If he has an open DWI from 2019 it means he failed to appear. If he already failed to appear, why is he allowed to walk?

Not understanding why on the first guy who looked like he is Hispanic and admits that he's undocumented that they immediately can't take him into custody and start deportation. If they have to give him jail time for this offense then let's start it now and then start the deportation, why was he given another chance, hard for me to understand?
This defendant has pending cases & they'll want to dispose of them all at once. He'll be deported from either jail or prison.
Deportation comes after you answer to your crimes. There is Law and order- a system to things. Just a really broken one.
