You did exactly the right thing, it is good to know the rules of the road but our number one rule is AVOID, AVOID, AVOID. Hard to say what the other vessels skipper is thinking so make your intentions known early and Avoid. No sense in arguing who had the right of way while your sinking. Too many people out there with the attitude “We’ll I had the right of way”. 🤔
You are stand on. In this situation the overtaking vessel is bound by Rules 9, 13 and 34, all of which the motoryacht failed to comply. Also, people should get into their head, there is no concept of "right of way" in Colregs (and read Colregs while at it), all vessels need to observe Rule 3.
Formenterra main anchorage was my first ever time anchoring after buying the boat and leaving the marina. We'd spent the two previous nights on mooring balls. It was high summer and packed. I certainly had to put my big boy pants on deciding where to drop our hook. And the sea grass patrols moved us on at one point because the wind had shifted and our chain was touching sea grass. Fun times.
Oh yeah we saw some of those patrols too! That’s why we reanchored at 6 in the morning 😂 I can imagine that’s a tough first Anchorage when it’s so full! Best way to learn right 😬 but lucky you didn’t get a fine. I’m not sure if the rumours are just there to scare you but we’ve heard you get fined up to 2000€! Which might be for superyachts. But still! Scary thought ..

Regarding the situation at the breakwater - were you still motoring or have you already been under sail? Then the motorboat would have needed to stay clear as you were the stand-on vessel. Regardless, the motorboat needed to stay clear even if you were still under engine as he is the overtaker, and you were overtaken. Still his call. And finally, one might consider that a sailboat, while still under engine but in the process of hoisting is somehow restricted to maneuver - even under this aspect the motorboat has to give way, and you're still stand-on. That said I'd probably would have reacted similarly as I wouldn't want to read "he had right of way and the other guy was at fault" on my graveyard ;-) Liebe Gruß aus Wien / Liefde uit Wenen, Ernest

I am a motoryacht captain, do not know the axact rule, but I would always give the right of way to any yacht with sails up. i can go anywhere where as sailing yachts are less flexible of course. I do know that between two sailing yachts with sails up, The yacht with the sails over port side, have right of way. There is no such rule between sailing and motoryachts. Fair winds from the Netherlands!
Nice video as always! If I understood your scenario correctly you were being overtaken and would have been the stand on vessel and they should have altered their course. I have noticed though that there are no shortage of inconsiderate power boaters out there and find it very frustrating at times.
If they changed course for a genuine reason you could also see them possibly frustrated that someone is hoisting sails while crossing the channel, as opposed to waiting a few minutes until they have fully crossed & cleared the channel

Seaway rules are human power first right of way second is sail, power must give way to both except a tug when towing. Though don't expect large ships to be maneuvering for you.😎 That yacht was in the wrong you could have reported it to the port captain/harbour master.

Hey Mikel, we were still under engine as we hoisted, so technically we didn't have right of way but yes - important observation - the MV indicated leaving and did leave the channel. And that opens up a new discussion, as you mentioned in the second part of your comment: They did not follow their obligation to keep course (going away from us) and since they changed course (again back into the channel) technically the MV did not have right of way anymore, after coming back onto us. Then again, if we did not follow the rule of Maneuver of Last Moment, even with our right of way, we still would be responsible for the collision. ... we think.
If the motor boat had hit you then he would have been clearly in the wrong. If you are blocking the channel while hoisting that is maybe not the best manners but it is still incumbent upon the motor boat to avoid a collision, which is easily done by slowing or stopping. However in this case it doesn't look like you were that close. I've noticed a lot of youtube sailors scream blue murder if another boat comes within five boat lengths, where an experienced sailor would be comfortable with a boat length separating two boats. Also factor in the North European vs Southern European mentality.
Why did you leave at 8am? The motor yacht was life telling you to get up earlier! Use all the light in the day and you won't have to anchor dangerously at night.
