Attention Golden Visa holders! Portugal just changed its citizenship laws.

  • On Friday 5th January 2024, Portugal’s parliament approved a proposed change to the law surrounding citizenship by naturalization, in response to the delays experienced by some Golden Visa applicants waiting for the approval of their residence permit.
    The executive summary of the changes is that the time taken between the submission of the Golden Visa application and its final approval will now be taken into account when calculating the required legal residency period for nationality.
    So what does that mean? To put it in simple terms, the 5-year qualifying period for nationality will now therefore begin on the date of the Golden Visa application submission, and not on the date of the issuance of the residence permit (as was previously the case). In some cases, this could potentially shave years off the waiting time for Portuguese nationality (particularly so in the case of those affected by the delays caused by COVID-19 and the restructuring of the Portuguese immigration authority). So if you’ve been frustrated by delays to your own Golden Visa, or if you were worried about the processing times - maybe you didn’t move forward with the Golden Visa for this reason - then this is probably music to your ears.
    That said: It is worth noting that parliamentary approval does not mean that the amended law is now in effect. The bill will now be sent to the President for ratification; however, it has met no significant opposition and is expected to be signed off by the end of the month. Whilst we cannot comment on the details of this until the final amended legislation is confirmed, I will keep you updated on this channel as the situation develops.

      My current understanding is “yes”, but we are still waiting for some key details to emerge - the proposals are still too vague on some points. Note this is for all residence permit applicants, not just GV. It’s also not clear what the impact will be if e.g. you haven’t spent any time in Portugal up to now.

    so, if I haven't invested and obtained portugal golden visa, can I still plan, and invest by May 2024 into real estate and obtain golden visa ?

      Not my area I’m afraid, but the rule changes are not specific to one particular type of visa. Suggest waiting for the final law to be ratified then consulting your legal representation 👍🏼

    What about Expression of interest filled under article 88 and 89?

      This change is not exclusively for Golden Visa applicants, rather all residence permit applicants. However it is currently unclear what that means regarding EOI, which is a notorious grey area.

      Could you elaborate on this please. Not sure what this EOI issue is. This is the first time I'm hearing of this. Been thinking about making a Golden visa application but the wait time has been holding me back. Many thanks.

      @@FrozenSkyy Expression of Interest (EOI) is for people already living in Portugal, but without a valid visa, and who wish to remain and become legal. It is NOT suitable for those looking at a Golden Visa.
      After this development, the wait time for the Golden Visa should cease to be a factor for the vast majority of people (although this will remain to be seen in the final law).
