  • All four defendants in the Belfast rape trial have been found not guilty on all charges. Newstalk Courts Correspondent Frank Greaney joins us to review the case & the verdict.

    Here's the problem... If a man goes out, meets a girl, chats her up by offering her the sun moon and stars, then the following morning after he's had the sex he was after, tells her, he's no longer interested.
    Has he raped her.... No. But he has definitely sexually violated her.
    When the young girl left Paddy Jacksons house they knew she was in a severely distressed state, and all they done was laughed at her, which was reprehensible.
    It was in that moment that she realised she had been sexually violated.
    Unfortunately there's no law protecting her against that. All she had to fall back on was rape.
    When we think of rape we interpret that as by force and/or violence.
    But there is a much more sinister way to rape a girl that we don't acknowledge and that is by degrading her after the act has taken place.
    This is the manner in which the rugby stars raped that girl.

      Dishonouring someone is not a crime. Men have told women what they want to hear to get sex since time began. Women are not children.

      ojideagu But rape is a crime. What really is the main point here is what do we consider to be rape.
      You can say what you like to a woman to get sex, but if the following morning you tell her your now not interested and start texting around your sexual conquest in a demeaning manner then you have committed a sexual violation. And if it is your intent to seduce someone for the purposes of shaming that someone then you are a sexual predator.
      Libel and privacy laws should be in place to protect women from this type of violation/rape.

    The backlash to this case is ridiculous. Noone knows what happened but the people involved.

      my thoughts exactly. People have such forceful opinions on it but no one actually knows what happened except them

      Exactly, you need to be at the trial every day to form a proper opinion. The people complaining about the system being corrupt don't have a clue about the trial process

      John Colby its not smart to make assumptions on the small pieces of information published by the media. I live in the real world and am aware that real people tend to make up their mind early and twist the facts to suit their argument.

    I find the lawyer's whining about social media absurd. Compare with the US where discussion about legal cases is free, and it works excellently. The fact is that court proceedings is of large public importance and suggesting that courts should be free from public scrutiny is dictatorial.

      it's not absurd in the context of legal procedure, it's a new debate and it has the potential to collapse trials. It applies to all cases not just this one. If a Jury is caught being influenced by something they see online then the case will collapse- you have to make your decision on the evidence alone. We don't live in the congo where anything goes. It might surprise you that as an advanced soiciety there are strict and formal rules in place to make the whole process effective.

    Very disappointing statement from Paddy Jackson's legal team, suggesting Paddy Jackson was victimized by the.complainant, the police and the prosecutors, but not expressing any responsibility for his actions. It seems clear that the girl was drunk and his actions if not criminal were at least dishonorable. In contrast, Stuart Olding while affirming that he had not committed a criminal act still expressed regret and apologized to the girl.

      Max Sch IMO people of "good character" live their lives to a higher value level than simply whether their actions are legal or not. An action may be legal, but also wrong, like someone who cheats on his partner or someone who takes advantage of a persons state of drunkeness.

      Their characters weren't on trail. I have no idea if they're 'good' people or not, I don't particularly care either way.

      Max Sch The judge instructed the jury to take the good character of the defendants into account. So I think it is reasonable to ask if thats a fair description. Also there is the question on his future selection for Ireland which on current evidence I would oppose.

      Well that's stupid, either they were the guilty of the charge out to them or they're not, unless they have previous convictions for sexual assault I can't possibly see how their characters are relevant.

    I don't ever want to see Jackson or Olding play for Ireland. I would not support that Irish team in any way. I dont ever want to see those two play for any Irish team in any way. I believe her,

      Stop being so intolerant and narrow minded. You didn't attend the trial so you can't possibly have known they did it. People like you think you know better than the jury just because you hear a few quotes in the media. The jury attended for 9 bloody weeks they made the correct decision. You can't convict someone for rape if there's any doubt as to their guilt and clearly there was plenty of doubt considering the complainant changed her story
