  • What's going on everybody, this is TGA, and in this video, a guy that seems like a fairly pleasant MOD Police officer, was very determined to get my details, so much so, that he followed me for miles till him and his colleague could see me get to my car, followed my car, then stopped me under the Road Traffic Act, at first saying he doesn't need correct legislation to stop me, then used Section 163 of the Road Traffic Act, a lot of effort to get my details, but they are finding their ways, never been stalked by officers to find my vehicle before, this is a new one.

    People are saying I should’ve got public transport etc there, I think most wouldn’t think about that especially somewhere as rural as this, and this is the first time I’ve literally been followed to my vehicle, I didn’t have a choice but to provide my details, since they quoted the RTA, I’m not a lawyer or a solicitor and I don’t know every little detail of the law, I know a fair few sections, but I don’t claim to be an expert, and at that point, even if I’d walked up to the pub or cafe for a coke or a coffee or something, they would’ve waited for me and then got my reg anyway, they had nothing better to do so they decided to go ahead and abuse my rights, I know there was no way out, so before you say I’m too soft etc, as I’ve mentioned before, get out there and do it yourself, then come back to me, half of you making criticisms aren’t actually auditors, so you wouldn’t know, it was a difficult situation, one that I haven’t dealt with before. Next video is a silent audit at Gloucestershire Police HQ, if anyone nitpicks that one then I’m not the problem, it’s the officers and some of you. Respect to those who support me and let’s stop these bullies in uniform, police might be learning new ways to abuse us but we are learning new ways to defend ourselves

      @@TheGwentAuditorTGA you parked far too close to the audit site and led them back to your vehicle. You forgot that the police are dangerous and can make your life hell if they so choose, its the very reason auditing started in the first place.

      you may not have been able to take public transport but a good counter surveillance tip is go and sit at a bus stop, if they get another call and pull away then go to your car, another one where there is better public transport is go along one stop then get the next bus back

      @@SeentySeen its not a breach of privacy. anyone who has a driving licence signed to abide by the Road Traffic Act 1988. section 164 of the road traffic act allows an officer to require any driver / operator of a motor vehicle to produce their license upon request when they've been operating a vehicle on the road
      the signature on the photo card licence is evidence of having accepted the conditions of being licenced in the UK. abiding by that part of RTA is one of the conditions. this auditor basically needed to use a different way of dealing with the situation

    Most Army training areas are publically accesible. It would take a huge resource to fully secure training areas. Other forms of security are in place. If you're going to access these areas then you should expect to be challenged by Police or Military personnel

    Dude are you aware there is a war going on in Europe? Why would you go film a military base with the slight possibility that you could capture some preparations the military are doing? I know its legal and all that but how would you feel if your actions costs lives further down the road if we go to war?

    Use a push bike next time sir, and find a few bike tracks you can lose them on... always check for drones to.... but fair play to you on this 1...
    I've walked the whole perimeter before and I was here myself a few months ago, within seconds of turning onto the Road we were followed up close by feds.... Once past there main gate they left us but then once at the fire station another was waiting and then followed us out the village...
    Super Random note, at Locks Garage in Alansmear, just up the road they do incredible stake lol incredible veg too... super cheap also... all local beef from 1 farm in Hereford...

    Under section 163 you are only required to stop it doesn’t give them the power to obtain your details they have to use section 164 for that just for future reference.

    I genuinely don't see anything wrong with that officers actions. He's not patrolling a local nick, he's patrolling a military base.
    It was obvious , and reasonable, that he followed you found as he had no other information to work with.
    The second that you started to drive your car it should have been obvious that he would use the RTA to get your details. If you were determined not to hand over your info then you could have just sat or slept in the car till they went away.
    Never watched a video of MOD police being anything other than polite and professional. Something the rest of them could learn a lot from.

    The way I see it with giving your details. Can work in Yr faver...
    How I hear people say.,, Well once they got your. Name and know what your doing.
    They would then have no reason. To hang around and let you carry on making Yr video.. As they keep saying once we know who you are and your no danger to us. We leave you alone....
    That could work in. Yr faver....
    And you can film away all day. As they say once we know who you are.. It worth a try.. As they now got you and your car details.. So after that then if they over step the mark.. See about sueing them..

    6:45 If they are concerned about the security implications of the site, they would be stopping everyone including joggers, runners, hikers, dog walkers, and getting them to account for the actions. I doubt they do that. They only do it when someone is using a camera. And that doesn't change the security implications of the site one iota. Also if they were concerned about security implications they would do more to keep the public away from the site and keep them at a distance and not able to come right up to the base. They would follow standard security protocols which is to have three layers, the first which stops the public for entering, the second which requires authorisation to enter but is visible to the public, and the third where anything they want to keep hidden resides. If they don't do any of that, then it's not a secure site, just a site with gates to indicate where their boundary is.

