My favorite was mentioned on the show "America's dumbest criminals." The judge tells the defendant (who is representing himself) "You are charged with one count of grand theft auto. How do you wish to plea?" The guy smugly gets up and says "Before we go any farther your honor, let me explain why I had to steal the car..."
The cop who told the show this says it was the SHORTEST trial he had ever attended in his life!

Seems like landlords are really easy to beat in court because they're so used to tenants putting up with whatever. The property I rent changed hands recently, so I don't know how much I should trust my new landlords. Fortunately, they seem to be really bad at writing leases, so I think I can threaten to take all of the appliances if we fail to terminate our relationship amicably on move-out. Also, they seem to have accidentally put an informally agreed-upon rent increase in the lease as a one-time payment instead of a monthly one.

I was taken to court by .gov agency. I didn’t bother with a lawyer. This agency had a worthless lawyer. He shows up half hr before. “So what is the issue?” The judge knew more then their lawyer did. Nobody from that agency (that was literally a block away) showed up. “The evidence is clear”
Well the judge has questions, the lawyer has no clue, so judge has to ask me. Ends with the judge orders the agency to work with me, respond to my questions if they are requiring me to make changes. So kinda a win. Zero fines. (They had threatened). Plus now they had to respond within 5 days to questions on requirements. It actually was smart not to have any staff involved to be present. I was wanting to tear into them. Just listing times calls made, messages left...
I will admit I was scared during it. I have talked to much larger groups. But was more nervous, ok scared.
Last one. IMO if you are found in your favor. There should be no court fees. Instead YOU should get normal court fees.

I was doing jury duty for a guy that tried to represent himself. Lots of counts of child porn and such. He was facing a long time in prison. The day the trial was supposed to start, after selection of the jury, we were waiting in the back room for like, three hours. He decided to ask for a lawyer, and they had to cancel the trial to get another jury when the case starts up again.

When my last landlord tried to evict me, she also tried to charge me thousands of dollars for damage to the unit.
Before we went before the judge, she came and talked to me. After about ten minutes I think she clued in that she was going to lose.
I didn't feel safe staying at a place where the landlord wanted to evict me. The deal we struck gave me an extra month to find a place (which was really difficult within my budget in my city at the time, for reasons bellow.) I also wound up not having to pay damages.
Rent in my city was skyrocketing. She'd been spending the previous years finding ways to evict people so she could charge more. She was doing some pretty shady stuff, and I had evidence.
Being a landlord ruins people. She originally helped me get off the street. I met her when she first started buying buildings and renting apartments. After a few years she had a couple buildings. She went from being the sort to help people off the street to conspiring to evict tenants to jack up the rent in just six years. Awesome person to parasite.
There are no good landlords. It's a broken system that ruins good people.

Life advice: if you are ever put on trial for a crime, *DO NOT* defend yourself pro se! Invoking your right to a lawyer will not make you look guilty! Their job isn't to get you an undeserved 'not guilty' verdict, it's to make sure your rights (especially your right not to incriminate yourself) are protected in the courtroom!

I have twice represented myself in court for the financial settlement on divorce, the first time I wasn't willing to pay (i think it was £120/hr) when only a couple of thousand was at stake. The second time my lawyers were allowing the opposition to ride rough shod over us and that was before they pulled a stunt of switching me to the newest qualified partner who I had been warned about by somebody she represented previously. I was under no illusions that I was going to get hammered but that was going to happen irrespective of who was representing me and the judge really did not like me not having a lawyer. I came out about the same but without the bill of a solicitor (£200hr+vat), my ex on the other hand hired a barrister FFS!
And as much as divorce cost me it was worth every - god - dam - penny.

Also, 'the one in the right should win' good idea but like, most cases aren't so obvious as a company bullying a poor victim, and many cases go to court to find out who's right, and when companies do bully people they can generally make it look like they're in the right, so the remark is less than helpful.

    • @kos2919
      @kos2919 3 ปีที่แล้ว

Also sometimes the definition of right and wrong can still be moved a bit and that grey area is a complete headache to deal with. Remind me of a bunch of people built their home on dried river close to the levee. It was illegal but they claimed that they're poor and it's morally wrong to evict them. But then the levee broke during a very heavy rainy season and flooded the small town killing some. Then they start crying about how "the govt don't give a damn about them" even when they keep fighting the govt previously. It was ridiculous and stupid. Oh the case is not from USA.

Had one similar to the last one. Was dropping my younger sister off at school one morning. We went to the same high school, but I graduated three years before her (I went to the local, major university). Anyway, the main/front door is directly across the street from an apartment complex, and there’s nowhere to pull over and park a majority of the time - 99% of the time it’s people who live in the units (duh). So I, along with only God knows how many others, was pulled over for obstruction. First and only time it’d ever happened. Go to court a couple month later. I don’t know how many had come before me, but when the judge saw my violation reason along with the date, time, and location, almost verbatim, she says, “I know what this is. Go home.” Turns out that cop was having a shitty day, and decided to take it out on folks dropping kids, grandkids, sibling, etc. off for school that morning.

