My understanding is, IF it (the bath bomb) consists of more than 2 layers, of the SAME concentration of mix, it is NOT violating their patent. This is what a patent lawyer told me. Their intellectual patent covers the specifics outlined in their patent, without any inclusion of variances.
Well, this particular one does have inclusion of variances, so I’m not sure on it. But the kicker really is the two layer with different concentrations.
I loved the idea with the core bath bomb, . It's an over size embed lol! If you want your bath bombs to float - make them with embeds ❤ 50/50 CA and BP. Thank you for doing this for us creators. It was something I was thinking about doing since your last video!

I'm not sure, but I think whoever registers the patent first gets it under their name; even if everyone has been making the same things for generations.
Patents I personally think would be for something really unique and not something that a ton of people do. I saw recently a company got mad at another for having the same name of something that they trademarked. However the receiver of the complaint had actually used the name way longer than the complainer had 🤦🏻♀️

I'm wondering though, if you could still use small different colored embeds within the bath bombs - as long as the recipe for for both bath bomb and embeds is the same, or would/could Lush kick up a fuss. Thanks so much for sharing this important information, as I never thought about there being any kind of patents on these types of products. I now know to be careful to research, research, research.
Isnt that the same as what everyone does with putting embeds inside their bombs? Embeds are usually the same ratio you used for the core, 1 to 1 . and the outer shell being the normal bath bomb and different ratio of baking soda and citric. Am I wrong?
@@jillianj310 not quite, as the main description of the patent states. I double checked against legal IP violation filings, and Lush seems to believe their patent covers the dual concentration first and the rest is secondary.

Yeah, embeds are fine. Just not an embed with a different concentration of baking soda to citric acid, it seems. It’s a pretty specific statement; If they had tried to patent just the mixture of a base and an acid in a spherical shape for a cosmetic product it would be broad and difficult to patent. Which I believe they attempted when they claimed they invented the bath bomb many moons ago.

I'd assume you're 'safe' if you're making them for personal use and not selling them. They have absolutely no way of finding out. I'm going to continue making them as I've always done as they only go as far as my bathroom. :0

Question for you I make pine tar soap.and I heard that there is a patent now but due to some health issues have been unable to find more information, would you be able to help please? Chantine, Do you watch Quench (Quench Bear) in Canada? She makes a dual core bath bomb of sorts. She places loose powder in the center of her bath bombs and sells them openly. She hides nothing. Is this against this patten? Can we ask this question of the Patten Attorney when she visits? I'm very curious as to what she says about this! Quench has a TH-cam channel. If you got time, and don't follow her, please give it a view. She says this is perfectly within the rules of fair play. I'm curious what you think and more so what the Patten Attorney says. In fact she does a video on Lush and their process. Others put multiple embeds in theirs and say that is permitted too! Let's look into that! You really got me curious now. As I would have thought by now, if it was a problem, Lush would have gone beserk on these situations. I can't wait for Ms. Patten Attorney to tell us the long and short of all the creators out there that have gotten away with it for at least the last few years. Although I think Lush is a very psychotic company and is ridiculous in their claims of having invented anything, lol! Most of the bath products have been around longer than Lush has been a company. As far as Canada/international patents go, I didn’t look into them, but as we saw yesterday within the deep dive, the devil is in the details of these patents. If they are making bombs this specific way (IE using two different concentrations of baking soda to citric acid), then they could very well be in violation. As to the companies that sue or don’t sue, a) they have to be made aware of it and 2) they don’t have to file the second they ARE made aware of it. Lush is paying attention more these days than they ever have been and are actively involved in litigation with entities that are making their bath bombs the way you described above, so take that to mean whatever makes sense to you.

It’s not how I do my embeds, for sure. 😬
My understanding is that if it’s a different ratio it can’t also have a surfactant AND cream of tartar, based on the patent.

I'm in Australia and looked up Lush's patents here. They have no current patents. I can legally make dual core bath bombs (from my understanding).
