      Not at all, it makes the prosecutions point that he can’t finish a sentence without the judge interjecting meanwhile the defence is granted the ability to finish their thought. This is how you can retry the case.

      To be fair, he is not asking the judge to not interrupt. He is asking for the defense attorney and later the stenographer not to interrupt.

      @@yellow4034 thank you so much. I thought something similar after reading your initial post. I was thinking of he has a Miranda right to remain silent so maybe is that. Wasn't 100% but it is all clear now. But for what I can see I don't think the prosecutor is not doing a good job.

Violating constitutional rights, and B. Bringing up something that was already explained wasn't relevant to the case. The prosecutor was acting way outside of what he was allowed to do.

    1. We didn't know that Kyle put out a dumpster fire that was being rolled down to a gas station to blow up, with people all around.
    2. We didn't know that the Police were told to stand down as businesses were destroyed.
    3. We didn't know that Kyle's Dad, Grandma and Friends all lived in Kenosha, 20 minutes from where he resided with his Mom part time in Illinois.
    4. We didn't know that Joseph Rosenbaum knocked him down twice and then attempted to kick him with lethal force to the head.
    5. We didn't know that Huber had hit him in the head 2x with a skateboard.
    6. We didn't know Gaige Grosskreutz, a felon in possession of firearm, aimed his gun at Kyle first, as he admitted on the stand.
    7. We also didn't know that in the State of Wisconsin, it is legal for Kyle to have a gun, even at 17 (which was why the gun charge was dismissed).
    8. We didn't know that Kyle did not cross state lines with a gun he wasn't supposed to have. The rightful gun owner did, as he was legally permitted to do.
    9. We also didn't realize that Rosenbaum was a 5 time convicted child rapist and that Huber was a 2 time convicted woman beater.
    10. We didn't know that Grosskreutz was a convicted Burglar with an assault on his record also.
    IF THE MEDIA DID THEIR JOB. we would ALL have known this !

The thing is, he still has every right just like anyone else to defend his life from being ended or hurt, regardless of what circumstances got him there. Having said that, he had no business being there with a firearm at his age and I think he should get a little time for it. What amount is for someone else to decide but he made a mistake that ended lives and justly should be penalized somewhat for it.

      @@eam4279 I do hear you about the judge stammering and not being able to express himself in the moment in an articulate fashion, but my understanding, being someone from the area, is the judge is widely respected. As for the prosecutor, he's got a good reputation too, and in other cases he's been a good trial attorney. With the video available in this case, which absolutely demonstrates self defense, I think the prosecutor felt compelled to do what he can to sway the jury.

    As a trial attorney, I can tell you it is quite rare for a prosecutor to deliberately sabotage a trial in order to get a mistrial declared. I’ve seen defense attorneys try and pull this kind of stunt. Here we see a prosecutor pulling out all the stops to get a mistrial because he knows his case has collapsed like a wet taco. Really, it is prosecutorial misconduct that should see this lawyer facing disbarment proceedings after this trial. And really, it is their own fault. They overcharged the defendant in the face of video evidence that everyone in the world saw, and now they are reaping the harvest they have sewn.
    This is what can happen when the prosecutor’s office is too tied into politics , and forgets their responsibility to honestly and fairly
    make a determination as to who should be charged with what. This prosecutor is taking his marching orders from the leftists who run most of the cities in this country, and I find it interesting he fears them more than any misconduct proceedings he could face before the Wisconsin Supreme Court at the conclusion of this trial.
    Perhaps worse than all this, it calls into question the integrity of prosecution offices all over this country. And this isn’t the first time we’ve seen woke leftists engaging in malicious prosecutions: Duke Lacrosse team, Ferguson, etc….