    7:00 They might appreciate having your name, but they aren't entitled to it. Having your name doesn't give them any insight into your actions. Even if it came up and said TGA films police stations and military bases, they wouldn't know any better what that meant. And they wouldn't be able to do anything with that information - they can't stop you filming just because you are on some database.
    And a better response than saying you'd rather not because it would go in their systems is to state that you are standing by your human rights and following the law to the letter and spirit. This puts the onus on them when they keep demanding your details that they are breaching your rights, and potentially breaking the law.

      Nonsense, there is a specific database that covers UK auditing and every dated entry that includes personal details builds a picture of someone's activities.
      He drove a motor vehicle on a public road (parking too close to the base), so of course he had to cough up his personal details and the Road Traffic Act certainly DOES entitle the officers to it.

    It's not for you to give reasons to maintain your right to privacy - it's down to them to supply a good reason for you to give up your right.

    I used to be a Gamekeeper on Wormbridge estate in the 80’s and spent many an hour watching the lads doing advanced driving, riding dirt bikes, assaulting the airplane that they have there and of course the killing house. Got to know a few of the troopers and DS too. We’re lucky to have them for when the SHTF.
    Hope you paid a visit to Gwatkins cider farm nearby at Abbeydore for some take home refreshments 🤪

    14:40 So he says you're not committing any offences, yet he's followed you all the way when he's just divulged that he it not using his authority and powers. That could be considered stalking and harassment. And he's just proved that he's bored and not doing anything around security by saying that it gets him out of the office. Your friendly demeanour means that he can't even have any suspicions that you are to do anything. If he had any real security concerns, they'd stop every car passing down the lane since they could stop at any point and a whole team of terrorists could jump out and attack the base.

    I really enjoy auditing videos and like to see over zealous police put in their place but I think guys who operate in the shadows should be left in the shadows, they don't bother us but they will put themselves in harm's way for us.

    I'm still trying to find a good PINAC site in the UK, they have either had very little input or died a death, probably for a good reason.
    Photography is not a crime, makes it sound legit, and yet upskirting is a crime that you can commit whilst doing photography or videoing, focusing of women breast feeding is also a crime if you intentionally film/photograph them without permission.
    These laws are recent, within the last few years, making certain aspects of photography and media a crime, so PINAC isn't correct, photography can be a crime if you don't use your head (common sense), or understand the law.
    And this is only the tip of the iceberg, the few will destroy photography and media creation for the many.
    Those who think that you have a 100% right to film what and where you want will kill photography and media creation for the rest of us, this is because there are always exemptions to the rules, the right to film anything from a public place with no consequences isn't actually correct, the right to film from a public place without infringing another law on the other hand is a far better way of putting it.
    Now, I wonder how many people think there was no offence committed by the auditor here? The MOD police did everything right, those saying he broke GDPR rules, nope, he was completely within his right to photograph, especially of it concerns security, he used his personal phone, its not controlled by GDPR, the person he took a picture of has not identified themselves so are anonymous, this is why cctv and the likes works fine in the UK, if you want a copy of cctv footage you have to give up that right of anonminity to request it.
    Where does that put photography?
    It puts photography exactly where it was pre camera phone, its just that due to the fact anyone can now film/take pictures means that there will be more abuse of laws because of poor information circulated about what you can and cannot do, it actually only takes a few minutes to find out if you will or are committing an offence depending on what you are wanting ro dilm or photograph, much harder to do 30 years ago than it is today.

    163 says you must stop when asked but what was their reason for wanting you to stop. They need another road traffic offence to stop you like speeding or dangerous driving. They just can not just use 163 or they would stop every good looking woman with it.

    Unlawful stop just to get your details. You should not of handed over your licence until they demanded it under section 164..163 only entitles them to stop you.

    This is a seriously stupid audit, it might be legal, but an sas trooper wouldn’t even tell his neighbour their job, do you seriously think catching one on film and revealing their identity is a good idea? Or even if it isn’t an sas member someone connected to intelligence or just an admin, you could put people at serious risk because of your right to film

    The smiling assassin. He was always going to get your details. That's why he went back inside the gate then contacted his back up team to follow you. Coppers NEVER just have a friendly chat. There's always an ulterior motive of sorts. You need to be far more careful now. PS. I would have handled the first encounter a lot different than you I have to say.

