  • How to evict a tenant immediately Ontario! Depending on your situation you will be able to use one of these steps! Evicting a tenant in Ontario requires you to follow the guidelines written out by the landlord and tenant board! If you don't follow these guidelines and understand how to evict a tenant in Ontario you can get yourself in a lot of trouble and things could get worse!       @@retf054ewte3 if you are evicting them for non payment of rent it would be the L1 that you file after the N4. You have to wait the 14 day period to see if your tenant pays the rent. Also make sure everything is filed correctly! Please feel free to reach out to me if you need any assistance

      @@retf054ewte3 if the lease ends the tenant still has the right to stay in the home. It just becomes a month to month tenancy. The N4/L1 will be what you need to get an eviction for non payment of rent

    I am a small landlord, I own one rental home and I have been extremely accommodating and supportive of my tenant. I recently got laid off and have been without work. I gave my tenant a proper notice n12 eviction notice and let her stay 6 months extra until I sell. The tenant refused to leave and stayed an additional 2 years. This tenant then decided to damage my property so badly it cost me 50 grand in damages. The LTB did absolutely nothing in 5 hearings and the tenant was taking advantage of the system. LANDLORDS NEED TO PROTECT THEMSELVES FROM PROFESSIONAL TENANTS AND REMEMBER THE LTB IS NOT ON YOUR SIDE NO MATTER WHAT. A landlord recently committed suicide, he was left one property that belonged to his father who passed away and the tenants refused to leave. After two years of back and forth at the LTB the landlord decided to take his own life because of the stress and money loss the situation was causing him. The government is basically trying to wipe out all small landlords and we need to fight for our rights as good landlords trying to provide fair living for people. We are not all bad. The government who has made laws in tenants favour is doing this for their own benefit so they don’t have to provide affordable housing. Wake up people Landlords have no right. The LTB doesn’t care if anyone needs it for personal use, they don’t care if your not well, family needs it, child needs it. They don’t care, the LTB doesn’t evict anymore. WHY own a house when you can just go out there rent, not pay rent and not get evicted for years? This system is so broken it’s ridiculous.

      One thing I have learned from being a landlord is don't be generous and accommodating to a tenant. They will try to squeeze more generosity out of you. The LTB is not on your side, only look out for yourself, don't feel sorry for these people getting evicted, if it were the other way around they would have no sympathy for you.

    Being a landlord in Canada is BAD business venture. Stay away from this kind of business. All you get is constant headache. Chances of you getting a good tenant is slim. Plus the rentals laws are not on your side. Better think of other business venture.

    Canada is an absolute joke when it comes to landlords. Impossible to get tenants out. You’ll lose dozens of thousands on rent before you do. Time to revisit the tenants act it’s not equal rights. Tenants all the power and no money.

    You do realize...most tenants who get an N12 will simply decide not to leave. Which means you'll have to wait 8-12 MONTHS before you even have a hearing...and those same tenants about 24 hours before the hearing will demand for a post-ponement because they are not ready (which the adjudicator often will give) thus DELAYING the hearing for ANOTHER 4-6 MONTHS.
    The minimum to evict anyone in Ontario is 1-2 years.
    Even if you offer the tenant cash, they'll either ask an insane amount, or they'll ignore the offer.
    DO. NOT. RENT.

      if they have signed N11 or N12 it's easy; hire a paralegal and do it through court most will not take it that far for fear of wage garnishment and they will not be able to find a rental

      yes you do not have to leave until there is a hearing. However you still need to pay your rent every month and eventually you will have to leave so I suggest start looking for a nother palce to live. I filed an N-12 and there will not be an extention. Owner need there home back that they payed for.

    Question:if tenant was given a notice to evict for non payment. But the tenant has been giving payments (not the full monthly payment) but paying 300-500$. Tenant still in home passed eviction date. Tenant has received a L1 hearing notice.
    What is the landlord able to do in this situation until the hearing? Would a tenant be able to submit a 60 day notice to move prior to hearing? Or will/can they tenant leave the home without giving notice? Can a landlord evict tenant even if they are making payments, prior to the hearing set in place?

      I just went through a similar situation. The adjudicator told the tenant they must pay the entire amount back to the landlord within 30 days or they would be evicted. If they pay it in full they can stay but they are not to do it again or it would be immediate eviction.
      Also the tenant can give 60 days notice to move out at anytime as long as the lease is up. It doesn’t however avoid them from paying back the rent owed. The landlord can still go after that.
      In a lot of cases. If a tenant just leaves. Most landlords just take the unit back and don’t follow through with anything as they are happy to have the property back

    My landlord tried to evict me illegally and ended up with so many fines he will never be able to rent the place again. I left right away, he became so crazyand hostile the sheriff suggested moving out and suing. Your mental health isn’t worth it. Don’t be a crazy landlord or tenant. Be respectful, have some morals and some dignity people

      They will send an N form first. What form were you sent?

      Obviously you didn't pay the rent. And just leave when you get the notice. There are other places to rent. It's not your house and it's not like they expect you to leave instantly. Obviously they will give you time to vacate.

