    You have the right to remain silent!? No one wants to have those words directed at them by an official in uniform. It's usually part and parcel of being arrested, only we didn't know what we had done wrong.
    Two officers, one from Parks and Wildlife, the other from Fisheries boarded our yacht requesting information about a video we had posted showing us swimming with whale sharks.
    It was about half way into 40 minutes of questioning that we realised what they suspected, that we had been involved in a non licensed charter. We quickly put the issue to rest and the officers completed their formalities with an inspection of our fish catch. As usual very little. They left with no arrests, thankfully.

    BACK STORY
    In 1997, after rowing at the Atlanta Olympics, Rob decided to row a tiny seven-metre plywood boat, 2500 miles from Tenerife in the Canary Islands to Barbados in the Caribbean. It took 6 weeks and he and his rowing partner, Phil Stubbs, won the inaugural Atlantic Rowing Race. His first taste of a blue water ocean crossing.
    Skip forward to 2014 and, married with three children, Rob and Rachel purchased Javelot a 43 ft Fountaine Pajot catamaran. Armed only with Rob's 3 years of racing P class yachts from the age of 11 to 13, and Rachel's non existent sailing knowledge, we set off to learn the ropes of ocean sailing. We broke stuff, replaced stuff and got to know our boat before heading offshore with the kids, Finn 19, Declan 17 and Ivan 14, in tow. Through trial and error, we have become confident wayfarers, kind of.
    Our plan? To sail around the world.
    Part of the journey will be retracing Rob’s eldest brother Kerry’s travels at sea. Using Kerry’s original letters from the 1970’s we will re trace his movements from Australia through Indonesia and South East Asia to Cambodia where Kerry’s life was cut short after straying into Cambodian waters in 1978. Kerry and two friends were attacked by a Khmer Rouge gun boat, captured, tortured and executed. www.brothernumberone.co.nz

    What a bizarre, circuitous, opaque communication from the ranger. He could not have taken a longer, more awkward way to go about that. The whole time I was saying to the screen, "Say nothing! Say nothing at all!". Australia has lost the plot, or the plot has taken a seriously dark twist. I am glad that this was your only brush with their current police state.

      The reason behind his language is that he was trying to let them know that silence is the way forward. He was certainly on there side but couldn’t say much as he was being recorded.

      PS we found it very difficult to say nothing though have had plenty of advice similar to yours. And in similar circumstances I don't think I'd do any differently. It just doesn't seem right to sit there and say nothing. Maybe that's a cultural thing, not sure.

      @The Cruising Kiwis Could be cultural or just differences in personal experiences with governmental authorities. I learned in my early 20’s that being “helpful” to the authorities can come at great personal cost. I was witness to an accident and was asked questions about what I saw by the police at the scene. I gave my honest observations. 3 years later I was unexpectedly served papers requiring my appearance for the resulting court case. It took my personal time with no compensation, was extremely stressful being grilled by lawyers about what I’d eaten on the morning I’d witnessed the accident and other such craziness. And it deprived me of being at my beloved grandma’s hospital bedside as her brain bled. Though it is generally my disposition, I so regretted having been cooperative and helpful and answering truthfully with the police. From now on, my response will be to be completely silent unless I know my information will be life or limb saving for another. Saying to gov authorities what you feel is perfectly innocent and true can actually get you into a world of hurt.

    I was enjoying the videos from Australia so much I was thinking of going there for a vacation. After seeing how uptight those game rangers are I will scratch that off my bucket list! I must wish you well and happy travels. Hope you don’t encounter any more overbearing authorities!

      Fish and wild life officials, throughout the world, deal with people who knowingly break regulations. They have to be tough and, in many countries, they must be armed because they get attacked. I think that the Aussie officials were VERY civil and understanding. And, most important, they agreed to be filmed.

      Yes, officers Moe and Curly did a fine job for the Western Australian tourism industry sending a loud and clear message - "step on one of our racket licensee's turf knowingly or unknowingly and we will hunt you down and prosecute to the fullest extent of the law". There's nothing wrong with government passing legislation to protect endangered species from abusive behavior or harassment. That clearly didn't happen here. The only potential "violation" that occurred is that a commercial tour operator who thought he/she bought a monopoly from the "whale shark management bureau" was disappointed to find his business protection racket had limitations. Moe and Curly were on the case though - with the audacity to demand to see Rob's fishing license (yeah, right, only doing their job). If I were Rob/Rachel, I would have cut this video in

    While chartering in the Whitsundays we were asked one morning how our night on the mooring was by a charter operator. Great was the reply. The response, 'Well you can fuck of then and let someone else use it'. Welcome to Straya! I couldn't get over how regulated the area was with a manual provided covering all the rules. No desire to go back. Plenty of options in the Pacific Islands.

