Summary Eviction Procedure Under Senior Citizens Act Cannot Be Invoked To Defeat Right Of Residence Of Woman In A Shared Household: Supreme Court
The Supreme Court has held that the Maintenance and Welfare of Parents and Senior Citizens Act has no overriding effect over the right of residence of a woman in a shared household.
The right of a woman to secure a residence order in respect of a shared household cannot be defeated by the simple expedient of securing an order of eviction by adopting the summary procedure under the Senior Citizens Act, the bench comprising Justices DY Chandrachud, Indu Malhotra and Indira Banerjee observed in the case S Vanitha vs. Deputy Commissioner, Bengaluru Urban District.
A senior citizen couple filed an application under the provisions of the Senior Citizens Act seeking eviction of their daughter in law and grand daughter from a residential house. This application was allowed by the Assistant Commissioner.
Later, the said order was upheld by Deputy Commissioner in appeal. The Karnataka High Court, upheld these orders by dismissing writ petitions filed by daughter in law. Before the Apex Court, the daughter in law contended that, she cannot be evicted from her shared household.
Relying on recent decision in Satish Chander Ahuja vs Sneha Ahuja, she further contended that the authorities constituted under the Senior Citizens Act 2007 had no jurisdiction to order her eviction. The bench said: "The Tribunal under the Senior Citizens Act 2007 may have the authority to order an eviction, if it is necessary and expedient to ensure the maintenance and protection of the senior citizen or parent.
Eviction, in other words would be an incident of the enforcement of the right to maintenance and protection. However, this remedy can be granted only after adverting to the competing claims in the dispute.
It is necessary to recapitulate that the situation in the present case is that the eviction was sought of the daughter-in-law, i.e. the appellant. Section 3 of the Senior Citizens Act, 2007 cannot be deployed to over-ride and nullify other protections in law, particularly that of a woman's right to a "shared household‟.

Friends, I am feeling so disappointed while writing this to all of you, that this Country System is horrific in regards to deciding the dispute cases, people are dying, ending their lives by doing suicides.
Judiciary system is pathetic, no one gives speedy trial. Lawyers are looting, police is lotting, Marriages in this country are becoming horrible day by day.
In our case my parents are senior citizens and they are being badly harassed by their dauter in law, Old person dont have any source of income and just have one house and its value is 35 Lakhs, they are giving fourth share to daughter in law when daughter refused they are now giving 15 Lakhs to end the dispute but she is demanding 30 Lakhs and there is no one to solve the matter.
Such a fucked up system of this country

In my Opinion, Very poor division. Is case me husband ne father ko property transfer ki hai. Ye ek different case ho gaya. Is type ke case me hona chahiye but ise land mark judgement nahi banana chahiye. Isse senior citizen jinhone saari jindgi ki kamaai se apne liye ghar banaya ho, unke fundamental right ka hanan ho rahaaa hai. Supreme court jo fundamental right ki suraksha ke liye banaya hai. Wo hi ese lendmark decision dega to kya hoga is desh ke senior citizen ka....daughter in law ka right husband ki property me rahane ka hai.

Hello Preeti....your father in law cannot ask for maintenance from you being daughter in law....moreover he is earning or has a source of income....so his case will be dismissed....just ask the court that let the father in law file his income affidavit....he can ask for maintenance from his children only....good luck...

My mother inlaw nd sister in law were there. Injuction ka dala hua hai unlog ne. But mujhe atleast rented ya unke dusre ghr ka to denge rhne ko. Pr nhi diya. Nd due to corona rented nd pg is not supported nor recommded as rentals se corona ka drr hai.meri sis in law nhi aane de ri thi.
This system of daughter in law , in laws etc. itself is a big failure. Nuclear families of each one and meeting all family members on and off is better than everyday fights and legal actions. What is the purpose of marraige then? Why is the bride made to shift from 1 family to another where there will be so many relationship complications ? Both the girls and boys should refuse such marraiges where the joint family system itself ensures insecurity for all members. Why are we still following this system of so called insecured "joint family"?

Seriously, aur yeh supreme court ek faltu decision sunai ku ladki ko divorce de ja sakti hain agar woh ladka ko apne maa baap se alag kare to, matlab yeh chutiue janwar ko yeh nahi pata, ki the way round bhi hum auratein kar sakte hain, kyon k8 sirf unka nahi humara bhi problem hain yeh, hummein hi sirf kyin may ki 6orna hain? Hello Gurpreet...normally jab wife in laws ke house main hoti hai to hi right to residence leti hai...kyu ki agar wo apne parents ke ghar hai to maintenance main hi wo accomodation expenses le leti hai...but right to residence to legally rehta hi hai...wo chahe in laws ke ghar rahe ya nahi...uska right matrimonial home par hota hai...in laws house jaroori nahi...agar in laws house hi matrimonial home hai to uss par bhi hoga...Thanks...good luck..god bless...

And daughter in law has field a DV case on 29-10-2019,
Mother in law is widow at the age of 70 years and all her expenses his elder son is doing also the rent, Ele city, mainteance and gas bill all paid by elder son so still mother in law has to keep the daughter in law with her as the daughter in law is working and does not want to stay with husband

Hello Nalini...senior citizen tribunal can evict only children that too when the property is owned by parents...in this case property is on lease which has expired...in this the one thing which can be done is husband need to take a rented accommodation seperately and then file case against wife for restitution of conjugal rights means that wife should come and join the husband..if she doesn't come then another option is that husband can offer her a seperate residence on rent and leave mother in law house..one more option is that seperate rented accommodation be taken for mother and move the mother there and let the wife remain at earlier rented accomodation...but this has to be done very cautiously if things are very dirty and not on talking terms..later if she still tries to interfere the police complaint need to be filed also...hope you got some points that might help you..thanks good luck..god bless...
