I don't care if there's a funereal going on. Report the damage right away, or else be ready to get grilled about why you waited and account for/prove what you did every minute from the time of the accident until the report.
Reality is he didn't have to go knock at their home to begin with. He must have some really horrible insurance. The incident happens, you called the police, do a police report and then it's up to your car insurance to do the investigation to get their money not his job. The reason you have car insurance is for them to do their job and pay you to fix your car. Plus pay you for the car rental if included in the insurance you got. Plain and simple
I would have told them right away too. They already tried to say it wasn't them right after it happened. My daughter got t-boned in a week old car. It took 4 months for them to get parts because the car was too new. The plaintiff couldn't have been more humble. And why would you have a 5 year old and a dog, unsupervised, in the front yard? Don't think much about the safety of your child or your dog, I guess.
These judges are funny. I saw a case when a guy waited the next day to report damage and she said how do we know it didn’t happen the next day. I believe he did the right thing.

You guys need to understand that his damage was not a crippling to the vehicle and the part could have been ordered and the car driven while waiting for the part to come in. When the part comes in bring the car in and the amount of time it takes to fix the vehicle is what the defendant is responsible. There is a reasonable amount of time a car can be fixed in especially if the damage does not affect safe driving.
The judge fully well knows that had he “waited a few days and returned to show them the damage because he knew where they lived”, she would have had a completely different attitude with him. She would have hit him with, “well how do we know that the damages were from hitting the dog?. What’s not to say that you had some incident within those few days and was like hey let’s pin it on the dog owners?” As unfortunate as this incident was the plaintiff did what he had to do. 🤷🏾♀️
You are absolutely correct!!! 💯 I've seen enough cases where that occurred. The defendants messed up his Christmas Eve by allowing their dog to run in the street and cause the accident. The plaintiff did exactly the right thing; except going back a second time without the car asking for the insurance info. That was a little silly. 🙄
Don't agree with the Judge's initial irritation about the plaintiff mentioning his car damage. Yes a family pet was killed but it was not his fault. He's got to bring it to their attention right away.

I have a 5 year old and I wouldn't leave him unrestrained/unsupervised any more than I would leave a dog the same. The owners are lucky that the dog didn't cause a fatal car accident. While yes, they are hurting, their neglect caused this and the counter suit pissed me off.
I don't agree with the judge on this one. Why should the plaintiff be out any money. Why did the rental cost so much? Why did it take so long? I mean, it was Christmas and New Years. Try renting a car during that season of the year or get anything done. It is honestly impossible. The timing was terrible for him as much as the defendants. I have a dog, he is my son. I have also experienced a death of my previous dog. I cried for him like any family member. But this man could have also died or hit someone else to avoid the dog. The death of the dog is tragic but it should have zero bearing on him. I don't think he wanted to do what he did but also didn't want to wait. The judge blames people for waiting too long all the time. He was running around in Christmas Eve dealing with all this. That should be considered. The defendant's attitude towards him is unfounded and misdirected. I liked the judge trying to make that clear at the end but her judgement didn't seem like good justice toward the plaintiff. Why does he have to sue to get his money? The family should have offered to pay. They definitely seemed like they were blaming him for the death of the dog...

She is just a mediator, for she can act any way she wants to in court. Judges act this way in real life. Go to your local small claims court and observe how real people act in the small courts. They are crazy and the judges have to act accordingly.
I have a question for the defendant in terms of why she let her 5 year old and the dog playing out in the front yard by themselves. She said they didn't see the accident and if she was outside with them, why did you leave your dog to run off? 🤔 I agree with most of the people in the comments. It was a terrible accident and if he did not take care of the situation right then and there, the judge would have laid it on him that he had no proof and question why he waited so long to report it. Our society has gotten way worse when it comes to responsibilities and blaming everyone around them but themselves. That child could have been hit as well if he found a way to escape. I was found out in the middle of the road at night at the age of 5 because I found a way to open doors and move locks. It can happen.

Had he drove off and told them later this would have been a totally different case and the plaintiff would have lost his case. I think the $1900 plus paid by his insurance company didn’t get awarded to him as he got less than that amount. I think it was his deductible, the special on his bumper and the award for 7 days of car rental.

I love Judge Marilyn Milian but some of the cases I've been watching lately drive me insane I completely disagree with her not awarding the plaintiff the full sixteen days of rental car fees if he has the proof that he actually paid for them and he has the proof that the vehicle was in the shop for 16 days you're supposed to be made whole when you go into court you're supposed to be put in the position you were in before the accident happened so by her only ordering 7 Days of rental car fees hes not made whole at all it's like she feels bad for the defendants because their dog was killed and it happened to be on Christmas Eve so she's softening the blow I'm sorry it sucks that they're animal was killed and I feel bad for them but that shouldn't have any bearing on how she rules.
I agree but you are also supposed to mitigate your damages. Someone could let their car sit at a shop for months and drive a rental, it's not reasonable, therefore they should get paid for it.
I get what you’re saying but it was cosmetic damage. The actual repair time was probably a day or two. The plaintiff could have easily had the shop order the new parts and driven his car in the meantime until the parts arrive. Instead his car just sat in the shop for two weeks.
This is such a sad incident that could have been prevented…. but we ALL know if the guy would have waited to go back to the house, even a day or two everyone would have been saying “Well why didn’t you go back as soon as you noticed it? You knew where they lived, how do we know that’s when it happened?” This poor guy was dammed if he did & dammed if he didn’t, he just so happened to have picked the solution that covered his ass…. The parent ran inside to use the bathroom not the child. From what I understand she was saying that even tho the father was outside with the child that day, none of them witnessed the accident because the father went inside and left the child and dog outside during that time. Either way, you don’t leave a child outside like that, especially to be responsible for a dog. The dog escaped. What if the child had run out after the dog?

