    I’m not a lawyer or an English major, but the phrase “Total impairment that occurs less than 25% of the time”, as stated, could include a one time event in my opinion. I think they will have to change the wording to avoid a legal loophole.
    Less than 25% includes zero, but they did include “occurred”.

    Thank you ladies...for expanding this process. We shall see the end product.....VA from my view are not looking out for veterans best interests.....they never did they never will not in my lifetime

      is the best interest of veterans being pay them so they do not have to work? when i was a recruiter i could enlist anyone just by saying that they can do 4 years and never work for the rest of their lives. why would anyone be a career serviceman/woman if they can just get their base pay and not work after discharge. i joined the military to do 20 years. knowing now that i am 100% p&t just a couple years after discharge i still would stay in the military for 20. even being retired at 11 years i still wanted to do 20 years. am i stupid because i love and want to give more than i want to take. people want to buy me house thinking i can make money. i said i do not care about money. i care more about having a home to live in that i can afford. if they wanted money i would have given them half my disability pay. i give more money away than i keep. seriously, i do not care about money. i would live on the street if i was allowed. people are too worried about money these days like it is a big deal or something. they want more and will not give any away. veterans are outrageous about thinking the VA is against them. my VA cares too much about me, i want them to leave me alone. they call me and tell me i have to see the dentist saying i have to come in. my doctor called the police because i told her i was quitting my medications. my therapist calls me every day after hours asking how my day was. they just wont leave me alone

      Well said and agreed! Crooks with hooks....I do pray for all my homeless vets and those vets without adequate health care as well as those vets who have to continue to fight for the benefits they sacrificed for❤

One can not measure the VA with just a few veterans that are so happy with their situation...Their are millions of veterans that got, and are getting screwed be VBA. I am 100% P&T for a long time and not once has the VA ever called me to see if I am still alive. If everything are so rosy their would be no need for VA lawyers, VA courts, etc..to fix the misdeeds of VBA. Took this bastards 38 years and court decisions to get my rightful disabilities....Let's not confuse the VHA with the bastards at the VBA....and from your reply I think you must be confused...I don't complain about the VHA/the hospital and their doctors, they do a good job BUT the VBA is another issue..You got your 100% a couple of years after discharge, good for you. I was discharged with TBI and many other in-service medical issues and VA did nothing at that time .....Even now I am still fighting for earlier effective dates which I will win even if I have to go to the Supreme Court. Every veterans have their own story and nightmare with their dealings with the VBA. Some veterans are lucky and things work as they should. There would not be BVA backlog if VBA did the right thing they don't and the appeal process continues.
      This is not about money..It's about holding VA feet to fire to do right by VETERANS. This is why the VA exists.

    When the VA transitioned to C&P exams by outside 3rd party doctors with an hour appointment instead of using the PcP evaluation who actually knows diagnosed and treated the veteran, that’s when you realized it was never about the vet.

      @@MK-js8yb not all are good just like not all Va folks are bad. However, PCP were causing the VA too much and the VA needed a more streamlined way to deny veterans benefits

      @@adtemporary69 Yeah exactly. its always a move to discount the claims. I wouldn't care about the money so much if the care was actually there. The VA is literally just a jobs factory. They want to cut down on waste but pay people 6 figure salaries denying veterans care.

    I worked for the same employer for 30 years. I loved my job. The "new" boss fired me because I verbalized a thought. Every place I applied asked me the reason for leaving your last job. "Because my previous employer thought I was going to shoot him." Not many employers are willing to hire someone who has ongoing PTSD and is afraid of you. Thanks to the VA, they recognized my issues and are continuing to help me through one on one MH treatment. I find it helpful. Never give up my brothers and sisters.

