding officer who understood how to interview SA / DV victims

"He cheated on her. She hit him." These two things are not remotely equivalent. Him being a jerk and cheating is not remotely a justifiable reason for physically assaulting someone. Getting your feelings hurt doesn't allow you to attack the person who hurt your feelings.
Revenge p*%n is a disgusting, vile thing to do to another person. There is never any justifying it. That 20 year old girl did not make a commitment to Elisa - the guy is the one who broke the commitment, broke her trust - I hate the way society has normalised the villainisation of the "other woman". Another way women are pitted against each other (because sadly it does seem to be more common, not exclusive however, to women). Elisa Jordan just seems toxic, and this whole situation really does showcase that loud and clear.

And even if this was planned, showing the leaking of nude photos/videos and sexts in response to your male partner breaking his commitment on a public platform with pre-existing followers/subscribers is literally textbook normalising villainising the other woman. So many forms of media through the years have shown behaviour like this, where taking revenge on the person who did not make any commitments to you as a way of "winning", even going as far as giving it "girl power, show you're a strong independent woman" vibes.

I worked in a DVSA shelter for two years-- in situations where a woman was reacting in self defense with a male aggressor, it was still very common for police to demand to know why they hadn't de-escalated the situation by walking away, etc. Women were even arrested when cops thought their response was "too aggressive."

As a 28-year fan of the Stern Show, I assure you that she was NOT an actual writer on the show. She was dating a writer and was trying to get herself on the show more. Her boyfriend, Benji, tried to sell Howard on the fact that Elisa was a contributor and begged for him to give her a writing credit. Howard was dismissive and basically said, “okay, whatever Benji.” She was a horrible person then and was a vapid clout chaser. She came and went very quickly. She is not a reflection of the show and had major issues even back then.

That’s, generally speaking, cops’ attitude toward male victims of violence or abuse. It’s why men don’t come forward with their abuses very often. That said, Baby Reindeer encouraged male survivors to come forth and the percentage of male survivors has risen 57%… which is both good, and horrifying. Whatever characteristics make up the identity of a survivor (male or female, ethnicity, etc.) - one must ask themselves, how many more are out there?
It's the typical cop response to any DV situation. "You should've just idk, left?" It's worse if the victim is unfortunate enough to live with the abuser because it's rarely removing the victim from the situation and when cops actually do remove victims they're often left with no reasonable access to safety or scarce supports and also typically involves the cops giving the victim a lengthy lecture about how they can "just leave" while blatantly ignoring any sound or reasonable logic and the abuser typically gets zero consequences to their actions and continue to do abuser things, typically getting worse every time cops are called to intervene (and the cops subsequently do nothing).

Cartoonish. It's infuriating. All that ignorance actively makes it harder for people to get out alive. I'm worried for abuse survivors - people are inconsiderate about triggering material. Yesterday was not great for people with PTSD. But yeah, it might finally be time for social change. There is not a way to avoid discussing the male victims. "Just leave" being a ridiculous, cruel thing to say is lined up and ready to go after the footage from yesterday. Fingers crossed. So much depends on how the media and the public balance "queer people can do horrible things too" with "being [orientation, gender, race] doesn't mean that person represents all [orientation, gender, race]". Some people may not like this but, my mama always told me "No one should ever hit anyone but...If you put yourself in a man's position, you better get ready to be treated like a man." Meaning, if you hit a man first, you better get ready to be hit back. The way he reacts when she just moves her hand tells me she's hit him before. DV Prosecutor here! In this situation we would *likely* charge Ms. Jordana - however, it's important to note that the idea of "mutual combat" is seldom actually the case. Typically, there is a primary aggressor, and someone who even if they react physically the law would consider as using self-defense. However, self-defense also has to be proportional to the level of harm that is being caused (which I do personally believe would be difficult for Zscorro in this specific situation to argue). Obviously, the specific law for various DV charges is going to be different from state to state - but that's how I personally would evaluate the case for charging purposes. DV is one of those crimes that is hard for people to even mentally prepare themselves for, so a video of the incident is going to be an INCREDIBLY powerful thing for either party to present to a jury! Why would it be hard for Zscorro to argue that he reacted in self-defense? Genuine question, pulling a girl's hair is disrespectful but I hardly think it rises to the level of violence she was displaying with hitting him in the face so many times, it looked like she drew blood. As a chick, pulling my hair doesn't even really hurt that bad, and i'd expect someone to do that if I were punching them in the face in an attempt to get me to stop, so it seems pretty cut and dry to me. Same with pulling the car over and 'throwing her out', I suppose you could argue that he should have hopped out instead, but I think it's unrealistic to expect someone to behave perfectly in that kind of situation.
Strange that he would have trouble arguing that. He was trapped in a moving vehicle she was in control of. He had to disable the threat to be able to leave her physical space. At least morally, to me, his actions seem perfectly defensible. But I recognize the law runs by a different standard.
Yeah I agree I don't see how it would be hard to prove self defense. She was driving so he couldn't walk away. She was punching him in the face and he told her to stop. He then told her if she didn't stop he would react. After ALL that he finally....pulled her hair. Which is literally the most mild way to physically get someone to stop physically abusing you I can think of.

