    Would be terrible of the VA to take away your P and T then you lose your champ va for your family, dis-enroll your dependents from their college, have to reverse all the state benefits like property taxes,etc etc.. and they wouldn’t lose a minute of sleep. No wonder vets commit suicide when their benefits are stripped.

      @@timothyberlinski2299 ChampVa is medical for your dependents and chapter 35 is college assistant. Money for your dependents to help with school.
      Unless you have TriCare. Then va is only for you.

    I feel like some of these vids are made to trigger vets into watching them. I'm 100% P&T and just seeing this in my feed gives me physical anxiety. Take my benefits away and you'll all see it on the news.

      Bingo.. I seen you post over at the other guy's TH-cam vids as well. Listen..T&P or P&T whatever they want to call it means just that..if you're not giving them a reason to reevaluate you..ie filing a new claim.. fraudulent activity...being convicted and encarcerated of a criminal offense after X amount of days ( can't remember off the top of my head)..then my brother in arms you're good.. live your life and hold it in the road as best as possible..

    My primary care VA doctor reported a so-called 'improvement' to the VA based only upon part of a conversation we had during a 'routine' visit. I had to file another claim to correct the information and get my rating restored. I do NOT trust VA doctors to have my best interest in mind when treating me.

    I had a 10% rAting for 10 plus years and then. 20% for another 10 years. (Left shoulder) after about 20 years with this left shoulder condition I applied for an increase and it was determined that the left shoulder was the cause of some cervical and lower spinal. Long story short I ended up with 40% shoulder, 20%, neck, 20% right nerve, and another 20 for something else. It ended up being 80%. Then I got tdiu with back pay totaling 120k. I had no lawyer (I don’t think they had lawyers back then) the point is the VA does not always rule against you. I never thought I would get the 100 in my wildest dreams. I was only trying for 40% for the shoulder at best. I read all the small print for each condition and made sure my language was in line with the regs. All my injuries are legit, but your wording in describing your injuries matters. Had I not described my injuries/limitations without reading the small print, I would have been lucky to get 40%.

      Was denied for 14 years and in in August 2023 they gave 60% for hearing loss and in February 2024 was given 100% for my heartP&T under the pact act

    I am at 60% which is my allowable service connected benefit. The best way to not get reduced is to stay in the system being treated. If it has been determined that you won't get better or that you are getting worse it is hard for them to reduce you. It took me almost 20 years to go from 30% to 60%.

    Question to those sating, "don't start a new claim if you're at 100P&T." So, I just found out today they granteed my EDS at the 100%P&T. However, when I filed my jnitial claim, it had like 11-12 items on it. This morning I had a telehealth C&P for depression & anxiety that was already on the books. Same with another upcoming C&P on the 18th of Aug, for loss of use of all my girlie bits... would these be considered a 'new claim' tbat I should be worried about, even though they were both scheduled by VA prior to this evenings new Rate Increase Update?! Or, would these preset appointments potentially add even more to this current rate? Help!!

    Thank you for your instructional videos! I am in process of a claim for PTSD and other mental health issues. I am currently working with a law firm. They are doing this on a pro bono basis. I did receive a reward for 10%TBI. I am thankful for what they have been able to accomplish, but they are limited when it comes to what they are going to do (probably because of pro bono). I have a long story and if I could maybe be in touch with someone from your firm?

      You should be good to go because you have the 20 year rule which is they cannot reduce rating unless it’s proven that fraud has been committed

    Good information. I retired in 2010 after 29yrs and was rated at 60% after 18mos, then increased to 90 after 2.5yrs. I dealt for 10years then hired an attorney in Mar 2021 and sent in original records and ten years of additional treatment/surguries and was awarded 100% P&T in Dec 2021. I'm 64 now.

    Was 80 percent went out on t&p iu 16 years ago paperwork says no new evaluation. Should be safe as long as I do not ask for an increase like for my wife took me 30 years to get this rating. Thank you from an old Marine

    63 years old at 80% But have TDIU P&T for two years now ..... Will not file any more claims .... Would that mean all good on them not messing with me any more , Suspiciousness is one of my many mental issues.

