I was on a road trip many years ago and had to pull over and sleep, I didn't know where I parked at other than it was a parking lot. i was over 350 miles from where i lived. I got woken up about 2hr later by a forest service smokey bear army cop with the who are you what are you doing yadda. He told me I couldn't park there and I said I was going on this trip and I got too tired for the safety of the road and had to pull over where I was. After seeing I wasn't drunk and checking my car he told me I could finish sleeping at the park ranger's firehouse office, they had a room where they hold lost kids and stuff and I got to sleep on the cot in there. He was actually more afraid I would get taken by a bear, as I had parked in a pull-off spot where the bears go through the park and my back window was down and i was literally in the middle of nowhere.

There’s a park right by my house, I got stopped once walking my dog after dusk. Sheriff stopped me and asked what I was doing, told him I live right across the highway and I work long shifts sometimes and walk my dog through the park so he can exercise. He told me “you’re fine” and now when they see me there they just wave. It’s pretty simple
The truck driver is a real jerk! He didn’t have to argue with the officer, and he refused to do anything then locked the door and wouldn’t comply with anything asked. Driver escalated and didn’t need to be combative. Brian, you refused to get out long before the dog came out.

This happened to me once. I'd parked at a closed for the night gas station after getting some Burger King. Only difference is I explained to the officer that I was just eating and watching videos after a long day of driving. Cop told me "oh, that makes sense. Just please relocate, we can't have you here after closing." A little politeness goes a supremely long way.

When I’m Patrolling, the park and the beach is closed my response is “It’s Closed Please Leave Or You’ll Be Cited” 99% of the time they leave without a problem.

The officer with the red subtitles explains very well why Brian was handled the way he was. Police can't look into your head, they don't know what's going on in there and if you're needlessly escalate, refuse lawful orders and keep reaching (!), you can't complain about the situation becoming somewhat unpleasant. While orders may be lawful, police always expecting blind obedience is a bit ridiculous. Having someone go “why?” is hardly unreasonable in many circumstances, and forces police to occasionally think about why they do what they do, which is a good thing. When police get angry that they’re being asked to explain themselves in a reasonable way, that’s uh, concerning to me, and should be to everyone.

I was just asked to leave a park that was closed. I didn't ignore the officer and keep eating. I didn't yell "As soon as I get done I'll leave!" , The officer asked for my ID, I gave it to him and he checked it. He thanked me for being courteous. I left. I didn't pull a Brian and whine, cry, lie, and complain.
It could have been: “The park is closed.” “I’m sorry officer, I wasn’t aware. I’ll leave immediately.” “Well, I’ll let you go with a warning this time. “ “Thank you sir. I’ll go right now.”

You are legally required to provide ID when asked, and required to get out of the veichle when asked, and you are legally required to NOT try to drive away when stopped. So yes, he did things wrong. Whether or not you agree to the law is irrelevant, law is law. Obey it, or face consequences. Write your local lawmakers, vote differently, etc is all you can do. Obey the commands, fight it in court if they are BS, and sometimes they absolutely are BS, but fighting that battle with the cop will never end well. Just do what they say, lawyer up, be quiet, and fight it in court.

@@SM-si5 it’s not illegal, but when an officer approaches you to ask you why you’re in the park after it’s closed and you immediately become aggressive with all those weapons within reach, there’s plenty of reason for the officer to ask you to exit the vehicle while he deals with you. Failure to obey lawful commands becomes obstruction and yes, that is a crime.

Here in the UK we have a different way of telling if the park is open or not. If the gates are open or don't exist then the park is open. If the gates are shut it isn't. What a thing to make a massive drama about.
Yeah, we're a little more on edge about when and who is allowed to use a piece of land, in the U.S. we also don't have the ancient assumed rights of way that let walkers cross a farmer's land in a given place at any time. About the only equivalent here that I can think of is the Appalachian Trail, and that's still mostly through parks that don't close and are designated for hiking/camping.
They need to start teaching Pennsylvania v Mimms in public schools. Cop tells you to get out of the car it's not optional. They don't have to have a reason, whether you like it or not

This happened to me once. I'd parked at a closed for the night gas station after getting some Burger King. Only difference is I explained to the officer that I was just eating and watching videos after a long day of driving. Cop told me "oh, that makes sense. Just please relocate, we can't have you here after closing." A little politeness goes a supremely long way.

While orders may be lawful, police always expecting blind obedience is a bit ridiculous. Having someone go “why?” is hardly unreasonable in many circumstances, and forces police to occasionally think about why they do what they do, which is a good thing. When police get angry that they’re being asked to explain themselves in a reasonable way, that’s uh, concerning to me, and should be to everyone.

You are legally required to provide ID when asked, and required to get out of the veichle when asked, and you are legally required to NOT try to drive away when stopped. So yes, he did things wrong. Whether or not you agree to the law is irrelevant, law is law. Obey it, or face consequences. Write your local lawmakers, vote differently, etc is all you can do. Obey the commands, fight it in court if they are BS, and sometimes they absolutely are BS, but fighting that battle with the cop will never end well. Just do what they say, lawyer up, be quiet, and fight it in court.

While the park he was in isn't exactly a dangerous place, there are plenty of places in Moline, IL (where this took place) and surrounding cities that it would not be a bad idea to carry a bat or other weapon for self defense with you.

Or, we could go about having some reform to our far from perfect legal system and possibly look at repealling PA v Mimms, as far to often the guise of use for reasons of officer safety is utter bullshit. It is akin to the “I detect the odor of marijuana, therefore I now have a legal right to search your car”. Both, I feel, are loopholes designed to circumvent given rights, and although I’m sure were implemented in good faith & to be used in the same way, they nowadays have been exploited & totally used against citizens as a means to no doubt more easily affect an arrest.
