Trinamool Congress member Mahua Moitra, among the most vocal Opposition MPs, was expelled from the Lok Sabha Friday over ‘cash-for-query’ allegations. In Ep 1364 of Cut The Clutter, Editor-in-Chief Shekhar Gupta explains the allegations against her, how they came to light, and past examples of MPs facing action over ethics-related issues.

Quantum of punishment can be debated, but it is foolish to defend her wrongdoing. Mahua Moitra admitted to sharing passwords with a private entity (not her secretary). There is evidence of multi-country access. Hira Nandani is a competitor to Adani. Clearly, Hira Nandani had a beef with Adani. Access to Parliamentary servers is not her personal property. Even employees cannot give their relatives access to their company property. Secondly, we had a situation in the past where terrorists entered the parliament through the brand power of the "ambassador" vehicle. Should we be so lax about national security?

    • @BharatThatIsIndia
      @BharatThatIsIndia 7 หลายเดือนก่อน +20

Yes she is not naive to share the password with a business person, even if he is a friend.
But main problem was how they behaved in the ethics committee. How can a recommendation be given without asking any questions from a person who has said that she has taken money from her?
He should have given proof that he has given money in exchange for questions being asked and not as a friend/boy friend//or whatever the relationship is.
Also, why will someone ask a businessman to pay/expend to renovate her government building?
Hiranandani should have been questioned and after that they could have given the same recommendation.

@@BharatThatIsIndia She admitted taking "gifts". Whether it constitutes "cash for query" is for the courts to decide. I'll merely go with facts: 1) Hiranandani is an Adani competitor. He benefits from bad press to Adani. 2) Her expulsion is in line with the precedent set by UPA with the 2005 "Cash for query" case.
The "should" and "would" are personal opinions.
Personally, I do not think she should have been expelled. A DISCREDITED critic is better than an EXPELLED one. It is highly unlikely that it's a thoughtless, overconfident decision from Modi. I think it's about sending out a message that you cannot corner the government on Adani. Quite frankly, I think it's fine. Every political party cozies up to Corporates. Without the Ambani and the NSE 200s, we would have been in a state of civil war. However, the Adani tirade is a deliberate attempt to obfuscate a usual G2B dealing to create unrest against the Govt. It did not cost Modi any election, but it cost us Green Revolution 2.0 (farm laws). I am from Maha, and I can vouch for their importance, esp for vegetables. Also, we live in an era of echo chambers - the Left will overlook her "fallacies", while the right ecosystem will latch on to these very "fallacies". Mahua never really captured the admiration of centrists. It's not enough to deviate most of the centrists from Modi, esp not with the Ram Mandir inauguration coming up.
      These are my views.

Shekhar seems to have taken the role of Mahua’s lawyer here - reading out the committee’s report with a tone of disapproval and pointing out past precedents of inaction or slow action as a justification against the speedy and decisive action in the current case. Shekhar took a similar approach when Chidambaram was arrested with an entire episode of “cut the clutter” spent on portraying it as a revenge by Amit Shah because he was arrested when Chidambaram was home minister. In that instance as well, the facts of the case and corruption charges on Chidambaram which he should have been declutterring were overlooked as was the fact that Chidambaram was arrested on corruption charge whereas Amit Shah on a terrorist encounter killing charge.

It is amazing how this Cut-The-Clutter makes a big deal of the speed at which this has proceeded. There is not much to this case. The party is not denying that she gave her account information. The party does admit that she did take gifts. The party, Hiranandani, that has filed a sworn affidavit as to the expectations he had and why he cultivated Mootra. Good luck trying to get this reversed in any court. Mootra went on TV and said she had done everything that has been alleged. Now as for money trail or anything else it is really not that relevant. At the end of the day even without a quid-pro-quo you cannot hand over your parliamentary privileges to a Business Entity.
Why is Shekhar making a comparison of such events in the past? Who CARES!!! Mootra is guilty as charged. The right thing has been done.
Mootra is projected as a firebrand, she is none of that. She is obnoxious, rude and uncouth.
This entire case tells me something, MOOTRA is also STUPID!!! How stupid should you be this day and age to give out your login to a business entity and have them log in from all over the world simultaneously and enter questions on your behalf, and presume there would be no consequences to pay. Be loud, uncouth, and rude and make enemies everywhere.

Shekhar Guptaji's argument of speed in this case is bordering stupidity and bias. This government has been implementing everything at a super speed - one such example is building of number of new airports in 9 years, equal to what was built during 65 years since our independence. Guptaji is unable to accept anything this government does and hence finds weak arguments of speed, etc, to satisfy himself and justify the sidestepping of Moitra's confessed criminality.

Dear sir .. in corporate life any password sharing means termination of ji .. here an MP is Sharing the credentials.. I don’t know what is part of the portal.. but ideally if it is established that password sharing has happened a person should be moved out irrespective of the level of benefits. MPs have to show highest standard of individual governance

There definitely were reasonable grounds for the actions both earlier and now. However, the earlier ones were more rational.

Another great insight by Shekar. I love your narrative but always with a pinch of salt. True, many BJP MP's had done crimes and irregularities, and leaders of those days may have different perspectives between a privilege committee and the ethics committee. This BJP puts lots of research and thought before hitting the ground. Have you ever watched Mahua speaking ?? She was supposed to have been working for an international bank but speaks like mavericks. He come out as a uncouth and uncultured character much like he party leaders. My guess is that people who think of the seat of people's power as a sacred institution could not countenance Ms. Moitra's casual shrugging away with, 'everyone does it'. I think this was the red line that she crossed, and not the attacks against Shri Adani, though they must certainly have been an irritation. Every recent symbol thoughtfully invested upon the new Parliament building - recall Kartavyapath or the art and the architecture inside the new building - has been to elevate the sanctity of the place in the minds of people, especially those who come there to work.

The inquiry and punishment process followed is as per Departmental Enquiries against delinquent employees of Govt services as also govt undertakings. The established principle is Preponderance of Probability i.e., the delinquent could have committed the misconduct without insisting fool proof evidence. A reasonable opportunity to the delinquent to defend serves the principles of natural justice. The punishing authority will not go into details except that whether reasonable opportunity is given. Then summary punishment as per rules is awarded. The issue of Mahua ticks almost all. She will probably face CBI investigation regarding bribe part of the charge. All such departmental enquiries are from Kangaroo courts since the onus of proving beyond reasonable doubt doesn't exist. The evidences collected from wherever possible and admitting them lies with inquiring authority. Mahua has not denied having parted with user id & password. She has admitted having accepted illegal gratification. This is enough to impose punishment.

This is the lowest of quality of defending a wrong doing I am hearing
I am an NRI and I work in a multinational environment. If the company find I have shared my credentials I will be suspended immediately without any debate or question
Here we are talking the sharing of credentials at the highest level where there can be National security risk and with out any debate or question she should have been removed long time back if there were proof
Further comparing to the past erodes the seriousness of the issue