      I agree you should be good but make sure that you stay in the loop with the VA. My primary doctor hadn't seen me in awhile so she had me seeing a psychologist to get treatment 😐the bright side to that is you're getting treatment. I'm pretty sure that we both agree That it's worth it

    I’m 100% P&T since 2015. Now getting ssi is the hard part. Va benefits were very easy to get

      Your not eligible for SSI if you get 100 percent since you make too much. SSI is a needs based welfare program. You can get SSDI which I think you meant but it can be hard to get.

      Get SSDI is very difficult to get approved but it can be done. I’m 💯 P&T with no future exams scheduled and was able to get my SSDI approved in 9 months completing and submitting the application and all medical documentation on my own. After seeking an attorney to help with this and finding it would cost $6,000.00, my wife and I decide I should do it. I just submitted my application and all medical records they requested. Attended two medical appointments Social Security scheduled and after 4 months I was approved.

      @@BLKKNT2 I have my final appointment November 7 & hopefully it won’t take long. Heck I had open heart surgery in March & it’s been hard as heck. With this crazy inflation & gas. I have so many dang drs appointments & cardiac therapy three times a week. It sux we have to wait to dang long. I did my claim in February before my surgery

      I guess I was stupid lucky I got ssdi about a year before I got my 100% rating it only took me 2 weeks to get ssdi approved I was totally surprised when it was approved with 12 months of back pay as well this was in 2013

      Issues they give it to you. I hit it. My spine is fused from T12-S1. 3 Spinal surgeries proved my case.

      You can’t have both.. TDIU can and will be reduced sooner or later.. 100% P&T 99% of those files will never be looked at again

      You can’t file a VA claim with a lawyer. You can only file an appeal of denial with a lawyer.

    Hi I'm 100% P & T I was wondering I am at 8 years on a disability that is 100% we scheduler.i know it is not necessary to filee a.claim for benefits, there is nowhere to go, but I want things documented that they are service connected I have sever osteoarthritis in both my knees I am walking bone on bone, I was a paratrooper in the Army and between that and the running my knees are just a mess, same with my ankles and my back 10% on left ankle, 40% on back. My question is this if I put in for a rating on my knees, I have a document that talks about the tactical athlete, that shows whatever did causes joint issues. Being airborne infantry, they gave you bags of 800mg ibuprofen, and you took that instead of going to sick call (you already had the Motrin that hey we're gonna give you anyway) what can I expect going into a claim for my knees?

    No matter what these lawyers say. The only time the claim that is safe from evaluation is after your have it for 20 years that even includes T AND P RATING.

    Also if you have been 100% for 10 years you do not have to die of service connection for wife she just needs to file for DIC and not surviving spouse.

      You have to have 100% P&T for that scenario. If you’re not P&T then no they do not qualify for that nor chapter 35 Vachamp etc

    Hi I had a brain MRI from a private provider and they said I had mild cerebral palsy. I had no idea that I had this condition when I joined the service and found out when I was 40 and I am 51 now and I am 100% permanent and total just wondering if I should get treated with this condition at the VA or do a private provider.

    Great presentation ladies. I no doubt will see you down the line. My rating is 100% for T2 urothelial cell carcinoma of the bladder. After 2 surgeries I have been clear for the past 1 1/2 yrs. Following my 1st surgery it was 3 years later it re-appeared. Don't know what to expect but will ask for your help. Thanks

    Ok.,I'm seeing you. In 1969-1975. I was in US Army. My rate was 80% .now after 50yrs they said that I was not service contented. Lost all. Butt now they tell me I'm 30%. Butt no Benefits. And they are telling me I have to go through more exams.

