You pay to have insurance, you pay to update your registration, you pay for an inspection. You put in all this money every year to keep your vehicle up to date and safe for the roadway. So can they…

Here in NC, I would file on that, and let the Insurance company go after her or any insurance she may have for recouping the money. That way you won't be out $. That is what you pay insurance for. Just went through this in October when an unsecured truck and trailer lost part of their load causing me to bail into a ditch to avoid being hit head on. I was still hit all down the driver's side of my truck, destroyed and bent step bars, and punctured 2 tires. Luckily, the truck owner stopped and turned around, but when he walked up to see my damage he offered me $500 not to involve insurance. *Red Flag 1* I laughed and told him that wouldn't even cover my step bars and contacted law enforcement. I asked for his license, insurance, and registration. He couldn't provide me insurance information so copied his personal information. *Red Flag 2* They came out and knew the truck driver by name. *Yellow Flag* The truck driver told the officer he was trying to avoid debris in the road, which was a lie because there was nothing in the road. Then the truck owner says he can't find his insurance card, so the officer gave him 24 hours to provide insurance. *Red Flag 3*
Fast forward 2 days later, I get a call from the officer and get told he provided insurance. AWESOME! I get all the information to my insurance and had to wait 3 weeks while my insurance attempts to make contact. I take my truck to a collision shop and find out the debris severed my oil and transmission lines, so now the truck is unable to be driven. The truck owner was not able to be contacted, so after a month, they tried his insurance. After 6 weeks, we finally get a response saying the truck owner has insurance, but the truck wasn't listed or covered. Then, I got told his insurance has to go through a 2-3 week process to investigate to see if it was used for business purposes. 4 weeks later I get a letter in the mail stating the truck owner didn't have coverage. I did have uninsured driver coverage, which I highly recommend to everyone, but yes, it was a hassle from the beginning to end. The entire process took almost 3 months had to pay for a rental OUT OF POCKET, so yes, I'm throwing the book at him.
Final Damage cost $8700 and rental car cost $3000.
At the end of the day, materialistic items can be replaced. I'm glad the accident was minor and your wife was uninjured.

I live in Costa Rica, so prices here are totally different, as are wages, but I have a story similar to this... Around mid 2018, a guy hit my car from behind during a bit of a traffic jam in a mall's parking lot (I was stationary, and he just had to get moving because he was in such a hurry...). His car was older, early 2000s maybe, and I was driving my 4 year old Fiat 500. He hit my rear bumper, and got it a bit dislodged, as well as well as put a nasty ding in the plastic. We called the traffic police, I called my insurance (he didn't have any, of course), we exchanged numbers, and we went on our ways.
The very next day, I went to a couple of repair shops to get some quotes, and the prices went from around $140 in the cheaper shop, to around $200 in the more expensive shop. So, wanting the best work for my car (which I had just bought a handful of months back), I told him I would need $200 for the fix, and sent him the quote. He naturally said that it was too expensive for him, he didn't have the money, so I told him (bit of a white lie), that I'd go get a quote from the cheaper shop (note, both those shops were on the list of approved shops by my insurance, so it was only fair to go with whichever I chose). The next day I told him, ok, the cheaper shop's quote is $140, but this time, he told me he had talked to a friend, and that he said that was too expensive, to which I replied that I went to the cheapest shop from the list of approved shops by my insurance in my Province (it's our national insurance system, so it wasn't a sketchy company, its the biggest insurance company in Costa Rica). He told me that he didn't have the money, and said to feel free to proceed through the traffic courts of justice, or whatever is the proper name for that part of the legal system. So I did, I went to the justice offices and sat with the legal rep (the dude that hit my car had also been cited), but as you would expect, he didn't show up, so not only did I win through the evidence, but by default.
The next steps would've been to proceed with a formal lawsuit, which I would've definitely won, but that would've taken many sessions, legal fees, time, and effort that I just didn't want to go through in order to save myself 200 bucks or even a bit less. At least he has to pay the fine to the traffic police, though I don't know how much that was (I believe it was perhaps around $75), otherwise he wouldn't be able to renew his car's taxes to be able to freely use it, and probably get his license suspended.
Point is, be grateful that it was a fender bender (and that your wife was unharmed, of course)... People just don't own up to their mistakes until there are actual consequences :(

When she hits the next person, she's gonna do it again and you had a chance to stop her. The rules are clear, you need insurance to drive and if you hit someone you have to pay to fix it. Consequences are a thing as an adult. So is accountability.

