I think you need to separate the issues. 1. New Jeans express that they have terminated the contract. Depending on what the contract entails, either Hybe or New Jeans will have to file a lawsuit with the court. This will determine if the termination is lawful and who pays who. 2. New Jeans are still working on projects with Ador because these were signed and agreed upon before the termination. They risk legal issues if they abandon them. That is the projects they said they would continue doing under Ador and Hybe. 3. The tour, independent activities is stuff that will happen independent of Hybe. Either they think they will get money from Hybe to do the tour or they already have a new backer and this termination is something happening to ensure they can go to their new sponsors.
They are “changing” the industry by showing other artists that it’s okay to throw unfounded tantrums when they don’t get their way. They are muddying their image and careers to follow one person on a power trip. They have all the potential in the world but, instead of focusing on their craft, they’ve allowed themselves to be used as tools to fight someone else’s battle. NJ was on the rise with growing popularity, but they let this person drill into their heads that big bad HYBE was after them. No, HYBE was after HER because of her back door dirt. NJ will never recover if they don’t let go of MHJ and place their careers as a priority. Even if the succeed and go with MHJ, no one in the industry will trust this woman and the other companies are not going to want to walk on eggshells around NJ in fear that they’ll be labeled as “bullies” when someone doesn’t smile at them.

I am not an expert on K-pop, but I have to say that all the idols I have seen are incredibly kind, so respectful, polite, caring. Maybe in private they are different, but in public they are certainly very respectful. What do these terrible girls have to teach those beautiful guys? The loss of investments would be catastrophic for the industry for a while, but also only for the young aspirants who can't pay for their own training. Only rich kids would be able to learn singing, dancing, languages, oratory, styling, etc. Quickly, companies would set up their own academies to charge for a service that they provided as an investment before. However, these academies would be very elitist and the industry would lose great future artist just because they have to make a living in other jobs.

Danielle has a Korean mother and might be OK, there are reports she was living in SK before she became a trainee. Hani is a foreigner and might have to move back to Australia. If she's being sued she'll be allowed back in on a special visa but not one that will allow her to work. Her current work visa is in Ador's name and depends on her remaining under contract afaik