    I thought the VA disability for many many years in October 26 of 2022. I had to have heart artery heart valve replaced and a AAA aneurysms surgery and now I am steadily losing weight have no appetite still can’t walk that far before I start really limping bad which then aggravates my back I am sad to have an administrative hearing March 10 of 2023 now what should I do because I am tried to get in contact with the VA person at Bay Pines medical center in Saint Pete Florida and nobody will even return my phone calls, which is normal because many years ago I got blackballed by my doctors

    They reduced my 100% rating for asthma. The only real change was that the allergist/ d/c a medication. I haven't been able to work for five years....and mostly definitely "have not materially improved under normal conditions of work and life...Persian Gulf/ burn pit exposure with a claim in for several conditions, and very seriously considering seeking legal representation...

      Did they actually reduce it yet? If not then file your appeal ASAP. I was rewarded 100% in December after 7 years of filing for increases, then they sent me a letter saying they will be severing some claims 2 weeks after getting my 100% rating. I just hired a rep to handle the appeal process for me. The VA is incredibly frustrating to deal with.

    I received a 100% disability for Ischemic heart disease attributed to Agent Orange in 2013 after bypass surgery while in Wisconsin. I previously had 3 stents. Shortly before I moved to Texas in 2014 I had an exam which showed no change from the previous exam. Additionally, I had to have a second operation to repair the incision which had come apart shortly before the exam. After moving to Texas my benefits were lowered from 100 to 30 percent. Then after my second event which was in July 2019 I received another stent. After that I received 100 P&T. My question: It is acknowledged by the medical community that Ischemic heart disease it is not curable and it will only get worse, so shouldn't I have maintained the initial 100% since the bypass surgery. If it should have what do I need to do now? If I file a claim does this not open Pandora's box to run the chance of having my benefits reduced?

      If you are already at 100 percent P&T then I would not file another claim. That gives the VA the right to go inside your medical record and review whatever it wants and they can find things and lower your rating. Leave it alone and go after more claims when your total 100 percent rating is fully protected

      @@Darkempress45 I apologize for my lengthy narrative before, I may have muddied the waters. What I was trying to say was: if the disease is incurable and it will only get worse, when I was rated at 100% how can the VA justifiably reduce someone’s rating? You aren’t going to get any better. This goes for all those vets that have been already rated at 100%.
      In my case (for example) when I was rated at 100% it should have remained at 100%. There are no do overs for incurables.
      At 76 I am not expecting to make it to a time when I am protected against reduction, I am more worried about benefits for my spouse.
      It just sort of sounds like grounds for a class action to me. By listening to this video it sounds like there are a whole lot of folks in the same boat.
      Sorry if I was sounding like it was all about me thing. It was supposed to be a general question.

      I don’t know where you got that information but ischemia heart disease is mostly caused by clogged arteries due to poor diet, lack of exercise, over weight, etc . What the va stated on that topic was ‘presumptive’ but in reality no merit really as far as a direct culprit hence why the fluctuations in ratings in that regard. My advice to you is take 100% T&P and run for the hills and be happy. You can run the risk of having your claim re opened and running into a competent cardiologist who actually knows this specialty and bring your rating down lol

      Can they? Yes. Will they? No, not if you don't give them a reason to look at your file, like filing a new claim. Or filing for specially adapted housing grant which is considered an increase claim.

      Jose one of the best ways to show any treatment that you may be receiving outside the VA is to message your primary care provider in the VA using secure messaging inside my healthevet to update them with what you are having done. I attach my progress notes from my outside providers to those messages which in turn makes it part of my VA health records. I also send all my treatment records to my representative to make sure they have records too.

    I already have a 70% Viet Nam related rating. I was diagnosed with prostate cancer at the VA IN September or October ‘21. This is supposed to be an automatic 100% rating. I completed and entered a claim for this in November ‘21 and had my nurse interview in December ‘21. This is now almost September ‘22 and I have not yet heard from them. That is ten months without a decision. Is there any way to get a decision? Thanks a lot.