I fall into reason number 2 as to why I went pro se with my case but I
was told by all the attorneys and law firms that they wouldn't help me
because they had no idea about the law. The law was easy and I explained
it to the lawyers over the phone but still had no help. The law is
called "Emtala Law". This is the law that forces hospitals that are
covered under medicaid that they are to #1 Treat the patient, #2
stabilize the patient or #3 transport the patient to a hospital that
can. That's the law in a nut shell. There are more things like, you must
enter through the ER entrance or be transported to the hospital by
ambulatory means, and to be able to get the most out of your settlement,
make sure the hospital has more than 100 beds. I know it's a little
weird but it's what is written in the law. The law was first addressed
in 1985 and passed in 1986 to stop hospitals from kicking people out
because they didn't have health insurance. Today I am using it because I
was denied treatment for having covid-19. According to the "right to
try" patients and doctors can try different drugs for solutions to fight
covid-19. I asked for ivermectin or HCQ and the Doctor walked out on
me. I was told by the staff to talk to the discharge person and leave.
No treatment, no stabilizing and I wasn't transported to a hospital that
could help me. I went to another hospital and the same thing happened,
but the third hospital finally treated me and now when I am done going
after the first 2 hospitals for Emtala law violations I will be going
after the third for medical malpractice. The didn't give me what I asked
for and I was still sick afterwords. I didn't get any help from anyone
on this and decided to go pro se. I did find something very helpful
called the "Pro Se handbook" that you can read for free if you just
search it and click on the PDF from a .gov website. Next I did find that
the federal court house would help me find the right forms and the cost
as well as where to submit everything. By the way, I will be making a
few videos on Fed 10th that talk about all of this so anyone can do
this. Also, I am asking for $248k, and that is on the low end. You see,
the law is very specific in everything. The Emtala Law says that each
symptom will be $23k, but this is when the law was written in 1986. The
inflation rate from then to 2022 is increased about 120% which means
each symptom is over $50k each. I had 4 symptoms and for the worlds
deadliest most contagious virus I just charged $62k for each. I will
charge more for the next hospital because they tested me for covid-19
then kicked me out. Knowing I have this, and just did nothing. I will be
taking them for way more. My third video will come out a little later
but after I win my cases. I don't want to let them know what I am going
to do next. I am going to ask the judge to waive the statute of
limitations of 2 years so there will be no hiding for anyone when I am
done. The hospitals have been breaking the law for years, and I am going
to expose them all, and teach everyone how they can do it too. Look for
my videos on Feb 10th. I must thank all the lawyers and law firms that
refused to help me. Otherwise I would have never done the research to
teach all of you. If you have any questions you can ask me here, or just
    wait for my videos.

Why is it that some cases burdens the loser with the administrative costs while other cases don't?

I mean... I would bet most people cant afford an attorney, its dumb... in the US.
I wish we had a loser pays system.

Well, in some cases you can recover that, but a blanket 'loser pays' system would be doubly punishing for cases that genuinely need sorting out and discourage restraint since you can just recover whatever you spend, this is why most fee recovery is for reasonable fees. Your idea is well intentioned but the law tries to avoid such blanket ideas as even with all the caveats and qualifiers in the current system it's still subject to abuse.

Okay, but a lot of suits are placed in the court system frivolous cases.
What if you get sued, but cannot afford a Lawyer?

Also, just about every other country does it this way, except for the US.
Its literally called the American Rule, when it comes to getting sued in the US.
Some states have implemented loser pays laws, Texas is one of them I believe, but I think its only one of two.

    • @DarkDesperado25

@@XFizzlepop-Berrytwist The Texas one, while called a 'loser pays law' is only slightly broader than the current Federal Rules of Civil Procedure, so if you consider that a 'loser pays' system then the US system already has it, in addition, clarify your statement, since we may have very different ideas about what you meant by 'loser pays' since I was under the impression you were advocating a blanket system wherein the loser of a lawsuit pays both sides fees, which again, seems unduly punishing for legitimate cases, whereas you may have meant something different. Would also want something more specific since the one specific thing you brought up, the Texas bill, can only be called a 'Loser Pays' system with enough stretching to tear several muscles.

Well, I was thinking more of a Blanket system, but maybe within reason.
Maybe if a case is pretty Gray, its each party pays their way.
But if a loser pays system was implemented, you wouldnt sue someone unless it was a legitimate case.
Maybe we can rework it so that if the one that sues, loses, then they are liable for paying for everything.
I dont entirely know what system would work the best, as I’m sure no system will ever be 100% fair.