Its never okay to hit someone. DV is never okay. But w that being said, I knew a girl who would INTENTIONALLY provoke her boyfriend, she'd hit or punch him, throw things at him, break his stuff... Intentionally trying to get them to react. And when she would succeed & they would react she would then call the cops to get the boyfriend arrested. It was absolutely disgusting behavior. Oh and she would even put bruises on herself, cause marks and injuries to back up her claims when police showed up. Finally one guy she dated had hidden cameras set up for months, waiting for one of these fights to happen... Sure enough, eventually a fight broke out. And she started beating this man, punching, kicking, biting, smashed a wine glass across his head... Crazy stuff. And even though be knew it was on film, after awhile you cannot blame a person for reacting. He grabbed her in a bear hug & threw her outside onto the porch, then locked the door. He didn't go out and continue the fight he just locked up his house and called 911. She too called 911. Their stories were DRASTICALLY different. She said he was hitting & kicking her before she HAD TO hit him w the wind glass & bite him to get him to stop choking her. Then she said that he grabbed her and body slammed her onto the porch before locking her out. Cops showed up ready to lock him up. And she did have some marks on her including a few broken fingers... Well, he told the cops that he had everything on camera, begged them to please watch the footage before arresting anyone. They watched the footage of the fight, her being extremely aggressive & the one physically attacking him. They saw how he grabbed her & yes he threw her outside, but it was no body slam.... And then they watched the camera footage from the security cameras he had on the outside of his house.... Those showed her intentionally slamming the lid of the grill onto her own fingers multiple times causing her to break 2 or 3 fingers, she also smashed her own forehead into the railing of the porch, causing a huge bruise. She did something else to cause a bloody nose as well. The cold were honestly stunned & speechless for a few. Meanwhile, she's outside talking w another officer, crying hysterically and telling such an elaborate & detailed story about how HE caused all of her injuries. Afterwards, the officers had a little meeting amongst themselves, watched some clips from the videos and discussed what actions to take next. She was absolutely shocked when they told her she was getting arrested for multiple charges, including making a false police report. She started cursing them out saying she's the girl, she's the victim, she has injuries & only reason be had any injuries was because she had to defend herself.... That's when they finally told her it was all recorded... The e tire fight that took place inside the house, giving examples of exactly what she did to him. And that they have footage of her smashing her own fingers w the grill lid, smashing her own forehead into the porch railing etc... Needless to say, she was absolutely enraged and tried saying that the video doesn't count because it's illegal for him to film her without her consent (he had already checked all the laws where they lived & whatnot that pertained to filming people in & outside his home etc He did nothing illegal). She tried so hard to come up w some sort of story to explain away the footage. Even saying it was all fake, he edited s bunch of other stuff together to make it look the way it did, she even tired saying it wasn't her in the videos. When that didn't work she tried saying that the entire thing was scripted, that they were both acting & filmed it all as some sort of reality show type bullshit.... Uhhh, yeah, that didn't work. But people like that, who will provoke others, intentionally doing things just to get a reaction cannot be surprised when the other person finally snaps & reacts!! And as a woman, it's not okay to continuously hit on a man, physically attack them & then cry victim when that man finally turns around & defends themselves. And no, in no situation do I condone anyone putting hands on someone else, HOWEVER I can understand how someone can be pushed to their breaking point & react wo necessarily thinking about it all. I think everyone has at one point or another, been pushed so far that they end up snapping & reacting poorly. Not necessarily physically either, but we are all humans and we all have a limit. There's only so much a person can take before it all becomes too much.

The only question I have is, why did he or any of them stay in the first place? This always baffles me, especially with men as the victims. I can see women being scared, isolated, vulnerable, staying for the kids, or being financially dependent but I never think of men having those same issues. Am I wrong? That's why it is so confusing & interesting to me that a man would choose to stay. Just want to preface this by saying, my mom was physically abused by 2 different men (my stepdads) & I witnessed most of it. I was an only child & they mentally abused me too. I felt helpless & confused because I never saw anything but violence. So I'm not discounting the seriousness of DV by any means.

Gwen just wanted a solo career. Fleetwood Mac would be a good example of couples not being able to work together, especially after a split.

When it comes to when is violence reactionary, I think it would be harmful to draw a hard line. Every situation is different, everyone's healing follows a different timeline. If we draw a hardline, then we're putting demands on healing and processing trauma without considering the nuances of the situation.
i have a degree in psychology, and i just want to say 2 things that add to the nuance of abusive relationships, esp resembling what is being displayed by Elisa. 1. the law is not written, interpreted, or enforced in ways that cultivate understanding or care regarding mental health- related issues. 2. trauma bonding, while often insinuating only one party is the abuser, can involve BOTH parties participating in a cycle of abuse against each other. from the small amount of evidence, it seems like the relationship was mutually abusive. even though it can be really hard for people to leave abusive relationships, when someone decides to become an active and habitual participant in abusive treatment (even if it’s towards their abuser) without any efforts to leave, i think that’s where the line from self-defense to abuse is crossed. this doesn’t minimize the abuse either party experiences though, and i think a lot of people struggle with the fact that 2 conflicting things can be true at once. sometimes the truth is that victims of abuse can also be abusers themselves.
Wow cantankerous was truly the perfect word to describe Elisa and this situation as a whole. On the topic of reactionary violence, a therapist once told me that sometimes our brains don't see a good or "healthy" reaction as an option anymore when an interaction has escalated to extremes. She also stressed the importance of not viewing who you were in an abusive relationship as evidence of who you are moving forward.