    @demguiz944 2 ปีที่แล้ว

I would definitely go through my insurance and let them go after her. If she has anything they will recoup. If not, at least you save $500. We got hit in the rear, totaled our car I had just done a lot of work to, the driver that hit us had no license, no insurance and no registration for the car he was driving. This was also in Alabama. The Birmingham cop who responded issued ZERO citations to the young man. He was 19 y/o, owns no car, no real estate and had no bank accounts. I have uninsured motorist insurance, which I had thought about dropping when the mandatory insurance law was passed, but I'm glad I didn't - it saved me my deductible. So my insurance went after the driver but got nothing because he had nothing. If you get hit by one of these marginal people you get zip.

I had a similar (humorous) situation in my white Chevy truck many years ago. But mine, the other driver got "confused" at the time of the accident, so we weren't able to exchange information. But his front license plate had torn from his car and wedged between my front fender and passenger side door. (got lucky!) My old roommate is now a cop, so he wrote them a letter, Basically, requesting that they contact me. About a month later, I received a call from the person(s). (husband-driver & wife) It's too difficult to explain the intersection and how we ended up not exchanging insurance info etc.. They could not figure out HOW I was able to find them, until I told them, their license plate stuck to my truck!! I am very handy etc., and was only asking for the materials it would cost me to fix my truck (approx $1000) At the end of the first conversation he/husband/driver said: "Thanks for being so cool about this." More than a year past. My fault, for not getting estimates and calling back until then. When I finally did, it was as though, I was talking to a different person! He was complaining about the amount and kept asking about how I was able to find him. Insinuating, my friend had done something illegal etc..
Realizing at this point of my comment, that your situation is at least a year old, I will say:
I HOPE YOU DID whatever necessary to get it taken care of. Do it as soon as possible and don't sympathize. She and/or G-pappy, won't appreciate it anyway! And don't feel the least bit guilty about it !! You seem to be a very nice guy. I thought I had treated the guy fairly, but could tell in the latter discussion, that he did not appreciate it any longer. They will take advantage, not appreciate!

If you let it go, she'll never learn her lesson and she'll do it to someone else. Not to mention, your just wasting your own money out of your own pocket. Don't waste your money. Worse comes to worse, take her to small claims court or sue her. But don't let her get away with this.
    That's just my opinion.

Definitely need to file with your insurance. Even my show trucks that I rarely drive. I have full coverage on them. She should be held accountable for her actions. This will also teach her to be accountable for her bills.

Personally I’d take her to court … regardless at minimum she should pay for the damages she caused…. Going theu your insurance could make your deductible and payment hiring… that happened to me with a hit and run… do it legally let court handle it

I would MOST DEFINITELY spend the $50 - $100, or whatever it costs to take her to small claims court.
You also did the right thing by not claiming on your insurance. As that should keep the "accident" off the trucks Carfax; which would ultimately lower the value down the road. Even just being a "fender bender".
But seriously.... Take her to small claims court. She needs to be held accountable in some way or she'll continue to take advantage of others down the road.
She obviously doesn't pay people back or she wouldn't have bad credit. Also she'd have insurance. I mean seriously.... Here in Texas a 30 yr old woman can get liability insurance for less than $50 a month. No reason not to have it. Shes lucky they didn't impound her car. Because in Texas they will for no insurance. Not to mention if you get two FMFR tickets... They suspend your license for a year and make you pay surcharges to get it back.