Why it wouldnt take more than 7 days? In 2023, I slid off the road in a 2008 Avalon. It was in the shop for 5 weeks. It took 3 weeks for the insurance adjuster to even get out there and look at the vehicle.
The plaintiff is 100% correct and handled it properly. If he waited, the Judge and defendant would then ask him to prove that it was from the accident with the dog. Dammed if you do, damned if you don't.

I've been in a few accidents in my time and the normal process is; the insurance adjuster has to look at the car and submit a report, which can take a few days and that's before the body shop even order the parts. Not to mention the standard body shop would not start working on your car the same day. Then it will take the body shop two weeks to fix your car and that's if everything goes right. In my last accident, my car was in the shop for two months! It would be a different story if there wasn't a dog involved.

Him coming back later in the night was a bit much. He could have written down the date and time, the location, taking pictures of his car, and get every little note he needed down to file a police report if things didn't get taken care of or bring it to court if it wasn't taken care of. He still has a right to the money, he won this and he was within his legal rights to that, it's just the way that he went about it that's a bit off putting.

A thing to remember is that under the law in all states dogs are only property and it is up to the owner to control the property. Also the driver doesn't even need to stop or report it so KEEP YOUR PETS UNDER YOUR CONTROL.
While I love Judge Milan I am finding myself more and more disagreeing with her. The man did the right thing in letting these people know that his car was damaged. If he had left and came back a few days later they would have said it did not happen and how do they know there dog did the damage. Her judgements against landlords many times are not correct because she never takes into full account of the damages and costs to the landlord if a tenant leaves the place damaged. More thought needs to go into these cases. Very few tenants take care of their rentals even if it says they are responsible for minor damages or repairs.

She is wrong about the rental. I had the exact same happen to me. Difference was the dog I hit was a stray. 2022 vehicle 4 weeks owned. It took a month to get my parts. Cracked side of grill, fog light and wiper fluid reservoir $4000 fix. I had a rental up until insurance max of $1500. He should have been made while even though his new car value just plummeted. She did that to pacify the defendants some.
But if your insurance is paying for the rental, you don't have to pay that because you already pay it in your monthly/year payments. You can't get recouped for something like that.

A lady ran my beloved kitty over on mothers day in front of my kids and myself. it was terrible and i miss him every day, my fault for letting him out to play. Another cat scared him into the road the same time a car was going by.
The same thing happened to me when I purchased my new car. Two weeks after purchase, I was driving down the street and out of nowhere a cat comes running out in the middle of the street is hit the side, corner power of my car I was extremely upset! So I understand, and I feel for the plaintiff.

The great thing now is that when something like this happens, take a picture of the home address, the car damages and start your claim with the insurance company. All images (at least on an iphone) have date and time stamps, even location stamps. That way he could have left them to grieve while he works to ensure that his car gets repaired.

I have a 5 year old and I wouldn't leave him unrestrained/unsupervised any more than I would leave a dog the same. The owners are lucky that the dog didn't cause a fatal car accident. While yes, they are hurting, their neglect caused this and the counter suit pissed me off.
I don't agree with the judge on this one. Why should the plaintiff be out any money. Why did the rental cost so much? Why did it take so long? I mean, it was Christmas and New Years. Try renting a car during that season of the year or get anything done. It is honestly impossible. The timing was terrible for him as much as the defendants. I have a dog, he is my son. I have also experienced a death of my previous dog. I cried for him like any family member. But this man could have also died or hit someone else to avoid the dog. The death of the dog is tragic but it should have zero bearing on him. I don't think he wanted to do what he did but also didn't want to wait. The judge blames people for waiting too long all the time. He was running around in Christmas Eve dealing with all this. That should be considered. The defendant's attitude towards him is unfounded and misdirected. I liked the judge trying to make that clear at the end but her judgement didn't seem like good justice toward the plaintiff. Why does he have to sue to get his money? The family should have offered to pay. They definitely seemed like they were blaming him for the death of the dog...

I agree with most of the people in the comments. It was a terrible accident and if he did not take care of the situation right then and there, the judge would have laid it on him that he had no proof and question why he waited so long to report it. This wouldn't have been easy for anyone... 😔

He could have taken photos with a date stamp. I think he aggravated the situation. Don’t read this the wrong way. The defendants should have to pay. I think the whole thing could have been handled better and there would have been no need to come to court.

