What happens if an ex partee decree has been passed in favour defendant and now immovable property has been sold with power of that decree by defendant and now plaintiff files application for for set aside under order 9 rule 13, what will happen in such a situation
Sir, Agr defendant ne cross objection kiya h suit me and plaintiff appear ni hua than court merit basis pe cross objection pe decree defendant k favour me de sakti h kya? and kr decree de diya to usko under rule 13 order 9 set aside kr sakti h?
Sir can we assume by raj kumar v. Sardar lal case that.. a person is entitled to file an application against exparte decree, only if, he is affected by such decree.. ?? Although this case decision only talked about the transferee..
Sir,as per Order 1 Rule 8 (6) read with Order 9 Rule 10 and Order 9 Rule 11 the decision is binding on those Plaintiffs and Defendants respectively, who did not came on hearing ?
An 'Ex parte decree' is a decree passed against a defendant in absentia. Despite service of summons, where on the date of hearing only plaintiff does and a defendant does not appear the Court may hear the suit ex parte and pass a decree against the defendant. It's only against the defendant
Sir, if defendent does not apper on the date fixed and court ordered exparte against him then in which rule the defendent will file application for setting aside the order. Is it rule 7 or rule 13.
