In England, some employment has to have a suitability check perfomed by an organisation called the Disclosure And Barring Service (DBS). This is the acronim for the check that is carried out (formely called a CRB check) and checks a persons criminal record. There are however different levels of checks, one which can even be provided by the person applying for the role. This is called a basic DBS check and only shows unspent convictions and conditional cautions. This is the only report that can be supplied by a potential employee. The 3 other levels of check are standard, enhanced and enhanced with barring and can only be requested by an employer. The standard check provides information on spent & unspent convictions, cautions and reprimands and shows final warnings. An enhanced check is the same as a standard DBS check but also includes information from local police but must be relevant to the role being applied for. The enhanced with barring check is the most thorough DBS check. It's the same as an enhanced DBS check but also checks the person against a barred list. If I was to make a guess, it sounds like the employers may have accepted the basic check provided to them by this monster rather than requesting one for themselves. They did do the right thing and drop him like hot bricks the moment this all came to light though.

But if someone doesn’t have a criminal record, then… You would pick up this sort of thing doing a standard due diligence, but you need investigators and lawyers to do that properly. As far as my knowledge goes it might have something to do with 'Contempt of court'. It happens when someone risks unfairly influencing a court case. It may stop somebody from getting a fair trial and can affect a trial’s outcome. Contempt of court includes: disobeying or ignoring a court order taking photos or shouting out in court refusing to answer the court’s questions if you’re called as a witness publicly commenting on a court case, for example on social media or online news articles Hope this helps anyone on UK law.

I wonder if it's just fact that they only went for the £18 one and not the £38 one. The £18 one only shows convictions and not arrests and charges. I know it's a small amount of money, but it's believable that a non-league team would do it.
I'm all for holding clubs accountable but this is one of those cases that some criticism should be withheld. 99.99% of low league teams are amateur/volunteers from the boardroom to the lunch lady. Meaning not everyone is savvy on these kind of matters. Secondly, the players are amateurs with fulltime jobs. So unless they're real close mates will only see each other maybe at best 12hours a week during the season. 1-2 training sessions and matchday. Unless you're a complete spaz you're not going to be asking "Hey bro how's your court case for beating up for a toddler going?" I don't believe there was any cover up or any untoward behaviour by th club. So sure , they should of paid for the enhanced report but at the very least they did some checks and thought that was comprehensive enough. I also have to wonder why something as serious as this would not be flagged even on the basic report. Which is also a massive concern - it should at the very least say that there is an ongoing matter before the magistrate. Just a mistake due to inexperience running a football club.

As someone who manages an amateur football team in England, I can categorically say that safeguarding by the FA is a complete joke. Let me explain: There are 2 types of DBSs (background checks) in the UK, standard and enhanced. Standard is your typical criminal record check, mostly used by generic jobs to prove you're fit to work for them eg. You don't want a guy convicted for money laundering working in a bank, but it doesn't mean he's gonna touch children so he might be OK in a school, although wouldn't be great morally. Enhanced is what is required in the UK in order to be able to work with children or other vulnerable groups (such as the elderly or disabled). These bring up any founded accusations, historical behaviours or question marks that do not meet the level of being illegal but could be an indicator of something down the line. And, by work, this does not necessarily mean a paid job, although it could be. For example, could be a volunteer manager of a u12s side. Up until the start of the 2023/24 season, managers of any football clubs did not require ANY level of background check to do that role. That being said, if your club had under 18s, you would be required to have an enhanced check as part of UK law on working with children. As of the start of that season, managers are only now required to hold an enhanced DBS check to be able to start working regardless of whether children are involved. This explains why Hashtag only conducted a standard background check, and why nothing was flagged (because there wasn't yet a conviction). If that wasn't bad enough, here is an anecdote from a couple of seasons back from my own experience that makes things far worse. I had an enhanced DBS check that the FA had conducted themselves and not correctly uploaded to their system, meaning the system did not believe I had a valid check despite the fact a human could go into my account and verify that I did actually have one. As manager of an adult club (ie we have no youth teams), I can sign players as young as 16 to play for me, who legally class as minors, and so registering them requires a valid enhanced DBS check. So I was registering some 16 and 17 year olds to my team, and the system was just allowing me, despite the fact that it didn't believe I had a valid check. Not only that, but the registrations were then approved. I only realised there was an issue when the FA site kept bugging out with teamsheets caused by the conflict above, and so I had to be told what was going on when emailing their help team. I think childrens/youth leagues are properly monitored although I have no experience there so don't know for certain, however if I were a parent of an under 18 I wouldn't trust putting them into a senior team, where either incompetence or deliberate negligence means people can very easily slip through the cracks.

A UK DBS (Disclosure and Barring Service) is a check that must be done for hiring in positions of potential power or dealing with vulnerable people as part of your day to day job. It is actually insane that he was given the all clear by the government with such serious charges over his head and although innocent until proven guilty is the standard, with such serious charges it should have been flagged in the system. To put into context on when a DBS check is performed I've had to go through DBS check for being a nursery assistant (obviously) and even as a supermarket delivery driver.
Enfield Borough are in the 9th tier, not 13th tier. They finished 13th in the previous season. 9th tier would mean 5 consecutive promotions will put it into League 2 and the professional leagues.
All the leagues below the pro league (Sky bet league 2) are part of the "step" system. The conference league (or national league) is step one aka 5th English football tier. So Zealand is correct actually.

