      In the 1st paragraph of the notice, it says that it retains to "tenancies that commenced or were renewed on or after January 27, 2023". So what about tenancies before Jan. 27, 2023?

      @@C.McLain that's related to delivery of the notice. Any renewals or leases signed after 1/27/23 must include the notice.

      Thank you so much for this ! Clearly put landlord is a slumlord 😢they refuse to post this , refuse to educate the tenants Ofcorse !
      I was the one to email my landlord with all these facts including the FMR fact because they tried to threaten and evict me , they also tried to extract $40,000 from me and ignore the huge amount of grant relief they received. Unbelievable 😞

    A few questions regarding the Fair Market Rent (FMR)
    1.Where do studios fall in the category since it's not mentioned in the FMR chart (for example a 600 sft studio)?
    2. Are the FMR $ amounts calculated based only on the number of the bedrooms or/and the size of the apartments too (since there're studios w/ more sqft [and maybe even more expensive] ]than 1 bedrooms and vise versa)?
    3. How can we appreciate all your informative videos?

      1) You'd use the column labeled "Efficiency" for a studio...it really should have said "studio" instead.
      2) Yes, it's purely based on bedroom count

    May 21, received notice, will fine $250/day. They give you 7 days grace to post it. We inherited a small 9 unit bkdg. My Dad never envisioned this bs.

    A tenant that lives in a condo in the City of LA has been claiming non payment of rent due to COVID.
    At the beginning of March, 2023, the tenant was served a 3 day pay rent or quit for Feb 2023. Then another 3 day pay or quit was given for rent for March 2023. (Tenant provided the COVID declaration weeks AFTER the 7 days required.)
    When rent was not paid, an Unlawful Detainer was filed. Tenant filed an answer to the Unlawful Detainer, claiming non payment due to COVI & being below the AMI income requirement. Should the landlord be concerned that the tenant may win in fighting the Unlawful Detainer by claiming poverty & the COVID defense? Hope that makes sense. Thanks

      Hopefully you have an attorney providing guidance...it could come down to the judge to make the decision, but the fact that the declaration came late, may work against them.

    Hi Christian - Thanks for always providing great information. It really is helpful and appreciated! Do you know if there will be more rent relief for tenants any time soon? I thought there was talk that that was going to (possibly) be the case, but haven't heard anything else about tenant rental assistance since the latest eviction moratorium/protection was put into place (back at the end of January).

    Your channel is invaluable! My elderly neighbors received end tenancy notice, but they stayed beyond the end date in Jan '23 until current. The landlord put the house on & off the market during that time. The landlord is now asking for back rent to Jan '23 if they want to stay in the house. Do they have to pay back rent or just rent forward?

      Thanks for watching! If they are in possession, then technically they owe rent. If that notice was given in LA, then it probably wasn't valid at that time.

    As always thank you for your video do you have videos regarding la city inspections the they going to check all units is it true that fines cab be given to tenants and to landlords ?

      I have not heard that fines can be given to renters, but maybe there are some circumstances where that would apply.

    FYI Folks, I spoke with LAHD about this notice yesterday. I was trying to determine if there was a penalty for NOT posting this notice. Well, LAHD said that they don't have a mechanism to enforce. I suppose you could use it as evidence that your LL doesn't follow the rules, but don't rely on this for anything substantive. I am really wondering why LAHD even exists.

      It's an affirmative defense if the landlord didn't post it and tries to evict you...just mention that landlord never posted the notice and the judge should throw the case out.
      One landlord told me he was threatened with a fine for not having posted it.

    Is LA County allowing tenants 12 months to repay past due rent owed between July 2022 and March 2023 due to the Covid-19 tenant protections resolution and also requiring a written 30-day notice prior to landlords filing an eviction for either non payment of rent for either past due or current rent as of April 1st and/or unauthorized occupants and/or pets ?

    Thanks for the awesome content. Do you know if I own one condominium in a 36 unit condo building would be considered a Single Family Dwelling? would that limit relocation fees to one month rent?

      You can confirm with LAHD, but, yes, it should be subject to the reduced relocation fees as a condo.

    Does anyone know what happens to someone who has paid their rent on time always. And has a lease is a senior citizen. Suddenly the house is on the market for sale. What happens to the lease and what does the new or old owners compensate the tenant? Please advise. Can new owners raise the rent and disregard what current tenant has been paying? thank you kindly.

      The terms of the lease or rental agreement need to be honored by the new owner. If you are month-to-month, then potentially the rent could be increased with proper notice. Is it in LA City? If so, and they terminate your tenancy, then you will be owed relocation assistance.

      They voted to end the Resolution 3/31/23. I don't anticipate them changing that.

    StayhousedLA does not have any info about potential $ help with back rent for July 22 to March 23 rent amounts.
    Any information anywhere ? Will Rent relief be reinstated ?

    What if the rental is a single family house, and the tenant haven't been letting us in, do we post the notice at the door? Even if they let us in, do we just post it in their kitchen, since there are no common area in a house?
    Also, if the tenant speak another language, do we need to provide both in English and another language?

      It's a little vague for single family rentals, just says "accessible common area." For a single family rental this would be something like near the front door or near the garage door. I'd have the notice match the language that the lease was signed in.

      No you have additional time to pay back rent, if the nonpayment of rent was due to COVID.

    Thank you for this. We just saw the posting requirement. We were going to email of course . Is the posting in common area- over mailboxes_ meant to be permanent or just a single event ?

      The law is ambiguous on it, but this may evolve over time. I'd recommend taking a picture when you do post it and periodically checking to see if it's still there...I've seen common laundry rooms with some pretty old stuff on the walls. 😀 The notice itself will change over time so you may want to check the website occasionally and re-post if it changes.

    Question...a tenant in Chatsworth CA has been served an Unlawful Detainer for rent not paid for the months of Feb 2023 & March 2023.
    The tenant's defense seems to be that he is not able to pay due to COVID, (the Covid Declarations were not received by the landlord until after the 7 days after rent was due.) How will the tenant be able to prove non-payment due to covid? As a landlord, how can it be proved that the tenant is lying? Can we demand bank statements, etc?

      You'll need an attorney to navigate the process...it is very complicated in LA right now. The self-cortication declaration should have been given to you and yes, you can ask for proof. Your attorney will help navigate this.

    I am in DESPERATE need of help. I have called The Housing Authority many times because I am LA City and my landlord has filed an eviction. We have court Monday and my name isn’t on the lease BUT I have been living here with my 6 year old daughter almost 3 years! My sister moved out shortly after moving in and I took over. The manager knew all along and had no problems until I fell on hard times in August of last year. I need someone to help so that me and my daughter aren’t homeless. 🙏🏽 any information will help. I WILL NOT GIVE UP!

      i typed a longer message before and it may be under review or too long. but i was saying try la law library. find 'eviction defense manual'. they can scan pages for free and email you. ask judge for continuance so you can get legal representation. i am not a lawyer.     Nope, my landlord has not posted this notice. I am not surprised! My landlord got sued for horrible gentrification a few years ago and was injunct to pay $2.5 million! I have the wrost landlord on the planet. I speak to an attorney three times per week thanks to this landlord.
