"It's Improbable He Will Face Trial" Chris Daw On The Russell Brand Allegations

  • Piers Morgan Uncensored is joined by Daily Mail columnist Sarah Vine, associate editor of The Mirror Kevin Maguire and lawyer and broadcaster Chris Daw to discuss allegations Russell Brand is facing and whether it is justified for the 'court of public opinion' to have made their mind up on the celebrity already.
    Chris explains that he feels it is "Improbable" that Russell Brand will go to trial for these crimes simply because it was 10 years ago and the lack of physical evidence that will be needed to prosecute in these cases.
    Sarah suggests that this is the result of Me Too movement and is an example of powerful men being held accountable and believes since this movement, men's behaviour towards women has changed in places such as the workplace.

    If only the same level of media concern was shown against the Grooming Gangs in places like Rotherham, Telford, Oxford etc. Those 1000s of young girls deserve to be heard and have the national scandal of those mainly Pakistani men brought to tougher justice.

    U know whats interesting about all this. I couldn't stand Russell Brand back then, i thought he was gross. But the very people goin after him now are the ones who loved him and egged him on, telling him how great and wonderful he was.
    Now he's a different person who i quite admire, the very people who used to love him are the ones going after him.

    This was not the result of people “speaking out.” It was the result of two media outlets colluding to question as many women as they could who had contact with Brand and taking forward as a story only those who agreed to claim some negative trait to their time with Russell, particularly any hint of any level of coercion or lack of full formal consent being involved.

    The women should have gone to the police FIRST, and if then they were denied due process, go the the press SECOND, and the story would be about police and the legal system. By going to the press FIRST, there is no due process, no defense, complete spin. The saying in the US that "a DA can indict a ham sandwich" applies here. Morgan's "editor's hat" is more about a story that sells than a story that tells a balanced view.

      I am not actually sure these women went to the press... it is possible they are soon to be "double victims" here ...I think is more a case that the "press" sought them out, and built a story around their account which the Documentary Producers shaped into a compelling narrative ( with emotive background Music) and using actresses ( which they openly disclosed on the Documentary) they presented a performance designed to make an impact ... the best Russell can do is have a day in court... painful .. trial by media

      It is unlikely to happen in the UK unless the journalists have completely fabricated things and/or ignored serious red flags for witness credibility. Libel and slander is very very hard to prove in the UK as the standard is that the journalists had reasonable belief that they were being told the truth.

    Sarah Vine is spot on with her assessment, and I totaly agree with her , Brand is unplesant narcassistic and clearly a lethario of epic proportions.     I would personally advise people to edge on the side of caution when immediately believing these women, and I talk from experience. My Son's Mother was making spurious claims about me to her friends and social services after our son was removed from her care, along with his siblings, (not mine) for abuse and neglect. Social services documented that my son was a rape baby, without evidence or a police investigation, which is disgusting. She has never directly accused me to my face, and refuses to give a statement to the police. After I was informed of her lies, I myself went to the police and they immediately launched an investigation, spoke to her and asked me to attend a voluntary interview, which I had no problem with. When the police spoke with her, she was shocked and asked how they knew what she'd said, she refused to give them a statement and begged them not to speak with me, but of course they already had as it was me whom went to them. Now, what she didn't know was that they already knew she was lying and that she made it up to attempt to prevent me getting custody of our son. Stupidly, she sent one of her friends a message and told them of her plans, which the police retrieved and later told me that the fundamental reason for getting me in for an interview was to actually protect me, not prosecute me as they knew I was innocent already, and I truly thank them for that, it was a brilliant bit of detective and police work. She has since been arrested for three offences, domestic harassment, perjury as she lied in family court under oath, and attempting to pervert the course of justice.
    I was completely innocent, I am completely innocent. She made up a rape allegation assuming it would prevent me seeing my son, but it didn't work. Social services did of course run background checks on me and assessments, which I was okay with as I knew they'd find nothing. What I didn't know until recently, it isn't the first time she's falsely accused a man of rape and or sexual assault, she's done it before but the police weren't able to tell me about it at the time, but have done since.
    I don't know what will happen to her in court, but I hope she's jailed, and although she's my Son's mother, I have no regard for her what so ever, not now, not after she tried to ruin my life for her own twisted and sick agenda, she deserves to languish in a prison cell to protect the public. People like her, are the reason why genuine victims cannot get justice, and it's wrong.
    I am not saying Russell is innocent or guilty, I don't know either way, but I refuse to immediately believe his accusers until tangible evidence is produced and he is charged and convicted by a court.

