    This would have been justified if the approval/processing time for the visa had been 2-3 months at most. Taking years to give outcomes and expecting people not to get married is unreasonable.

      I disagree, couple of years is not a big deal if not getting married, if you know it is somewhat complicated in going through PR process why not make ur case as easy as possible????

      ​@@akashvhegde1it is not about PR process. It is about outcome of the application. They just need to check documents, verify them then give the outcome. Couple of years is not small time my frnd when your average life is 65-70 years

Fairness should prevail, and transparency should be enforced for those who deserve a fair chance.     My friend got stuck for 22 months 😢 As he could not get married whilst 491 bridging. These things are not cool!

      that ain't nothing I got stuck for 27 months being single, two PCC and medicals. I literally had to send Clare O'Neil and Andrew Giles numerous messages before it was finalized

    Thanks Karl for helping the prospective migrants in navigating the tricky course of immigration. I am glad you highlighted the WA DAMA that may gain acceleration in this fiscal year given the dramatic rise in planning levels for the employer sponsored visa. I was wondering if you could discuss the issue of separate assessment requirements for an occupation listed both for DAMA and general skilled migration. Its mind boggling to pay hefty fees to assessing authorities to get the same thing with a different header. Thanking in anticipation for your consideration.

      Generally the assemment required for DAMA is lower than for GSM applications. If you have a GSM sill assessment result you sould be able to use it for DAMA

    At the minimum they can at least refund the application fee after refusal for the negligence of not updating the immi website earlier

    Karl, please make another video about the claiming point for work experience and the years that vetassess discounts. ( when you submit your EOI in the part of claiming points the information in the ? Sign is confusing . It said that you should claim the years that are in the skill assessment. Thanks 🙏

    Kindly also plan an episode on 482 to 186 transition/ any grand fathering arrangements expected as they are scrapping 482 in late 2024. Also there is no clear info how new SOL is gonna affect existing 482 visa holders.

      Judging by the info released so far, the skills-in-demand visa seems like somewhat of an upgrade from the 482. Not sure if grandfather clause is necessary. We will have to wait and see.

      It would be expected of course the requirments for the 186 TRT stream will continue to include the 482 visa. ANy lew list should not apply but we will have to wait and see

    It is such a painful situation even for those who are in pathway visas such as the 494 or 491. I heard that now they are requesting medical exams again for those who are applying to 191 from July 1 . So what should be next new requirement to previous rules to apply for permanent visas for those in a pathway one ?

    Thanks to some earlier videos from Karl, I was fully aware of this partner points being assessed at the time to decision thing, so during my wait for my visa grant, I didn’t even attempt to find any partner, let alone going into any sort of relationship. I feel sorry for those people who are entering a relationship before visa grant, either by their own accord, or pressured by family members, thus losing points in the process. DOHA’s misleading wording and deceptive practice did not receive the justice they deserve.

    I lodged my application for a 190 subclass visa to VIC in January 2020. I married in 2021 after 1 year of waiting and added my spouse. she took PTE and I completed NAATI CCL and compensated the 10 points lost due to marriage. But after 53 months of waiting they picked my file and simply refused my visa application. I lost my hard work, my 4 years of waiting, my family's future, my wife's career everything. Now I don't know what to do, only because of this non-humanitarian law. What can I do?

    The age old debate, To be or Not to be married during the visa grant process... The processing time, keeps increasing week on week. Just hope, the applications are assessed and processed sooner than later.

    This is really disturbing and scary as DHA can change any rule anytime and applicant may victimised.
    What about the age points and waiver of income threshold for 191?? Can they change the waiver of income threshold for 191 later on?

    Rules are clear. If you claimed single points you cannot change your relationship status. You are claiming 10 points for being single. For someone who is already married, they will lose those points and have to spend money on PTE and skill assessment to regain those points.
    If you claim to be single and then marrying someone means you are claiming 10 points and jumping the queue ahead. If you knew you are getting married in December or possibly before the visa is granted then should have claimed the correct points.
    I stand with the department of home affairs on this decision. Blaming the content published on website doesn’t give you the right to cheat on those 10 points. You could have taken an advise from a migration agent on this issue.
    P.S - I agree that waiting for 4 years is unfair. That is the only thing Department has done wrong on this case.

      @@mikys-aus-diary that is what exactly everyone complaining here. If you have such rule, then simply process the visa in 12 months, at max 18 months. Or else, freeze this partner points at the time of lodgement, just like other points.. simple :)

    Is exactly the same with the TR WEBSITE they used to said as a s chef you have to do 1,7500hrs they did not said anything about months, so for people who work as a FIFO that kind of hrs you can make it in 6 months, finally they change the inf and you have to work exactly 12 months.

    I got stucked for 7 years because of this condition in my previous visa and at the time that AU invited me for 189 visa. DHA should be considerate to applicants since the processing of PR visa takes a considerable amount of time.