      Yeah now they’re Bleeding because of Covid . Most of the mooring in the Whitsundays are empty most of the time and charters are going broke daily .
      As cruising yachty in Australia , it makes me Embarrassed to see how foreign guest cruisers are treated.

      Talking to the police to clarify a misunderstanding or the like could save a bundle on legal costs and wasted time. So, all you have to do is ask yourself , am I guilty or not guilty and if you are guilty and not trained to BShet, then pay for it.

    As a retired enforcement officer I can say that a caution 'may be used in court' is issued when the office reasonably believes an offense HAS been committed. At that point the officer does NOT have sufficient evidence to convert that reasonable believe to a court conviction as FURTHER evidence is required. Basically what is required is Who, What, When and Where, all of which are required for a conviction. Politely declining to fill the gaps is probably the best action.

    What got me is the embarrassing way (to himself) that that officer tried to interrogate you guys. It was arse-cringing to watch, and you could tell it looked like his partner was totally embarrassed.

    I do actually remember when I saw a hand reach out to the Whale Shark (apart from "Wow that would be amazing") that it was not a good idea. Its the same with Dolphins, even when they come to you for food as they do at Tangalooma, you are not allowed to touch them. Its interesting to know that they are so busy that they have time to watch Utube videos. Probably as you say, one of the Tour operators reporting you.

      More than likely a complaint, which they would of had to investigate. The simple fact is, the person should not have touch the whale shark. This type behavior only makes it harder for everyone else and makes laws tougher. A few screw it for everyone else. But it appears more about the number people on the boat and and if it was an illegal charter or not, So these 2 were only doing they job after a complaint was made. Knowing it would end up on TH-cam, they did it by the book. They could of made you turn your video off, but they didn't. They were only being professional and doing they job.

      Umm.. no, they could not have done so. The law on that is quite clear in Australia. If you are not interfering with their ability to do their job, you can record them.

      @@TheCruisingKiwis Back in 1970 we were boarded by Interpol at Kiel, the Germans were not nearly as polite. We had quite a few search's done by Interpol & finally figured one of the crew from TX was putting his name, phone & address on small pieces of paper & handing them to girls on the docks. Thus raising suspicions.

    Fair call. Good Officer and Fisheries. Officer was polite, explained all personal rights very clearly and often. Fisheries just stood out of the way. Not sure what your complaining about?

      They were decent dudes doing their job. However, the false claim that it was unlawful to swim with whale sharks (you watched the video I take it?) set the scene, then the circuitous oblique questioning that took 30 minutes before we got to the point being suspected unlicensed charter.

    You do not have to answer any of their questions. They do not know much, and are doing their best to gather evidence. They have nothing and they know that. They want you to provide all the information that they can then use against you.

    Gosh that was intense, great video! Sad that there interrogations were not concerned with any potential infringement to the whale sharks safety, but that a commercial undertaking without proper licensing (and therefore payment to the authorities) had taken place!

    I don't know what all the hoo-har is about... they were polite and not pressuring you at all, they didnt try to entrap you in any way, if anything they went out of their way to prevent you saying anything bad/encriminating.
    They were just doing their job, they saw your video which contained three acts that potentially broke the regulations and it warranted investigation. CTO without a license and, aerial device flown too close, and touching a whale shark, all fineable offences (Biodiversity Conservation Act for the whale shark touch/aerial device) . You answered their questions and they left.

      Thanks Ickus. For us it was the round about oblique way he went about the questioning. They were indeed polite. If they had got to the point early on with the charter questioning it would have made things a lot quicker with less anxiety. The comment that it is "Unlawful to swim with whale sharks" (which is not the case) really caused us concern.