      I been illegally evicted. 20 years of living in the same duplex, I paint, repair, take care of the garden and building, never late in 20 years got her cheques on the 1st at her door because she did not pick up rent and made my sing a paper in french that she knows I don't understand in false penance. Saying was just the Normal yearly increase like everytime changing the contract from 12 months to 1 month rent. We tenants are not always bad. All the neighbours belive we own it because we even pay the electrician, put the back fence outself etc. Laws are there to help tenants because landlords also not all are dishonest like this one. I do believe tenants have responsibility to keep a house well maintained and care for.

    Hey Dan, so here’s a question, what if they signed the N 11 but refuse to leave after the fact, how long does it take before you can get them out? And does it have to be done by the sheriff? Could you practice jujitsu on them to get them out? Joking.

      At the moment the LTB hearing wait time is about 6-8 months. It does have to be done by the sherriff as they are the only ones allowed to handle evictions.

      Good idea to report the non payment to the Credit Agencies thru a firm called Front Lobby

      If they have signed the N11, send it to the board, the board will give you a verification that the tenant will leave at the date which is on N11. If the tenant does leave, the instruction is on verification, about one month they will be evicted.

      Then you need to file an N4 immediately. Just make sure you are aware that the N4 becomes void if the tenant pays in full before they are evicted.

      This can happen. Submit to the board immediately after issuing the N12 so you don’t waste any time. Depending on why you issued the N12 you need to be prepared for the worst if that happens. So if it’s a sale. Make sure everything is noted in your agreement of purchase and sale so you can handle that

      @@danielhaletv Hey Dan, I'm guessing you can't issue an L2 until the N12 period has passed and they are still sitting in the house. So you just submit the N12 and hope for the best? What clause should you put into a real estate transaction to provide notice of this situation other than to state you will be issuing and providing proof of an N12?

      @@mikaelbentley9870 hey Michael. No you should 100% file the L2 to the board asap! This way when you get closer to the termination date on the N12 there is a very strong chance you’ll have a hearing date scheduled. Which always helps as the buyer will be more comfortable with the transaction.

    Selfish people suck, crappy tenants making other tenants lives harder and the landlords. Not paying rent is horrible there should be a law or something that if the rents not payed by a certain time then the tenant should be evicted without needing to go to landlord and tenant board.

    I'm not a landlord or a tenant, but I do agree the system is broken in Ontario. If you are a tenant, at the end of the day it's not your property and if the landlord want you to move and given reasonable time. I think it's fair the tenant should move.

    This video is completely bulls$&@. I work/own a property management company. People like this do not actually witness the eviction. I do. And I absolutely despise it. But how I sleep at night is that offer compassion and empathy face to face with the persons being evicted. The banks/financial institutions and landlords don’t have the ‘balls’ to do it for themselves.
    I take control of the situation and liaison with respect. Most people in my situation will ‘remove and destroy’ all contents. I just pray and hope I offer a service that protects and provides dignity to those lives being affected and upended rather than accountants and lawyers throwing paperwork like confetti on a military parade. I honestly feel for those losing their homes- I truly hope I’d rather have someone like me doing that than the disgusting swamp rats that get pleasure out of witnessing people in utter distress. Sorry for everything I’ve done.

      youre part of the problem then do you ever screen your applicants ? why am i paying for then? you take one month rent you don't bother checking their rental history ? whether they're junkies drug addicts or convicted felons ?have they don't this before?

      cry more baby, every situation is different. Not all tenants are saints. The friendliest landlords in the world are the ones that get stomped on by bad tenants and a system meant to help poor off people but only really helps bad actors on both sides.
      Most people would absolutely do it themselves, but the law is there to prevent them from doing so in a way that would work. Distancing yourself from the situation is good practice for safety and protecting yourself from liability. Leave it to the professionals. If you don't have the stomach for it go flip burgers bud.

    My landlord's lying and saying he needs his uncle to move and gave me an n12 after I've only been here for 9 months and paid on time with no complaints, you best believe he's going to be signing a fat cheque to get me out of here. I had other places I could have taken and not been in this mess, I guess he got tired of being landlord and thinks he's going to get rid of me quick and cheap with the family loop hole lol don't pretend to be a landlord and have someone move into your basement you advertised to rent out long term then tell them they're sol 9 months later because he changed his mind. Someones living accommodation is serious especially in the middle of winter and the market is brutal right now especially if you do['t have perfect credit score or whatever bs these scum/greedlords want..and the threat of homelessness in 60 days is stressful af, it took me 4 months just to find this place.... end of rant.

      nah, he already offered me 10k to leave and I told him to suck it, It's going to cost more, my time is valuable and don't like it wasted I have my own business that I run and I don't got time for landlord games. He should've done his homework and trying to talk down to me and harass me was a bad move on his part lol he has ZERO authority over me he can wait 11 months until are hearing and I'll prove it's a bad faith eviction and as long as I'm paying rent the apartment IS mine.@@asht7899

      He we went through his wife's phone and found out me and his wife were texting and she told me that's why he really wants me out of here so I sent him a video of us in bed lol she still sneaks down to my apartment when he's sleeping and at work, I'll be telling the ltb about this too.... and when I finally do leave with at least 20k of his money I'll be taking his wife with me too but I won't be keeping her for long, just for a month or 2 until I get bored of her and replace her with someone else... nobody fucks with Bill Sanders.... NOBODY!!!@@asht7899

    Pay any gang to pop your landlords, go on holidays for a week while the jobs being done then enjoy your life. There's no sin in removing social parasites . It's also far cheaper to pay n pop vs paying your enemy to extort money from you