As someone with family going through that, can you elaborate a bit on the “‘rearranging’ of memories” thing? I have a sibling who seems very convinced things have happened before that never once happened. If she were just talking about her experiences, I would think I just wasn’t there, but she’ll recall memories with me saying and doing things I absolutely did not…. It’s really, really terrifying and I can’t ever get her to understand I didn’t do or say these things. And yet, at the same time, she doesn’t recall some of the (borderline abusive) things she did to me. Like, she claims to have no recollection of beating me to near unconsciousness, but whenever the moment is brought up, she says the incident hurts her more than it ever hurt me. Couldn’t breathe for awhile and it HURT to breathe for, like, a week, but sure…
@@HavianEla As I understand it, I'm not a mental health pro but I have talked to my pro's about it, some people with certain issues will subconsciously 'fix' their memories to keep them from being the abuser and to keep them the victim. I dated a woman once who would change things to match her feelings, for example. If I calmly told her something she didn't like she would turn it into me yelling at her and genuinely believe I had. I have a relative who even when confronted with video of their bad behaviour would deny it and claim it was fake (way before deep fakes). Unfortunately there's not much to be done that I'm aware of, if you can't get someone to understand they're the problem then it can't be fixed. Sorry to hear about your family member, I hope things get better and they get the help they need.

The thing with self defense is that when you're in a situation that needs it you don't often have time to consider all the options and worry about going too far, you just do what you need to get out of a dangerous situation, I believe when self defense goes too far is when it continues after you're out of that dangerous situation, not how violent it is. (and even then sometimes arguments could be made, continuing to hit an attacker after they're unconscious because you're still fearing for your life/safety, and you're not in a state of mind to understand that the immediate danger is over.(though that's not relevant in this case.)) In this case, he was being hit by the driver of a moving vehicle, she hit him so hard he was red in the face, he gave her a verbal warning to stop, and she didn't, he stopped the moment she was out of the car, so, as violent as his reaction was, I do still see it as valid self defense...
100% yes. They both aren’t in the right, but he was literally defending himself from someone who has obviously hit him before this because of way he flinched.

The way I see it is, the punishment has to fit the crime. Cheating is horrible for a lot of reasons and so is hurling insults at your partner, but does it justify being repeatedly hit? Especially in a car, where you're both trapped in a confined space? I really don't think so. I think this is one of those situations where two things can be true at once, they both weren’t great and in my opinion she has been worse. In regards to retribution - I trained in self defence growing up (Shintani Wado-Kai Karate) and we were taught to use it just enough to get away from our perpetrators and not act on aggression ever. But also as a person who has experienced trauma in many areas I totally understand the desire to inflict the pain that a person has caused to you back at them. I think the best way to deal with this is to share our stories and come forward with who hurt us when we’re ready regardless of how much time has passed because that trauma is still valid. This is important because we don’t want to stoop to the level of those that have hurt us and possibly get ourselves in trouble. It’s like that saying goes -you cannot fight fire with fire.
Honestly, I think her backtracking is a DARVO. She knows that video shows he did not wrap his hands around her neck, yet she keeps saying it. Why? Because it makes her sound more vulnerable and victimized. As a female survivor of DV, I honestly find it insulting and vile that she is trying to claim that to get sympathy and lessen her own crimes. She attacked him, over and over, and even when he warned her, she continued. Was he emotionally abusive? Absolutely. Was his counter attack justified? Maybe, maybe not. But what she did was DV, for sure, and I don't like her riding on the backs of other victims to diminish it. It's icky, and it muddies the waters for future victims.
You would call what he did a counter attack? I think a lot of us would call it self-defense. Whether or not they had been going back-and-forth verbally or not, he hadn’t been physical with her and he told her to stop hitting him. I don’t see a world where anybody should just allow themselves to continue to be assaulted by someone, regardless of their age, gender, or any other things. I think he made a mistake even getting in the vehicle in the first place when he knew how volatile the situation was, but that’s neither here nor there. At the end of the day, this woman is clearly a narcissistic sociopath that needs therapy and medication.

