      They commonly split the tips with other employees. Its company policy , nobody is supposed to break it. If she breaks their agreement with eachother, what is stopping other people from doing the same.

    Translation of the owner's words: We definitely fired her because of that tip. I just never knew it would blow up in my face like this. So I'm just gonna say that it's company's policy to not disclose what really happened because that would mean digging my grave even further.

      The customer, who planned and prepared with his colleagues to give a big tip that night, said he had called and checked the restaurants tipping policy.
      The owners say that customer lied.

      @@athorpe1937 I work restaurant and one of the things that we never do is call a customer a liar. Even my managers don't do that. If someone calls and asks a question, the manager will say that the question was asked. Both the owner and his dumb wife, are lying and the grin proves it.

      I don't see the problem here. They took the money from her to pay the rest of the staff too. Not like she is the only one that was working hard that day. She just happened to be lucky to be serving them so I see no issues dividing the tip money with the rest of the staff.

It was her tip that her and the other lady earned I don't think it's fair that they have to split it because if it was lesser tip or a what you consider a regular tip there would have been nothing said. Of which the Restaurant Can Not do as so far 4 employees and 1 ex employees has stated that the Practice was Never used before this event. Secondly, bartenders and Cooks Do Not Get tipped out.       @Dead Memes in ark min wage is 10hr...so cooks are getting at least that...while servers get 2.63 hr. Rules regarding tips is on wage & hour website.
      If theres any tip share it's done with tipped employees...because the pay taxes on tips.
      If servers are giving other employees a portion of their money ...its between them( for appreciation) the server claims tip and is responsible for the taxes.

      Ancia Gabe. That's a bs smoke screen. That statement simply means SOME of the tip is distributed. The owners take an undisclosed percentage (could be 20% or 90%) then "distribute" the rest to employees. That's why when asked, the owner states they never told the tipper that the money goes to the server.
      Your problem is you're approaching this from the perspective of a person with common decency so that's how you interpreted the information provided.

    The restaurant owner's behavior regarding to the waitresses firing was utterly disgusting. It was obviously clear that the owners wanted a piece of that tip money. If the owners of the restaurant wanted the waitress to keep the money then they should not have made a big deal about it.

      While I’m happy this woman got her gofundme money and found a new job, it’s not as simple as you’re making it out to be.
      When you tip the waiter/waitress serving your food, remember, there’s someone in the back that had to cook it. There’s also someone washing the dishes so that there’s actually plates. There are a lot of people involved in serving you, but you only see one person. This is why, generally, wait staff share their tips with everyone involved and it’s why restaurants in most states in the US are able to pay such a low salary.
      It’s no different in this case. There was a guy in the back, running around like a mad person, cooking 40 meals, 40 appetizers and preparing 40 drinks. There was someone in the back washing dishes like a mad person. No doubt, there was more than just these two women bringing out meals for 40 people. By giving a $4k tip just to the waitresses, everyone else involved got cut out from the generosity of the diners.

Happy to hear she was able to keep the money and even got a new (and hopefully better) job. The fact that they fired her over this during covid and literally two weeks before Christmas speaks volumes. I hope they enjoy the PR hit this probably took to their business.

      For at will employment states, you can be fired for any reason as long as it's not an illegal reason (wrongful termination), i.e. discrimination, breach of contract, etc.
      While I don't know if being fired for a tip dispute is illegal or if what happened is in line with their tipping policy, the problem is that employers can make up whatever legal reason they want that she got fired for and generally it'd be pretty hard to prove otherwise.
      But while they may not face legal repercussions, they do take a huge PR hit and are probably getting review bombed right about now lol

      @@SuperTamig Actually my family and I are suffering from it right now. Two of my relatives got it, and have no insurance thus needed help from the rest of the family to pay for hospital bills. I have to be a caretaker for one of my uncles because he can't leave the house due to this new variant. I also need to be wary and can't get a normal job because I'm a recent heart patient and if I get covid, I'm a goner.
      Never assume everyone has the same exact situation going on. It makes you look inept.

    The waitress was not technically fired for wanting to keep the tip, she was fired for disclosing to the tippers that the restaurant was taking 80% of their money.

