Rules are clear. If you claimed single points you cannot change your relationship status. You are claiming 10 points for being single. For someone who is already married, they will lose those points and have to spend money on PTE and skill assessment to regain those points. If you claim to be single and then marrying someone means you are claiming 10 points and jumping the queue ahead. This is misleading to Immigration. If you are in a relationship (not marries) but apply as single applicant just to get those 10 points, then it's misleading. Rather, apply as couple and see if Ur partner can get points also.
@@rohitjoshi8132 You misunderstood me. If you're single you get 10 points. If you're not married but with a foreign partner, you get 0 point or 10 pts. So in this case, people should apply as a single if they know they would get 0 point.
@@jayson4602 I understand your perspective. I obtained my Permanent Residency (PR) through a similar process, with the distinction that my partner who is foreign national is a highly skilled and was working in her field and possesses a superior English proficiency score. According to your reasoning, it seems you are considering applying as a single applicant despite being in a relationship. This approach, aimed at not forfeiting the additional 10 points due to your partner's lack of skills or English proficiency, is misleading to the immigration authorities. Such exploitation of loopholes impacts genuine applicants adversely. Couples where both partners are skilled and possess superior English scores face stricter regulations as immigration authorities are aware of these loopholes. Should you proceed with applying as a single applicant and subsequently obtain PR, the challenge arises when securing PR for your partner. For a partner visa, you must demonstrate the duration and legitimacy of your relationship. If you have been in a relationship or married for a year or more, immigration officials will question the inconsistency of your single status application. Do you believe the Immigration Department overlooks such discrepancies? You must either remain single post-PR approval or ensure your partner is skilled and possesses the requisite English proficiency if you wish to maintain those 10 points. Rather than exploiting loopholes, which may ultimately lead to application rejection and jeopardize future visa applications, I recommend that your partner enhance their skills and English proficiency. Consulting a proficient immigration lawyer, such as Mr. Karl Konrad, who is highly regarded, would provide you with sound guidance.
@jayson4602 I understand your perspective, but it is important to clarify that misleading the Immigration department is a serious offense. I obtained my Permanent Residency (PR) through my partner, who contributed 10 points as a skilled partner working as an accountant with superior English proficiency. Your intention to claim the extra 10 points by presenting yourself as single is, in fact, a misrepresentation. If you apply as a single applicant and receive PR, how do you plan to subsequently prove your relationship to Immigration? They require comprehensive documentation of your relationship or marriage. For instance, if you gain PR on July 20, 2024, and later apply for your partner’s PR, Immigration will demand evidence of a long-standing relationship. Should you state that you were married on March 20, 2023, or any earlier date, they will question why you applied as a single applicant. Immigration is well aware of these tactics. If you wish to claim the extra 10 points, you have two options: remain single until one year after receiving your PR or ensure that your partner meets the criteria for a skilled occupation and achieves a superior English score. Misrepresenting your situation complicates the process for genuine applicants, including both single individuals and skilled couples. For accurate guidance, I recommend consulting a reputable Immigration lawyer. Karl Konrad, for instance, is highly regarded.
@@jayson4602 I understand your perspective. I also obtained my permanent residency in a similar manner. However, my partner is skilled, works as an accountant, and has a superior English score, which contributed an additional 10 points to my application. It is important to acknowledge that attempting to mislead immigration authorities by downplaying your partner’s lack of skills to retain points is unethical. Such actions exploit loopholes that immigration officials are aware of, ultimately complicating the process for genuine single applicants and skilled couples. This behavior contributes to stricter immigration laws, making it difficult for truly deserving applicants. I have witnessed many skilled individuals and their equally skilled partners struggle under these increasingly stringent regulations due to such practices by people like you.

Hi Karl, Firstly, thanks for doing such great job and keeping everyone up to date regarding the changing visa requirements/conditions! Could you please clarify if this scenario is applicable in case of changing age, experience, or if your PTE score gets expired? I hope that this all should be good before you lodge your visa application as those are the points on the basis of which your nomination was issued and your application was locked right? Now, as we know that all visa applications are taking over 18-24 months to get processed so the points tests circumstances might change for most of the people as during that course of time, your PTE score might get expired, same can be the case with your skill assessment. If you can throw some light on the same, would appreciate it!

The regional extensions still apply

Hi Karl so the government is going to do nothing for 485 age cap for the existing students? How wise is it to wait and watch for some relief as my husband's 500 visa expires in 6 months. From their covid promises to the 485 "glitch". Isn't there an internal body that holds them accountable for this?
Unfortunately no, and that’s the scary part. They never had any body internally to police their practices, and likely never will. Reason? Just a simple “protect national security and community safety”.

Hi Karl,
I am in the same boat as I got married after the invitation, but I got my partners skills assessed and also have my partner take PTE where she got at least 6 in each band, so is that good enough for 10 points and would it impact my application status

Single people still get 10 points? In this case isn't it better to apply as someone single if you're not married with your partner yet?
How about the partner english test? We are still waiting our PR to be granted through 190 visa, and my partners english test is expired. We were already married at the time of application. Does he still need to take english test again before the visa is granted?
Proving functional English for partners is a requirement. Please check the departments requirements on that issue
@@ailsaustralia We got the invitation and applied for PR and provide sufficiend english document at the time of application. Becausw now you said partner skills will be assesed at the time of decision, we are all trying to understand if partners must get new English test even if they already provide at the time of the application
Hi Karl,
Firstly, thanks for doing such great job and keeping everyone up to date regarding the changing visa requirements/conditions!
You don't need to worry about those points becuase they are all assessed at the time you received your invitation to apply.
@@ailsaustralia Thanks Karl! Appreciate your valuable inputs here mate.