Self-defense is not necessarily just violence, it could also be moving yourself away, verbal, etc. He got into the car after she had already tried to hit him. He had plenty of chance to disengage and get away. Additionally, self-defense is usually motivated by fear. Was he afraid when he did this, or was he angry, making it more like revenge? I'm not sure, honestly. I'm not in his head, I know nothing of his past experiences, their relationship, etc. So when I chose the term counter-attack, I did so carefully. It is meant to impart a neutral term for return of violence. I'm not making assumptions on what he did, I am unsure of how I feel about it. I don't have enough information. What I do think is that she's 100% abusive in this scenario, and it was her actions alone that I chose to comment on for this reason. Hope this helps to clarify my position.
38:00 I grew up in a house with mutual abuse. I didn't realize what it was as a kid, but as an adult in therapy, I realized that I had a very warped definition of love, obedience, and abuse. It wasn't until I was in my 30s that I started speaking up that they both were wrong. Didn't matter "who started it".
As violent as it looked for Scorro to grab Elisa's hair... in that moment, I believe he was absolutely defending himself... and the way he flinches every time she makes a sharp gesture towards him makes me think this is *NOT* the first time she's been physically abusive... It might be the first time caught on camera (idk... I have never seen any of her live streams, I didn't even know her name before this), but I think off camera she's definitely has hit him before, multiple times... I found the uncensored video and it looked like to me, as soon as the car is stopped, he pushed her away/out of the car, so that he could get out without her coming towards him. As soon as she was moving out of the car, he let go and ran out of the car (I'm pretty sure I saw him go to another car that had stopped) and while the car was still moving and he was grabbing her hair telling her to stop the car, he was also begging people watching to call 9-1-1...
Elisa Jordana gives me the vibes of a person who has always been able to get away with bad behavior because is very pretty and plays dumb. She didn't get told no enough in her childhood imo. I think, no matter what, if you hit someone who isn't actively threatening you, like walking aggressively towards you or has a weapon, first you are the aggressor.

Self-defense is a very slippery slope. I work in a knife shop and we get a lot of people who come in for a self-defense knife. We *always* tell people to go with pepper spray or a stun gun instead because laws are very tricky. We had a man who had only one arm (his other arm was paralyzed) come in because he purchased a knife from us and someone was threatening him in a parking garage so he pulled it out to scare him off. The guy ran off but also called the cops, and the guy who was being threatened with violence and could not defend himself in any other way was given a fine. It's all down to interpretation
I think I said this on Atozy video. I had a couple like this for neighbours, minus the rl streams. They were so toxic and abusive to each other with constant police calls, ROs, cameras installed but never able to get actual evidence. Even when there was actual charges placed on the man cause they finally fought in front of a witness, they still met back up and lived homeless behind and abandon building, was forced away from there and IDK where they are now. I walked passed them once a couple of years ago so they are still in the area. There is nothing you can do with a couple like this, you could have them in jails across the country and I'm sure they'll still find a way to get back together and repeat the same toxicity and abuse against each other.
This scenario seems to happen a great deal with influencers whose egos have gotten the better of them. What truly amazes me is how often she admits to repeatedly striking another person on video almost as though it was a trophy moment for her.

DFV Specialist here with 10 years experience. It’s important to look at a number of factors when determining primary perpetrations vs response violence.
The most basic area of self defence is looking at parities and disparities. If an 80+ year old frail woman slaps my shoulder, I as a 6 foot tall 30yo male am not at risk for that and should not respond by laying her out. Now is it okay for her to hit me? No. It isn’t. But that isn’t free rein to respond with violence.
Secondly, especially in relationship, we look at what we call “the rights paddock”. Who in the relationship has the most number of rights. Are the rights equal (not necessarily the same, but equal - for example if he has a job and she’s a stay at home Mum then their rights such as “going to work” and “spending more time with the kids” are going to be different in some respects). The person who has more rights is usually the person using primary perpetrations. But we still need to dig deeper.
We then examine core beliefs. Perpetrators of DFV have one or more core beliefs which fall into - Superiority, Entitlement, and Adversity. The idea they are better than their partner, that they show entitlement for their partner’s time, resources, body etc., and that in order for them to win their partner must lose.
When it comes to what we call ‘Mutual Conflict’ (some refer to this as mutual abuse but I disagree with the term), what we’re really looking at is a destructive conflict resolution style. Now this can include everything up to severe physical abuse. It’s two people who lack communication skills, and aren’t able to express their needs. This is still an issue and requires addressing, but isn’t the same as abuse. It’s usually characterised by people who have equal rights but aren’t attempting to control each other.
Relationship counselling can work for mutual conflict. It cannot work for abuse. In fact it’s very VERY dangerous to use in abuse situations.

Where I live women get up to 3 hits before a man can claim self defense if he hits her back.
I was appalled to hear that. I may be a woman and I def dont do any work outs or strength training but if I am slapping or hitting a man intentionally trying to harm them, then I think hitting me back to get space immediately for their own safety should 100% be legal.
My boyfriend is a foot taller than me works a physical labour job and it 100% wouldnt be a fair fight because he can hold me down with one hand quite literally if he wanted to.
If I ever attacked him, and abuse him physically I believe he should 100% have the right to hit me back so he can get to safety.
Of course I think self defense ends when it enters retaliation/the threat is clearly subdued or fleeing, but if I went after someone and they had to let me keep swinging before they can physically stop me if there are no other options to safely get out seems like it is just punishing male victims.
My first relationship was very emotionally abusive with so many threats of violence and death and still have trauma responses to certain things even though my current partner is one of the only people I feel truly safe with now.

