    Thanks for the help, this is great. I have a long question: what happens if the applicant leaves the US before the extension is approved (since waiting time is so long now), and does the fact the applicant leaves before USCIS decision, affect the applicants future B1/B2 visa applications to come back to US? Response could help us a lot, so thank you in advance!

    Hi,
    Your instructions are so helpful. I have two questions. While I am filing the extension for my parents, can I do it through my uscis account or I need to create one for them.
    Second, while applying online, it is asking to describe how you are supporting yourself and include any documentary evidence of the source,amount and basis of any income. Is it okay to mention that he is staying at my place?

    Thank you for all of the wonderful information. My step daughter is here helping care for her mom who has been recovering from a serious cancer issue. Her 12 year old daughter also came with her and has been able to go to a local school here near where we live.
    Does she need to fill out a separate form for her daughter or can it be combined in with her I-539? They are from Thailand

    Great vide. I have a question, I am a visitor on B2 visa and I applied for I-539 one week before my I-94 expired. I did my fingerprints but I haven’t got a response from USCIS yet. Will I be able to travel back to my country? Also the question where it asks how long do you want your visa to be extended to I put June 1st 2020 but now its September and I am still in USA waiting for the USCIS response so I can go back to my country. I am planning to leave USA September 10 do you know if thats okay or will it be a problem for next time I want to come back to USA. Thank you

    Quite informative video. But still leaves with me one question in regards to the biometrics. Does the application require biometric data after filing (I-539) extension stay of B1/B2 visa application?And Does applicant need to attend appointment for biometric submission at application centre for that ?

      There is a biometric fee that must be paid with the application so most likely there will be an appointment scheduled for the biometrics.

    I have applied two extensions one ending six months by 09/20/2020. Another request for Sep 20 to 01/20/2021. Applied in time as per laws. Biometric ccompleted. One week ago my First extension got approved. Regarding second request shall i wait or how the procesure normally is. My Visitor Visa B2 first permitted 6 mpnths and then extension 6 months approved. Requested 4 months shall i wait for the result/reply. Please guide me here

    My parents B2 visa Expires on 1st May,2022 and when they arrived in USA in last December they got I-94 date until June 24th,2022. Can they stay until June 24th or they have to leave before May 1st ?
    They tried to renew their i-94 beyond 06/24 today , and land border CBP officer said they have to leave before 05/01 and they cannot stay until 06/24. He even said if they stayed until 06/24 their visa renewal in future will face issues.
    I think that CBP officer has conflicting knowledge
    Can you please clarify ?
    Also are they eligible to apply extension by submitting I-539 even though their 10 year B2 visa expires on 05/01/2022?
    If they apply I-539 and they stay beyond 06/24/2022 and leave in September 2022, will there be any issue applying for visa renewal in their home country consulate in future?

    Great video, really helpfull , i have a doubt my wife got stucked due this pandemic thing in the US and she couldn't return because the comercial airline o which she initally purchased her ticket were not operating at that moment, now she has the chance to return to the country on another comercial airline that is coming to but since she started this process to apply for stay extension she's affrait that if she leaves the US with the resolution still pending over her i-539 application she could have issues in the future when trying to get into the US again, so question is, is it safe to leave the country even with a pending resolution?

    Hi - thanks for the video- it really helps a lot. I'd like to add that it's often not possible to leave "N/A" if you file it online. If you type sth else than a number (for exaple in the place where you need to put the A number), it will only accept number and no letters at all. Do you have any advice on how to approach this? Leave it empty and write about it in the comments or to leave it "00000"?

      Excellent question! With online applications, USCIS is less picky about the blank spaces, so if you are unable to type "N/A" you can simply leave it blank. But I would not recommend with bother with extra comments, not to create unnecessary confusion.

      You can change the address, the biometrics appointment location is set based on the address the USCIS has on file.

    Great video. Tricky situation. On the "Online" Application, it asks what is your "Non-Immigration Visa", and I must select one. However, I am Canadian and I did not need to apply for a B2 Visa to enter USA. Therefore, as a Canadian, I have don't hold a US Visa, but I am planning on staying past the allowed 6 months stay in US. Can I still use the "Online" Application and just select "B2" as my current non-immigration visa? or Should I apply through "paper" application. Thanks!

But does this mean that you can still get a Work Visa/permit/EAD for the Police Department even if the employer says that they don't sponsor people for it? Or will they just not file your documents to the USCIS and department of labor if they say they don't sponsor?

      So if they say that they don't sponsor, it means that they do not help you file all the necessary documents to USCIS. Basically, they are saying that they cannot help you get the work visa.

