Actually it’s not a public entity. The mall and all the businesses can make the rules they wanna. Now like Mike said they can kick you out and trespass you from the business and mall itself and if you don’t leave then they can have you arrested for criminally trespassed. That's a tough one on the recording. Most malls have language about that but it uses loose wording like "unauthorized photography". I had a guard stop me from taking a picture of my daughter next to a store display. No store name or logos in the photo. Just blanket "no". I didn't argue because my daughter was young and the vibes start making her feel like she did something wrong. But the mall we were in is a tourist destination. People take pictures and do tiktoks ALL THE TIME. Why you picking with me?