I was in a shelter from late 2022 - early 2023. I saw a woman burst out from the shelter and start brutalizing a man who was very obviously under the influence. He was sat on a bench, bopping around to whatever music he heard and talking to whoever he saw. All because he allegedly told folks in the shelter not to trust her... I won't get into specifics of what she did, but if the roles were reversed... the other folks with me in the courtyard would've jumped him to protect her. But the MOMENT he grabbed her arm to STOP HER ASSAULT AND HOLD HER AWAY FROM HIM AT ARMS LENGTH. IMMEDIATELY, the crowd started cussing him off, joins in on brutalizing him, and kicked him out of the smoke pit.
The way folks are so brainwashed by the patriarchal notion that "men (and boys) can't be victims of ___ assault" is disgustingly mind-boggling. The only silver lining from situations like this is the truth that anyone (unfortunately) can be a victim of abuse, and anyone can be an abuser. Hopefully, we, as a society, can improve the ways we recognize abuse and support victims, regardless of sex/gender

Honestly ngl one of the things I love about Swoop Too is just how much more fun y'all seem to be having with the editing. Every time I'm about to see cops on camera handle DV/SA I clench so hard. Because I know some BS is coming. My own experience where a neighbour called the cops when I was being assaulted by a partner and they treated me like I was crazy because I was sobbing and shaking, and my partner was calm and collected. And then I got told not to waste police time. Girl my NEIGHBOUR called you.

Yep, my ex assaulted me but I ended up getting arrested because HE was the one that called the cops! Not a mark on him, but I had a black eye and giant chunks of my hair were all over the place. Luckily the judge dropped the charges against me after spending the night in jail 🤦♀️
I got lucky and ended up with pretty lovely officers when the same thing happened to me.. I was shocked frankly because I wasn’t expecting anything great. At least there are still some pretty good ones out there -but I’m so sorry you had to deal with such shitty ones 🥺

While yeah, most of B cluster ones can be pushed into questionable behaviors by their disorders, histrionics are (by my biased unprofessional opinion, but still) the ones who win the least from choosing to behave like… THAT.
NPDs fear of not being perceived as the best, so pressuring the outliers into compliance is an easy way out; BPDs fear of abandonment, so poking everyone around to relieve the stress is an easy way out. Asocials are asocial. HPDs fear of being unnoticed; being an a-hole to remedy that is not easier than other options, it’s a personal choice.
Basically, if “histrionic” in “histrionic a-hole” was treatable, the result would be an a-hole with lackluster performance.
P. S. By mutual agreement with my therapist we’re not tackling the HPD traits cause (in my case) they don’t cause distress to anyone. But I can see how *in combination* with something else such traits may result in a feast.
@@aho5666 I'm absolutely not saying she's not an ahole or that all people with HPD are aholes. I'm just noticing tendencies. Obviously with every disorder there are people who have other issues or are just sucky people who can further stigmatize those disorders. Cluster B personality disorders being very very negatively stigmatized. So I apologize if my comment came off in a way that adds to that stigma. But my thought process was more separating HPD as a whole and more looking at her traits, which the way she acts to get the attention she's looking for is bad. I'm not saying that as a whole for all people with HPD. As you said if you treat the HPD she will still be an ahole underneath, but that doesn't reflect all people with HPD. I'm also not diagnosing anything, just noticing tendencies. She is absolutely choosing to be an ahole to get what she wants and I agree there are easier ways.

Yes!!! Also, when it comes to self defense, while every state is a bit different, the common legal theme is that you can defend yourself with reasonable force to do so. For example, someone hits you and comes to hit you again so you shove them away and they trip/ fall and get hurt. Justified because you shoved them away to prevent you from getting assaulted again. However, for example, your partner hit you, you both go to bed, and then you shoot your sleeping partner. Highly likely it will not be justified because even though yes you were assaulted previously you were not in immediate harm when you shot them. Now, especially in intimate relationships, there's usually so much more to situations than the simple examples I gave. But just as you said you can't physically harm someone just because they said something you didn't like you also just can't go assault someone and call it self defense when they are not currently in the process of harming you or are about to harm you (i.e. have their hand in a fist starting to swing at you). Again, so much grey area but I am so sick of people claiming self defense for their violent behavior when that level of force is blatantly not necessary.

I worked as an SA crisis advocate in FL and had to sit in on a lot of police interviews with victims. The types of off handed comments and suggestions of victim blaming was shocking. It was rare to come in contact with a responding officer who understood how to interview SA / DV victims

I’m going through a lot of the same physical pain and on disability at an early age due to my body just being wrecked like I’m 85. You inspire me to wake up and try to make every day a good one.
I worked in a DVSA shelter for two years-- in situations where a woman was reacting in self defense with a male aggressor, it was still very common for police to demand to know why they hadn't de-escalated the situation by walking away, etc. Women were even arrested when cops thought their response was "too aggressive."

