      @@vickieclark5931 I hate leaches, too. But it's a fact that tons of people who lost their jobs during the pandemic and weren't receiving unemployment due to gov. inefficiency would've been evicted and out on the streets. That's bad. There needed to be at least some moratoria in place. I agree it's gone on too long though.

      @@Andrew-eq2wu it's tragic all around. The thing is, landlords are going bankrupt as well and for some strange reason...its ok if they go homeless. Why isn't the government sending landlords monthly payments if they are so concerned about homeless.

      Update: Trial date was today and my tenant didn't show up! My property manager and attorney were there and represented me. I'm so happy that I can finally evict based on non-payment of rent for April 2022. Btw, tenant is in arrears for over $20K and I received $6K from HIK in April.

    Stimulus checks that went to renters should have gone straight to the landlords instead of going to large screen televisions and vaping products. Landlords could not evict, let alone raise the rate, so now they are making up for lost time.

      I got real lucky. Both of my tenants moved out. Gave me some chance to make up for the loss of income during the pandemic. Even losers get lucky.

    Non payment of rent should always be cause for eviction. Non renewal of lease should always be an option for landlord.

    You are the only channel ive seen that looks directly into the camera. If you could make some small changes that makes you look at a different spot (that is not the actual camera location), that would be the best.

      Its all right after this wave of evictions landlords will raise rent to the max to make up for losses. And I will be right there behind them when I raise my rent up to match their new market rates haha

    Here in Kern County the Housing Authority stopped taking applications as of today (July 1st). They said that they will be out of money by the end of August. My tenants that applied last year in October for their Nov., Dec., Jan. rent have applied again, about two weeks ago. Their case has not been assigned yet. The first time they applied, it went very smoothly so we'll see what happens this time. The Kern County Housing Authority was receiving about 250 applications a week before they stopped taking applications.

      The housing authorities can only take apps on waitlists that open up. By federal law, if certain Sec8 or Sec42(for those incomes just above an allowable sec8 max which usually include the working stiffs yet easier abd faster program to get on but historically the GOPpers ignore the needed funding every year in the feds yearly budget battles). Several levels of Sec8 also...but when an avail list gets low, the housing authorities put on their websites that they are taking applications. They are required by fed law at any given time to have a minimum of 50apps. My understanding that once a subsidized program has a unit with an upcoming vacancy, they need to start the rental process immediately. And that list they start priorities and it is anywhere from a fifth person to about the tenth person gets rented to. Usually because people move out of the area or some in the area that forget to update phone and other contact info. Or they get rented to othet places on the list. Or...for several reasons they move on...for me I got to the 'top ten' which they say the wait timr usually goes faster. But twice I got bumped down by a veteran applying. As always, they rightfully go straight to the top of the wait lists yet me being the person of two military fathers that severely abused me leaving me to grow up fending for myself. i had to push all of that out of my mind and have the prayers and expectations that they are good people in reality and keep holding on to faith and prayers that I will get placed in the best unit God sees for me. And it finally happened.

    Eviction moratoriums guaranteed evictions once a few months of rent went unpaid. The sums owed became too large for many renters to get together. A huge mistake.

      But good luck with getting all the back pay from the tenant's. They will disappear with out going to Court and evade an eviction leaving onwers to civil sueing but that's not guaranteed either

    Hi Christian! Thanks for this video. My tenant in LA County has been paying rent all the way up until July 2022. They haven’t yet claimed inability to pay due to financial hardship and the 80% AMI thing. Correct me if I’m wrong but I believe they technically have until today July 8th to do so as it will be 7 days after the rent was due. Would I be able to serve them the regular 3 day notice to pay or quit?

      Yes, you could serve a 3 day notice to pay or quit, but discuss with an eviction attorney.

      I do believe some people are taking advantage, but I am happy that there was an eviction moratoruim, becuse not everyone are like children, your entiled to your thoughts, but I am so tired of people like you whow act like children poutting , and throwing a fit, bcause you think everyone needs no help at all. Have you ever been homeless? If you have then shame on you. Never forget one day , you could be homeless and it could happen, if you ever been in a bad spot never forget that feeling, and most of all STOP JUDGING EVERYONE.       @@judihare9071 I will never be homeless because I did not put myself in such a situation. First thing that I did as a working adult was to build a 1 year emergency fund. Saved and invested my money instead of buying junk on Amazon or buy new cars like most Americans. 10 years later, I own a home and got enough to pay off my home if I wanted to. Not rocket science with what I did.