    Hello! Thanks for the great content. I have a question. Should Infill the form twice if it is for two people? My question is because after you select the number of people that you are including in the form, there are no spots to put your information.       Great question! So there is a supplemental form I-539A for each additional person. In the very first section of the form you put the information of the main applicant in for I-539 and then fill out the information for each additional individual. The two forms are otherwise identical. Regarding the fee, the instructions do not say that there is an additional fee for I-539A, but I would recommend filing this online, because online it tells you exactly how much you need to pay before the applications are submitted.

    Hello quick question- any answer would be helpful.
    1. Do I fill I-539 only or do I need to fill 539 along with 539A for parents extension due to covid-19?
    2. do we file on behalf of our parents or does my father file for himself and his wife saying he is supported by his son?
    We would ofcourse be filing these online. When I created my account at USCIS, it said currently you can only file for yourself. Does that mean I cannot file for my father and he needs to create his own account and go about that way?

      Great questions! You should be able to fill out the application on behalf of your father, because typically you do get the preparer's certification at the end of each application. Also, the last time I had to deal with USCIS online account, you could do all the applications from one account and then file and pay for them together. And just the I-539 should be sufficient.

    Incorrect. 10:15 in. It appears you don’t get a USCIS Online account number when you create an account online. You have to have already submitted a form to get an account number.

    Hello, I have applied for an I-539 extension on my B-2 visitors visa online. I received a notice to appear for Biometrics. After my biometrics appointment, will my i539 application be submitted to USCIS, or is there a chance they will still require me evidence or documentation?       This is a great question! From my personal experience, it was possible to file both application from one account and at the same time. Unless the rules changed, it should still be possible to do.

    What if you are not only applicant ? What if you are extending it for yourself and wife ? I assume you will have to file forms I-539 and 539A. Do you have to pay for two people or one since it’s joint?

      Yes, you are correct! You can use I-539A for your wife. The instructions do not mention any fee regarding the I-539A, but I would recommend filing online, because online it tells you exactly how much you owe before submitting all the applications.

      Correct, for the additional applicants, you do file the I-539A, which is exactly the same as I-539, only it has a part where you fill the information of the main applicant.

      Great question! So according to the instructions, you will be attaching the form I-539a to your application. Does not look like there is a separate fee for the I539a, so it should be $370 for the application and the biometrics fee of $85.Write a check payable to U.S. Department of Homeland Security.

      Laxus Dreyar thank you, i had a talk with one of the immigration lawyer they recommended me doing paper then online as they said all Docs can be sent as one shot and online sometimes doesn’t work properly. It might take 1-2 weeks to get recipt number.

    Hello.
    My mother’s 6 month stay will expire in Aug 18, 2020. I applied for extension on June 30, 2020, still haven’t heard back from them. Can she stay in the US while her I-539 is pending? Also does getting an extension affect her entrance to the US next time? She have a 5 year visa of the US currently.

    NEW I94 VALID until March 2 2021
    Can I apply for a 2nd extension submitting my documents of approval from my 1st extension application?

    Hello. Thank you for the video! I have a question. I applied to extend my brother’s stay in the beginning of June. His I-94 allows him to stay in US until August 19, 2020. But we still haven’t get the response if the application is approved or not. So i want to know what his status is going to be after August 19, 2020 if we won’t get an approval for his stay extension.     Hi, thanks for the video. I have a question for you- I m filing I-539 for my parents who are visiting me on B2 visa. Before coming to US on B2 visa their green card process was almost complete - only biometric interview was remaining. Since covid came in 2020 the process went on halt in home country. In 2021 they came to US on B2 visa. Now I want to file their i-539. Would it hurt their extension if USCIS know that earlier green card process was going on until covid happened?

      Hello! So in your case you would file a form I539 and a form I539A. I highly recommend doing it online, however. When you do it online, it tells you exactly how much you owe before your application is submitted.

    I filled the I-539 online for a B-2 Visa stay extension about a month ago before seeing this video, I left blank the questions that did not apply, instead of putting N/A, will this impact my application?       Thanks for your question. Looks like blank spaces in online applications are not such a big deal, as they are in paper applications. There is no way to edit it, but I would not worry that much about it. And typically these take about a month to process, however, looks like there are some delays currently.

      Sure thing! No, you cannot get the work visa for the police department, unless they file to sponsor your employment. There is no option to file documents yourself, only employer can do that.

      Excellent question! The extension is based on the I94, which means that you can request to stay here longer than your visa that you received in the embassy.

