  • Harry talks with Matthew Seligman, fellow at the Constitutional Law Center at Stanford Law School, who was an expert witness, at the request of the California bar, in the recent disciplinary hearing against John Eastman, which concluded with a recommendation that Eastman be disbarred. Seligman undertook a historical analysis of Eastman’s claim that his theory - which in brief was that Vice President Pence was constitutionally empowered to determine the winner of the 2020 election - and found it to be utterly lacking any historical evidence, while the view that Pence did not have the power has strong roots in American constitutional practice. After explaining why Eastman’s theory was meritless, Seligman goes on to identify different, and less ham-handed, possible risks for a hijacking of the upcoming presidential election.

    The most important part of this is the end where Seligman talks about State Legislatures doing their own version of this again - we are not out of the woods.

      Nor are we out of the woods should Trump lose solidly 2024. We'll still have dysfunctional members of congress and senate, A Russian infection in both media and political parties, one party in dire need of rehabilitation - which could be a long process if it even gets started, a hugely apathetic public that's uneducated about government and their role in it, another portion of the public that's seeking some kind of savior, and another that's willing to engage a violent purpose in their lives. There is a lot to be done.

      Yes, that sounds the most risk and, as AIUI Seligman stresses it would be entirely legal and constitutional. So why won't they use it? Of course they will - imo.

    Very interesting! It’s appalling that even if disbarred in California, Eastman could still apply to practice in other states. He was at the core of the coup attempt and should be held accountable.

      @@gene8172 : good question, and I hope it’s answered by someone who knows. IANAL, and my brief searches on this question were inconclusive. I speculate that not all states would respond the same way to disbarment in another jurisdiction. I’d be surprised if all automatically blocked disbarred lawyers from other states. But as I said, I hope someone who knows about this posts.

    Does a "permanent disbarment" in California mean ONLY that Eastman is not permitted to practice law in California?
    Or does that judgment bar him from practicing law anywhere else? He may be permitted in some states?

    Harry, I love you to pieces as a presenter and legal analyst, etc, and your channel is very valuable to me-as I’m sure it is to everyone else here-but PLEASE please please: STOP interrupting your guests so much.
    When you do that, it becomes extremely hard to follow them…especially at a moment when one is hanging on their every word, b/c they’re *just* about to get to a really interesting point/conclusion.
    When someone interrupts them at that moment, it is extremely frustrating and jarring. Thank you, apologies for being frank/direct but you seem like a reasonable person so I imagine you can. welcome constructive feedback.🙏🏼

    Would anyone really be surprised if Arizona, a state where the Supreme Court has upheld an 1864 pre-statehood ban against abortion, would independent of how the voters in the state actually voted? it certainly doesn’t seem to stretch the imagination very far when one looks at the reality of what Arizona Supreme Court has just done in the face of the reality that the vast majority of voters, including Republican voters do not support an absolute ban on abortion. There is real danger here and there’s real danger here for the Supreme Court. The judges currently sitting on the Supreme Court need to wake up and realize that they’re making themselves redundant if they continue to hold in favour of right conservative theories of the Constitution, the law and democracy.

    Some commenters are complaining about Harry interrupting. I see it more like an actual conversation. He isn't being rude. He's asking for clarification or interjecting things people like me wouldn't know. Mr. Seligman doesn't seem irritated.
    Try grilling with a neighbor when you are known for one food and the neighbor is known for something else. Would you not ask questions? Not just what is different but why.

    I just love these kind of discussions! The first paper I wrote in college was an interpretation of the U.S. Constitution from a Marxist perspective, although I didn’t know at the time that that particular historian always did that. 😏

    For an alternative view... I experienced Harry's interventions appropriate and useful. I would have found it a challenge listening to Matthew speaking non-stop, without Harry's input. In fact, I would have stopped listening.
