In New York, if the undercarriage is rusted or has holes in it it will not pass a New York State inspection.The only recourse is to replace the undercarriage or junk it. The seller should have been aware of the condition of the undercarriage and never ever offered to sell it to anyone without letting them know that the undercarriage was in such bad condition.

Frame rot is a big no no. In my state they can get a fine for selling a vehicle with a rotted frame. Especially a car salesman! You can sell for parts only! Not as a drivable vehicle. I edited to say- it should have NEVER passed inspection with bad suspension & frame rot!! Even in an AS IS sale! This plaintiff should’ve gotten his money back!! when i bought an older used car, the first thing i did was lie down next to it and i had a good long look at the undercarriage. The muffler to the tail pipe were kind of rusted, but other than that it was a good car that just cost me $2,000. later i DID have to put several hundred into the talipipe etc., but it lasted for 5 good yrs....and then my aunt had to give up driving and gave me her car. Cheers!