      @@untouchable360x your dedication to building financial security for yourself is admirable and deserves accolades, but that being said, none of us can pretend to know what it’s like to walk in someone else’s shoes, or if we did, how we would cope/react to those circumstances. We’d like to think we’d act in a certain way, but we just don’t know. I don’t know how I’d fair if I were abused as a child, or if I was never taught financial responsibility, or if I was systematically discriminated against my entire life. Perhaps some put their energies into things you haven’t done as well. Whatever it is, I don’t believe it is our place to judge others or name call or insult. It is our place to show compassion and to help others learn that which they may not already know.

      @@janeorcutt These tenants didn't show compassion to those landlords. Many landlords lost their properties due to leaches living off of them. It's not our job to take care of these children in adult bodies. I don't know either what it's like to be homeless, but I've never went 1 day in my entire adult life without a job. Some of us believe in making a living while others think it's everyone else's responsibility to take care of them. Many people are abused or have been discriminated against and still did well for themselves. Some people like to play the victim and other's decide to be the victor. It all has to do with if you have & good character & have integrity.

    what if a 60 year old dead beat son was allowed to move his nonfictional nonregisterable old motor home onto his dad's property using an extension cord for electric throwing breakers in the house and now im dads POA because dad is in severe dementia the cops says they can't do anything if he has been allowed to live there but dad doesn't have the money to support my brother and keep his house going and he's eating dads food how do i get him out and my brother has done accumulative 30 years in the state pen for probably what you can figure out it's all bad i need him out

    What the media never admits to is that people who file in court for eviction do so because the rental situation is beyond completely unworkable. These are the worst of the worst tenants.
    And don't tell me good tenants who pay their rent get evicted. It never, NEVER happens.

      That’s a load of crock! I know Single parents with children who have paid their rent to the same landlord for a decade and never been late on a payment and because of the pandemic their levels of child support started going down and have gotten worse - which can be proven. They got assistance from the state and the landlord was paid their share - over $30k…. and they are still paying at least 25% of their rent and the landlord is EVICTING them!! So please don’t tell me it doesn’t happen!! Most landlords are extremely greedy and they are the cause of the rental price is going up because when one landlord hikes up there rent all the others follow suit because they don’t want somebody getting more money than they do!

      @@itsweimartime you do realize it costs landlords money to file to evict? And they have to pay again just to serve an eviction notice.
      And easily $200/hour if they hire a lawyer.
      And that it can take months of repeated court apperances, and then if they win a judgement they may have to spend a month cleaning and renovating an apartment, and another month interviewing and background checking and driving all over town showing and on and on? Or at least pay people to do all that.
      And that there is a public trial by an eviction court with dozens of people watching including a county recorder..... and the judge hears both sides of the case?
      No judge is going to evict a tenant for "greed", please.
      "Your honour, this tenant is paying their rent & is just an incredibly Good Person. But I'm just damn greedy! Will you rule an eviction anyway please? I paid all the court costs, I just love to see people evicted."
      Greedy pfft. Leasing apartments pays dirt after all the costs of upkeep and property taxes and drama/hassle and work. Its hardly even worth doing, there's tons of professions that pay way more if you're greedy. Being a landlord is more like public service work. Sorry, I've been there and actually done it.

    Can we use our pre-covid Pay/Quit notices for all past due rent from Oct '21 - Current? Or do we still need to use special notices for the rent that became due during the protected periods?

      Normal 3 day notice should be fine for rent from 10/21 to today, but discuss with an attorney before dropping any notices.

    Got 2nd & 3rd successful non-payment fault eviction confirmed by Commissioner against lazy tenant bums... Sheriff lockout asap. I focused on just Apr/May rent, nothing from prior. Next step is small claims judgment... but hardly worth it if uncollectible from these turnips. Any tips on small claims collections?

