Challenge of Presidential and Parliamentary Elections in Ghana

    This video is an elaborate discussion on the Courts that have jurisdiction in matters related to the challenge of Presidential and Parliamentary Elections in Ghana.
    Please take note of the following points which have not been discussed in the video but are very relevant.
    There is one crucial point which is worth noting but is not discussed in the video. It is the law as captured under section 17 of the Representation of People Law, 1992 (PNDCL 284) which deals with the categories of persons that have capacity to challenge a parliamentary election and the section reads as follows:
    "Presentation of election petition
    An election petition may be presented by one or more of the following persons:
    (a) a person who lawfully voted or had a right to vote at the election to which the petition relates,
    (b)a person claiming to have had a right to be elected at the election,
    (c)a person alleging to have been a candidate at the election,
    (d) a person claiming to have had a right to be nominated as a candidate at the election."
    Take note that the election petition referred to in section 17 above is a Parliamentary Election Petition.
    Also important to note is section 17 which provides the reliefs that the High Court may grant in a Parliamentary election Petition. The section reads as follows:
    After the hearing of an election petition the High Court may make any of the following orders:
    (a) declare that the election to which the petition relates is void,
    (b)declare that a candidate other than the member whose election is questioned was duly elected, or
    (c) dismiss the petition and declare that the member whose election is questioned was duly elected."