      Yes. I am not a law expert, but I often wonder if something in the system should be changed to safeguard prosecutorial integrity. Where I live I often see the opposite problem where DA’s refrain from prosecution in order to protect political interests. There are two cases I’m aware of that were obvious homicides and DA refuses to acknowledge compelling forensic evidence or give any further consideration to cases, even after promising to do so during his campaign. I wonder if maybe DAs should have shorter terms, should work in rotation to avoid biases and political entanglements, or should there be a more accessible route to appellate court when necessary.       @@gymzilla12 I think the OP was saying the prosecutor wants a mistrial so he can get another shot since this one has gone so poorly. Of course, if the defense can get a mistrial with prejudice then they can't retry.
      Binger has been playing dirty from the start, and Rittenhouse's defense has neglected to object on pretty clear hearsay (the statements by the guy in yellow pants that were a major part of Binger's cross today, for instance). I think Binger is figuring that if he can slip in enough prejudicial information then either a mistrial will happen, he'll get a hung jury, or he'll get a guilty verdict.

      @@adara4635 I'm a huge fan of America and support liberty and justice for all. I also love Batman and the idea of doing your part to rid Gotham of crime. That said, Kyle isn't my hero. He's an idiot for putting himself in the position to have to protect himself. I understand his anger and his sense of community is admirable and should be applauded. The way to effect change is what he was doing during the day, cleaning graffiti. At night, going out with a gun to protect property that isn't yours is a recipe for disaster. I feel he was justified in protecting himself in shooting these people. He was also within his rights to have the weapon with him for defense. However, just because you have the right, doesn't mean you have to use that right. Use can turn to abuse easily and you're better off not putting yourself in positions to approach that very thin line. And he didn't do me or our country any favors. Conversely, he has created more harm and divisiveness thusly, and most importantly, giving more fuel for tyrant individuals to push against 2nd ammendment rights. If anything he now has a debt to all Americans because of his actions. Not legally obliged, but by his pledge of ALLEGIANCE.

    "You have the right to remain silent." Several years ago, the United States Supreme Court ruled that the Miranda rights are absolute and cannot be skirted or abridged in any way. If this prosecutor wants to say that a person using an absolute right is an indication of guilt, then he needs to find a new profession. Any first year, criminal law student knows this.

The prosecutor has continued to ignore criminal procedures, trying to lead witnesses, obscuring evidence and outright telling the judge that he’s wrong about his understanding of certain laws. Like a 7 year old telling you that you’re tying your shoe strings wrong and that you are not only stupid but shouldn’t even be wearing shoes.

      @@dariusvincent9087 jurors are always selected randomly. Trying to add a clause promoting greater diversity (race, economic background, gender, political leanings, etc…) would compromise that. Background checks and interviews are done to weed out people who may have strong bias against or towards a particular side. To add onto that, most people hate jury duty and will try to get out of it. Your statement just doesn’t make much sense as almost every court in the world works this way.

One of the things that a jury must do is not take these things into account and basically him bringing this up is a violation of the deepest ingrained rights of our constitution by trying to use stuff like hypothetical situations things said in passing, and his pre trial silence: which he has a right: most people know if your arrested don’t speak.

    This was such an important trial in many ways and i don't mean who was guilty or innocent that aside.I believe the proceedings from both defence and prosecution as well as the judge show the layman an excellent breakdown of how a court case unfolds and how a judge uphold laws and manages a courtroom. This case will hold precedence in further cases in the future.!

      I don’t need to be a lawyer to understand the amendments granted to us by our constitution. If you got arrested for any reason why would you talk we are allowed silence as a right and bringing that against him is a clear violation. While not a good look it’s an important part of American law that the Miranda rights be read out you have the you have the right to remain silent anything you say can and will be used in a court of law, and you have the right to an attorney

      Believe it or not, depending where you go to school, you are kinda taught this in a round about way. It's basically called speaking without saying a word. Every reaction you make is noticed be it conscious or subconsciously, and it can often times hold weight in the judge's or jury's mind. Also, I just made all that up, but it sure sounded right huh???
