  • The plaintiff says she brought her car to the defendant after she hit a pothole, but it was in bad shape when she got it back. Another shop told her there were no new parts, so she claims the plaintiff ripped her off. She’s suing for her money back, plus pain and suffering. The defendant says he made the repairs, and the plaintiff only called two months later to complain. He’s countersuing for stress and aggravation.

I used to own a shop. A lady came in with a brake problem. I diagnosed it, gave her an estimate, got an OK, ordered parts, made an appointment and then when she came back and did the repair. The repair was 2 front brake hoses. 10 months later she took her car into another shop because she had another brake problem. She told the mechanic there she knew it couldn't be brake hoses because she had brand new ones on it. The mechanic looked at her 10 month old brake hoses, that had been through a winter, and told her they didn't look new to him. She came back into my shop and threw a fit. She claimed I never bought the new parts and never replaced her brake hoses. I told her I had and asked her if it was working properly after she picked it up? She said yes but she still didn't believe I had replaced her brake hoses. I opened my filing cabinet where I had all of my vendor receipts. I would write the last name of the customer on every receipt to keep them straight. I thumbed through them as she watched all the way back to the previous October where I pulled out the receipt with her name printed on it. She still refused to believe it and I ended up giving her the $58 bucks she had paid me for the parts so she would just leave. I knew the mechanic at the other shop that had told her the hoses weren't new. He saw me a few days later and asked me if I had just replaced them because it didn't look like they were new. I told him I replaced them 10 months earlier and he said, oh, sorry, she said they were brand new so I told her they weren't. He apologized profusely because she got really mad at his shop. Funny think is the new brake problem he had to fix was just worn brake pads so she was still driving with the new hoses I installed for several years afterwards. But I at least had good records.

I feel people fail to understand that when you're doing business with someone, there's no friendship. I can't tell you how many times I've had to say this to my (musician) friends...my friends know that I mean business when I bring this up (in the beginning, IF I use a friend). Essentially, what happened with this case is the fact that he was overwhelmed and that he works alone. He needs to work on his time management skills (pace yourself, be honest with your customers and own up). It's clear that he loves his job, however, he has trouble managing his time. Another thing people fail to understand is that just because you have a long history of doing business with someone doesn't mean that they can't be disappointed with you for not following through. It happens. Therefore, if you do a poor job, they have the right to bring that to your attention. Fortunately and unfortunately these are hard lessons. Let's just hope that both parties have learned something. Best.

I have a good mechanic, but on the extremely rare occasions I have to go to another shop, I demand to SEE the part and work done. Any shop that has the rule "No Customers In Bays" I won't use them. Thinking of installing a hidden camera inside hood of car just to see what mechanics are and aren't doing while working on my auto.

The plaintiff is another example of an individual that gets in their vehicle, hopes it starts, crank the tunes and put their petal to the metal!
I know individuals like this, they never check their oil, the vehicle can be making an odd noise, they crank the stereo louder, hell they barely know how to put gas in it!
Then the repairs pile up, they want them done as cheaply as possible (I get it, upkeep is expensive!) then complain after the fact!