      Great question, Paul...I haven't done any content on this. I'd see if there's a local attorney who has advice (the same one who did the eviction, if you used one).

    does the 30 days need to be given right after the 3 days' pay or quit if they don't pay May and June rent? or we skip the 30 and file unlawful detainer after the 3 days' pay or quit not paid?
    tenant has a verbal month to month and has been renting only 8 months, property is in city of Victorville county of San Bernardino

    Love your videos. An thanks for all you ;do. I have a quick question. I’m in LA County, and I’m aware that things are back to the “normal moratorium” protections for tenants now that AB2179 is over. if I have a tenant that does not pay rent now in July, and has not given me any notification that is is Covid related, can I then move forward with a 3 day Notice and start eviction for non payment? . I understand he’s protected under the moratorium, but he has not followed the protocol of giving up day notice that it’s Covid related. Thanks so much.

Yes, theoretically if the tenant doesn't self-certify to be at 80% AMI and can't pay rent due to COVID, you could move forward with the notice, but if the tenant self-certifies (even if late) a judge may throw it out, discuss with an attorney. Did the tenant pay April, May and June?

      They’ve paid. But I caught wind from another tenant that this one particular tenant will intentionally start withholding just because he thinks he’ll get away with not paying. He’s just that kind of person. But he hasn’t given any notice of Covid hardships, or anything else for that matter. He’s just going to withhold, to withhold

      And you’re absolutely right. Just because he doesn’t give any Covid notice, doesn’t mean he won’t do show in court. And 90% of the times, the judge will side with the tenant. That’s what I’ve heard from friends of mine who have gone through the same thing. It’s ridiculous.

    If a tenant is below 80% income can he be evicted in la county for non payment of rent for April, May and June 2022. As far I know they cannot be evicted, as la county local ordinance says if below 80% , not paying April ,May and June rent will not lead to eviction as la county phase 2 takes effect after July 1st. Is my understanding correct.?

      No, that's incorrect. LA County lost rental protections for April, May and June 2022. You could potentially be evicted for missing those months after July 2022. It's the month of missed rent that matters, not necessarily when the notice is given.

      Do you think if the homeless person has kids you should let him or her share your rental because they are in a worse situation than you ? I do not understand why so many people think its ok for politicians to gain votes by allowing tenants to legally steal Landlords rents and rights to freedom just because they might have more money than the Tenant ( how would you feel if the police took your car (that has a huge down payment and you are making the payments ) and gave it to someone that they think might need it more than you?. July is the only month where I wasn't able to pay so I've payed all the months before. I sent them that on July 5th. But now, on July 12th I've been sent a notice to pay rent or quit?

    So this is me I paid in June but didn't pay April or may, I have had an eviction notice for 3 weeks, I don't have one family member and I have to live in my car, i have worked all my life, Scripps health for 14 yrs, I took care of all my dying family members, and I lost mom, dad, stepdad, two brothers, and then top it off my husband of 34 yrs and my second income, I got myself in a bad spot, so I had application in for rent on March 8th, before March 31st deadline, BUT I didn't pay April and may and only 25 percent of June. I don't know what I am going to do. If anyone has any idea what I can do pls let me know asap. There is nothing I can do, and I am going to be living in my car within two months. I live in Oceanside ca, i was eligible, and a lady called me and said ok send you lease, she called around the last two weeks of march, and i was so happy, and then she said oh it looks like you have a term 2 duplicate application, I DID NOT have any kind of term two ,term two was over in January or months ago, and paid, why would I do that, my application said March 8th, deadline wasn't till March 31, 2022 ,I was eligible , I was told yes, then got a denial, that was `100percent false, I told them no i didn't do any term two at all.So how are they trying to say that when the date of March 8th proves it all, I appealed it and the denial was term two duplicate, that is false, they cannot put a reason that is 100 percent false. They acted like I was getting all of March, so then I got behind March, April, May, and i paid 25 percent of June, so I don't know how it works, are they going to just kick us out right away? What if I get social security and my roommate is disabled and a senior who had got knee surgery and needs the other done, can you need time if you're unable to move fast or cannot hurry is there any extra time for those reasons or no?     Ok, I am so confused, I live in Orange County, I complied with all my dead lines, applied for rental assistance with Housing is Key before dead line, I was not paid by EDD for six months because someone was collecting my EDD money when the pandemic first hit, and yes six maonths later and cost of a lawyer and going to court to prove my identity i is how I got behind "and still behind, just lost my car insurance, because my son got sick with covid and missed pay checks,. I make way less money , so I know I can catch up even if I had to get two jobs just for my rent. so do I self certtify for May, April, June rent, or Orange County has moratorum that no longer exsist, so self certification is not accepted in OC? I have July's rent and am paying tomorrow of course with my late fee, (waiting for paydays) because my July rent wourld be late? Why did I not recieve my 3 day notice at least for July's rent, now I can get back on track finally! I am so confused, I was think I would get some notice and that would tell me , what I wourld need to tell a lawyer, and one final question..... EDD put in this situation, I took EDD because my posistion as an Assistant Director for many years allowed me to give hours to our youg employess with families, and now all this, i would do it all again for them, but EDD has no responsibility in all my extra cost of past due registrations, new car insuance, I had to pay repoe dues on one of my cars . I am thankful for the states help, because this has hummbled me as a person and I was pretty down at one point, becuse i have worked ALL my life, so I was mad inside my heart until I prayed for whoever took my money from me and my family. BIG THANK YOU to YOU MR. WALSH for all your help, you were my life savior and some day when I am ready to buy a house I will ask you for advice. Thank you from the bottom of my heart Mr. Walsh for helping all of us.