    The person who arranged the tip had checked with the place to ensure that the entire tip would go to the server and that it would not be split. This is a lousy place that wanted to use this gift to the waitress and give to the rest of the employees of the store instead of manning up and doing it themselves. Disgusting!

    This happens all the time...In my town a waitress had her car stolen some of the customers tip her $3000 to buy a car, she was a single mom with 2 children. The owner wanted the tip and when she said no she was fired. Once the news got out on what the greedy restaurant owner did the nearby restaurant hired her with better wages, the greedy restaurant owner lost much business and put out that they were following tips guidelines. greedy...!!!

    This happens every year. This is really just a statement to how selfish we are as a country. We cannot just be happy that someone want to show some appreciation. It usually happens around the holidays. I personally think shared tips are a joke.

    I'm from TX, waitresses here make like $2.30 an hr + tips. Having experienced waitressing myself, tips are what makes the weekly paycheck.       That’s exactly the way I heard it explained in another article. A tip is not meant to cover their payroll, it’s a gesture of gratitude to the servers. They should pay their employees properly and the tips should only be a bonus for attentive service.

    Here's my point of view coming from a family of sisters who worked hard as bartenders relying on tips to feed their kids, and now my niece owns a successful bar due to her mother's hard work. These owners
    Should be fired for their arrogance in jumping to dismiss a worker over this. Rather than fire, they simply should have pointed out that the next big party would go to another server in the future. And this server should have shared at least $1,000 from her tip with her coworkers who helped her do a wonderful job. She could still go home with $3,400 and none of this would have been that sensational. The only losers here are these two owners who probably wanted to get their hands on that money for their own.

      I don't understand, if every person gave a 100 dollar tip that would be 44 people, how many waitresses helped that group, was the owners splitting the tip among all waitresses and is that the policy, many restaurants pool the tips and split them at the end of the shift, were the owners keeping part of the tip for themselves? Did the realtors not even think how it would make the staff that also helped not to get any of the tip?
      I do agree, pay your waitresses well and don't allow tipping.

They did buy almost all the hospitals, almost all the gas stations, most the fast foods, furniture stores etc that's why when you go to buy something at Walmart click it and the price is then higher. They got paid to come here, get everything free and don't pay any taxes, And they have Specific Government doctors that have Government Insurance.     While I understand restaurants have a tipping policy, I really thought that the tip is for the specific server it was given to. I would tip a server because of his/her service and I don't expect it to be shared with his/her co-workers.
    The manager's story is bogus! The big tip was not a problem but yet she was fired several days after. I don't believe it to be a coincidence. God bless the gentleman that not only gave her the tip but started the GoFundMe for her. He really cares and is generous :)

      They discussed their own policies, but not the specific circumstances under which the server was fired. If you get fired from a job and go try to get a new one, this same practice prevents your old employer from tainting the opinions of prospective employers when they call to ask about the employee's work experience.
      So if it's not okay to disclose those details in one situation, it's not okay in the opposite situation. Just how it is everywhere I've ever worked. 🤷🏽‍♂️

    One time we had an accident in the parking lot at my work. Both vehicles were stationary and was partially blocking the entrance to the drive through. Prior to working there, I was a traffic controller for a hotel and already had knowledge on how to handle a situation like that. I volunteered to go out and assist the drivers along with the traffic coming into the drive through. I was out there for about two hours, and towards the end, the wife of the man I was comforting (who was in the accident) came up to me and tipped me $100. She thanked me for staying with her husband while also making sure cars were able to get around and make it less stressful. My manager saw what she did and when the women left he insisted I give him the money and said "your co workers will thank you for this tip." I probably only saw about $5 dollars of that after it was split between co workers. I was pretty upset.

    Everyone saying she should have had to split the tip with the cooks, and bartender, and other servers are wrong! The cooks and bartender are paid a mandatory federal minimum wage or higher, that's what they live on. Servers are paid a minimum wage 3 times or more less then the federal minimum wage. Servers live on tips. If they normally never shared tips with all staff working on their shift then just because this amount was exceedingly large she should not have to share with ANYONE other then the one other server that served that group with her. Period.