    My issue is this... Would it not have been more prudent to do the thorough expose AFTER his trial and CONVICTION-NOT before.
    This isn't about caring about how these women were treated. I was with a severe and abusive narcissist for 4 years. He used me, lied, cheated hurt my family and destroyed my career.     Introduce a statute of limitations on claims of rape or sexual assault. After it has expired one is not entitled to make an accusation against another.

      I am aware of that. I am equally aware of situations where accusations are made and lives and careers ruined when spurious, unfounded and false claims are levelling decades after a supposed event (never) happened. If one feels wronged, then act on it and make the accusation in a reasonable time frame. Don't wait for some unscrupulous journalist to make a call, offering an financial inducement.

      They did a 4 year report on it, (2010-2014) but it wasn't splashed all over the media for days. I don't think there was a TV documentary about it. The way I found out about it, the Northern Reporter that carried out the investigation was featured in a YT video after the fact while doing a presentation at some kind of conference and the matter was included in it.

      The testimony shared in the documentary revealed they were working at CH4. Listen to it again. The only aspect of annonymous is their names and some people were playing a part in the doc. However, if we take what was said literally by the people that spoke including the interviewer you will find it clearly said. @@1574john

    There wasn't forensic evidence in the Saville case but the verbal evidence was still believed.
    Why does forensic evidence come into historical cases when there is really only verbal evidence.

    Law & Morals
    If the law says no crime between consenting people after the age of 16, then that aspect isn’t a crime,
    The only discussion that needs to occur is, was it forced, coercive or criminal under any UK law…
    That’s the investigation here, not “moral age of consent”

    I am all for justice, but I think these "Historical Claims" are a joke.
    The fact that someone, anyone, can say what they like about a person 10-20, however many years after the alleged incident and immediately that person is classed as guilty, really is not right.
    What happened to "Innocent until proven guilty"?
    As far as all these claims go, that law has gone right out of the window.
    The other thing wrong is, the one doing the accusing can stay anonymous, while the one being accused, is plastered everywhere for everyone to see and if the case is dropped, it is "oh well, no harm done to the accuser", life goes on and the one accused has their life in ruins.
    Anyone with a a vendetta, or grudge, or that wants to get rid of the accused person, can come up with this and no prosecution to the accuser if the accused is found not guilty in a Court of Law and the accuser is allowed to just walk away and even if the accused is found not guilty, in the eyes of quite a few, he is still guilty and will always be classed as a Rapist and a person that Assaults others.
    Is that right, or even just?
    I think not.
    On a footnote: why is there a Journalist (Woman) in some of the videos encouraging people to go to the papers and not the Police?
    That is all wrong too.

    I found it disturbing that what being passed off as news journalism is using Actors in the video clips rather than video of the actual accusers talking. Imagine if that was allowed in the court of law? Whatever the merits of these claims, this in itself is an unacceptable for a news piece. Actors belong in docudramas and fiction, not in news.

    The simple thing to do would be put a law in place where the media couldn't publish any articles or opinion pieces about crimes like rape, until the accused has been found quilty and has also ran out of appeals. Do that would allow any innocent people who have been falsely accused to avoid having their entire lives ruined, as once you've been publicly accused of a horrific crime like rape, you'll forever be quilty in a lot of people's minds.
    Also having court cases be the accused trying to prove that the accuser has made a flase claim (if they have done so) would go a long way in taking such allegations seriously, especially if being found guilty of commiting a fake rape claim carried an automatic prison sentence.

    Those who are defending Russell are not defending his bad behaviour in the past, but rather his right to be given a chance to defend himself against allegations.
    If there are criminal accusations then this should be a police and court issue.

      Spot on!! This should never have been aired on television either, it should be made a criminal offence. The TV company should have gone straight to the police with their findings, not aired it until a fair trial has been had. They don't care one iota about the 'accusers'.

    In my previous job, we had a father turn up to have it out with a 34 year old guy who was dating his 16 year old daughter. The father attacked the guy and the police were called. To cut a long story short we were told it wasn’t a police matter because the daughter had consented. She outwardly said to everyone she liked the guy. I remember thinking I thought 18 was the age on consent.

      Well, hang on. Chatting up a 16 year old on the street isn't illegal. Sending a taxi to her school gates isn't either. Neither is asking her to save his name in her phone as someone else isn't and coaching her what to say to her family also isn't. Yet, it is predatory and hints at grooming and most people in the country will find it creepy, or worse. Yet, no crime. Now, does Brand have an automatic right for that experience to stay hidden forever because it wasn't a crime? This is a guy who is discussing some quite far out there theories on his channel without a shred of evidence in case of the Maui fires, for example.
      If he is found to have done as outlined to that 16 year old he will be automatically convicted in the court of public opinion for everything else, even if they don't go to court.
      Of course, it might all be nonsense and this open secret thing we hear about is a complete nonsense based on numerous instances of hearsay.
