Bull crap. Marsy's law WEAKENED my state's victim's rights. The previous laws REQUIRED the DA to notify the victim of a crime of all court proceedings. Now you have to request notification, and if the DA forgets to tell you that you have to request that - oh well, too bad for you.
That's not true, unfortunately I've been a victim of a crime and you do get information in a victims rights booklet you get a card from the officer what the case number and also a number to call. So what are you all talking about?
That little blue card means nothing. They give you an advocate to, but what does the advocate do? Nothing...What my advocate told me was that if he would’ve killed me he would’ve gotten away with it. Now as a victim would anybody want to hear some shit like that. That happened seven years ago today I’ve had to have surgery and I come to find out that I had a fracture that had calcified and was putting pressure on my cervical spine. Meanwhile the case never want to trail.
This is super misleading. People accused of a crime are not given a "right" to voice their defense -- sometimes they're never allowed to testify in court. And when someone is released, there's usually a lot of restrictions on their freedom, including where that person can live and who that person can talk to.
You always have a right to testify in your own defense. Its well known that its probably a bad idea though and so many choose not to testify in their own defense. I have never heard of someone WANTING to and not being allowed. Public defenders are offered and if you're just getting out of prison for rape or murder, I sure as hell don't want that person living near me and especially if it was ME they raped and not to even be told they are out? pshaw lol
Just came from a video about a women who killed her child but is protected under "marcys law" and can never be identified, allowed to simply go out and have more children. So much for any consideration about the victims.
This is on the ballot for KY. I don't mind getting info about court dates etc. and notified on release of accused. I'm not really a huge fan of victims being allowed to speak in the court hearing though. That seems like it could be problematic. They should be trying to determine if the accused is guilty of the crime, and what their punishment should be. I think allowing emotional speeches by the victim might prohibit the jury and judges ability to make a fair judgement based on facts and evidence. A very emotional victim might cause a lengthier sentence on the accused while a victim showing little emotion might cause a shorter sentence.
re: Lauren case - she and her daddy had all the info - and do u really believe the nanny got a fair trial - no way - and where were her parents all those years ??? Shouldn't they have taken responsibility or lack thereof ????????
This law is unconstitutional and banks on the support of misinformed, emotional, bloodthirsty people. This law infringes on the rights of the accused because "victims" are sometimes no victims at all.
Or say the victim is actually the criminal and they try to harass the actual victim who is out on bond facing false charges then the actual victim is stalked and set up by the liar victim and the actual victim goes back to jail losing their bond because of another lie by the liar victim, did nobody think about this? Apparently not, I oppose Marcy's law because of the lack of logic and common sense in this area.

The word OFTEN was used. There are thousands of people victimized by criminals each year, I'm sure there are times when no information is given.