    I moved to Europe 5 years ago. So far the servers and kitchen staff I've seen here all get paid well. I tip well anyway because I'm from the US and that's just what I've always done. But the restaurant staff are always surprised and often politely refuse to accept it.
    If the US would simply pay living wages, these fights wouldn't be necessary and greedy business owners wouldn't have so damned much control over the economy.
    You shouldn't have to depend on "tips" to live. That's another sign of a disgustingly backward society.

      I worked as a server and we had a downtown location that was very popular to tourists and often times Europeans would come in and rack up huge tabs and not tip because they weren’t aware that servers here make nothing hourly like they do over there.       She has to report it, as a tip it is taxed and you have to report all of your tips. 4400 cash is a wad and someone would find out and tell on her. The IRS assumes you get 8% tips and if you don't report tips or report under 8% they might investigate .. but billionaires and other rich people get a free pass on their taxes. Ronald Reagan did that.

    I've worked in service 35 years. I was tiped 200$ and was asked to share it with my co-workers, as they helped me bring out the food. We're talking 60 people they pre ordered, I did hand over 20 to two coworker and the 10% to kitchen so now my 200$ tip was 120.
    Service is a hard job and employers walk all over them because well here in Canada under the employment act service falls into general labor, and they can fire you for, calling in sick, going on preplanned holidays, not PAYING for mistakes, like if I for got to add something on the bill I had to cover it, or breaking dishes, or eat and runs. These are all things I have been fired for or paid for to keep my lousy minimum wage job because I need to support my family. My boss took two dollars from me because I forgot to add an egg roll to the bill. Her words to me " what are you going to do with two dollars."
    My answer to her " buy eggs so my kids can have breakfast."
    Oh the stories i have.

    This doesn’t surprise me as a server for over 25 years the last restaurant I worked at charged the servers 3.5% of every credit card sale. Basically making us pay the credit card fee for all credit card fees. I left that restaurant in Columbia Missouri called Glenn’s Cafe inside of The Tiger hotel. I feel the customer should feel wronged and the poor server. If they did stuff like this there is always more. Thank you for this story

      Legally they can only charge the server 3.5% on the credit card tip amount. If the 3.5% was on the entire bill, that is illegal.

    She was let go because she told the customer what was happening. I've had the same experience (not even close to $4400). I did 100% of the work for some customers who were in the establishment I worked in for about 8 hours. No exaggeration, 100% of the work. They went to tip and my boss took 100% of the money. I told the customer the next day and then I got reprimanded.

    I made a huge tip when I was at PF Changs in Chino Hills, CA. The servers told management and they told me to share the tips. Well after being miserable I quit and eventually PF Changs was sued and I was able to get a settlement for the exact amount of the tips I earn. I understand this lady and it’s sad how people become greedy then they threaten you.

      Over the years, I've realized how greedy some people are, and how they become envious over very petty things. When I worked at McDonald's, I've had coworkers demand that I split tips as low as $5, and eventually people got so envious of each other for getting tips from customers that management banned tips. And these tips were usually under $10. To this day I still wonder why they didn't bother to just put a jar out? Personally, I still accepted tips, but did not let my coworkers know. In the future, if you are still a server, it might be in your best interest to lie about your tips. For example, if you receive a $1,000 tip, just tell them you got $20

    I saw an article about this a few days ago and I had to laugh at it because of the idiocy of the restaurant. The waitress got fired because she told the customer most of her tip was taken by the restaurant owners. The customer demanded to the owners that she keep all the tip and they respected that wish, but now they're upset and I think they wanted to sue her because they are doing worse in business now and keep getting stormed with bad reviews and being slandered as a place that treats its employees horribly. I love the irony in that, they're getting what they deserve and they know it.

