    I still don't understand how it's legal to share someone's name with a tenant of your family member moving in. Isn't their right to privacy, for the future tenant, your relative?

      the system is all set up for "poor"tenants . no one cares how you saved up to be able to have a rental property.... California is communism

    It should be 10 day notice for all states and if the landlord can prove that the tenant didn't pay for that month on the 11th evict...tenants will abuse the system to their advantage to live rent free

      decide how you want to play it, what are the pros and cons. Maybe call the landlords bluff, let him find out in court his notice is wrong? Call code enforcement on him? I would advice getting an attorney, however only YOU know what your final goal is. Do you still want to live there? For how long? Ect.

      @@WIREassociates I am calling an attorney today. The notice is very generic. It only gives 60 days with the unclaimed property language, proof of service and NO reason. He said no fault when asked why at the time he delivered and added he can do this anytime for no reason as I am month to month. I don’t believe he knows the laws changed 4 years ago. I live in a single family home, however never have received an exemption from TPA disclosure notice at anytime. So, am hoping I have just cause rights at the moment. I’ve been here 18 years and this is out of the blue. Hopeful I can have this notice tossed out.

      You know you only have 5 days to reply and if you don't reply the landlord will win by default it isn't easy to do all the court paperwork but I am helping my landlord do the eviction paperwork and the court house gives you a packet with instructions and samples so make sure you respond and don't expect to win due to a technicality.

      @@ericatritch2071 This only applies to when an unlawful detainer suit has been filed AFTER the 60 day notice expires. It hasn’t gotten to that point.

    I'm glad to have see your video I was given a 30day notices to move out on a rental agreement but I have never signed a rental agreement with no one my father payed 15,000.00 for this home y should I have to move out on a rental agreement

      If you've lived there longer than a year, then it would need to be minimum of a 60 day notice in California. You may be protected in other ways, as well. Definitely discuss with an attorney.

      Your well thought out reply suddenly disappeared ! What happened? Do you know? Put your critical thinking skills to work. I guess I'm not a critical thinker like you but I have a thing called common sense. do you? It"s just that when someone leaves garbage in the kitchen for weaks. You'd "think" that the chances of this person leaving left overs in a broken refrigerator, when they could just could just toss it with the trash in kitchen, are pretty low. Yeah? The type of comment this person wrote about her own niece says other things to me. Like maybe the refrigerator isn't broken? Again, not a critical thinker here but something tells me that maybe someone is that careless would probably not take the time to put left over food in a broken refrigerator? Oh yeah, and it's weird that a landlord is snooping around a refrigerator that does not belong to them. And in just the right time. I mean perfect timing!!! The landord has issues in the building that gained her access while her niece took a vacation!! I'm not a critical thinker like you but it's safe to say I also do not suck on my thumb like a 2 year old.

    Can you just not renew the lease after a yr lease has expired. Or what if you require a renewal for a year but the tenant refuses to sign but doesn’t want to move.

    So my mom is 83 and diagnosed with cancer. She has been living in her house over 3 years. She received a 60 day notice to vacate with no explaination. I asked the management several times why and no answer. I have sent numerous letters explaining my mothers condition. I finally understood from the neighbor that they are evicting her because they want to rent the property for a higher amount and it's way over the increase cap law. It is a single family home in Glendora that shows the owner as a family trust. Does my mom have any rights? I have been looking and nothing is very affordable. If I can't find her a place I will have to put her in a home and I swore I would never do that...

      You should definitely reach out to an attorney ASAP...you might be able to get some additional time for her in the home because of her condition as an accommodation for disability. A good attorney will be able to get her some extra time.

      @@WIREassociates How much time? She is on a fixed income. Are the attorney costs going to be the same as the increase? She must be out by August 15th and I am stuck here. To make things worse the cancer has started to spread in various bones. I am not sure how long she has given its spreading so fast.