As a 28-year fan of the Stern Show, I assure you that she was NOT an actual writer on the show. She was dating a writer and was trying to get herself on the show more. Her boyfriend, Benji, tried to sell Howard on the fact that Elisa was a contributor and begged for him to give her a writing credit. Howard was dismissive and basically said, “okay, whatever Benji.” She was a horrible person then and was a vapid clout chaser. She came and went very quickly. She is not a reflection of the show and had major issues even back then.

That’s, generally speaking, cops’ attitude toward male victims of violence or abuse. It’s why men don’t come forward with their abuses very often.
That said, Baby Reindeer encouraged male survivors to come forth and the percentage of male survivors has risen 57%… which is both good, and horrifying. Whatever characteristics make up the identity of a survivor (male or female, ethnicity, etc.) - one must ask themselves, how many more are out there?

It's the typical cop response to any DV situation. "You should've just idk, left?" It's worse if the victim is unfortunate enough to live with the abuser because it's rarely removing the victim from the situation and when cops actually do remove victims they're often left with no reasonable access to safety or scarce supports and also typically involves the cops giving the victim a lengthy lecture about how they can "just leave" while blatantly ignoring any sound or reasonable logic and the abuser typically gets zero consequences to their actions and continue to do abuser things, typically getting worse every time cops are called to intervene (and the cops subsequently do nothing).

DV Prosecutor here! In this situation we would *likely* charge Ms. Jordana - however, it's important to note that the idea of "mutual combat" is seldom actually the case. Typically, there is a primary aggressor, and someone who even if they react physically the law would consider as using self-defense. However, self-defense also has to be proportional to the level of harm that is being caused (which I do personally believe would be difficult for Zscorro in this specific situation to argue). Obviously, the specific law for various DV charges is going to be different from state to state - but that's how I personally would evaluate the case for charging purposes. DV is one of those crimes that is hard for people to even mentally prepare themselves for, so a video of the incident is going to be an INCREDIBLY powerful thing for either party to present to a jury! Great video and great analysis!

Why would it be hard for Zscorro to argue that he reacted in self-defense? Genuine question, pulling a girl's hair is disrespectful but I hardly think it rises to the level of violence she was displaying with hitting him in the face so many times, it looked like she drew blood. As a chick, pulling my hair doesn't even really hurt that bad, and i'd expect someone to do that if I were punching them in the face in an attempt to get me to stop, so it seems pretty cut and dry to me. Same with pulling the car over and 'throwing her out', I suppose you could argue that he should have hopped out instead, but I think it's unrealistic to expect someone to behave perfectly in that kind of situation.
Strange that he would have trouble arguing that. He was trapped in a moving vehicle she was in control of. He had to disable the threat to be able to leave her physical space. At least morally, to me, his actions seem perfectly defensible. But I recognize the law runs by a different standard.
Yeah I agree I don't see how it would be hard to prove self defense. She was driving so he couldn't walk away. She was punching him in the face and he told her to stop. He then told her if she didn't stop he would react. After ALL that he finally....pulled her hair. Which is literally the most mild way to physically get someone to stop physically abusing you I can think of.

Its never okay to hit someone. DV is never okay.
But w that being said, I knew a girl who would INTENTIONALLY provoke her boyfriend, she'd hit or punch him, throw things at him, break his stuff... Intentionally trying to get them to react. And when she would succeed & they would react she would then call the cops to get the boyfriend arrested. It was absolutely disgusting behavior. Oh and she would even put bruises on herself, cause marks and injuries to back up her claims when police showed up.
Finally one guy she dated had hidden cameras set up for months, waiting for one of these fights to happen... Sure enough, eventually a fight broke out. And she started beating this man, punching, kicking, biting, smashed a wine glass across his head... Crazy stuff. And even though be knew it was on film, after awhile you cannot blame a person for reacting. He grabbed her in a bear hug & threw her outside onto the porch, then locked the door. He didn't go out and continue the fight he just locked up his house and called 911. She too called 911. Their stories were DRASTICALLY different. She said he was hitting & kicking her before she HAD TO hit him w the wind glass & bite him to get him to stop choking her. Then she said that he grabbed her and body slammed her onto the porch before locking her out.
Cops showed up ready to lock him up. And she did have some marks on her including a few broken fingers... Well, he told the cops that he had everything on camera, begged them to please watch the footage before arresting anyone.
They watched the footage of the fight, her being extremely aggressive & the one physically attacking him. They saw how he grabbed her & yes he threw her outside, but it was no body slam.... And then they watched the camera footage from the security cameras he had on the outside of his house.... Those showed her intentionally slamming the lid of the grill onto her own fingers multiple times causing her to break 2 or 3 fingers, she also smashed her own forehead into the railing of the porch, causing a huge bruise. She did something else to cause a bloody nose as well. The cold were honestly stunned & speechless for a few.
Meanwhile, she's outside talking w another officer, crying hysterically and telling such an elaborate & detailed story about how HE caused all of her injuries. Afterwards, the officers had a little meeting amongst themselves, watched some clips from the videos and discussed what actions to take next.
She was absolutely shocked when they told her she was getting arrested for multiple charges, including making a false police report. She started cursing them out saying she's the girl, she's the victim, she has injuries & only reason be had any injuries was because she had to defend herself.... That's when they finally told her it was all recorded... The e tire fight that took place inside the house, giving examples of exactly what she did to him. And that they have footage of her smashing her own fingers w the grill lid, smashing her own forehead into the porch railing etc...
Needless to say, she was absolutely enraged and tried saying that the video doesn't count because it's illegal for him to film her without her consent (he had already checked all the laws where they lived & whatnot that pertained to filming people in & outside his home etc He did nothing illegal).
She tried so hard to come up w some sort of story to explain away the footage. Even saying it was all fake, he edited s bunch of other stuff together to make it look the way it did, she even tired saying it wasn't her in the videos. When that didn't work she tried saying that the entire thing was scripted, that they were both acting & filmed it all as some sort of reality show type bullshit.... Uhhh, yeah, that didn't work.
But people like that, who will provoke others, intentionally doing things just to get a reaction cannot be surprised when the other person finally snaps & reacts!! And as a woman, it's not okay to continuously hit on a man, physically attack them & then cry victim when that man finally turns around & defends themselves. And no, in no situation do I condone anyone putting hands on someone else, HOWEVER I can understand how someone can be pushed to their breaking point & react wo necessarily thinking about it all. I think everyone has at one point or another, been pushed so far that they end up snapping & reacting poorly. Not necessarily physically either, but we are all humans and we all have a limit. There's only so much a person can take before it all becomes too much.