    VA absolutely LOVES complicated. They do complicated on purpose!
    Complicated allows them the maneuver room to give low ball rating decisions to disabled veterans.

    it really is like a slap in the face for someone like me that has an overall rating of like 170% and a 70% mental health rating which makes me 90% disabled I don't know how this works in the grand scheme of things

      @David Johnson he is referring to the va math. all of his disabilities add up to 170, and he has a 70 percent for ptsd, and because of the math with all his other ones he only gets 90

      yeah it's annoying but basically the additional disabilities only add a % of the largest % it's quite annoying. my disabilities add up to soemthing like 130% but i only get a 70% over all because my largest one ( mental health stuff) is only 50% and my back is 40% and some other smaller ones. but reality my back feels like it should be 100% on it's own, ( arthritis and lordosis) and that constant pain had ruined everything i enjoy and made work near impossible as the pain feeds into my anxiety and depressive disorders.

    I understand that once the rater determines the 'diagnoses' then they will ask how often the symptoms occurs. like 'often' alway's' sometimes".... how often in a week, or month symptoms do they have a panic, episodes occur. or how often they take care of themselves (clean, or shower). sucidal, or hospitalized.

    It seems like these proposed changes are tightly linked to the CAPS-5 rating system. It might be beneficial for veterans to see a civilian psychologist who is experienced with those surveys. It might help them preview where the veteran may stand in the severity and frequency scales.

    Hello H&P . I currently have a 10% Tinnitus service-connected claim that was recently granted. I have a few questions. During my C&P exam the Doctor told me I have significant hearing loss and advised me to file an additional claim for Hearing Loss. He said that I file within 3 months the report that he prepared at my C&P exam would suffice and get me approved. Additionally I am planning on filing 2 or 3 secondary claims to my Tinnitus. My plan was to connect Migraines, Anxiety and insomnia. Any advise anyone has I would appreciate it.

    Quick question. Had my c&p exam the other day for increase on ptsd and depression. Well she was overall decent. But tried to make small talk about my shirt etc and I just didn’t make any comments back. Then halfway through the hour and a half exam she has asked me if I had any NJP’s while in service. What does that have to do with anything???! I did tell her I had one for something small. But seriously should I be worried

    What if the Veteran has already received an acknowledgment by DoD or the Defense-Department for a Service-Connected Disability? How then can the VA deny this disability that has already been acknowledged by DoD that it is Service-Connected?

      @@HillAndPonton thank you, actually I do, but its regarding about our father, he is also a vet, and he was only recently been approved of his disabilities, however we found out that it looks like someone else tried to file claims years ago posing as him we guess, and also said that our father went to a va that he never been to before. What can we do about this and should we be worried about it, again, thank you

    I am watching your podcast now. I have no attorney. I am 50% service connected for major depression disorder. In the last year and a half I have bought and sold a home that I could of made probably $50,000 profit on. I signed the property back to the seller for $500.00. I gave up my section 8 housing voucher. I am now homeless and have been for a year off and on. I have applied for a few jobs, but because my age 64, be 65 on May 9th, 2022. Also because I did 17 years in and out of prison. Then on top of that Social Security Retirement, paying in I took early benefits at 62 because I couldn't find a job after I got out in 2012. I did my whole 5 years on my 5 yr. sentence. I have been off parole since. I don't know who to trust. I almost hired this Veterans group then changed my mind last month. My Step Dad that gave written testimony on my Major Depression disorder claim, says I need to tell someone that I have gotten worse and am making major life changing decisions. I dont trust the Veterans Hospital or psych people. I had to appeal for over 10 years to win my first disability decision, can you help me please.

      Peace Brother This happen to me Was 70% Percent Aniexty 20 for ankle 30 for skin total 80 Percent went for TDIU And their severed my Pay from 80 Percent to 40 percent I'm in appeal process...

      2012 I was awarded 40%. In 2016, I went to file a claim for depression and bipolar disorder and was awarded 100% within 3 months. 2017 I had another C&P exam and thats when they awarded p and t. Most civilian docs are really for the vets. good luck to u brother.

    The big take away i get on this is NO MORE tinnitus UNLESS you have some other Hearing loss, or ear condition. This would eliminate a very LARGE % of future stand-alone) tinnitus claims approved....... On anyone that has a granted tinnitus claim now, without it tied to other ear condition you BETTER leave it alone if this proposal goes through.