No way she's gonna pay you the money if you stay relax. Either eat the cost and forget about it or go 100% to get her punished and have her pay for the damages.

Sue her. You’ve already done 100% more than you needed to. You’ve given her plenty of chances to try to make things right and nothings happening. Time to stop forgiving and get your money back

If you have a friend that’s a lawyer get them to send her a letter outlining the details of what she will go through if she doesn’t pay, and the consequences. If not take her to small claims court.

You're a kind person and it definitely shows in how you dealt with the people involved. I've been hit by someone who didn't want insurance involved (or didn't have it) but luckily they quickly followed through on paying the repair costs.
I would go though the insurance route and at least attempt to hold her accountable, I wouldn't personally sue her (as some commenters have suggested) because now I'd have to deal with unnecessary stress and cost as well. Sorry you and your family have to deal with this around the holidays.

I had this happen to me in October of 2019. An uninsured driver plowed into a Hyundai which was ping-ponged into me. After the wreck, she tried to drive away, but couldn't due to her wheel separating from her suspension. She didn't say a word to us, she claimed to cops that we all slammed on our brakes and she was going 20 miles under the speed limit. Long story short, the police didn't believe her one bit and she got a heavy ticket. After everything, I was beyond thankful to have Uninsured motorist coverage because of the damage and injuries that were sustained.
I am so glad to know that you guys are ok!

Accountability. No one is accountable for their actions. Entitlement. Everyone is entitled to your money and your possessions. The way I was taught is if you do the crime, you do the time. I’m so tired of people playing the victim after they infact are clearly not the victim. And grandpa needs to chill or pay for her mistakes again.

I’d let my insurance co. go after her. If not I’d for sure take her to court and sue for the $1550 plus court cost plus compensation for any time you miss from work to deal with all this. I’d tell her your suing for $3000 or she can pay up on the $1550.

The fact she immediately ran to grandpa shows she has no accountability or maturity, take her to court and ruin her. Additionally, her being 32 with a credit score so low she can’t put 1500 on a card for an emergency incidental charge is embarrassing at best.

My dad got hit by a drunk driver that didnt have insurance. My dad went through his insurance to pay for it. The insurance company went after the deductible that my dad had to pay, by doing wage garnishments from the guy that hit him. So every so often my dad would get a 20 to 50 dollar check in the mail. Slow process to get your money back but she would learn her lesson i think. But the most important thing is your wife was not seriously injured. Hope this helps. Merry Christmas!!

  • @pheto1521

Out of principle, I would have went through the insurance. You reported the accident to PD and now your truck has an accident. It's actually $1,550 plus diminished value. Could be $4,000. I personally had a lapse of insurance due to my bank account having fraud (someone else using) for over a week, it was frozen. My insurance autopay didn't go through. My wife hit an old 2003 Sonata worth a few grand (in a car solely in my name). My car just had minor front bumper damage. My insurance requested proof I had my account frozen, sent them documents from my credit union and they still declined to cover. Long story short, the other ladies Statefarm cashed her out $8,500 and went after me. I had moved and never received documents, one day I was pulled over and told MY license was suspended. Her insurance suspended MY license and I wasn't even at the scene, but it was because MY car wasn't insured. I ended up writing a check for $5,000 to Statefarm and settling and they released my license.

Lady goes to the junkyard and gets a new mirror for $50. She then makes jokes to her friends about how she paid $50 for a new mirror to fix her car and got out of paying $1500 to fix your truck after causing an accident while having no insurance. She wins and you lose from being kind-hearted. You should definitely make her accountable one way or another or its gonna be a joke to her

Might want to check on “broad form coverage”. It waives the deductible if the other part is determined to be at fault.

She needs to take responsibility for her decisions and actions. If you let her off, she is the one who will be celebrating....at your expense. Take her to small claims court. She has to learn that mistakes have consequences.