    Why go to this base, you could have done the same at Sterling Lines. Thank goodness there is a air exclusion zone in these areas. Before you say Google Earth this is just a training area in Pontrilas!

    Me and a few mates were fishing the stream that runs alongside the camp a few years ago,when all of a sudden we are confronted by two of the biggest blokes I’ve ever seen ,and they had the biggest dog with them,they not so politely asked what the f*ck we were doing,when we said just doing a bit of fishing we were told,not asked, to bugger of and fish somewhere else,the size of them,and the dog plus the fact they were armed ,we thought it prudent to agree!

      Misuse of what power ? There are no limitations on sec 163 - 165. So how exactly was it misused ?
      Cop bashing on every video is not the point of auditing ! Find and publicise abuse of power, ignorance and incompetence by all means - but unless your advocating for a complete withdrawal of police from the streets (?) then at least acknowledge when they're doing the job right, otherwise it's a pointless activity.

    17:55 So they openly admit that they want to know who are and are only innocently taking pictures. I'm afraid they are exceeding their authority and power in this free country that the first constable talked about. In this free country, they have no authority or power to investigate you and identify you - until you do something wrong. Until then they have to stay in the dark. They are purely and simply attempting to intimidate you. That could be grounds for a civil claim against the MOD. You weren't intimidated, but the threat was still there. An easy £100.

      Actually I would rise that a bit, since they abused s163 & s164 to unnecessarily get your details. It was pure intimidation since they didn't stop you for any traffic offences. If they had done their security properly, they'd have someone in plain clothes follow you to your car to get your number plate. And that's all they'd need since the vast majority of people drive their own car. And everything you had said to them should've dissuaded them from having the suspicion that you were terrorist. They were just bored.
      Another point about the civil claim, they will have to spend a lot of time and money getting all the details for their side of the case which is why they will more than likely just pay up rather than go through all that hassle. And if they do decide to get the evidence, then the two coppers will realise that you've used the legal route against them and might think twice about using the same intimidation tactic on the next photographer.       Well if it’s a free country how would you feel if someone came outside your house and kept filming the back front side etc and said free country ? Also this guy has tons of places like church garden roads country side etc he can go film . But he wants to go film a military base . Some places should be off limits like mi5, mi6 , military base gchq etc etc free country or not

    Your best now changing your car with a new plate, as your details will now be on a database for photography of bases etc, the only thing now is to basically make sure next time bike in your train in etc.

    If you give your name, not only will they check for it on the system but they will PUT IT ON the system for the next time, with a comment like "acting suspicious " or god knows what beside it. They always act like its an innocent question

    If he uses his private phone when on duty to take images of you it is still covered by GDPR. Particularly when he shared it with security. Make the request.

    22:10 Doesn't matter if it's work or personal, you can still get a copy of it or ask for it to be removed. It's just that with a personal phone, his phone is likely to have to be examined by someone else who could see some private stuff. In all likelyhood, they will just ask the guy for the photo to be forwarded on. But the possibility still exists.
    It might be worth stating on record that you don't give them permission to take a picture of you since they won't have a reason under GDPR to take it. Security concerns won't wash since they will have CCTV all over the place so his picture of you does nothing to help security. It's not likely to actually stop him, but that lack of permission helps your case to get them to delete it.

      And his statement that he will pass the photo on to the security department wipes out any excuse that he could have about using a personal phone so doesn't come under GDPR. His statement means he is caught by GDPR. And he's also disclosed the reason to which you have not given permission for him to use it for. GDPR requires permission for any use of your data. So in terms of security, it's useless to take someone's photo. CCTV is different as that is covered by the regulations since it captures everything 24/7 and is not targeted at your directly.

      However, the Police are not a business and use special rules.
      Trust me, real world… it matters not anyway. As they’re out of control - especially the met. I have so many untruthful GDPR emails it’s astonishing.

But taking your picture whilst they are working and then saying what it will be used for doesn't make it legal if they are a copper. They are bound by the same rules and laws as the rest of us. In fact, many laws are designed to curtail the police. Though in reality and the real world, it hardly ever happens and they police generally see themselves as above the law.

    He took a picture on his personal phone. You are/were entitled to request a copy of that and EVERYTHING that is on that phone. (unless he deletes it.) You need to be more forceful with your rights.

    They are not personal plates. They are owned by the DVLA and are public information. He's now a data controller and is working in his official capacity. Request a copy of that picture and where he has sent it. He is not allowed to share it. His phone will be searched. What a plonker that cop is. He's in big trouble.