      No it is only partner points at time of decision, all the rest time of invitation

    Rookie mistake though if they hired agents. It's pretty well-known that any new condition change should not reduce your points at the time of invitation. E.g. if you claimed 10 points single, then added a skilled partner with competent English, the DoHA will still approve the visa. I know this and I DIYed my 190 application.

    Now that’s a complete joke. In Australia you can have as many partners as you want regardless of whether you are married or not and it’s not against law. But you can’t get legally married to save your visa.

    I am in the same situation as him. I received an S56 asking me if I want to add my wife to the application or not. And received an acknowledgement of a valid applicant. This is ridiculous if it is true.

    So finding a partner will let you apply a partner visa, but having an adult child with AU citizen parent can’t apply for family stream unless 25yrs below. Even being skilled, still need to wait for years to get invited for 491 visa. Unlike the partner visa the person will get bridging straight away. 😢

      Unfortunately no, and that’s the scary part. They never had any body internally to police their practices, and likely never will. Reason? Just a simple “protect national security and community safety”.

    I applied for a partner visa and over 19 months and requested to do 2nd medical assessment, keeps getting delayed. My experience with immigration was really bad and lost close to over 23000$
    My partner pregnant now and I can't travel due to my training purposes and immigration stating not valid reason to priorities my case.

    Asking since we are seeing many grants for Jan to
    April 2023. Will processing times come down, or will we still have to wait until November/December 2024 this year?

    Hi Karl,
    I am in the same boat as I got married after the invitation, but I got my partners skills assessed and also have my partner take PTE where she got at least 6 in each band, so is that good enough for 10 points and would it impact my application status

      It seems if the skill assessment and English was in place when you received the invitation they will accept this

    I am 37 and enrolled in MBA. After spending thousands of $$$ the government sort of deceived me when they made it a policy that they will not give me a TR. Don't know what to do now - are all doors locked for people like me? I carry a lot of work experience but they don't want skilled people anymore I guess.

    Hi karl,
    I applied for my 190 visa with 90 points in jun 2023
    I had applied with 5 yrs experience
    On 11th Nov 2023 i completed 8yrs, so i get 5 more points
    On 20th Nov 2023 i got married and lose 5 points
    So the score still remains 90
    Will this be considered?

      Remember all other citeria are frozen at the time you got the invitation

      This is misleading to Immigration. If you are in a relationship (not marries) but apply as single applicant just to get those 10 points, then it's misleading. Rather, apply as couple and see if Ur partner can get points also.

      If you're single you get 10 points.
      If you're not married but with a foreign partner, you get 0 point or 10 pts. So in this case, people should apply as a single if they know they would get 0 point.

    How about the partner english test? We are still waiting our PR to be granted through 190 visa, and my partners english test is expired. We were already married at the time of application. Does he still need to take english test again before the visa is granted?

      Proving functional English for partners is a requirement. Please check the departments requirements on that issue

Becausw now you said partner skills will be assesed at the time of decision, we are all trying to understand if partners must get new English test even if they already provide at the time of the application

    Firstly, thanks for doing such great job and keeping everyone up to date regarding the changing visa requirements/conditions! Could you please clarify if this scenario is applicable in case of changing age, experience, or if your PTE score gets expired? I hope that this all should be good before you lodge your visa application as those are the points on the basis of which your nomination was issued and your application was locked right? Now, as we know that all visa applications are taking over 18-24 months to get processed so the points tests circumstances might change for most of the people as during that course of time, your PTE score might get expired, same can be the case with your skill assessment. If you can throw some light on the same, would appreciate it!

      You don't need to worry about those points becuase they are all assessed at the time you received your invitation to apply.

    Just saw an update on dha website related to whv for indians...
    Places allocated are 500 instead of 1000 agreed in IndAus FTA
    That too if implemented later is an insult for the country with worlds largest population.....
    China has 5000 seats that too according to DHA receives overwhelming response...
    Now with $25 battot fee is on top of everything, seems like dept wants to earn money from young Indians by selling it as lottery ticket with winning chances of less than 1% or 0.1%....

      407 is a TR visa
      and yes you can apply for other TR visa after training visa but if you 36 and above, you cannot apply for PSW but you can always apply for other TR work visas and when you are eligible, you can apply for eligible PR visa

    I did my masters from Deakin in 2019, and lodge my visa at 85 points. Then this rule came that single will get 10 extra points. All of my friends who were single went to 95 points, and are citizen now😢😢😢😢. Unfortunately, I was married during that visa changes, Its 2024 now and I'm on student visa, and all my unmarried friends are citizen😂😂😂😂.
    I was the first person who cleared pte and NAATI in my Group😂😂😂😂😂

      @@prasu1769 no one knows how DOHA manages all of their caseloads. I just offer one possible explanation. 191 was indeed granted quickly initially when cases were far and few between, not so much today. Still, there’s nothing much we can do to tell them to prioritise your group, cause otherwise every group would want to be prioritised, and then no group would be prioritised.

      You can marry before your invitation as long as your EOI reflects this. But yes overall it is very cruel that is why we have highlighted it
