If you are drunk enough to black out… I don’t care how much she seemed into it, at that point she did not have to mental capacity to consent and the guy should have stopped, noticed her inebriated state and stopped. Maybe gotten her some water and a blanket to sleep it off. By herself.
How do you know when someone’s black out drunk. I never know when my friends are black out drunk. However I don’t agree with Kira either
@@raerae15xo that’s where it gets tricky. If someone has been drinking all night it’s probably better to assume they don’t have all their faculties about them and not continue. If you can’t tell if they are black out drunk you shouldn’t be going any further, it should be pretty clear. If someone is drunk they cannot properly consent.

That's tough because you can't usually tell when someone is "black out drunk" and honestly, girls still want drunk sex. So just saying don't sleep with them if they have been drinking a lot doesn't really work either.
@@allymarkwell891 actually it does work. It’s pretty simple, if you notice someone is not sober enough to make good decisions…. Don’t continue. It’s as simple as that. Where it gets tricky is when everyone is too drunk and no one is making good decisions… but if you are able to tell “this person is drunk and probably cannot consent” then you most definitely should stop and it’s actually pretty simple.

Male or Female, it does not matter if you are drunk or sober. It is never okay for another person to sexually assault you. Saying you deserved it or you were asking for it says more about the person than the victim. I was sexually assaulted from age 5 to 13. It's never a person's fault. No matter what you wear, drink, drugs, dance, or the words you speak. A monster is a monster. they did it, not you.

I'm sorry but I think many people, including Josh are misunderstanding what "blacked out" means. As someone who was with a bad alcoholic for years, blacked out does not mean passed out at all. It simply means loss of memory retention. My ex would blackout all the time and there was no way to know they were blacking out or not. They were coherent and verbal, talking,laughing etc. but talking the next day they had no memory of certain periods of time. I'm sure that's what she meant. Not passed out. Blacked out drunk is not unconscious.

Josh…Being unconscious/passing out and blacking out are two different things. You can be conscious and “blacked out”. This is why, I think, drinking to this level is just unnecessary. Because how is one to know if someone is blacked out? Everything gets real messy.