The only question I have is, why did he or any of them stay in the first place? This always baffles me, especially with men as the victims.
I can see women being scared, isolated, vulnerable, staying for the kids, or being financially dependent but I never think of men having those same issues. Am I wrong? That's why it is so confusing & interesting to me that a man would choose to stay.
Just want to preface this by saying, my mom was physically abused by 2 different men (my stepdads) & I witnessed most of it. I was an only child & they mentally abused me too. When it comes to when is violence reactionary, I think it would be harmful to draw a hard line. Every situation is different, everyone's healing follows a different timeline. If we draw a hardline, then we're putting demands on healing and processing trauma without considering the nuances of the situation.

i have a degree in psychology, and i just want to say 2 things that add to the nuance of abusive relationships, esp resembling what is being displayed by Elisa.
1. the law is not written, interpreted, or enforced in ways that cultivate understanding or care regarding mental health- related issues.
2. trauma bonding, while often insinuating only one party is the abuser, can involve BOTH parties participating in a cycle of abuse against each other.
from the small amount of evidence, it seems like the relationship was mutually abusive. even though it can be really hard for people to leave abusive relationships, when someone decides to become an active and habitual participant in abusive treatment (even if it’s towards their abuser) without any efforts to leave, i think that’s where the line from self-defense to abuse is crossed. this doesn’t minimize the abuse either party experiences though, and i think a lot of people struggle with the fact that 2 conflicting things can be true at once. sometimes the truth is that victims of abuse can also be abusers themselves.
Wow cantankerous was truly the perfect word to describe Elisa and this situation as a whole. On the topic of reactionary violence, a therapist once told me that sometimes our brains don't see a good or "healthy" reaction as an option anymore when an interaction has escalated to extremes. She also stressed the importance of not viewing who you were in an abusive relationship as evidence of who you are moving forward.

These kind of narcissistic tendencies, entitlement and "rearranging" of memories can be a symptom of serious mental health issues like borderline personality disorder or sociopathy. She doesn't need couples therapy, she needs intense one on one therapy. Allegedly. I mean, word on the street is she does.
As someone with family going through that, can you elaborate a bit on the “‘rearranging’ of memories” thing? I have a sibling who seems very convinced things have happened before that never once happened. If she were just talking about her experiences, I would think I just wasn’t there, but she’ll recall memories with me saying and doing things I absolutely did not…. It’s really, really terrifying and I can’t ever get her to understand I didn’t do or say these things. And yet, at the same time, she doesn’t recall some of the (borderline abusive) things she did to me.
Like, she claims to have no recollection of beating me to near unconsciousness, but whenever the moment is brought up, she says the incident hurts her more than it ever hurt me.
Couldn’t breathe for awhile and it HURT to breathe for, like, a week, but sure…
@@HavianEla As I understand it, I'm not a mental health pro but I have talked to my pro's about it, some people with certain issues will subconsciously 'fix' their memories to keep them from being the abuser and to keep them the victim. I dated a woman once who would change things to match her feelings, for example. If I calmly told her something she didn't like she would turn it into me yelling at her and genuinely believe I had. I have a relative who even when confronted with video of their bad behaviour would deny it and claim it was fake (way before deep fakes). Unfortunately there's not much to be done that I'm aware of, if you can't get someone to understand they're the problem then it can't be fixed. Sorry to hear about your family member, I hope things get better and they get the help they need.

