That being said, there’s no way any magician in their right mind would pay money for that trick. Both versions performed used only the most basic principles of magic that could be performed by a child. The methods behind them are all old enough to be considered public domain. Buying a trick from a creator involves receiving materials or gimmicks required for the performance, and/or gaining insight to original methods strong and unique enough to be considered intellectual property. If I paid money for a trick, just for someone to explain a riffle force or Svengali book to me like I’m 5 years old, I’d be asking for a refund. Likewise, if I encountered a magician claiming any kind of rights to such things, I’d laugh him out of the room. Nobody asked, but I rule in favor of the defendant.
If I may be so bold, the demonstration was not the actual trick. These are all actors not the real litigants. The two actors come in with a "Scene" and Matt is reacting.
The real trick is in the satire, this show is making fun of people who actually believe judicial shows and trials are about justice. The whole point of useless tricks is to poke fun at useless legal cases, on and off TV. Both tricks did really well in that context, being rubbish and having no merit.

That's not the same thing at all unless the comic sold the right to use the joke. The magician got consent to use the trick in any way he likes when he handed over money for it. That is, assuming there were no terms of use that specifically stated that the joke cannot be used when performing with the original creator. But clearly that document didn't exist, otherwise it would have been brought up. Defendant wins.
This reminds me of karaoke where it is in bad taste to sign another singer's signature song. On King of the Hill Kahn's father-in-law intentionally embarassed him by doing just that and Dale said that singing another man's karaoke song is like having coitus with another man's wife and forcing him to watch.
I hate to be that guy, but don't "sweet", "salty", "spicy", and "bland" all have the same number of letters? If the number of letters is the only relevant consequence of the decision, isn't it completely irrelevant?
Okay, that seems like a legit trick and more than just sleight of hand. Seemed like the judge had free choice in the second case, so it's hard to imagine how the paper could have "banana" on the back.