    Question. I'm currently rated 50% due to Sleep Apnea. So.... I'm 'grandfathered' in. BUT... what if I'm called in for a '5yr' reevaluation. Will I be evaluated under this NEW SLEEP APNEA POLICY (If this proposal is approved) or will I be reevaluated under the old policy? (I.e. if you are prescribed a CPAP you are 50%). ???

      Great question! I doubt they will grandfather you on the 5 year exam. Please look into the new proposal for how Sleep Apnea will be evaluated and take the necessary steps to ensure your rating will not be reduced!

    I wonder if individuals who are already rated 100% for a mental health condition will be able to work, or if they will need to open a new claim to receive a new 100% rating under the new guidelines (to remove the "Total Occupational and Social Impairment" wording on their current rating). It will be interesting to see how this all unfolds.

      Well if they re-examined you they have to go off the most recent standards so if you are a 4 in any of the domains you’d still get 100% and then you’d be able to work. The VA is so confusing technically you can still work. You don’t have to report you are working or not. The point is the mental health disability is hindering your life and by these new standards I think it’ll paint more of an accurate picture rather than total occupational and social impairment, which just seems unrealistic. Unless you didn’t work at all not, not even activities around your home. And you’d also have to be mute to be totally socially impaired

    What if you are already 70% and on TDIU , And on SSDI for same issues. Seems to me you would be automaticly 100% Schedulare. IMO .

      The VA is not into just hand out stuff you have to ask for it sometimes fight for it someone asked me why my PTsd isn't permanent and total when I'm not improving it's because I'm young and they don't want to just issue it to me so I am going to file for permanent total

    I do agree that the C&P is important. In a short period, I had 2 appointments, one for disability and the other for TDIU. TDIU interviewer while reading notes from the previous was questioning why I wasn't recommended for 100% disability and only got 70%. The disability interviewer also seemed very uninterested in what I was saying and seemed to take some only in passing.

    How does medication factor so, if I did not have meds, i could not get out of bed or I would not be able to have relationships. so because I take meds I can - is that considered? Also, if I am an alcoholic but have been sober and only by going to meetings I stay sane how is the considered?

    Here l thought this video was about a change in the VA mental health! Still the same old pill pushers! All va mental health departments need a nutritionist to start with ! All mental health has done for me is given me a severe case of (VA Derangement Syndrome)🤬

    I have that impairment about every two - three weeks and only rated at 50%. Along with nightmares that keep me from sleeping. their criteria blows.

    I recognize that these new ratings could be good, but we all know that VA is going to make it difficult somehow. I just wish the VA would do what is right for the Veterans.

    Listening to you guys it seems my C&P was based on these 5 criteria. So they must be already doing the new procedures. I had my exam February 8th. I'm hoping all goes well.

      @@riotz8742 from what I remember because it's been a while now, they start simple asking you about basic information about yourself and ask how was it finding your way to the appointment and then moved to asking all the things about your life if you are struggling with anything and how often you struggle with it. At the end it was a lot of competency test like repeating after the examiner or saying things in a pattern if it's words or numbers. I'm sure there's something else but I'm not remembering. They gave me 70% 2 weeks ago. The turnover was pretty quick.

      @@colinblalock9125 they did not do none of that for me. Basically the lady was rushing me on, made me feel as though i was wasting her time, she arrived late did not even ask how I was doing and just ended the chat. It took about 20 mins but really pissed me off.

    Have these changes went into affect yet? Should someone who is at 50% but thinks they qualify for 70% under the new changes file for a review of their claim?

