A Provisional Patent is a great way for you to test the market to see if your idea will do well in the market. It is a little over $70 and a great way to get temporary protection. It's also now obsolete, have been through endless frustration trying with authoring tools meant for the EFS system which has now been supplanted by the patent center. There's quite a need for updated videos for the new system, I'm trying to file by snail mail now, very difficult to find out how to do this if it's even possible.

You don't have a provisional patent you have provisional APPLICATION!

god, what a disaster the USPTO website is. There are so many contradictions, duplicate forms with slight variations, dead links, dead buttons, bloated and outdated documents, error messages....

I am an attorney and I found this video very helpful. I would like to see examples of the drawings and specifications that are approved, so I can better understand the threshold for detail. Do you have examples of acceptable drawings/specifications? Also, what if the invention is modified after the application is submitted?
Google patents or USPTO is a free resource for you to find successful patents. That would be much better to look at. I'm not an attorney, I'd imagine the patent would have to be amended.

You can't edit in the USPTO system, in order to change input you must cancel session at the bottom, and submit a new application. That could be some useful information in a new video.

Can't anyone make a video on TH-cam that is clear, accurate, and straight to the point? I haven't found one yet unless it's been done by a specific manufacturer. This is a perfect example! We already know what a provisional patent app does. We wanna know how to file it. Hence your title how to fill a provisional patent application in 5 minutes well then why is your video almost 9 minutes long. Jibber jabber. Jibber jabber.

I have an idea for an invention, I just found out that someone else thought of my idea as well. Luckily, my idea is a bit different and a different material. I can still patent my idea right? And I had another question, can I use someone elses material to make my product? For example, if I bought windows from Home Depot, and converted them into stained glass, would I get sued? The one thing missing from all the videos I've seen is how to write the specs and description document and if there is a form or template to use. I don't think there's a particular/specific form to use (pls correct me if I'm wrong). There are a few templates online that vary slightly but all have similar sections (title, background, description, etc.)

@@mike9483 I ended up taking a few templates I found online and pieced together all the common sections. 1 template would have been enough to cover all the major sections. I drafted everything first then copied and pasted/edited into the actual online form. Once you get going it's pretty straight forward. A lot of the sections will seem repetitive.

I understand EFS.uspto is no longer working right?? It's now Patent Center only. However, thanks sooooo much for this tutorial. Helped me with my first Prov. Patent.
On another hand, now the Patent Center says I don't have a privilege to Patent??? Weird.

This is a good guide but it is still not complete. You still need to fill out a SB/ 125 Request for Customer Number and a PTO 2042a Patent Electronic Verification form. Otherwise, no one can view your Provisional Patent. You still need to become a registered filer too which is also important.
I never had to fill that out prior, maybe this is an updated form?
I did not have to fill those out either can you point me to where you are getting that info?
Great video! In order to pay for the provisional patent, am I required to file the PTO-2038 form to pay by credit card, or can I simply pay on the website after uploading the files? I'm asking because the sb/16 form asks for a payment form, but it isn't mentioned in the video.

Helpful... but you don't really help that much. A lot of glossing over documents with comments such as, "Just fill out what you can...." Really? Lack of attention to detail, this entire video could be 5 seconds long, starting off by you saying, "Go to this website and fill out what they want you to." Like literally... I have so many questions about every little detail you left out.

Thank you for doing this. I don’t have it in me, anymore, to deal with government forms without it being spoon fed. hahaha.
Still.. so many questions I can’t find answers to. Where do you add a secondary inventors name? There’s no “add” button. Also what does the document look like that you upload. Does it have to have certain headings? Certain format? Or do you just write all the information and magically the uspto puts it in the right format? Also the pdf vs docx thing. I didn’t realize converting to pdf could ruin all the formatting and add errors and artifacts. And what is ADS? Upload vs enter ADS. There isn’t anywhere that actually says what this is/what it means. So many people out there saying “you can submit a provisional patent start to finish in 20 minutes!”. makes me laugh. There’s no way. The most basic questions - first thing people need to know - can’t find answers anywhere. 😅
One question, after paying the fee.. how long until I can see the ppa?

What if your idea was created by you, but owned by your business that you created for your idea? Do you still put the inventor as yourself or your company?

That's complicated. If the invention hasn't substantively changed and the patentable subject matter isn't going to change, then your inventor list shouldn't change either. A person is an inventor based solely upon the facts of what that person contributed to the conception and reduction to practice of the invention. You don't add someone as an inventor because they are your friend, they put money into the company or for any other reason OTHER than what and how they contributed to the invention. Patents have been invalidated/lost because the proper persons weren't listed as inventors.

My understandings w/ PPA's is that this is where you also include "the story" the "why" etc. Where do we do that? Or is that supposed to be done in photos as well? I went to the Provisional Patent form, pressed new applications, and I didn't see " Provisional " as a option.

How do you know someone doesn't already have your patent before paying?
Someone else can't have your patent/application. But there may be a pending application that discloses your exact invention or something close enough that would prevent the award of a patent to you. Non-provisional applications are generally not publically available until 18 months from the priority date. So if a Non-provisional was filed without the benefit of a previously filed provisional, it is open to the public only after 18 months from the filing date. Referred to as hidden prior art.

Yes, that is how I did it.
In terms of the specfications it's usually numbered based on the drawing. If you labeled a hand component #3 you would specify what it's done, it's function, etc.
Remember, I'm not a patent attorney, they would be able to go way more in depth with you. If you're doing something serious I'd recommend seeking a patent attorney.

So I just finished and paid, printed the receipt and what not. Will I get an email saying it's been accepted or a letter in the mail? And at that point can I try and pitch my idea to a company?
When I did it I was e-mailed.
You can try and pitch it to a company but just be aware when dealing with companies you are best to deal with a patent attorney. Doing it yourself is best used in applying for government grants like the SBIR. The government is less likely to give away your intellectual property compared to a private company that could probably just steal your idea.
If you do it yourself you may not have filed the provisional patent sufficiently and could have no recourse.