Interesting judgment - he deserved full rental and his deductible but not sure why he is given money owed to the insurance. Insurance companies subrogate for money they pay out. Highly doubt he’s going to reimburse his carrier what they paid him.

I literally just made this statement. And who paid for the rental was it his carrier. In a claims rep and I know the subro process. He should have only gotten what he paid out of pocket and the rest back to his insurance carrier.
I think the $1900 plus paid by his insurance company didn’t get awarded to him as he got less than that amount. I think it was his deductible, the special on his bumper and the award for 7 days of car rental.

I love Judge Marilyn Milian but some of the cases I've been watching lately drive me insane I completely disagree with her not awarding the plaintiff the full sixteen days of rental car fees if he has the proof that he actually paid for them and he has the proof that the vehicle was in the shop for 16 days you're supposed to be made whole when you go into court you're supposed to be put in the position you were in before the accident happened so by her only ordering 7 Days of rental car fees hes not made whole at all it's like she feels bad for the defendants because their dog was killed and it happened to be on Christmas Eve so she's softening the blow I'm sorry it sucks that they're animal was killed and I feel bad for them but that shouldn't have any bearing on how she rules.
I agree but you are also supposed to mitigate your damages. Someone could let their car sit at a shop for months and drive a rental, it's not reasonable, therefore they should get paid for it.

I get what you’re saying but it was cosmetic damage. The actual repair time was probably a day or two. The plaintiff could have easily had the shop order the new parts and driven his car in the meantime until the parts arrive. Instead his car just sat in the shop for two weeks.

From what I understand she was saying that even tho the father was outside with the child that day, none of them witnessed the accident because the father went inside and left the child and dog outside during that time. Why it wouldnt take more than 7 days? In 2023, I slid off the road in a 2008 Avalon. It was in the shop for 5 weeks. It took 3 weeks for the insurance adjuster to even get out there and look at the vehicle.
The plaintiff is 100% correct and handled it properly. If he waited, the Judge and defendant would then ask him to prove that it was from the accident with the dog. Dammed if you do, damned if you don't.

I've been in a few accidents in my time and the normal process is; the insurance adjuster has to look at the car and submit a report, which can take a few days and that's before the body shop even order the parts. Not to mention the standard body shop would not start working on your car the same day. Then it will take the body shop two weeks to fix your car and that's if everything goes right. In my last accident, my car was in the shop for two months!
It would be a different story if there wasn't a dog involved.

The only reason everyone is harping on the timing of him bringing the damage to light when he did is because it was a dog. Had it been a car on car and he waited because "it was Christmas eve", the judge would have told him why that was a mistake and then gone on a bout how the damage "could" have been caused later that day or the next and he should have called the police then and there, yada yada and he had no proof that it was the other car that did it, on and on.
Emotions over it being a dog rather than it being another car made this worse and I think the guy took an unfair 'beating' over that.

@@WesleyLindsey I agree with you on that it wasn't his fault. But the way he went about it was a bit excessive, he could have exchanged numbers or get it all situated the first time he was there. Him coming back later in the night was a bit much. He could have written down the date and time, the location, taking pictures of his car, and get every little note he needed down to file a police report if things didn't get taken care of or bring it to court if it wasn't taken care of. He still has a right to the money, he won this and he was within his legal rights to that, it's just the way that he went about it that's a bit off putting.

It’s totally the defendants fault for not securing her dog, yet the judge is so nice to them. If the plaintiff had waited then judge would’ve been saying why didn’t you tell them right away and the damage could have occurred after. He was smart to let them know right away because anything can happen after and the defendants could have said it happened after. This poor guy obviously upset too that his car killed a poor dog.
A thing to remember is that under the law in all states dogs are only property and it is up to the owner to control the property. Also the driver doesn't even need to stop or report it so KEEP YOUR PETS UNDER YOUR CONTROL.

While I love Judge Milan I am finding myself more and more disagreeing with her. The man did the right thing in letting these people know that his car was damaged. If he had left and came back a few days later they would have said it did not happen and how do they know there dog did the damage. Her judgements against landlords many times are not correct because she never takes into full account of the damages and costs to the landlord if a tenant leaves the place damaged. More thought needs to go into these cases. Very few tenants take care of their rentals even if it says they are responsible for minor damages or repairs.

The incident happens, you called the police, do a police report and then it's up to your car insurance to do the investigation to get their money not his job. She is wrong about the rental. I had the exact same happen to me. Difference was the dog I hit was a stray. 2022 vehicle 4 weeks owned. It took a month to get my parts. Cracked side of grill, fog light and wiper fluid reservoir $4000 fix. I had a rental up until insurance max of $1500. He should have been made while even though his new car value just plummeted. She did that to pacify the defendants some.
But if your insurance is paying for the rental, you don't have to pay that because you already pay it in your monthly/year payments. You can't get recouped for something like that.