After BTS got big they never whined that other groups were copying them. In fact, when they were coming up it was other groups that tried to accuse BTS of copying them. I’m usually pro artist because they are often taken advantage of by large companies but in this case New Jeans needs to suffer consequences. One has to be smart when dealing with situations like this and they have proven they are either ill informed by legal counsel or they are just making decisions based purely on emotion which is always a poor choice. I anticipate that after this is over, unless one or two of the New Jeans members gain clarity as Keena of Fifty Fifty did, their careers are over. Honestly, the Sth Korean legal system and Government, should look at acting in the full letter of the law, to do otherwise would set a precedent that would have long reaching implications not only on the Kpop industry but contract law, overall. The country could be thrown into economic crisis if everyone who is unhappy with a contract simply did whatever Jeans are doing. I suspect that most major Corporations & Businesses will be looking at what these Mean Girls are doing with trepidation. Or as I went to McDonald's where someone yelled at me, and then start threathing my contractor to terminate the contract because of non existing (even by law terms) and non proven workplace bullying. As soon As Ador asks contractor to pull out certain video or whatever on sponsors demand, that party has legal duty to do so. Ador is not even obligated to quote legal reasons for such decision. Ador's IP. The training photos haven't even been published by Ador so girls are barking at wrong organisation - they should bark at media that posted those. And last but not least, who is CEO of Ador and how is company being managed is not any idol's business, any employees business, it is board of directors decision (and board is directly respondibg to stakeholders and owners of the company), and it every company's right to freely persuie its business activities. You know what's wild? I never heard a kpop song before becoming a BTS fan, and even after 4 years I'm still reluctant to call myself ARMY bc I'm THAT DEEP into not wanting to throw 100% loyalty behind people I don't know and who don't know me. But BTS is the closest I've ever come to stanning something. There were some kpop songs I enjoyed, but rarely enough for me to follow a group (Mamamoo was probably the only group I kept up with). UNTIL NewJeans. I loved their toned-down music and visuals, and as a y2k teen it all appealed to me. And even better I actually really liked 99% of their songs. I was playing their whole discography every morning to start my day. I wasn't a fan of more of their recent music though (how sweet was ok). I was getting bored when I heard that they still weren't letting go of that Jersey Beat type music. I liked it when I thought it was just a part of a specific concept or project, but then it followed to the next project and I realized, oh, I guess that's just their sound now..hmm, ok. THEN MHJ played that unreleased song at the Samsung event, and I'm not the best ear for music but IT SOUNDED JUST LIKE THEIR SONGS FROM TWO YEARS AGO. Anyhow, I was fatigued at the fast beat, soft vocals sound and stopped following their music. I'd listen to maybe 20 seconds of new releases, and as soon as I heard that beat I'd click out lol. So I forgot about NewJeans until this whole debacle. I never followed debuts for GG or BG bc 100% of the debut songs I listened to never stood out to me so I gave up. I knew I liked NewJeans' sound (even if I got tired of the lack of variety), so when I heard that there were supposed "copy cats" called Illit, I gave them a listen and WOW. I was blown away lol. I think they have like 8 songs and not a single one was a miss, AND THEY WERE ALL DIFFERENT, and the music videos were bright and colorful and fun. So now I play Illit's whole discography every morning. Thanks NewJeans! Oh, and it sounds nothing like NJ to me. It's fun, playful, cute, great hooks (that don't just rely on vibes). And the girls themselves seem more approachable than NJ. It was clear from the beginning and even from the MVs that NJ was always meant to only appear down to Earth, but really their brand has always been to be separate, elite, aspirational, too cool. How they debuted, how they promoted, how they interacted (or didn't interact), and now we're learning, how they functioned within HYBE, they really leaned into that "not like the other girls" untouchables vibe and I think it's coming to bite them.

One thing I've learnt about HYBE is that they give you the "rope" and make you believe you have the upper hand while they get their ducks in a row and by the time they are done you have wrapped that rope so much around yourself you have no way out. If ADOR stays open, I think the next group will be amazing. It would be a perfect Karmic event for the ones who used underhanded methods to steal it. Hybe is a young company. They will learn and grow from this. It was built by BTS, Bighit and BSH. With that foundation, they will bounce back even better. They are not perfect, but they were already progressively ahead of the other labels. We don’t know what happens behind the scenes but I trust BTS and they could have left , but didn’t. ador mgmt is simply acting with strategy, not pure emotion. the girls think everything is going fine. well, yes, in their tiny bubble called phoning (their exclusive app).
I think you need to separate the issues.
1. New Jeans express that they have terminated the contract. Depending on what the contract entails, either Hybe or New Jeans will have to file a lawsuit with the court. This will determine if the termination is lawful and who pays who.
2. New Jeans are still working on projects with Ador because these were signed and agreed upon before the termination. They risk legal issues if they abandon them. That is the projects they said they would continue doing under Ador and Hybe.
3. The tour, independent activities is stuff that will happen independent of Hybe. Either they think they will get money from Hybe to do the tour or they already have a new backer and this termination is something happening to ensure they can go to their new sponsors.
They are “changing” the industry by showing other artists that it’s okay to throw unfounded tantrums when they don’t get their way. They are muddying their image and careers to follow one person on a power trip. They have all the potential in the world but, instead of focusing on their craft, they’ve allowed themselves to be used as tools to fight someone else’s battle. NJ was on the rise with growing popularity, but they let this person drill into their heads that big bad HYBE was after them. No, HYBE was after HER because of her back door dirt.
NJ will never recover if they don’t let go of MHJ and place their careers as a priority. The loss of investments would be catastrophic for the industry for a while, but also only for the young aspirants who can't pay for their own training. Only rich kids would be able to learn singing, dancing, languages, oratory, styling, etc. Quickly, companies would set up their own academies to charge for a service that they provided as an investment before. However, these academies would be very elitist and the industry would lose great future artist just because they have to make a living in other jobs.

