    Mam, I have one question to ask u, is the term license fee used in place of rent qualifies to get the form 16 from it's employer by salaried class people on submitting the receipt given by the landlord/ licencer. Even the ITR form does not contain the term license fee in place of house rent for HRA exemption.

    Lessee can get an injection against eviction is Lessor tries to evict against the agreement terms but a license can't get such injunction. Licensee at best ask for compensation for premature eviction without any default in his/her part. This is another major difference between lease and license

    What about the duration of leave & license agreement? Period of 60 months as maximum period of leave & license is true or a misconception?

      as per registration act nothing directly is mentioned regarding the maximum period of leave and license. Also in maha stmp act, stampduty for leave and license is same as lease if executing for more than 60 months. SC in judgements held the diff betwn the two lease and L& L can be figured out of course through the intention of the agreement and also terms.

    Mam are the formats of leave and license or the rent agreement for 11 months prepared by the typists sitting in front of the collectorate on 100 or little more amount stamp paper and certified by the notary LEGAL or we need to register in SDM Office.
    Becuase in Manesar/Gurgaon the stamp duty is very high about 1% as compared to Maharashtra where it is much less as you said. So if the owner is giving his property on rent on Leave & License mode, as per 1%, stamp duty/registration charges would be about 15000/-
    Please guide.

    Madam, in LLA the premisses is given for use and no possession is given to the licensee... Now in such a case if a LLA is registered, won't it amount to giving up the possession of the premisses, as the registration is required when the premisses is transferred by way of sale or lease...

    hi madam, can I do rent agreement for a period of 11 months and 29 days, so that as per interpretation of Sec.17 of Registration Act , it will less than 12 months period. Is it OK or I have to do agreement for 11 months not 11 months and 29 days ? /

      Yes. But apart from the Registration Act, you need to comply with the provisions of your respective state stamp act also

    Mam one question. If its for commercial and taken for more than 2 yrs then when should we start increasing the fees i.e. after 11 months on 12th month or after 12 months from 13 month??
    Like should we do 11-11 months agreement or 12-12??

      If an agreement of 12 months or more is executed then stamp duty has to be paid, so to avoid stamp duty 11 months agreement is executed .
      but in case of maharashtra you have to pay stamp duty in both cases
      so 11 or 12 doesn't matter

    I have a question
    Suppose I have informed my owner 3 months in advance that we are going to vacate the flat
    So we won't pay rent in last 3 months to settle with security deposit
    But do we need to pay maintenance and electricity bill during these 3 months or owner should take care?
    We don't have any rent agreement

      you have to pay electricity bill charges till the time you "occupy" the premises.

    There is no legal restrictions in entering into long term license agreement. Therefore this comparison on the basis of tenure is not valid .