    Hey Christian, for at fault evictions in LA County, could a tenant be evicted if they caused physical harm to another tenant within the same duplex property? Law enforcement was called out to the scene and the tenants involved both the victim and the aggressor will be heading to Superior Court pretty soon.

      Yes, this seems like grounds for eviction, but discuss with an attorney. There are special protections for domestic violence which may come into play here (for any other tenants in the unit with the aggressor) and the attorney will help navigate through this.

    I paid my April, and May rent by check and put the specific rent month in the check memo. My landlord served me a 3 day notice in June requesting April, May, & June rent. Looks like they now applied it to the past due rent prior to April although I am still waiting for housing is key for those previous periods. I am currently still in the apartment even tho the notice has expired. I’m assuming they will now start a UD. What should I do?

      Discuss with an attorney from Lawhelp.org. Under the eviction moratoria laws a landlord wasn't able to apply the rent as they see fit, the tenant was able to determine which months and it sounds like you designated correctly.

If as of July 1 2022 if a tenant falls below the 80% poverty line and certified along with providing documentation as to how covid is still causing hardship (specifically health wise which effects financial situation) on July 1st and Aug 1st why then would I receive a 3 day notice on @ August 12? I am in LA County incorporated city of Covina. Just to make sure I was understanding it correctly I consulted a housing counselor and was told me I was correct and still protected.     I have a tenant who hasn’t paid rent in full since COVID began (March 2020). Rent is $1900 and has only paid $500 a month. They are a family of 4 with 2 children so I’ve been told that if I begin the eviction process, a judge will side with the family because of the 2 children. The local housing authorities have several programs not only to help out with rents but to get them moved or at least established on waitlist before the high numbers pandamonium that was inevitably to happen.       Based on another comment you left, you're in LA County, correct? (Not LA City). You need to reach out to stayhousela.org immediately to discuss your situation. You can potentially be evicted for the rent missed in May and June (but not July because the LA County Moratorium went back into effect).

I got my second payment from housing is key mid May. they haven't told me to leave by then. they gave me time to leave by the end of June!       I saw in the news a similiar scenario ..older gentleman had a unwanted,non paying tenant who wouldn’t leave. So he had no choice but to sell the home at a lower price that mentioned a squatter in place..in youre case it would be the same. U would sell property as a income based investment if u currently receiving rent from youre tenants so the potential buyer would buy it as an investment and not to live in. Or if he chose to buy it for him to live in it,then it’s up to him to evict them as u selling home as investment purposes only ..and negotiate if need to..but the bottom line u would be selling with live in tenants as part of the sell.

    Out of curiosity.. What if the application is still pending for rental assistance and a eviction notice has been served to the tenant.. What happens if the landlord gets the funds for previous months before it’s time to go to court will the renter get to remain in the home? Housing is key did mention that they’ll have all applications done by June 30th 2022. By the way thank you for all the updated Videos throughout the pandemic you’re awesome!

      Thanks for the kind words, Janis! That's a great question and probably the tenant would be able to stay if the landlord evicts for months that he/she ultimately gets paid for (as long as the payment comes before the trial).

      I read somewhere that It might just be cheaper for you to not spend your money on lawyers and court just to have the assistance come through before you can finish the court processes.