    I have to say that I disagree with many of the comments here, and also with the tone of the voiceover in the video itself.
    I think we can all agree that a 60 foot catamaran with 19 people on board going swimming with whale shark LOOKS like a commercial operation. Yes, we know that the Cruising Kiwis and Zatara are not tour boats, and in this case it was in fact innocent. But that's not what it would look like to one of the commercial boats.
    So now, put yourself in the shoes of the commercial boats. If you were running a tourist business which involved spending a huge amount of money purchasing licences, training your staff, providing safety equipment for your passengers, training the passengers on how to interact with the animals etc etc, and you saw what looked like an unlicensed competitor who has done none of this presumably charging passengers and stealing your business...you'd be pretty pissed off, and you'd be right to be.
    If footage then appeared on TH-cam from that potentially unlicensed operator, showing guests touching the animals (which everyone knows is a big "no no"), then you'd be doubly pissed off.
    Surely its entirely reasonable for the authorities to want to check that out?
    I thought the police officer came across as a little bit bumbling, but that's because he was falling over himself to try and appear reasonable on camera.
    The commenters here who are talking about Australia being a police state...? Get real! DO you really think this would be treated differently in ANY other country? All countries protect their tourism businesses and operators. And I can assure you, the police officers in every country I've visited are nowhere near as polite and pleasant as the guy was in this video.
    As guests in Australia, it would have been nice if the Cruising Kiwis had thought sufficiently about how their behaviour looked, and the over the top niceness of the authorities in investigating it, to present the situation more fairly.

      Agree with most of your commentary, thanks. The main issue we had was the delayed circuitous and oblique questioning combined with the false claim that it's unlawful to swim with whale sharks - this sent us in a spin and caused a lot of unnecessary anxiety. I've commented elsewhere on the CTOs which I think had every right to make a complaint. No problem from us on that.

      I was amazed at the level of Policing when I was there. I drove from Melbourne to Sydney and amassed $980 dollars in speed camera speeding tickets. some were for going just a few KM over. We had a Cop walk up to us at a petrol station and just start questioning my kids.

    If they had approached me like that, I would have them wait until I talk to a lawyer. Maybe have the lawyer with me during any interview.
    I hate it when someone keeps asking oblique questions. That gives the impression they're trying to trap me. Ask me direct questions and I'd be happy to answer them - honestly.
    I'm a blunt person, and I appreciate that same direct bluntness from those I talk to.

    Spot on,a commercial operator didn't like seeing all those people onboard Zatara. He doesn't see people, he sees money and lots of it. But its not in his pocket. I hope all people going to West Australia for tourist season, remember that commercial boat and don't spend any money with that greedy guy. The poor guys onboard your boat were only doing their jobs as they had received a formal complaint.

    I wonder if Zatara also filmed their encounter and how different it was with them (being from the U.S they may have been treated differently). My assumption on this is that the tour operators in the area didn't like that you were there so they complained. Good thing you stood your ground and didn't fold and cave. No shame in being honest and transparent because in the end, the truth always wins.

    Hey there. Well, what an experience. I thought maybe the boys had been caught jumping off and running alongside again! He sure took a real roundabout way of getting there though. Like he was trying to get you to drop yourselves in it. What a relief when he finally got there. Would have loved to be a fly on the wall when he questioned Keith!
    My boat worknis stumbling along. Stern gland and cutless bearing replaced. I'm progressing with cleaning and painting the engine. Hull is dry enough to start sanding etc, so boat builders will be tenting and getting stuck in next week. Covid has sure messed things up. Had my two jabs do hopefully ok now.

    I think the Aussie officers were quite diplomatic without trying to cause a ruccus, but they need to do their job and what we don't understand is that officers that aren't power hungry don't enjoy confrontation (they do it cos its THEIR JOB) and he was trying to make it as easy on them as possible without allowing the situation from getting out of HAND. All in all I think it went well.

    Totally was a commercial dive operation that reported you! Great episode tho, I am glad they are looking out for the whale sharks. Wonder how many of the commercial operations have tourists touching the sharks that isn’t recorded! Safe travels! Fair winds and following seas!

    Rob, that's a good way to spend a quite, beatiful night shift (and not falling sleep -sorry Declan, can't forget that funny episode😂-). And Ivan being Ivan😂😂
    As Ivan said, Not cool the way they did approach you. But those two agents were doing their job. And well done, I must say. After all, its not good if lots of ships go around the poor sharks and whales. (Big yay for Keith there).
    All in all, glad it was just another scary adventure (scarier than the hammersharks around the Javelot haha). Don't mess with aussies!!

      We expected to be boarded and were fine with that. It has to be said though they were respectful and courteous at all times. If they had got to the point early on with the charter questioning it would have made things a lot quicker with less anxiety. The comment that it is "Unlawful to swim with whale sharks" (which is not the case) really caused us concern.

    Change of subject...Rob When you swing your leg in the air over the other leg, keep the leg on the ground upright as much as possible--ie the foot still pointing up in the air. You won't go as far and its more difficult but it's a far better stretch... This is based on Ryoho yoga which is a weird, kooki Japanese style yoga that hurts lots but does amazing things for the body! I've also passed your site on to your doppelganger here in Sydney--he loves it and thinks that you're a lucky guy to be just like him!