    Taking everyone’s tips and splitting them among employees has always been an idiotic practice. If I were a waiter, and I busted my butt on a table of 6 while the one next to me had two people, and she only came to their table twice during the meal, why should I have to give her my money!?       I work in Back of the house in the kitchen at a restaurant and if servers never split up all the tips back of house would get nothing I understand and respect the hard working staff who serve our guests but you can't expect to get way more money then the rest of the staff because you got more tables then the others it's a team effort working in a restaurant trust me you are contributing to your work family. Everyone should be contributing anyways if they are not then the management team needs to fix things

I’ve was a cook for years, and yes sometimes the server would make more then me on a particular week but that’s what they live off of. Typically the restaurant pays wait staff $2.10 an hour legally by law because the Tips make up the difference. There is no obligation to split tips with anyone. If they toss you something, it's done out of kindness.
      Some restaurants collect the tips for the servers and then they settle up at the end of the shift. They're required to record the tips received for the IRS. In the case of a $4400 tip the restaurant could/should withhold 25% for gift tax.

      Thank you! I'm in Arkansas and wanted to know the name. Either I will not go there or maybe I will and make a tadoo about tipping MY server. I waited tables for years when I was a young single mom. If you work hard and give good service it's actually good pay. Better than entry level office work! And everyone I ever worked for was proud to have a good staff! Because even if good food comes out of the kitchen if you can't get your tea refilled or another beer while you're eating it folks will forget all about what the food taste like!

    Another news station covered this in its in depth. Servers are to share a small portion with kitchen staff and the bar for taking part in the labor. The tipper told the server to keep it for herself, which she did, against the restaurants policy.

    They definitely fired her because of that tip that the customer had took back and had given to her privately. They were going to give out her money that was a gift to othet employees and keep some for themselves. The server would've gotten $880 ( 20% of $4,400) and the other employees would've gotten about 5%-10% of what was left. Any remaining money would've went to the owners. I used to be a server. All places do the tip thing differently but for most places they all put their money together and divide it equally. This is just a sneaky underhanded pratice restaurants do to not pay their employees at least minimum wages. And they wonder why people in that profession aren't going back to work. They just don't realize that they just cost themselves soo much business from future and regular customers because of this.The owners appear to be nothing but liars and thieves.

And waffle house only pays their servers $3.25 in Texas and they all have to put all their tips together at the end of their shifts and split it with each other and with the cook who gets paid about $2 more than them. The only one who really gets paid is the manager and assistant manager

      @@tbishop4961 actually waffle house does here in Texas. I worked there when minimal wage was $7.25 and our pay as a server was $2.75 plus tips. On days I was a cook it was $5.25 an hour. The next time you visit or know someone who works at a waffle house ask them their pay rate. You'd be surprised

      @@tbishop4961 it actually depends on the state. In many states the minimum hourly wage for servers is $2.14, but in my state they are actually paid the standard minimum wage (now $10/hour). It seems crazy how low the minimum STILL is for so many. I feel bad for the weekday servers at slower restaurants in those states. Some days are literally just NOT worth their time, and yet these restaurants require servers in order to function and maintain quality customer service...

    Handing her the 4k would be like saying she did all the cooking, prepping, serving the whole 9 all by herself. If she did all that, I can understand she deserves all of its. Have you ever been to a restaurant where they did all that alone without any type of help?? Firing her was probably a bad idea but you might want to look at it from a different prospective. Most restaurant services is done and accomplished with teamwork.

      Except that it's been proven again and again that tipping has almost nothing to do with service and wildly varies in discriminatory ways. Pooling tips prevents that from happening.

      I hated getting tips. I get paid by the hour why would I want to be tipped? Also we had people in kitchen who never get tipped. I didn't see that as something fair. I'm not from the US.
      I just find tips stupid honestly. People never tip the person on kitchen even though they made the food. I also find tips insulting (that's my opinion).
      If you tip someone in certain countries they will see it as an insult too. I don't think people realise how tips can mess with the staff at an establishment. It can cause a divide with the staff.

    these owners are disgusting, When I was a waitress I made $2.25 and was told my tips would get met to minimum or over. The company never made it minimum, even when you never reached it. Pay a living wage or keep your money hungry hands off someone's tips.

    When people tip their server they expect that to be for the server alone, not for the restaurant owner or to be shared among other servers that had nothing to do with serving them. If there was a second server assisting her she maybe should have broken off a little for that person, but the restaurant owners need to keep their greedy grubby hands off of tips.
    This is why if I'm going somewhere to eat I make sure I have cash to hand directly to my server, and never leave a tip on my card because I don't trust that it'll actually get to that person in full. I also don't eat at places that I know share tips among staff. That is a stupid system and isn't fair to those that work hard to give great service because not everyone pulls their fair share of the weight usually. Ideally servers in the U.S. should be paid a fair wage so that they don't have to rely on tips in the first place but we're a long way off from that.