Yeah, I think there needs to be more accountability on both sides. Getting blackout drunk is a choice (obviously only when it is done on ones own terms), and it’s not a good one. That bad choice then brings additional repercussions.
While I NEVER agree that some should be r***d, and that lack of consent is r***, getting blackout drunk and telling a guy yes, and then not remembering what happened in the morning and saying you were r***d when in reality you can’t remeber telling that person you wanted to have sex, isn’t okay to me, especially when the guy was also drunk, which is most often the case. I don’t agree with a guys life being destroyed and him being labeled a rapist for the rest of his life is right in that kind of a scenario. I just don’t.
It’s a completely different story if you never actually gave consent though.
Additionally, you can’t always tell when someone is blackout drunk. Some people seem relatively fine and normal, carrying on with normal conversation and seem to be present, when in reality they are so drunk that they won’t remember a single thing the next day. Some people just handle intoxication better than others when it comes to how their body presents that intoxication outwardly and behaviorally.
Obviously if it’s really obvious that someone is that drunk, that’s just a flat out no, as at that point it is clear that that person is not even able to consent. But what about the times when that’s not obvious and the person seems relatively fine and cognizant, acting in a way that someone would reasonably think consent was possible? How is it the man’s fault in that situation if the girl gave consent and seemed alert and aware enough to make that decision, when in reality she was blackout drunk and then doesn’t remember the next day? Guys aren’t mind readers or psychics, even more so when they are also drunk themselves. How does all of that blame shift to the man and make him a rapist in that scenario?
At the end of the day, more accountability needs to be taken for bad choices, and that goes for men and women. But these days, women seem to be treated as if our bad choices mean nothing and don’t matter, and that we are mindless creatures with no capacity to act voluntarily or make our own decisions. All of that responsibility is shifted onto the man, and it’s all about his bad choices, when in reality it’s a mixture of both in many of these situations (obviously not all, r*** still very much happens and should be treated seriously).
Women need to start stepping up and making better choices for themselves, and stop putting all the blame on men for bad outcomes. When you chose to get yourself blackout drunk, you are making the choice to not have any recollection of the things that happened to you or the things that you willingly agreed to during that period of time. The same goes for men.
I don’t drink and never will. I’ve seen the devastation and evil that alcohol brings, and I make the choice to not have any part of it. Same goes for “casual” sex. Both of those things on their own are dangerous and reckless, but both of them combined is catastrophic. But they are both still choices, and people need to take accountability for that. It’s not at all difficult to not get yourself blackout drunk.
It’s also not difficult to not sleep with any random person you meet. And it’s also not hard to not sleep with drunk people.
The entire situation revolves around bad decisions on BOTH ends in so many cases. And the sooner we all recognize that and stop pretending that women have zero faults and can make any choice they want with the expectation for good outcomes, the sooner we can put an end to things like this happening.
Again, I do not condone r***. It is never okay when that is truly the case and consent was never given. But in our current society, men are being labeled and charged as r**ists for sleeping with a girl who actually did give consent, but later can’t remmeber giving that consent so claims it didn’t happen. At that point it’s his word against hers, and the default is believing the woman in so many cases. I don’t agree with that. I just don’t.
As a survivor of SA her statement infuriated me. What kind of person thinks it’s okay to continue to have wed with someone when they are passed out. No means no and silence doesn’t mean yes. If that happened to her daughter would she tell her that it was her fault or she shouldn’t feel violated because she made out before she passed out? Yeah I’m so sorry, I was raped when an acquaintance KNEW I was doped on medication.. and couldn’t fight him off… despite saying no also. But even so if someone is incapacitated… due to drugs or alcohol.. it’s pretty low. In a relationship you should even have an understanding of what is acceptable when drinking or taking medication or any drug. "Blacked out" just means that you don't remember what happened or some things that happened. It doesn't mean that the person is passed out unresponsive. They are still completely awake and seem cognizant. Like, I've said things that I don't remember saying or doing at all, but no one else would've been able to tell that I wouldn't remember it.

This infuriates me 🤬 Consent can be given and withdrawn at ANY TIME PERIOD! Does she NOT realize that consent is unable to be given if someone is underage or under the INFLUENCE!?!? Why do people not understand that they say if you're under the influence you aren't capable of consent?? Whether it is drugs or alcohol; it actually changes the way your brain processes things and effects decision making! I got so furious the other day at work because a mom came in with her teenage daughter and niece and was talking about a woman can't claim she was assaulted if she willingly goes to a hotel room with her boyfriend. Hey Josh...it sounds like you're using "blacked out" and "passed out" interchangeably. You can be blacked out drunk and still be wide awake, interacting, actively participating in things. "Blacked out" just means you don't form new memories during that time... So the next day it's like that period of time is "blacked out." So, although it's still scummy to sleep with a girl in that state what she said isn't AS bad as you're thinking.

Consent is so much bigger a conversation than at least 95% of people realize! As you said, it is ongoing thing. You can give it and rescind it, you can give consent for one thing and not another, so on and so on. That said, someone who is inebriated in any way CAN'T consent! Psychology and neuroscience say that they are not cognizant enough, like a child unable to grasp consequences and the future. Even if you feel fine, even if you're not THAT drunk and you never pass out, still no. Even in a relationship, a committed, monogamous, consenting relationship, you cannot make the decision while drunk or high or anything else. It is ALWAYS r*pe, even if both parties verbalize consent. This needs to be talked about more! So many people, men and women and non-binary/genderfluid, have woken up sober and regretful, and did not know how to verbalize what had happened or why it felt wrong. Because no one ever told them or their partner what to do in a situation like that. It's so scary.
