So, 5 months evaporates, lawyer gets $6 or $7 thousand, that leaves me a back pay check for around 2 or 3 months , I wish I was made aware ,jeez

I think this is what happened to me concerning my back pay (5 months rule)? The SSA representative claimed she has legal rights to take some of my back pay (she didn't explain why and was very rude). Anyway, I supposedly got back for 12 months from my onset date.

I applied in December 2022. Got denied once, then denied with my lawyer. Got a hearing in October 2023. The judge told us that there gonna pass on my information to a psychiatrist and use what they have on file to make a decision. It's July 2024 and I'm still waiting. I feel my lawyers aren't doing anything on my behalf. All my lawyers say is, well we have to wait on the judge. This is stressful! I would've thought by being 100% P&T would help but I guess it doesn't.

I just recently filed for SSDI. Now the waiting game starts...

You have to simplify your explanation of back pay. Respectfully, you are all over the place. My recommendation is, use an eraseable white board and write down the dates & speak slower.

my on set date is 05012020. I applied for SSDI on 092821. I got unemployment from 040120 to 073121. If I am approved for SSDI. Will my back pay be offset by my unemployment? I live in the State of Texas

I filled for SSDI November 17th, 2021. I've been denied twice, (My attorney recently filed my 2nd appeal) My question: When I was denied both times, they deny both SSI/SSDI. I never applied for SSI. By chance I win my case. When determining back pay, will I have to wait the 5 month period for SSDI, which I originally filed for? Or receive the regular back pay for SSI since they deny me that also, even if I didn't apply for it?

what if it took the SSA 4 years to approve past the AOD? Still maximum of 12 months of back (SSDI) pay? What about the other 3 years it took to decide?

I applied 17yrs ago here in TX. Took 1 year for Medicare to kick in, they auto enroll you. I don't even qualify for food stamps, Medicaid, etc. because they say I get too much money! $2k a month isn't that much.

If I got disability nov 10th 2022 do I have to wait 5 months ? My first hearing was March 2020.

  • @katrinagarland5219

I just won my SS Disability case BUT the Judge wants to change my onset date to only one year in arrears from today's date! Can he do that and what can I do to fight for what I'm entitled to without the Judge changing his mind?
