The difference between the dismissal of suit and rejection of plaint is that there no specific grounds on which a suit can be dismissed. If the summons has not been duly served upon the defendant, the suit is liable to be dismissed. Another ground is that if neither party appears on the day of hearing, then the Court can make an order dismissing the suit. Order IX of the Code of Civil Procedure states certain grounds on the basis of which a suit can be dismissed. On the other hand, rejection of plaint occurs only under Order VII Rule 11 of the Code. The plaint is rejected on the grounds which have been mentioned under the said Order.
i watch all your lectures ...Thanku very much sir sir please clear my one doubt that when only plaintiff appears rule 6 of oreder9 will apply that the court will pass ex parte against defendant and if ex parte order passed then only by rule 13 he can set aside the exparte orders. but sir when only defendant appers and court passes order in favour of defendant then how plaintiff can set aside that order? please tell because in the lecture you have told plaintiff can set aside by rule 13 but rule 13 is only for defendant as its says setting aside decree ex parte against defendant
If plaintiff failed to appear and the defendant appear in a court then he has a two option, either to accept the claim of plaintiff and the court decide the matter in favour of plaintif or file a written statement and contest the case, in that case court dismissed the suit due to non appearance of plaintiff.
@@harpreetsinghkahlon2827 sir got your point. In video from 30.00 to 30.46 that you have told that plaintiff can setaside order aginst him by Rule 13. But rule 13 is for defendant only.
R.7 said about when suit is adjourned for hearing ex parte. R.13 said when ex parte decree is passed. Main difference is in one case (R.7) ex parte decree is not passed yet but only date for hearing is given and in other case(R.13) ex parte decree is passed and application is made for set asside exparte decree. Sir if suit is dismissed under rule 5 there is no restoration, the only remedy is filing fresh suit under rule5 sub rule 2 kindly correct it ,it will confuse your student.
Sir, In rule 9 it has mentioned that plaintiff by giving sufficient cause for his non appearance can satisfy the court to set aside the dismissal but if under rule 8 court has passed a decree against defendant on his admission and plaintiff is not satisfied with that decree so can he file any kind of application to set aside that decree under Rule 9?
Sir if in initial stages the defendant appears but later stages the defendant did not appear..... Here what will happen? Same exparte hearing or something else?