      @@Opal5674 they SHOULD, but unfortunately that's not the way the world works. I've worked in several bars where we split tips, and it never once seemed unfair to me. Everyone gets customers who shaft tips either because they just hate tipping or because of a kitchen mistake outside the wait staff's own hands etc, and THAT'S unfair to me. This one girl got lucky enough to get a party tipping far above average, but another waiter/ess in the same night may have served a huge, ungrateful party, worked their butt off, and gotten less than $5 out of it. I've even worked for bars where I turned a blind eye if my managers got a share of tips because I knew the owners were struggling to keep the place open and the management was working just as hard (the last place I worked at was like this, and literally did not survive two months into pandemic conditions despite the owners and management pouring their blood, sweat, and tears into the place and consistently working off the clock and 100% for tips, coming in and paying full price plus tip of their own dime for drinks, etc). If they usually split tips and this waitress suddenly decided she didn't want to share because she got a glimpse of a tiny come up, then she's in the wrong here. If I was still working in my last bar and got a $4k tip, even if I was entitled to all of it, I would have happily shared. If this were a multi-million dollar chain, then it would be really messed up, but I've worked for too many places where I've overheard the owners talking about how scared they are about just staying in business, and I've worked for three different small bars that have gone under and ruined the owners lives.

    In my opinion, tipping should be at the discretion of the customer to reward exceptional service. All employees should be paid a fair wage and not have to depend on tips to make up their salary. I don't want to pay your employees for you. And having a huge tip tacked on to the bill automatically, no way!

      Trouble with that is it's a well known fact that tipping is not related to service and is wildly discriminatory. Men get more than women and white people get more than non-whites. If tips are pooled between all staff (including those like bus boys who the customers likely don't interact with or notice) that prevents the discrimination from affecting everyone.

    It was(probably) pooled cause people get jealous.
    You hear your co-worker walks away with 4K+ on 1 shift, while others bust their hump for 1, 2, 300(if lucky) for their hard work.
    It probably caused fights & a headache, so I’m guessing it would have been easier to let the woman go.
    Not taking the restaurants owners side, but no good deed goes unpunished.

    Working three years as a restaurant server, you always got 100% of your tips. We never collected it and split it, and the manager/owner never took the tips. She made sure not too even when she worked by herself.

      She did NOT do 100% of the work for a table of 44. Even the guy who gave her the tip said she was their "main person" meaning more than 1 waitstaff was serving that table. So given that the business was trying to be fair to the other 4 waitstaff that helped the party/table, they took it upon themselves to divide the tip evenly so that everyone got $880. I've been in the food industry several years. And have never liked tip pooling EXCEPT this situation is different. 5 people were waiting and serving this table. Only 1 of them was bubbly, smiley and did the small talk but I guarantee they were all busting their butts. Illegal? I don't know their policy? Unethical? No. They weren't keeping it for themselves or sharing it with anyone but the waitstaff that worked that table.

    It’s sad to see how an infrastructure that consistently fails to pay its workers are real salary will inherently make these same people fight over an amount of money they may only receive once in their lifetimes. This is what it does to people. It makes them bitter and inhumane. And then it makes outsiders on the internet quarrel about what is wrong and what is right when in fact all of it is just plain wrong.       @ tim ye some servers make a lot of money. If you ask servers in amaerica if they would rather be paid more an hour and get rid if tips. Most of them would say no. I used to be a server and in 4 hours I would make a average of 150-250 a night. Now if you asked me if I wanted to be paid 25 bucks an hour instead i would say no. Sounds great but way less than what I make.

    As a dining customer, if I want ALL my tip to go to a particular person, I expect to go to that person. It is not the public’s responsibility to pay for the restaurants staff. I tip my server. The business can and should pay a living wage to all employees. I am fair about it though, I pay 20% of the tab then give cash to the server. That works well. Our system of paying food service workers is horrible and I know abuse and mistreatment occurs.