    When a married couple rented from a church friend without a lease contract, pay every month with cash but no receipts for 5 years in a mobile home. The landlord sold the mobile home and gave 30 days notice of No-Fault Just Cause. Is that how its supposed to be?

      Definitely discuss with a local eviction attorney since mobile home laws vary depending on location. Seems like it should be a minimum of 60 day notice, but an attorney will give the best guidance.

    My landlord gave me a 60 day notice on march 31 one day before SB567 went into effect for substantial remodel. I checked the city records and he has not applied for any permits. The stated reason is foundation repair but I suspect it is pretextual since we wanted to raise rent by %30 verbally and i refused a more than %10 increase. He is trying to kick us out to raise the rent. Can I fight it?

      Once the landlord gives you a notice, he's lost control of the situation. I would personally check if the notice is correct, if you have doubts and are unsure, you should look for an attorney. I would double check with an attorney to see if SB567 is in effect once he files the unlawful detainer or once the notice is given. Do your own research as well though, don't be afraid of your landlord, his property has gone up in value thanks to the tax payer, don't let him disrespect you and punk you around.

      This all depends on the remodeling. If the landlord only works on the interior and no changes to the plumbing or electrical, a permit is not required now sometimes the work can take longer then 30 days for example. Replacement of cabinets, floors, damage wall boards, plumbing fixtures, etc, etc. These are items that tenants have no clue of what it cost and time, until they have their own place! Best of luck.

    I am renting a back house unit in Granada Hills California for 18 months and the landlord told me early March that she is giving me a notice to vacate the place because her brother is moving from east coast but the notice is verbal yesterday May 1 she hand me a written notice that I need to vacate before the end of May because she also scheduled a company to clean the place she is called deep cleaning and besides her brother is coming on on the 7th June,I am month to month because the lease is only 1 year.the notice that she gave to me there is no date its only said that I need to be out by May 31. Which is 30days notice. my question is is that legal?I'm been renting there for 18 and I pay rent on time sometimes advance...

      She needs to give you 2 months written notice and you can ask for paperwork to proof that her relative is indeed moving in and will live here for a year or.more. otherwise you can move back in at your current rent rate.

      first thing I would do is check if that unit is even legal and go from there, you can go on the county assessor website for that. Then I would talk to an unlawful detainer attorney.

    We’ve had to relocate six times in the last 12 years. I don’t appreciate anybody telling me that I’m gonna have a two-year lease and find out that the third year. I can’t stay there yeah how much money it cost to move every time.

    Thank you so much for your videos. They are fact based and forms are well explained. I have a question. We have wonderful tenants in our single family home that have been with us for over 10 years.in Riverside County, California. We are thinking about moving closer to our kids out of state...medical reasons. Their lease expired a couple of years ago and have been on a month to month tenancy (no formal lease) and we advised them several months ago that if we were going to sell, we would give a 90 day notice to vacate. We would love to sell to an investor to keep them in the home but that may not work as we have not increased their rent for a few years. Could you please advise the proper forms we need and attorney if needed. Thank you

      I've had excellent renters, except for my 1st one that did thousands in damages & had to be evicted. After that, I was always very careful, even waiting 2 mos once, until I found the right couple. All my former tenants still stay in contact with me, & even use me as a reference for jobs etc. It's been amazing, once I really took my time, instead of worrying about getting them rented asap.

    I read the replies……what a joke! These tenants have no idea how much it costs to maintain a unit in the state of California. All they do is complain about the rents going up, well then, stop complaining and just buy a place. This should solve all or most of your problems.

      Why should tenants have to worry about how much a property is maintain? It’s on the landlord whether or not to buy the property initially 2:01 and if it costs more to maintain it then so be it.That’s the responsibility that you take when you purchase a property that you’re going to rent. Nothing last forever things breakdown.

    Question, Ive been in the Rental home 10 years. I have been given a 3 day notice. What if i get a 30 day notice to evict but was due a 60 day notice. What legal court document do i need to fill out to fight this ?
