      Yes, Rump was a useful idiot for appointing young conservative judges to the Supreme court and federal courts throughout the country. He has outlived his usefulness and has become a liability, so now the Federalist Society disavows him and throws him under the bus. If the Federalist Society was truly run by constitutionalists they would have disavowed him after January 6th if not sooner. What they are is a bunch of cynics, just looking for a way to capitalize on constitutional and legal loopholes, and to weaponize any levers of government that might be bent to the will of their wealthy donors.

      This was a contrived plot , called the Powell memorandum in 1971 thanks to greedy Republicans it has devolved the United States of America into two camps, the learned and the ill informed, just what they wanted while they continue to pilfer the wealth and treasure of the middle class right under your eyes..........Since the end of WWII, the government increased wages every year to keep up with inflation. It was a rare year that the government didn't raise wages because of fears of deflation/stagflation. Almost ten years of inflation that climbed over 14%. And Americans are whining over eight months of 8.2% inflation. I can understand why.....! In 1980, Republicans entered with trickle-down economics and filibustered yearly wage increases. We've only had SEVEN wage increases in 42 years and just one in 13 years. Meanwhile, Republicans have given corporations and the mega rich three massive tax cuts, bailed out Wall Street and corporations TWICE using tens of trillions of taxpayer dollars, given corporations over-generous subsidies and cut estate taxes for the wealthy. Republicans have transferred 38 trillion from the middle class and the poor to corporations and the Uber wealthy in the last four decades. This should be the last time a Republican runs for anything, this cancer is about to eat itself !. RUN the Republicans completely out of American Politics, they have earned nothing and stole the American Dream from all of us !

      Over the years, around the time Obama was elected POTUS the Federalist Society drifted from it's founding principles; and, became easy prey for corrupt billionaires; and, far right factions to use as a tool to hollow out U.S. democracy from within. IMHO Merrick Garland had no clue regarding the cancer growing within the Federalist Society and the RepubliQan Paty. One (probably the only) benefit TFG provided is that he unwittingly unmasked many of the corrupt individuals who were slowly plotting to overthrow the U.S. democracy.
      The Plan to undermine U.S. democratic institutions was in the works for a long time. Trump, because he's about as subtle as an earthquake shouted the quiet parts out loud.

      I'm guessing you're referring to the objections to the certification of certain states' electoral votes. However problematic that is, it's not an insurrection--in part because it's provided for in the law governing the proceedings. Certainly some in Congress do deserve disqualification on those grounds if Trump himself does (though I disagree with these judges), but it's a smaller number than that.

I live in Texas, and his hypothetical about disqualifying Biden b/c he failed to ‘secure the border’ is very believable here. @nebulousvoid is on the right track tho: let them win the primary, get nominated, and run all the way to November - where the American voters will ‘disqualify’ them. That’s the only way not to leave a weapon lying about that their anti-democratic allies in state gov’ts can pick up & use to further entrench minority rule.

    The Federalist society got what they wanted from him. Packed the supreme Court with federalist members or endorsed. Barr, who is a member didn't seem to have a problem doing Trump's bidding, until the last month. Many members of FS got what they wanted from trump.

      - The Electoral College is removed to facilitate a true will-of-the-people democracy!
      - Judiciary appointments are time-limited, can be renewed but are a function of senior judiciary (not short term politicians)!
      - Presidential pardons must be sent to the (apolitical) Supreme Court for approval!
      - A House Impeachment recommendation, must sent to the (apolitical) Supreme Court for adjudication. (Allowing “Family members” as jurors is retired)!
      - Gun control is enacted!
      - The 25th Amendment is under the jurisdiction of the Supreme Court!
      - The 1st Amendment does not protect news outlets for spreading lies, misinformation and conspiracies!
      - Politicians can be stood down and dismissed for corruption, conflict of interest... offences!
      - All Bills from the House must be debated in the Senate!
      - An electioneering fund is provided that is divided amongst all parties. Cap amounts from “donors”. Cap to total amount for each party.
      - Gerrymandering and voter obstructionism is illegal.
      - “Acting” government positions have a time limit.
      - ...

      There is one. The 14th Amendment, sec, 3. Mr. Griffin one of trumps supporters that answered the Jan. 6 call to overthrow the government, was prohibited from running for office in AZ. Trump violated his oath to uphold the constitution and peaceful transfer of power. He is legally disqualified.

There are a number of those who were involved, and the Fourteenth equally disqualifies them (if it does--I don't agree with the judges here and think the section needs relevant enabling legislation and a clear establishment of facts via legal or political process).

The 2 authors of this legal opinion only started working on it last year, around the time the House J6 committee was wrapping up. What, they couldn't see 45's complicity in 1/6/2021 in the previous year and a half? They want him out now to clear the way for another (R) candidate and this would, if successfully applied, also keep 45 from taking (R) voters in a 3rd party run.

    While I ABSOLUTELY believe he meets the terms for disqualification under the 14th, I'll feel better when he's convicted of the January 6th stuff and every state and local official can point to it and say, "Trump is not on the ballot!!" Assuming both that Trump is convicted AND state and local officials follow the Constitution...

      This is why it was a mistake for Jack Smith to only charge Trump with fraud against the US, instead of insurrection. A conviction on insurrection would be the finding of fact Beau mentioned that would make the application of the14th amendment, section 3 inescapable. Without that, I have to agree that the courts would be opening the doors to quixotic determinations by every Secretary of State or board of elections out there. Nevertheless, expect to see multiple lawsuits filed to apply the amendment. Also, expect them to be shot down by the Supreme court if they get that far.

    This is the only thing that gives me hope if Trump tries to run his trial appeals up to the SCOTUS, the republican nominated judges are all from the Federalist Society and jump when they're told. If the Federalist Soceity tells SCOTUS to not help Trump they won't help Trump.

      To "self-execute a bid for office" would mean for a bid for office to be self-instated. You mean "abrogate." But, in any case, that is not true. The Constitution does not provide for disqualification based on a past false claim of election. It provides only three criteria for qualification to hold the office of the Presidency: natural born citizenship, an age of 35 or older, and not having engaged in insurrection. Literally anybody who meets those three criteria can theoretically hold the office-- even an incarcerated murderer.

    In New Mexico, three citizens went to court to prevent Cuoy Griffin from being seated as county commissioner. The judge ruled that Jan 6 was an insurrection. Griffin participated and was convicted federally. Griffin was not seated.
