    I live in an area where ATVs are used on farms and ranches all the time. Generally when you load an ATV onto a truck, you use ramps or a board to get it on the bed, you don't lift it on. She's also changed the story from the seller holding a gun on them so they left and were scared to he followed them and pulled a gun on them. Lots of holes here.

    Defense attorney Jerome attempted to put inaccuracies on the record. He slid into the hearing and the denied being a part of the previous hearing, so that the record would reflect that whatever was done, was done without him. He didn't know the judge would recite the actual events onto the record in response. He's not only contemptuous, he's also dishonest and totally devoid of integrity.

      When your client is guilty as charged you learn to come up with crap like that. Good work on her part honestly. What you don't want is a defense attorney that just admits they did it and doesn't try to come up with some BS. It's the way the game is played. Only time you do admit it is when they have you red handed like there's a video of the robbery happening but since no camera caught it and they didn't find the gun then it's one persons word against another. Of course the facts only add up one way but like they said if you can't pound the facts then pound the table. You just have to try to get an inch of reasonable doubt in there and then that means you can get better deals for your client even if they are guilty as sin.

    I think this is why a lot of attorneys skip the probable cause hearing. Judges rarely hold the Prosecution to standards and will let it just go to trial. Judge Milton Waddams wasn't about to dispense any justice, he was just let it go through. This is why we have jury trials, because any sane jury member is going to see it for what it is. The real question is: Did the defendants have the funds available to purchase the ATV? If they didn't they are pretty much dead in the water. If they did have the funds, then it becomes complicated.

      When I'm (more or less) asked to explain something, and it is seemingly (or deliberately) misinterpreted, and I give a further, more complete, explanation, I do not appreciate being accused of going too far. While I admit that there are times when the right words to describe a situation are difficult to find, please be assured that the words used in my original comment to you were well thought out, where your response to them were to (seemingly intentionally) say that I'd said/meant the opposite of what I'd said, or at least something that was not what I meant. Evidently, I was totally mistaken to think that you, or others, would have been able to consider the fact that between the times of the interaction between the attempt to buy the ATV (with the theft and running away with it) and the return of it, as described, there was evidently sufficient time (if the two actually HAD produced a pistol/handgun) for them to have discarded the handgun and worked out a story to give about how the owner of the ATV had pulled the gun on them. It is a well-known trope that crime suspects are often going to lie and come up with some story where they are as innocent as newborn babies, when confronted about the crime, because that has been happening since the start of recorded history in crime annals, which anyone with even a single shred of common sense, or the ability to think rationally would/should be able to recognize and be aware of that simple fact!
      Until it has been hashed out in a court of law, nobody but those who were actually involved in the incident knows what occurred then and there, especially since there are conflicting stories about how everything went down, as there usually are, so until we actually hear/see the testimony of the case, it is all speculation about what really occurred by those who were only viewers of a preliminary hearing on the case, but were not actual witnesses to the events that the trial/hearing was about.

    As someone who rides quads, All I got to say is no adult let alone a freaking child picks up a quad and puts it in the back of a truck, its called a ramp and you can literally RIDE THE QUAD UP THE RAMP! The Defendant's Lawyer was lucky the court was clueless about this fact.

    Depending on the size of the ATV it's absolutely possible. I'm 5'6" tall and can put an attempt in a 2 point lift.

    Attorney Porter being in her car just rubs me the wrong way. It’s not ok for Defendants and it should definitely not be ok for Attorneys. Zoom hearings are useful tools, but we really need to have rules on remote hearing etiquette.

      For defendants, they may not have a quiet private place to attend the hearing other than the car. They use their phones because they don’t have laptops.

    Some of these Atlanta attorneys really act up in court. Prosecutors and defense bump heads all the time but still manage to maintain professionalism and good working relationships to the benefit of victims, defendants, and the public. Pretty darn outrageous. Also for those that asked: GA has theft by taking, by receiving, by conversion, etc. Theft by taking is very broad. Sentencing for those sets of laws are the same, based on dollar amount of the underlying property allegedly the subject of theft.

      (Assuming you are talking about the first judge) He was also patient and didn't let the guy control anything.

      It’s impossible for the prosecutor to interrupt Jerome because he never should have been talking in the first place.

    To me, it sounds like the attorney realized his client's family would be ticked about what happened, so he felt he had to jump in and perform like that so that he could go back to the family and say he argued as much as he could but the judge wouldn't listen.

    Absent a ramp, an ATV is typically loaded into a truck by lifting the front end onto the back of the truck, then moving to the rear and lifting the rear onto the truck. They are on lifting half the ATV at a time.

    I mean the non-zoom equivalent of this is just walking in the courtroom while in session, walking into the well, and yelling out "I demand to discuss a new case". In any physical courtroom the CSO or Ballif would immediately move detain you. You file a motion and request a conference or request reschedule of your preliminary hearing. I heavily suspect that you cannot get bond adjusted in a conference call, but at least you may be able to plead as to why delay is causing continued hardship for a minor.