      @@TheCruisingKiwis so you've got one let in the air that is swinging from one side to the other. The leg that is on the ground needs to keep the feet pointed up as you swing the other leg over it. Normally, if you don't do this the foot on the ground swings out on to the ground. Keeping the foot pointing up towards the sky means you don't swing so far but is also better for the hips. Happy to send you links. I do three online classes a week and they're amazing!

    Yep, they are pretty touchy , looking after whale sharks and the tourism industry up there. We went out with Ningaloo cruises out of Exmouth, amazing day. Great they are doing their job.

    Oh my! Maybe you can send them a bill for waisting your valuable time out on the water! Why did they not just get to the root of the issue straight away than go around in circles! Yes I think your right a tour operator must of got upset that they were not getting the cash to take people out. What makes them so special? I’m sure you all would of looked up the guidelines and rules before you went out for the day. And yes I could not see Keith taking anything from anyone. I’m glad they allowed you to film as it was interesting watching their questions. I wonder if Zatara also filmed them? Now that would be a great watch!😂

    OMG… we’re moving back to Australia with our boat next year after over 15years living away.. I understand the job the fishos have to do, but really, if this is how they approach situations its pretty embarrassing.. meanwhile, foreign vessels are continuously raiding Australian fish stocks… 🎣 👮‍♀️ 🤷‍♀️

    I can see why that would have been disconcerting, but they had obviously received a formal complaint, which they are obliged to investigate. They would need to include your responses in an investigation report, hence the caution which protects everybody. It makes it clear to you that you don’t have to answer, and it also makes it clear that they haven’t gotten information from you under false pretences. His caution could have been better, and his questions more to the point, but that was a pretty friendly encounter and he took significant pains to make it clear that it was your right not to answer. If they seriously thought you had done something wrong the whole scenario would have felt much less friendly. I think think they were trying to get what they needed from you to close the complaint without further action, without spooking you into clamming up and not answering (not saying they did this well).

    First, I had a high opinion of Australia and with what is happening there now, It seems highly regulated. Some regulations are good indeed but at what point does it become too much? Do I need permission to breathe air? Second, can’t wait to see what Keith will say! Furthermore, yes they were doing their jobs, but remember the Germans were doing their jobs too! And no I am not equating them together but doing your job is not an argument to instil fear and control!

      An no, Emporer McGowan runs WA now, laws going in place to double vax anyone wanting to enter or leave WA, so, my daughter in NZ will never see me again. (I'm in W.A.) We all in our family are not getting jab'd with experimental poison, when there has always been good meds to stop viruses.

    Well done for sharing this, hopefully people who visit the area will think twice about breaking any rules that protect the whale sharks. Such a great experience for you all and glad you all did the right thing and got to share such a wonderful moment swimming with these stunning creatures. I too was surprised when they mentioned you had to be a tour operator to swim with them, according to the Ningaloo Coast visitor guide you are permitted to swim with them as long as you stay within the rules.     Hey folks, Love the adventure and Vlog. As a counter to the prevailing outrage, I am glad the fisheries are on it. It can be intimidating and confronting and i understand its uncomfortable. I would prefer over zelous protection of our fisheries than a "nahh she'll be right mate" aproach because I see that is often is not right or OK. All our seas are under deep pressure. I have no problem about you visiting the whalesharks and have some envey at the experience. I am also please that situations are being followed up as they should be. These people were doing a nessacery job. No you were not doing anything wrong nor were they. It is a formal process and need to be. I am sorry the experience was confronting.

    Pull the fishing license
    can't eat
    Pull the boat license can't travel
    Pull the freedom licence
    Sit it out in a cell .
    What would you teach the boys about things like this?
    Respect the animals / wildLife
    Research the laws,
    know the regs,
    And about authority,
    Parental, police, wildlife management, fisheries, ranger, whichever they are called there.
    As kids drive, travel, etc
    less likelihood of problems
    with authorities,
    Attitude may have a lot to do with,
    Oscifer, letter and meaning of the law, not going off on enforcement,
    Even if you don't agree save for lawyers, court, if it gets that far. Front line isn't always
    everything, discretion,
    and where that line ends.

    and governors race
    with independent sister
    running against big parties
    over her brothers killing
    by a police officer