      @@WIREassociates my tenant is trying to sue me now for $15k in small claims claiming that I forced him to pay rent while he was going thru the rental assistance process, I legally served him and waited for the 15 days required and he did not complete the covid distress form a d ended up paying me several months of rent which he is now trying to sue me for

      @@mikedeee6968 Two separate things. The moratorium would be based on location...some areas have it and some don't. If there isn't a moratorium, then a 30, 60 or 90 day notice would be required.

    (Zip code 90057) How can someone find out which applies to their area? I believe my friend is in LA COUNTY. Can she be evicted if she didn’t pay APRIL, MAY, JUNE, JULY? Her building has about 300 tenants but it seems like no one really knows what’s goin on. (just trying to get some info for a friend with little kids)

      From what he said in the video, if your friend is within LA County, yes she can be evicted if she didn't pay April May and June rent because AB 2179. But because it's now over, for July and onward I believe? If she self certifies that she is at 80% of area median income or lower and the fact that COVID is affecting her then she is protected from getting evicted.

      Thanks bricxc, yes, that's right. Just to clarify, if a tenant in LA County didn't pay for April, May, and/or June 2022, the tenant probably could be evicted for that even in July 2022 or beyond if the landlord only mentions those months in the 3 day notice to pay or quit. If the tenant pays the rent in the 3 day pay or quit (for April, May, and/or June 2022), the tenant would be protected.
      If missing July 2022 or beyond rent, then tenant must self certify to the 80% AMI and being effected by COVID. Hopefully that makes sense...think of them as different time periods with different rules.

    So if I am understanding correctly -- Since I live in LA County (DTLA) in an apartment building, if I self certify with my building, they will not be able to evict me due to non-payment of rent from July 1st and onward. My rent will still accrue and be due -- But for the time being they cannot legally evict me. Is that right?

    We have a deadbeat in our rental who hasn't paid a dime for the last 3 years as he claims he lost his job from covid...3 years later he still claims he can't find a job and California won't allow us to evict the criminal...we are a family struggling to stay afloat like many...and if the deadbeats get a judgement against them then turn around and file bankruptcy, WE LOSE

      my friend who is a property manager has used me a few times to serve evictions. If you do not have a friend you feel comfortable having them do that, hire a process server

      How bad does the nuisance have to be to evict. The problem is the tenants are " Adults "throwing out from the top stairs,glass lamps , glass mirrors ,clothes, beer bottles multiple times and I have pictures videos to prove it , I have tenant kids and my kids playing in the yard and they have been lucky not to be struck with those glass items.       That's my question as well. I paid April but couldn't pay for May June July. they gave me the 3 day notice on July 6th. I have communicated with them via email that my income is below 80% and I can't pay for rent. also I did apply for housing is key and got paid and paid the landlord whatever they gave me. i am so confused!

    Spent all day trying to save my house from further destruction i think i have all forms will be serving tenant 3 day to vacate non curable breach..they say i need to include a covid worksheet...cannot find it ..please help is there any other form i need...you are a life saver truly and a go to for important information thank you so much whether you can answer me or not...i wish i could hire you! Im already out 9000 in damages and 4500 in rent tenant says they wont pay ...i just want my peace of mind back i have to believe all people arent like this now or i would loose my mind...thank you what is sad that the state is condoning this type of abuse from tenants yes i know there are bad landlords too all so sad i feel like im paying the price for others

      Agreed that every landlord needs a good eviction attorney. Some places have been easier to evict than others...for example, tenancies could be terminated starting October 2021 in many places and some you still can't.

      Correct, no evictions for nonpayment of rent in LA City. Yes, one year after emergency is over, but City Council may start a phase out at some point sooner...stay tuned.

      It's still owed, unless paid by rental assistance program. The tenant and landlord can work out a payment program or the landlord can take the tenant to small claims court.

      @@varinialopez6391 Yes, potentially because the months you owe for are the months where evictions were allowed for nonpayment of rent in LA County. Those 3 months are treated differently from the months before and the months after. Discuss with a attorney ASAP if you receive ay notices.

      @@oliviainsd2103 Up until July 1st, there was a law in place that protected tenants (AB 2179 was the one that expired then). Some areas have a local eviction moratorium still in place that protects tenants (for example, LA City and LA County and Sand Diego has a no fault termination ordinance in place).