Danielle has a Korean mother and might be OK, there are reports she was living in SK before she became a trainee. Hani is a foreigner and might have to move back to Australia. I’m usually pro artist because they are often taken advantage of by large companies but in this case New Jeans needs to suffer consequences. One has to be smart when dealing with situations like this and they have proven they are either ill informed by legal counsel or they are just making decisions based purely on emotion which is always a poor choice. I anticipate that after this is over, unless one or two of the New Jeans members gain clarity as Keena of Fifty Fifty did, their careers are over. Honestly, the Sth Korean legal system and Government, should look at acting in the full letter of the law, to do otherwise would set a precedent that would have long reaching implications not only on the Kpop industry but contract law, overall. The country could be thrown into economic crisis if everyone who is unhappy with a contract simply did whatever Jeans are doing. I suspect that most major Corporations & Businesses will be looking at what these Mean Girls are doing with trepidation. I'm quite sure behind closed doors there is a lot of lobbying going on to Politicians to ensure that New Jeans contract is upheld, and a significant penalty for breach of contract be imposed, as they would want to discourage other disgruntled employees from copycat actions.
It is as what I have been claiming all the time. First, contract is still valid because NJ violated legal timeframe for Ador to respond. Not only material breaches of Law count, but also procedural (process) breaches count and have legal effects. While Ador materially and procedurally (processually) breached nothing, these girls breached the Law and Ador's lawfully protected rights even processually (proceduraly).
Second, claiming that your employer abused you on that 4th level mutual space shared by different companies, is same as I would claim that my emploer bullied me because I went to restaurant in building I work in, and some random visitor from that restaurant, nobody from my company though, said "ignore her", or god forbid, spell coffe on me. Or as I went to McDonald's where someone yelled at me, and then start threathing my contractor to terminate the contract because of non existing (even by law terms) and non proven workplace bullying.