    I’m amused about the people going on and in about the “Police State” and how you were treated. If it was the US and they had an official complaint against you, and video evidence of people breaking laws by interacting with protected animals in an illegal way, they’d have boarded the boat with guns drawn, handcuffed everyone and taken you to the police station for questioning. Obviously, the tour operators there, who paid a lot of money for commercial licenses to operate, complained about your “alleged illegal tour operation” and using their radio network to operate an illegal tour. They presented their complaint and video evidence to the authorities. By law, the authorities are obliged to act on the complaint. Since you’re video recording the interaction, they had to “caution” you as it’s required by law and they do so if you’re suspected of breaking the law and they’re going to be asking you questions about it. The same as reading you your Miranda rights in the US. At the stage they’re speaking to you a complaint has obviously been formally made and video evidence presented to them. They did you a favour by cautioning you and kept repeating that you’re not obliged to say anything. They would have had to prove beyond a reasonable doubt, that you’d committed an offence, and even with video evidence of you being there with the Whale Sharks, they don’t have evidence of a crime such as illegally running a tour operation or using an unlicensed radio transceiver for a commercial purpose, or you personally interfering with a protected species unless you admitted to doing so or they had receipts or some other evidence to prove it. They now can go back to their bosses and say they investigated and there was no offences detected. They can also tell the complainants the same thing, and they have video evidence that they cautioned you before asking you questions as is required by Australian Law and your answers showed that you didn’t do anything illegal. It wasn’t your radio, and it wasn’t you touching the Whale Shark. These guys were acting on an official complaint, not randomly harassing you for no reason. They were simply doing their jobs as required by Law. I think we need to be fair and reasonable and realise that they acted appropriately in the situation.

      Fair point. Maybe it's worth making clear that the law is stupid, hence stupid is as stupid does. Very sorry for those officers playing a stupid role.
      One thing has been made crystal clear in the last year. Australian politicians and the legal system in place sucks.

      A law doesn't need to be fair, right, ethical or moral. It is. At the discretion and will of those in power. Somebody mentioned here about Nüremberg trials, and in fairness those guardians were only abiding to "the law". Yes an antisemitic, xenophobic and murderer law. No questions asked, just do tour job. Same here with these officers. "Cannot touch the fish"... say what? And what if i take my mates for a ride on my boat, they pay for the beers and that could be considered a payment? A beer has a monetary value, hence I might be found guilty.
      What's been shown lately about Australia is going to deter MANY of travelling there for leisure. It seems the police and border forces are still behaving as when the country was an English penitentiary.

      Thank you for your balanced and considered comment. We agree with the majority of what you are saying. A couple of things I will add: Whale sharks are fish therefore have no laws only guidelines for swimming with them. It is unlawful to catch or harm them but not swim with them, as yet.
      The radio was a UHF so the tour companies don't own the network and anyone can own a UHF radio. The crew member onboard with us was communicationg with the tour guides who gave us the all clear to move in and swim with the whale sharks once they left and finally the officers were recording us so we asked if we could record them.

So these officers were summarily executing people, rounding them up, stealing their businesses and putting them in concentration camps and gassing them and burning them in ovens? Yes, the draconian implementation of lock down orders, a separate issue has not been done well, but I don't think being asked about possibly operating an illegal charter operation is comparable to Nazi atrocities in WW2. Get a grip.

    So sorry you guys got caught up in our licensing system , I did raise it with Keith and Renee some time ago not to get in a position where you could be seen as a charter vessel.
    It’s a bit harsh that you can’t swim with the whale sharks without paying money to the Gov for a license.

      That could very well be why they didn't even accept a contribution towards fuel that day. If ZERO money was exchanged then there is no way they could be seen as a charter, no? They could literally say "all of us buddy boats were planning to go together but to reduce the number of boats in the area and to enjoy each other's company we offered Zatara as a 'carpool'".

      I wouldn’t say there is no way they could be seen as charter, as in Qld the powers could say that although money didn’t change hands, this has happened before that it was seen that their may be advantages leveraged to your advantage. I now it sounds bureaucratic bull but it has been done before.

    The guy basically told you that you don't have to say anything multiple times. He obviously didn't want to be there, was down there under instruction and did everything he could to give you an out. But anyway, apologies for the Australian authorities. They're getting way out of hand. I guess at least we can be happy about the fact that if this is all fisheries have to worry about, then we're all pretty safe. Happy sailing.

      Jay, you need to watch this again. He said "You used a radio" to which we replied "We didn't use the radio". That's the truth. Of course we knew who used the radio but that wasn't his question. As for the whale shark, I'm glad you know who touched the whale shark because we don't.
      The great thing about YT is you can choose what you watch.