      No as far as I know these are not in effect yet, I'm starting to think they may not go into affect until next year if at all

    They must already be going by these ratings because I had my C&P exam for mental health earlier this month and the rater said that he was only going to ask me the questions that the VA wanted to know and my exam only lasted about 5 minutes, waiting on their decision now. 🤞

      If that happens again file a complaint for 5-minute exam that may not be that good file a complaint before the decision is made that the exam was only 5 minutes and you didn't get to stay at your part
      I hope it works out but sometimes The examiner just go off with they want to go off of and maybe not necessarily your records they could decide what I just don't want to give this person disability regardless of the records that's with the social security administration did to me

      @@thepoboy9698 try your regional veteran affair office find out who is the C&p examiner tell them the situation I'm not sure if they're going to refer you to like a patient advocate or they've got somebody they have to refer it at a higher level but I'm sure somebody in the regional office to your local VA would be able to help ---I would like to know the update when it happened sir I hope it works out I'm getting really scared about my C&p there's just so many horror stories about the examiner not asking about mental health or the actual complaint instead they're asking you what you watch on TV, but then have the nerve to reduce benefits when they should be asking the right assessment questions looking at the documentation. It's like some weird form of discrimination to where they don't want veterans to get benefits and they've made it in their mind that they're not going to give the benefits or even do the CP examination 💯 this is happening more frequently than I would like for it to happen but those situations are out there I'm sure there's good CP examiners so if you end up with results you don't like or you just want another CMP I think the regional VA office to where you live should be able to help you best wishes,!!!

    what if i am rated 100% p&t for schizophrenia and i do not have schizophrenia. how do i prove i do not need a high rating for any mental illness? maybe 10 tinitus and 10% back strain is all i have.

    Is the VA going to be open and transparent if the change occurs? What happens if the data trends to show an overall lowering of rating.

    How about someone who has debilitating emotional distress during the time of year between the holidays of Halloween and new year. The holidays for children … when in the service I this is going to sound weird. I had during my first tour of military duty a long term bad relationship with my first wife that at times became violently physical. The best way to describe it was battered spouse syndrome that was not spoken of because marines who suffered the physical violence never complained just swallowed … men don’t cry … they got the attitude of don’t complain it never happened. During divorce being accused of vile conduct and loss of a loved, wanted child but no help in getting even joint custody. Presents given to the child were either given away or not allowed to see the child even in photos wear or use them. In that way not allowed to share paternal affection at those holidays. How I handled was to work within the Masonic fraternity to share affection towards others but not my own.

    I'm 100% P&T so I'm not concerned about my ratings as I will not file any increases. IMHO, the VA has lowered the bar for 100% MH deliberately. But I definitely think they will start cross-checking IRS and earnings records (The hiring of some new 89,000 IRS agents should be a clue). The VA will be able to see who has a 100% rating and whether or not they are gainfully employed. These vast VA changes will have more impact than veterans can imagine.

    How does a veteran obtain a PERMANENT DISABILITY RATING? The disability has to be shown to have existed for 5 years or longer?

      It will be indicated as P&T on your paperwork OR the passing of time (10 rule, age cutoff, etc). If you don't have it, they think you COULD improve.

    Or unless the VA schedules you for an exam. Then you will fall under the new changes. That’s how the VA will get us who are grandfathered.
    Plus last year and before my 5 year mark they scheduled me for 2 exams and afterwards they combined my PTSD and TBI. They were two separate ratings before that. 🤔.

      The explanation I've heard about combining PTSD and TBI stated that many symptoms of TBI carry over into PTSD; therefore the examiner cannot determine whether your symptoms are caused by PTSD or TBI (without pure speculation) and combined them (sustaining the higher rating of the two).

      They worked for it they earned it they deserve it I hope every veteran that falls under those categories apply for it the VA has the money but don't want to pay out if they don't have to some veterans are too embarrassed and some are just won't take the time to apply so that frees up money right there there is more veterans that deserve it that don't get it that get it but dont deserve it I'm sure

      @@blindsey1043 I applied do you my list of income from having a brain injury I wanted to be a cop after the Army but when someone hits you an Ax and fractures your skull your left with many disabilities and short term memory impairment. So I was disqualified from Law enforcement I tried going to College using my GI Bill but my memory was so F up

      Make sure you have absolutely everything documented from you being in the service and out and do not exaggerate anything their are a lot of veterans that need lawful compensation some have snapped on their families as I have and the va makes you wait months sometime win rare cases years as long as you are honest snd prove your case with a lawer the outcome should be granted again every case Varys