Sean, thanks for this vlog, it vas very informative and it is good that we finally heard real legal experts talking. Not those so called legal experts cheerleading for NJ (bunnies uncles) that were also very loud about how not saying helo is workplace abuse, while they clearly knew that legally that's complete nonsens. And yet they were lying and manipulated public opinions with nonsense about workplace bullying. . Some of these still claim that NJ has good case against Ador. It actually doesn't have case at all.
POST FESTUM:
1. demand to reinstall MHJ as CEO reecks of tempering.
2. If any judge would say yes to NJ, this would destroy not whole kpop industry that is based on heavy investments in idols, but also whole Korean economy, as I warned many times. MHJ and NJ are alone in this, there is literally no company that would support such legal prencedens (including evil Kakao).
3. The fact that girls went in Japan in Ador's arrangement means that they legally acknowledge VALIDITY of their contracts, that contracts are still ongoing. This is how the law sees it. Mark my words.
4. Ador did not protect NJ? Do you have bodyguards hired by Ador every time you travel somewhere or attend some event, NJ girls? Don't you have Ador's manager driving you around, taking care of your safety and comfort? Did not Ador react every single time when NJ got media threaths or was attacked by netizens with public warning of strong legal response? Ador did all that. And this is how it is Ador's job to protect you. Nothing else. Ador isn't kindergarten, nor replaces your parents. It is business in which NJ are equal contractual partners. For other kind of protection go to your parents.
5. Banghyuk is chairman of Hybe, a mother company, he also doesn't have anything directly with Ador or you. He is in managerial spheres of mother company that aren't business of any idol to deal with.
6. And to end my comment with this: if I was Ador, I would proceed exactly as Shawn said. Girls showed up on Ador's arranged activity in Japan, meaning that "we cancel contracts" was nothing but public emotional breakdown in organisation of MHJ, and that legally it meant nothing - girls fullfilling their contractual duty today in Japan is legal proof that they weren't serious about terminating their contracts, although they naively still believe they were serious. Not to mention that they violated 14 days deadline, because of which contracts are consequently de facto and de iure valid, because this is what the law says).
If I was Ador, I would pack them with duties, just as Sean cleverly suggested - and every time they would refuse to do the job, I would write it down till enough of breachments would accumulate, and then ADOR can give them legal notice of cancelling contracts with them. Christmas is coming, there is plenty of activities Ador can demand from them to fullfill.
And as I said: that press conference wasn't under legal advice, if it was, legal answer/argumentation would be presented on that very press conference. It was on MHJ's advice and arrangement.
If I was Ador (ha ha - but I'm not) I would collect the proof e.g. ask prosecutor to give green light for investigation under suspicion of tampering. Why the prosecutor and not just lawsuit on the court, you will ask? Am I insane? Well, not really. It is because Nation Assembly made this case a national problem, and a lot of money is at stake. Free business initiative visciously attacked for months, resulting in significant fall of company's stock value . Because many state entities were already dragged into this. You know what's wild? I never heard a kpop song before becoming a BTS fan, and even after 4 years I'm still reluctant to call myself ARMY bc I'm THAT DEEP into not wanting to throw 100% loyalty behind people I don't know and who don't know me. But BTS is the closest I've ever come to stanning something. There were some kpop songs I enjoyed, but rarely enough for me to follow a group (Mamamoo was probably the only group I kept up with). UNTIL NewJeans. I loved their toned-down music and visuals, and as a y2k teen it all appealed to me. And even better I actually really liked 99% of their songs. I was playing their whole discography every morning to start my day. I wasn't a fan of more of their recent music though (how sweet was ok). I was getting bored when I heard that they still weren't letting go of that Jersey Beat type music. I liked it when I thought it was just a part of a specific concept or project, but then it followed to the next project and I realized, oh, I guess that's just their sound now..hmm, ok. THEN MHJ played that unreleased song at the Samsung event, and I'm not the best ear for music but IT SOUNDED JUST LIKE THEIR SONGS FROM TWO YEARS AGO.
Anyhow, I was fatigued at the fast beat, soft vocals sound and stopped following their music. I'd listen to maybe 20 seconds of new releases, and as soon as I heard that beat I'd click out lol. So I forgot about NewJeans until this whole debacle. I never followed debuts for GG or BG bc 100% of the debut songs I listened to never stood out to me so I gave up. I knew I liked NewJeans' sound (even if I got tired of the lack of variety), so when I heard that there were supposed "copy cats" called Illit, I gave them a listen and WOW. I was blown away lol. I think they have like 8 songs and not a single one was a miss, AND THEY WERE ALL DIFFERENT, and the music videos were bright and colorful and fun.
So now I play Illit's whole discography every morning. Thanks NewJeans! Oh, and it sounds nothing like NJ to me. It's fun, playful, cute, great hooks (that don't just rely on vibes). And the girls themselves seem more approachable than NJ. It was clear from the beginning and even from the MVs that NJ was always meant to only appear down to Earth, but really their brand has always been to be separate, elite, aspirational, too cool. How they debuted, how they promoted, how they interacted (or didn't interact), and now we're learning, how they functioned within HYBE, they really leaned into that "not like the other girls" untouchables vibe and I think it's coming to bite them.
Same, I'm an ARMY, but of course I listen to other Kpop groups so there's no way I wouldn't know New Jeans.

If ADOR stays open, I think the next group will be amazing. It would be a perfect Karmic event for the ones who used underhanded methods to steal it. Hybe is a young company. They will learn and grow from this. It was built by BTS, Bighit and BSH. With that foundation, they will bounce back even better. They are not perfect, but they were already progressively ahead of the other labels. We don’t know what happens behind the scenes but I trust BTS and they could have left , but didn’t.