      Tell combat Craig he has connections. After I got my 100% they were still playing games this was Jan.. 6 2006. I actually worked in the Federal building in Nashville. Said they had to have my last day of work. My work records were archived with OPM WHO IS OVER THE WHOLE GOV. After 7 months the commissioner of the state VA was at Kesahn when I was I had turned in 7 boxes of records on my last filing my Gov. Retirement Social security I got in 2& 3 months. If u got lawyers etc. They would just through your records aside. I found the letter stating they had my last day of work. The State va was bringing in the OIG on the following Monday and used my case as an example of their stupidity and negligence. I got a call at 9:00 Monday morning case settled. He also cleaned the VA admin. In Tn. Out. The VFW IS GOOD also some state reps. The Vietnam veterans league. I have only had trouble 1 time since then I have contacts in DC but there is a helpdesk no. Which is actually in the White House. This had to do with my CBOC BEING TAKEN OVER BY NEW CONTRACTOR problem was solved in 2 days. There are some good people in the VA now but still plenty of pticks. The new director seems honest and so does Biden as far as the VA goes. Where are you?. Good luck am trying to get you that no. I worked in computers many years a go they don't like me now. I understand the wait time is about 10 months now also us Vietnam Vets have been moved back again for all the new ones?

    Ive been 100%, they finnagled my ratings, increased my ptsd to 100, and onece I hit over seven years of 100 ptsd, they reduced me to 70. Im owed backpay for over a year, for two dependents. I missed an appointment because they cannot get into contact with me. Im the international, I'm refusing to live in The USA, and I'm turning 40 in a couple of months.

    I'm 73 Vietnam veteran, have stage 4 prostate cancer, matasized into my bone and is spreading. Also lesions in my left lung. Had so far, chemo, radiation treatment on bone, fusion on bone. Radiation and chemo caused nerve damage, neuropathy in feet and hands, now numbness in arms and back. I won an appeal a couple years ago but worry they will come back and hit me with reexam. I'm still at 100% for now but it's still temporary as far as I know. Cancer isn't getting any better. What are the odds they'll cut my 100% rating?

    Well, this video sucked inasmuch is it causes us to lose sleep at night wondering if there's some bean counter at the VA looking for a promotion, and the promotion will depend on how many Veterans he gets their ratings yanked or close to zero. I guess it is better to know that the VA can come gunning for me, but I'm kinda regretting playing this video.

      Your rating document should say whether or not your 100% TOTAL and PERMANENT if your total and permanent they can't take that rating away from you

      How’s are they ‘fear titles’ when it’s the honest truth? The democrats will be looking to reduce funds for the va very soon and this will most likely trigger cases being reevaluated and benefits becoming more difficult to obtain. I know vets that have had their 100% ratings reduced this past year

    100% Disability was designed for Combat Mos Veterans! But since Army and Marines primary mos’s is infantry! Others Mos’s qualify. But if you Served in a Combat Mos for 90 Consecutive Days, you qualify for P.T.S.D. if you have a Loss of jobs, divorce, incarceration, homelessness, unable to cope, isolation, YOU MUST BE MEDICAL INDUCED DAILY. it’s so much more, get a NSO OFFICER.

      ptsd dose not always involved combat there are other situtations that causese ptsd ie sexual assault other tramatic experinces war and war related situations are 90 precent cause but 10 precent are other non combat releated matters

      Your absolutely wrong saying 100 percent disability is only for combat veterans. Also you can get PTSD for non-combat situations such as an accident or military sexual trauma.

    Correction...if a veteran has total knee replacement on a sc 10% knee, VA increase that knee to 30% from 10%. Also, due to one 100% for recouping for 4 months you get SMC-S for the 4 months.
    The VA increase to 30% is permanent...no reduction.

    I was at 70% after 3 years It went to 90%, after I had 5 bilateral knee replacement with left knee was infected during surgery, my left hip is painful when I walk, applied and got 100% P&T just last month, at 69 years old I hope they don't downgrade my disability.

    What if you have a rated primary that's static and it's been less than five years and you want to file for a secondary? Does that open you up for a possible re-evaluation of your primary?
