    Donald Hartung, 63, stands trial in Escambia County, Florida for allegedly killing his mother Voncile Smith, 77, and his half-brothers John William Smith, 49, and Richard Thomas Smith, 47. He faces three counts of first-degree premeditated murder. Prosecutors are seeking the death penalty.
    Escambia County deputies say the crimes happened July 28, 2015, according to an amended arrest report obtained by Law&Crime. Richard Smith, an employee of the Department of Homeland Security, had no-showed worked for a few days, so on deputies checked up on him on July 31. They found no sign of forced entry, but were able to enter through the back with the help of firefighters, and found the three victims dead throughout the home. Each person was under “large piles of clothes,” deputies said.
    Richard Smith had been shot around his right ear, and had a stab wound to the throat, deputies said. He was found face down in the TV room at the foot of the TV, investigators said. Authorities said he was wearing the same clothes he’d been wearing when pictured leaving work at 6:36 p.m. on July 28.
    John Smith was found in a sofa on front of a TV. He sustained blunt force trauma to the top of his head, and received a stab wound to the neck, authorities said.
    As for their mother, she sustained blunt force trauma to the top of her head and received a stab wound to the neck. Authorities said she’d been dragged from a chair into John’s bedroom.
    According to deputies, Hartung was at the house on the 28th to cook dinner, as usual. He left between 5:30 p.m. and 6:00 pm, he allegedly said, but he denied seeing his brother Richard. A neighbor, however, claimed to see Richard arrive at the residence before Hartung left, investigators said. This witness was not sure of the time, but said it was just before dark because the lights on Hartung’s car was not on, authorities said.
    Another witness-who was a co-worker’s of Hartung-said that he previously had a conversation with the defendant. In it, the alleged killer said that if anything happened to Voncile Smith, then he would inherit all of her property because he was the oldest son. The mom’s attorney, however, said that she’d kept him out of the will, deputies said. Hartung would’ve been the “potential sole heir” to his family’s estate because there were no other living relatives of the Smith family.
    The defendant has been called the “Blue Moon Killer” because at the time, the local sheriff described the slayings as “ritualistic” and apparently coincided with a semi-rare blue moon.

    Even if Mr. Seaborn isn't the best estate attorney ever, I still want him for my grandpa! He looks like the sweetest old man.

      Helen Phelan no I’m waiting on actual evidence everything is barely circumstantial. If no real evidence comes up in this case and he gets convicted that will be a huge failure on the justice systems part. So far I haven’t heard anything or seen anything concrete

    That’s a huge error in the will. Although his name wasn’t in the will the person excluded isn’t the defendant. It’s his son.

      No, because the will specifically states, "I make no provision for my son..."
      While the attorney may have made a typographical error in putting "Jr.," instead of "Sr.," this is the reason a proper will calls for you to mention each person's relationship to you, not just their names.

    The estate attorney seems just as incompetent as the investigator. How in the heck do you get a name on a blasted will wrong as an estate attorney???? Is he correctly recalling details of this, or is he wrong, just as he was when drafting the will???? And then, at the end of his testimony, he had the audacity to addesss the jury on his own, without being questioned, and tell them he hoped his testimony cleared things up for them????? As an attorney practicing so long, he should definitely know better than to address the jury on his own. Once again, a state's witness has been proven to be incompetent.

      I agree it's improper for him to address the jury, and the judge should've said something, but regarding the will, it specifically states, "I make no provision for MY SON..." [emphasis mine]

      Everyone makes errors at all ages. No one on earth is exempt from that. She should have caught the error when she read it before signing it but then again everyone makes mistakes.

    Personally I think he did it--but if I were to base his guilt on the evidence--I would have to find him not guilty. Also--he is creepy, but a lot of the "creepiness" comes from his weight loss. If you look at photos taken when he was arrested, he has probably lost 40 lbs--makes him look like the living dead

      I'm only just watching this today (2023) and I agree with you. I'm watching with an open mind and relying on only the evidence presented here in court (I have no prior knowledge of this case) and so far (I'm on day 4 of this trial) I could not find him guilty. That may change as the case goes on but so far I see no evidence.

    Why isn't the original will registered in the county or court, who gives the original will to the person to take home, or did I hear that wrong? I don't think they have any evidence either, and the prison informer murdered his girlfriend with a hammer wtf

      The defendant was smiling because his co-worker's testimony actually worked for his defense. (about how lovingly he talked about his mom all the time. ) It actually hurt the state's case and he was their witness! Oops!

    The fact that the coworker said Hartung thought he would inherit money, only helps the defendant's case, since the state insists his motive was being left out of the will. And the gentleman from the crime lab ony reiterated the fact that the state has no evidence, apart from the testimony of an 8 time convicted felon, who probably snuck and read the defendant's discovery materials.

      A 43-year-old man has been sentenced to 30 years in state prison for savagely beating his girlfriend over the head with a claw hammer and fleeing the scene, leaving the woman unconscious and bleeding in a bedroom...... Marlin Devon Purifoy pleaded guilty to attempted first-degree murder in May....... The 9-year-old daughter of Purifoy's girlfriend called police after she found her mother unconscious and covered in blood in the family's master bedroom on Feb. 6, 2016. The girl took her younger siblings to a neighbor's house for help.
      The woman had severe lacerations on her head and face and suffers from a traumatic brain injury.

The 8 time convicted violent felon LITERALLY, acknowledged that he hopes the judge in his original case might decrease his time based on his testimony in this case. Judges decrease informants' time regularly. Why else do you think informants inform? Do you genuinely think this dude, who bashed his girlfriend's head in with a hammer, leaving her with major traumatic brain injuries, had zero ulterior motive in this? If so, I've got some oceanfront property in Arizona I'd like to sell you. ;)

    "He said he was going to retire when he got his share." He never had a "share." His mother could do anything she damned well pleased with the money. If she wanted to buy a million dollars worth of stuff from QVC that's her right. It's her money, not his or anybody else's. He did this for one reason: greed.

    I was bit did he didn't he kinda thing ,but more I listen and more I watch him ,I believe he did it ,he is very creepy ,I know that's doesn't mean he's a murderer ,The way he resigned straight away ,not compassionate leave ,he new money was coming ,also I believe he thought he could get away with this ,after all didn't arrest him till October , This cell mate ,I know he's looking for some kinda deal ,but how would he know these details if he didn't tell him stuff ,