No knowing the football club backgrounds but working for a major 100k+ employee company in their HR department, pre employment checks would not show any ongoing legal cases just current convictions. However, the employee would absolutely have to disclose any convictions that occur following their hiring legally (it would just be common courtesy to mention ongoing legal/criminal action too) and such conviction carries gross misconduct as it can be justified that the conviction impinges on the employer and employee relationship. Not telling them after conviction just strengthens the companies justification.

I think there is an exception when it relates to sexual crimes, where charges might flag prior to trial but i'm not 100% certain of that. But yeah, innocent until proven guilty. There are upsides, there are downsides. Guilty until proven innoccent would also have upsides and downsides. Its a shitty situation that really doesn't have a great answer. If they had known of the charges, the likely action would be suspend them until trial. But yeah, ultimately. Its a difficult situation.

HE would have to have waht is called Enhanced DBS this basically checks all criminal records, makes sure that people can work with children and vulnerable people however the issue is, this guy didnt yet have a criminal record - but the flaw that has come about, with the Enhanced check the Inspector of police has the chance to divulge any information they feel might be relevant - think one example i know personally a teacher was accused of having affair with a pupil, but there was no evidence however, on any future enhanced DBS this accusation appeared (the girl did later admit to lying as teacher had given her bad grades) but this should have been highlighted as a serious issue even if he didnt yet have the conviction.
UK law is strange when you are a coach of any sport you have to have background checks done it's standard law procedures to coach kids etc sports club have to do this by law the worker has to give details to the employer if they've been arrested or not if they don't put in that they have been arrested the club can ask for the background checks if the person has been convicted to prison they won't employ you

A UK DBS (Disclosure and Barring Service) is a check that must be done for hiring in positions of potential power or dealing with vulnerable people as part of your day to day job. It is actually insane that he was given the all clear by the government with such serious charges over his head and although innocent until proven guilty is the standard, with such serious charges it should have been flagged in the system. To put into context on when a DBS check is performed I've had to go through DBS check for being a nursery assistant (obviously) and even as a supermarket delivery driver.
Enfield Borough are in the 9th tier, not 13th tier. They finished 13th in the previous season. 9th tier would mean 5 consecutive promotions will put it into League 2 and the professional leagues.
All the leagues below the pro league (Sky bet league 2) are part of the "step" system. The conference league (or national league) is step one aka 5th English football tier. So Zealand is correct actually.
@@SeranaTheStudent Actually no you're wrong. Rewatch this part 4:35, specifically states tier 13 (Enfield finished 13th so assume that's what he's reading). I'm also incorrect partially as they're in the Eastern Counties League Division One South which is the 10th tier.

There are truly some vile people out there - that man definitely deserves a hefty prison sentence - hopefully life in prison but I don’t know if that will happen.
No knowing the football club backgrounds but working for a major 100k+ employee company in their HR department, pre employment checks would not show any ongoing legal cases just current convictions. However, the employee would absolutely have to disclose any convictions that occur following their hiring legally (it would just be common courtesy to mention ongoing legal/criminal action too) and such conviction carries gross misconduct as it can be justified that the conviction impinges on the employer and employee relationship. Not telling them after conviction just strengthens the companies justification.
I struggle to believe no-one in these clubs knew, from purely word of mouth in the communities.

Background checks would only find convictions. He hadn't been convicted yet. I think there is an exception when it relates to sexual crimes, where charges might flag prior to trial but i'm not 100% certain of that.
But yeah, innocent until proven guilty. There are upsides, there are downsides. Guilty until proven innoccent would also have upsides and downsides. Its a shitty situation that really doesn't have a great answer.
If they had known of the charges, the likely action would be suspend them until trial. But yeah, ultimately. Its a difficult situation.

HE would have to have waht is called Enhanced DBS this basically checks all criminal records, makes sure that people can work with children and vulnerable people however the issue is, this guy didnt yet have a criminal record - but the flaw that has come about, with the Enhanced check the Inspector of police has the chance to divulge any information they feel might be relevant - think one example i know personally a teacher was accused of having affair with a pupil, but there was no evidence however, on any future enhanced DBS this accusation appeared (the girl did later admit to lying as teacher had given her bad grades) but this should have been highlighted as a serious issue even if he didnt yet have the conviction.
UK law is strange when you are a coach of any sport you have to have background checks done it's standard law procedures to coach kids etc sports club have to do this by law the worker has to give details to the employer if they've been arrested or not if they don't put in that they have been arrested the club can ask for the background checks if the person has been convicted to prison they won't employ you

Two-tier UK system covering this up just like they did with the grooming gangs. We need to apply for DBS Checks when doing any job which involves interaction with minors or vulnerable people. How this guy was able to pass all these checks multiple times indicates it was scrubbed from his record.