The thing with self defense is that when you're in a situation that needs it you don't often have time to consider all the options and worry about going too far, you just do what you need to get out of a dangerous situation, I believe when self defense goes too far is when it continues after you're out of that dangerous situation, not how violent it is. (and even then sometimes arguments could be made, continuing to hit an attacker after they're unconscious because you're still fearing for your life/safety, and you're not in a state of mind to understand that the immediate danger is over.(though that's not relevant in this case.))
In this case, he was being hit by the driver of a moving vehicle, she hit him so hard he was red in the face, he gave her a verbal warning to stop, and she didn't, he stopped the moment she was out of the car, so, as violent as his reaction was, I do still see it as valid self defense...
I agree she also broke his nose , she would of kept unless he defended himself

The way I see it is, the punishment has to fit the crime. Cheating is horrible for a lot of reasons and so is hurling insults at your partner, but does it justify being repeatedly hit? Especially in a car, where you're both trapped in a confined space? I really don't think so. I think this is one of those situations where two things can be true at once, they both weren’t great and in my opinion she has been worse. In regards to retribution - I trained in self defence growing up (Shintani Wado-Kai Karate) and we were taught to use it just enough to get away from our perpetrators and not act on aggression ever. But also as a person who has experienced trauma in many areas I totally understand the desire to inflict the pain that a person has caused to you back at them. I think the best way to deal with this is to share our stories and come forward with who hurt us when we’re ready regardless of how much time has passed because that trauma is still valid. This is important because we don’t want to stoop to the level of those that have hurt us and possibly get ourselves in trouble. It’s like that saying goes -you cannot fight fire with fire.

Honestly, I think her backtracking is a DARVO. She knows that video shows he did not wrap his hands around her neck, yet she keeps saying it. Why? Because it makes her sound more vulnerable and victimized. As a female survivor of DV, I honestly find it insulting and vile that she is trying to claim that to get sympathy and lessen her own crimes. She attacked him, over and over, and even when he warned her, she continued.
Was he emotionally abusive? Absolutely. Was his counter attack justified? Maybe, maybe not. But what she did was DV, for sure, and I don't like her riding on the backs of other victims to diminish it. It's icky, and it muddies the waters for future victims.
You would call what he did a counter attack? I think a lot of us would call it self-defense. Whether or not they had been going back-and-forth verbally or not, he hadn’t been physical with her and he told her to stop hitting him. I don’t see a world where anybody should just allow themselves to continue to be assaulted by someone, regardless of their age, gender, or any other things. I think he made a mistake even getting in the vehicle in the first place when he knew how volatile the situation was, but that’s neither here nor there. At the end of the day, this woman is clearly a narcissistic sociopath that needs therapy and medication.

Self-defense is not necessarily just violence, it could also be moving yourself away, verbal, etc. He got into the car after she had already tried to hit him. He had plenty of chance to disengage and get away. Additionally, self-defense is usually motivated by fear. Was he afraid when he did this, or was he angry, making it more like revenge? I'm not sure, honestly. I'm not in his head, I know nothing of his past experiences, their relationship, etc. So when I chose the term counter-attack, I did so carefully. It is meant to impart a neutral term for return of violence. I'm not making assumptions on what he did, I am unsure of how I feel about it. I don't have enough information. What I do think is that she's 100% abusive in this scenario, and it was her actions alone that I chose to comment on for this reason. Hope this helps to clarify my position.

I grew up in a house with mutual abuse. I didn't realize what it was as a kid, but as an adult in therapy, I realized that I had a very warped definition of love, obedience, and abuse.
It wasn't until I was in my 30s that I started speaking up that they both were wrong. Didn't matter "who started it".

I found the uncensored video and it looked like to me, as soon as the car is stopped, he pushed her away/out of the car, so that he could get out without her coming towards him. As soon as she was moving out of the car, he let go and ran out of the car (I'm pretty sure I saw him go to another car that had stopped) and while the car was still moving and he was grabbing her hair telling her to stop the car, he was also begging people watching to call 9-1-1...
Elisa Jordana gives me the vibes of a person who has always been able to get away with bad behavior because is very pretty and plays dumb. She didn't get told no enough in her childhood imo. I think, no matter what, if you hit someone who isn't actively threatening you, like walking aggressively towards you or has a weapon, first you are the aggressor.

Self-defense is a very slippery slope. I work in a knife shop and we get a lot of people who come in for a self-defense knife. We *always* tell people to go with pepper spray or a stun gun instead because laws are very tricky. We had a man who had only one arm (his other arm was paralyzed) come in because he purchased a knife from us and someone was threatening him in a parking garage so he pulled it out to scare him off. The guy ran off but also called the cops, and the guy who was being threatened with violence and could not defend himself in any other way was given a fine. It's all down to interpretation

They were so toxic and abusive to each other with constant police calls, ROs, cameras installed but never able to get actual evidence. Even when there was actual charges placed on the man cause they finally fought in front of a witness, they still met back up and lived homeless behind and abandon building, was forced away from there and IDK where they are now. I walked passed them once a couple of years ago so they are still in the area. There is nothing you can do with a couple like this, you could have them in jails across the country and I'm sure they'll still find a way to get back together and repeat the same toxicity and abuse against each other.
This scenario seems to happen a great deal with influencers whose egos have gotten the better of them. What truly amazes me is how often she admits to repeatedly striking another person on video almost as though it was a trophy moment for her.

She literally used and abused kids but okay.
