As soon as he found out about the lein he should've IMMEDIATELY looked into it and hired an attorney... not forget about it... I would've cancelled the contract after 6 months of nothing being done to my home. This man couldn’t afford the repairs he needed so he damn sure couldn’t afford a 10-15k retainer. You might get a free initial consult, but other than person injury cases, attorneys don’t work on a contingency fee basis; you pay up front and as you go if required. He did what he could. Could he have done it faster? Sure. Better? No. Should the state AG investigate this low life company? Absolutely. That’s what people should be asking to be done on his (and likely, others’, behalf)
It seems far too easy to just file a lien. Nobody should be able to assert you owe them money without first proving it in court. Go to court to get a judgement to file a lien.
Sounds like a good torturous interference lawsuit right there. When I built my house I got slapped with a lien because a contractor, who I had paid, never paid his supplier. Fortunately, I had canceled checks and was able to get the supplier to lift the lien.
As a lawyer, let me point out that it's a great idea to file a bar complaint against the attorney before doing anything. An attorney can't file a lawsuit without doing due diligence to assure the suit is not frivolous. Just make sure you have good grounds for the complaint. We really hate bar complaints. We can fight lay people and other attorneys, but with a bar complaint, we're up against the Florida Bar and the Supreme Court of the State of Florida.

I have had leins up north here in Cannuckistan. All that needs to be done is to send a notice to take action. All actions involving leins are dealt with in the supreme court which will cost about $5,000 to initiate fifteen years ago. It will probably cost more today. I have done this on my own several times for fraudlient leins.
That's the problem of the suing culture, it never ends in justice. If it's "illegal" to place a lien when no work has been done, then they should be barred for 5 years before they can submit another lien.

i know thats what i was thinking i work in real estate and had all the windows replaced. unless your custom ordering huge bay windows or custom sizes windows are like a few hundred bucks a piece. i highly doubt he was buying custom fancy ones should have been like 7-8k in windows, and you can find people who will install them for maybe a g total

Releasing the lean does not absolve the company from putting a fraudulent lean on his house. A good counsel will sue for the amount of the lean plus costs and fees... and he will win.

The terms allow Home Depot to assign the contract to any other company without the homeowner's agreement. The terms also allow Home Depot, a subcontractor and/or any of its employees or hirelings to file a lien on your property -- even if Home Depot has been paid in full.

Maybe he felt justified. How much was the initial contract for? If there were cost overruns, were they approved beforehand? Were there any approved change orders? Were there any disputed or unapproved change orders, that you thought were approved? Was the job delayed and did your client lose revenue as a result? If so, what was the nature of the delay, and whose fault was it? Yes, he could have been a bad-faith client, but the opposite could also be true. Did he state why he didn't pay the whole invoice? 🤔🤔🤔 Sounds like there may be more to the story.

When youre a shady contractor you name your company with a name starting with an A, that moves you to the top of alphabet based listings, an old trick from the phone book days. They do this because they dont get word of mouth business or referrals, because the constantly burn bridges and steal. This is were pro bono attorneys would help, most people cant afford to put the attorney fees up to get the case into court. Perhaps laws should be enacted to force business organizations to pay into a fund to cover contractor/customer dispute attorney upfront costs. I know for a fact that the chamber of commerce (a republucan organization) could afford it, and there are others. Contractor license fees could be increased also to help with this. I hope he sues them and they have to pay for all the injustice they did to him.
honestly i dont want to give this away but criminals like this need to pay. when doing work on your property either yourself or hiring a company. make sure you get pics of before, during and after the work so you can show progress being done. in this case of an illegal lien, call up the bank with the lien and inform them that the lien is illegal and that if they dont remove it today they will be added to the possible lawsuit you are going to file. you will not be able to speak to anyone else but their legal department from then on but when you show them proof that the money that the person is asking for is for no work that has not be completed, they will have no choice but to drop the lien.

If only you could get triple pane double hung windows. My great granny had double hung windows (not triple pane, mind you) and 10 foot ceilings. Even when it was a hundred outside in east Texas, it was only 86° in there. So . . . Do you really want new windows that are going to roast you? How about find someone to create some double (or triple) panes that can be mounted from the inside. That way you don't have to remove your security bars on the outside. Here is another thing many/most don't understand when or if you don't pay a contractor they can force a foreclosure on your mortgage your bank can forclose on you if you get a lein placed on your property for not paying a contactor who worked on your home. Always check and make sure the contractor you hire is licensed with the state you live in make sure they have workman comp on all there help an make sure the company has a solid reputation in your area. You may pay more however this covers you of potential issues later
a license means absolutely nothing and is the biggest myth in the business. i work in construction and my best/ most honest gcs are the guys without licenses. my tile guy is an 18 year old kid who will run circles around any major company. ive seen more people get ripped off by licensed contractors then unlicensed people. license does not equal solid reputation

It should be illegal for contractors to put a lien on anyone's home. I've gotten lots of work done by lots of different contractors and so many times they forget to remove the lien. What's worse is you have to pay the city $375 to even see what liens have been put on your home. The ONLY acceptable reason for a lien to be put on a house is by the bank. I'm thinking about opening an anonymous LLC and putting a full lien on my home just to protect myself from these evil contractors. I don't know how to do this legally though so now I have to pay thousands of dollars to an asset protection attorney to figure out how to do it. It's all a scam.

I am a a contractor 41 yrs this past 2 years we have had to place several leins on homes due to non payers so before you hire someone an try an yank them on payment you better think twice as we can slap a lein on your home an make your credit sink quick

I agree, homeowners can lie lie lie and get away with it, BECAUSE so many contractors have dicked homeowners around it makes it tuff on the law abiding, code complaint, trust worthy contractors
The contractor had a chance to give their side and they chose not to. It’s apparent this contractor, at least, is the liar.
One would think someone who has placed liens on customers would know how to spell lien…unlike you.
I'm also guessing you had done work and purchased materials right? In this guy's case, zero work had been done and I'm willing to bet they never purchased anything. If you had bought a bunch of windows and doors, I'm guessing this would be custom sizes too, and then just say, "Okay, we'll forget about the whole thing"? Zero chance. That company's books need to be audited. They sound very predatory.
Well from what you just said I would NOT hire you for anything, the contractor he hired DID NOT do any work at all and refused to show any proof of it.

Another case of someone getting screwed over until he reached out to a tv station’s news division. Maybe the stations should be given the legal power to help people. Apparently the legal system won’t.