    Hey, I recently asked another question on one of your older videos after you elaborately answered one of my other questions, but I think you did not see it. therefore, I will ask it again here. How can I get a Work Visa/Work Permit if the place (in my case a Police Department) allows you to work there if you are eligible to work in the USA, but does not offer sponsorship of your Work Visa/Work Permit/Green Card? It is also not possible to get the Work Visa/Work Permit at another job and use it for the police department right? Thank you in advance for answering my question.

      Hello, thank you for your question and I am sorry I missed your previous one. Yes, you are correct, you do need a job offer from the place where you are planning to work in order to get the EAD. And unfortunately, it is not possible to get the work visa/EAD otherwise. Here is is how it works, briefly, you get a job offer from the US employer. You accept it, make an employment contract. Employer files all your docs to the USCIS and Department of Labor. Once everything goes through, you go to the embassy and get a work visa. Once you come to the US with work visa you apply for the EAD and social security. So as you can see, the EAD is pretty much the very last step.

      According to instructions, if you are applying for more than one person using your I-539 application, use a separate
      Form I-539A to provide all of the requested information for each additional applicant listed. Each Form I-539A must
      include the signature of the individual applicant. Only written statement is needed when completing the application.

      Hello, thanks for your question. So, in your case, might be able to do it together with forms I-539 and I-539A. You do not need to attach financial statements to the application, but I do recommend mentioning the financial details in the written statement. Also, regarding the translations, you can definitely translate them yourself, but I recommend certifying them by someone who speaks both Spanish and English.

      @@ranvirbrar8634 it’s hard to advise you but when I traveled back to us it was smooth, they did not ask about my situation. But it depends the costumers borders protection, some them are nice and some are more kind difficult to deal with. Make sure if you came to us before get the response of your case bring some evidence than you did everything the right way when you were here and when you leave the us you did not have overstay your I-94 to show them if they ask you.       If you have a way to leave US before July 11th in case if you do not get the approval by that date, I would recommend doing that just to be on the safe side. There is always a chance that your application may be denied, so I always try to recommend the less riskier way. But if there is not way to leave by July 11th and your application is not processed yet, then there are really no other options.

      Check your duration status mentioned in I94 at the website, search in google get recent i94. Once you are on the website type your details such as name, passport number and get recent i94. It will show you your durario of stay and i94 number

      Quickly apply for extension or call USCIS what needs to be done after checking i94 duration of stay. They don't stamp it on the passport. Its all in the website. Hurry up if you overstay. It will be challenging on your part. They may reconsider due to covid19..

      Hello, yes, like C K mentioned, you need to check the I94, it shows the duration of stay. Typically it is given for 6 months, but it might be less, so I highly recommend checking on that ASAP. If you have another 3-4 months according to the I94, then you should be fine, but if you only have 1-2 months left, I would recommend doing an extension just to be on the safe side.

      Excellent question! From my personal experience, it is a bit risky, because there is always a chance that your application may be denied. So I would say, if you have an option to leave on time without taking a risk, I would do that, but if there is no such option (which is understandable with everything that is going on), well, hopefully your application is approved.

      @@auieswow5052 I applied couple of weeks before my I-94 expiration and I seek an advice from a law firm and they told me that it's okay to stay here until the decision is made and as of now, I haven't receive any reply yet. they also told me that it would take months for the confirmation. I suggest that you apply for an extension and follow their 45 days before expiration.

Although I have a question tho, I did the Application and about two weeks later I got an biometrics appointment. however it was sent to my old address and I called USCIS Tier 2 and I got my address changed, and scheduled a new biometrics appointment. however it’s been 9 days since since I rescheduled and my visa expires on August 10th. what do I do? should I continue to wait or give USCIS a call?

      Auie's WoW I filed on May 21, and my biometrics was scheduled on July 11. But rescheduled and changed address, and sent the notice back to USCIS as told on July 12, and Im still waiting. If I don’t get anything by August 7th, Im going to book an emergency flight to Canada since I have visa for there.

      Auie's WoW I have a close friend who works for immigration lawyer Margaret Wong in Cleveland, Ohio and he said to just wait for a reply back, since there isn’t much to do. I have a 10 year visa, but I can only stay for 6 months at a time as a visitor to my family. I just don’t want to be denied my extension and then leave the country and risk being denied on reentry because of possible extension denial and overstay of visa. I think Im just overthinking this, just a little worried.

      I know, the wording is definitely confusing, but basically it means that you have to be already eligible to work in the US, whether you are US citizen, permanent resident or someone with the employment authorization document.
