My i130 was approved after 3 years but now uscis asks for 824. Now it's 6months now after submitting 824 and still waiting. Should I just resubmit 130 and maybe it is approved before the i824?I choose the consulate in Islamabad Pakistan because that is where my husbad will interview ad that where I live(I travel back and forth between U S and Pakistan)
Today I Got RFE online and Same day Get Another Message that CANCELATION OF RFE . Now I am confused. I already submitted all document which are they asking for I130.

If the spouse of the GC holder has a valid visit visa and wants to extend his stay in the US by filing I-539, would he need to file the extend of non immigrant visa/visit visa before the authorised days expires or he can directly apply for I-485 soon after landing US, does any of the above decision would effect I-130 processing?
And the stay in the US after filing I-593 and I-485 would be considered as legal?

It has been 5 months since we sent my wife's RFEI-485 case all it says they are started working again, How long it's going to take, I am an American citizen and wife from Colombia.
I-130 has ben approved a year ago, can you help us.
On May 24, 2023, we received your response to our Request for Evidence for your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number XYZ. USCIS has begun working on your case again. We will send you a decision or notify you if we need something from you.
I tried contacting your office to help with our case. According to the immigration customer service representative we need to request a motion to terminate removal proceedings from the immigration judge. Now I was told recently we should have a I-601a filled out & not a motion? So I’m just wondering if I could request a motion myself or if it has to be a lawyer and if it’s the same result as an approved I-601a where they would forgive the 10 years?
Also, your office said they don’t work with these cases. My husband is eligible just entered without inspection.

And that is right, we currently don't handle cases for people who's removal proceedings have not been terminated by an immigration judge.

If I submit them together should I do them both by mail? Im worried if I do my 130 online and mail in the 485 it will cause things to be slower. How will they link the 2 together?

I see now from the visa bulletin that the I-485 dates are not "current" so can we submit i-130 now and wait for the I-485 to be "C" again?

If your father was a U.S. citizen before you were born and you were born, you are natural born U.S. citizen. if he was a citizen and at that time you were under 18 you should still be a U.S. citizen, but I think that was not the case. so were you complaining that your father was not doing the right thing?
My I-130 was approved today after only 35 days. 485 has been under active review since it was mailed, it was only mailed 2 weeks ago. I don't think anything is wrong, it seems fast for an I-130 approval. i did get a biometrics reuse notice for the 485. Beneficiary has no criminal history whatsoever, and no immigration black marks.Hope this helps someone.

I think the application form for green card is I-485 rather than I-45, but I keep hearing you say I-45

You were unlawfully present in the United States for 365 or more days, This ineligibility will expire ten years after you departed the U.S. June 16,2031>>>ban expires on this day.'
And I may be eligible for waiver of the grounds of ineligibility.

I130 got accepted after 6 months of waiting the I485 got denied, I'm unsure why, still waiting on notice for their reasoning but i find it odd when we did everything right with a lawyer, have all forms and proofs needed & never received a notice about an interview, hopefully we can fight it to get it accepted

NO if you are outside of united states .you just apply for I-130 and that is it....I-130 is the immigrant visa application once its approved ,your spouse enters to u.s with an immigrant visa and done...
I-485 got nothing to do with that. AOS is for the adjustment of status while your spouse is in the u.s because you dont have brain and patient to wait abroad..so you use the AOS and get denied ..
@@laxer123 This is not fully accurate...Once the i-130 is done, the case is transferred from USCIS to the NVC and their is more paperwork + an interview before my spouse can enter the US.

I think you don’t know what you was talking about. When USCIS rejects they always give the reason why. You should give us info how to solve the problem

@@milappatel4655 the 765 will be closed. The green card is all what you need. Same the 131 Advance parole. The green card is the only proof you need as legal status to work and leave the country, and come back
