When it came to the movie “when they see us” the actors and producers worked closely with the victims for accurate accounts of the events, even though their story was already public, they were carried along with the making of the movie, even the press conference, premier, awards on the movie.
I feel pity for this lady and if what she is saying is true this, I hope they do right by her and I wish that she eventually finds closure.

Exactly! When Chadwick played James Brown, even if it's on Netflix he worked very closely with his fam. He went to his hometown in Carolina, visited his place in ATL etc. He's daughter held a service for him when he passed away. That's respect and love. Well its 9ja anything goes. I'm sure Mo knows better not to do this mess in the States and now , we see why the movie ended the way it did. No one knew the outcome of Oloture.

They missed out on an enormous opportunity to tell a great story! As a writer myself, this is disheartening to say the least. You put in all your time and energy to tell a story and it gets plagiarised. She needs to be compensated. Tobore, write your book, it will travel even further, and who knows, a better and bigger conglomerate will offer to tell your story.

They also claimed production started in 2018 but only contacted Tobore in 2019, O wrong nau!

I can't express enough my pity and concern to this brave lady. On a good day, MoAbudu should be compensating this lady, big time! Then, in a law court, facts are discussed. First, MoAbudu claims she bought the story. The fact that MoAbudu contacted this lady prior and during the making of the movie shows that Mo isn't telling the entire truth, cos you couldn't have bought the original story and still went to the rightful owner of the story... It doesn't add up. Mo must have got extra information from this lady, and very painful enough -- claims the story was bought. That lie can't be bought by any sensible Judge. But having said that, Mo has chats with the lady, which somewhat shows there was cozy relationship up until the release of the movie on Netflix. This is where the court would side Mo. For the lady to demand compensation shows that something somehow went wrong in her relationship with Mo. I hope she gets a good lawyer to fight for her. Cos the rich can be very very greedy.

I read the article on her ordeal in 2013 on premium Times if I remember correctly. When I watched Oloture I knew it was her story but I thought she must have given the story to Ebony life and was part of the movie herself. Am surprised to hear she wasn't credited, thats sad. Cos I remember this story, the difference between the movie and her story is that in the article she escaped at the border but in the movie she was caught trying to escape. Even the killings of the girl by the madam at the pool side was described in the article. Am very surprised at Ebony life but will like to hear their side of the story

    • @HumongousMan
      @HumongousMan 3 ปีที่แล้ว +1

She and Premium Times were credited on the film. What is an issue is monetary compensation to her. However, according EbonyLife, the monetary compensation part could have happened if the film had gone to theaters but this couldn't happen because the film went straight to Netflix.
This is what i think should have happened:
      1. Her contract with them should have covered all grounds.
      2. She should have contacted Netflix with concrete evidence instead of demeaning the company in this interview.

Ebony's comment you will find on Mo Abudu's instagram handle. It's sad really, but in winning this case, I hope she has evidences or like contract copies, in order to back up this emotional side. Otherwise, Ebony will continue with the claim that there are similar stories as this and not hers completely. Like for me, I keep thinking was there a time she sat down to tell them the story and was recorded by all the film makers. Like you know how oyibos do it na. I don't know much, I have just been thinking how she can pursue it legally, asides the interviews. But in all , I pray that justice happens and the rights of all in this is duly compensated.

This is like a story of her life that is nothing so close to a normal story but a serious criminal activities that involves homicide, exploitation, human trafficking, sex trafficking just name all that does exist in the underground world. What I am still baffled about is when investigative journalists are working on a top notch dangerous topic like this, do they work all alone or in conjunction with the security apparatus of the State or to what principal achievement that could make people to embark on such project, I don't want to believe it was for movie making or to benefit from the lucrative aspect of the story that is by the way because with the engagement of the security apparatus she already got all the coverage of the authenticity of her story covered that could implicate anyone that breach that rights of the intellectual property that she owned exclusively. Secondly how did the story slipped into the hand of the producer, was it duplicated from any journals or how?! coz I didn't get that part. Lastly in the real sense of the matter, why do we have these devilish, satanic, reckless inhumane people that have no respect for human lives in our society?! This is a serious problem we are dealing with in this society and it seems we are only interested in the money making of every aspects of our lives, even if it is to kill for a meager of bread there are people that are willing and on standby for it. What is wrong with us, this could happen to anyone of us but we always take everything so lightly. So seriously I am more scared of my fellow compatriots than the government we all intend to attack all the time and accused of wrongdoing. We have a long way to go in #Nigeria like so seriously.🤔🙄😱😭😭😭😭

  • @jenniferd.7646

The article she wrote about her experience entitles her to copyrights and moral rights. Someone may dispute this fact and say: "1) she transferred her copyright to her employer 2) moral rights do not exist in Nigerian law."
Yes in case she has transferred the copyright to her employer, she cannot claim compensation nor royalties on this basis.
However, she has grounds to invoke the violation of her moral rights which are: her right to disclose the story, her right of attribution (right to be duly given credit), the right to the integrity of her work. Such rights are found in civil law countries. Yes it may sound like I am speaking Chinese to some Nigerian lawyers. But I am pretty sure Nigeria has ratified the Berne convention which enshrines moral rights. Finally, she can argue the (psychological) injury suffered, resulting from the release of her traumatic story without her consent. So this woman may have a very strong case.
PS: Moral rights are not transferable and any contractual clause stating the opposite shall be null and void.

Mo has quickly gone and done interview with receipts she kept. Talking about how there was no contract. She may be big and well connected but she is profitting off people's pain and blood. Her children anf grand children will experience such. That's for sure. Zero integrity. If she was a Nigeria leadership, she will do worse. Oppression and suppression. Forget court of law, you know what is right, do It. The same way Kiki and BBC. People should just learn how to protect their intellectual properties and monetizing it. This is why employees don't like to put in their best, because they know employers are cheats! Nigerians preach religion all but are stepped in lies and cheating.

Publishers do not have perpertual rights to authors works. Its is usually time bound through a licencing or IP transfer agreement. If premium times contract with their journalists are not time bound, then they are exploiting their staff. Also if her employment contract does not state in express terms, an intellectual property transfer clause, then she has a good case. Besides that, its only morally right to compensate the author to such a sensitive topic.

If you have they copyrights to the article, then you have a fantastic cause of action in court. However, if you were an employee of premium times when you wrote the article then this is a pure case of work for hire which means premium times owns the IP for anything generated while employed. Go through your employment contract to see if there is any clause to that effect.
