      @osteenjoseph I suspect that your question was rhetorical, but it's because they're ENFORCERS for the wealthy and politically connected (those who create laws and their donors). The enforcers' bosses care more about the number of boots on the ground keeping us in line than they care about their enforcers' ability to testify in court.
      It's one of the reasons that we're told to fight it out in court rather than by the roadside. If we all started fighting back in the streets when they fail to uphold their end of the social contract, the enforcers would be overwhelmed and their bosses would lose control. If that happened, the gov would fear the people in lieu of the people fearing the gov.

    The Supreme Court has previously ruled that an officer requesting a driver's license at a traffic stop is not considered a search or seizure (Kansas v. Glover). Also, it is in fact Arizona law that a driver must present their license and registration when requested at a traffic stop, regardless of the reason behind the stop, and failure to do so is a Class II Misdemeanor (A.R.S. 28-1595(B)).
    Or you know, just don't do 71 in a 45.

    • @bearmotorcycle7305
      @bearmotorcycle7305 ปีที่แล้ว +31

      What is considered a traffic stop in AZ? Just the activity of being pulled over? Does AZ law require identification “just because” at anytime whenever behind the steering wheel?
      My municipal police idents themselves and reason for stop before asking for identification. Supposedly, they do that for officer safety. On the odd occasion the driver just murdered someone an hour earlier, it saves the officer from being shot if they just disclose the reason for the stop as a (simple) traffic violation.

    • @DeathScouter
      @DeathScouter ปีที่แล้ว +75

      If you're going to try cite law.... cite it correctly. Words matter. Arizona law requires a driver to "DISPLAY", not "present", not "hand over", etc. This officer who, "does this for a living" insists a person "GIVE ME" their driver's license, which is not a lawful command. He also instructs them to "not say another word", again a clear violation of the 1st Amendment and a "command" that is no where in his authority to issue.
      28-3169. Possession and display of driver license; defense
      A. A licensee shall have a legible driver license in the licensee's immediate possession at all times when operating a motor vehicle. On demand of a justice of the peace, a police officer or a field deputy or inspector of the department, a licensee shall DISPLAY the license.

      The Pinal county sheriffs office has the time to do all this editing of Frank (sometimes) being foolish. The driver was accused of speeding, it was not proven in a court of law, in America we don't convict people on the side of the road. Frank said it was a Chrysler clear as day and we know super Frank does this for a living all day long, he tells everyone that on every stop. How could such a super cop get the make of the car wrong? Does he not know a Chrysler from a fancy new Hyundai? Seems dubious, or Frank isn't as great as he says he is. But, he got him on laser at 1000 yards! Wow, what a super duper cop but I wonder if the operations manual recommends using the device at nearly 1/5th of a mile away? Sorry, CASE DISMISSED. Frank's own arrogance created serious reasonable doubt in this case. No matter what traffic law you quote the Constitution and the 4th amendment cannot be infringed. With some LE training, I can tell you with certainty that officers get trained to be manipulatively "nice." You think you're being civil and reasonable by complying without question, but the fact is many officers rely on naivety and ignorance for people to dehumanize themselves by alienating their own civil rights.

      @@gregogrady8027 Except the pig _DID_ know how the 4th Amendment applies to a traffic stop. It was the driver that screwed it up. The cop was an asshole...but he was right and the driver was wrong. When pulled over for a traffic infraction in Arizona (I'm pretty sure all states, but definitely in Arizona), drivers are required by law to display their valid driver's license upon demand of a cop, and failure / refusal to do so is a class 2 misdemeanor.
      The 4th Amendment in no way prevents swine from demanding a driver's license during a traffic stop, even without telling the driver the reason for the stop. Way too many auditors and "rights defenders" _think_ they know and understand the law, but they actually get simple things like this absolutely wrong. A traffic stop is absolutely not the same as a cop approaching you on the street, whether you or the driver in this video like or understand that.
      The pig was still an asshole, and he's clearly a useless piece of shit, since he couldn't even be bothered to file the damned ticket. But him being a piece of shit doesn't make his understanding of the law in this specific scenario incorrect.

    • @eshootziscrs2868
      @eshootziscrs2868 2 ปีที่แล้ว

      You mean sue you right? "They" don't pay anything, they get paid. We pay them, pay for the cameras, pay for the equipment ( realizing this situation is slightly abnormal in the fact that the cameraman could be a private party and the footage not necessarily public)
      And we pay them to delete our own evidence or blur the transparency of the record.
      The officer notes, correctly so, that there is no law requiring he identify his cause. There is case law supporting the constitutional requirement that a person arrested be informed they are under arrest and the nature of the charges against them. However that case law also allows nothing relating a traffic stop to an arrest, the information is only suggested when possible and practical while the informing of cause or charges is really only for the in court.
      This is a bit off topic specifically but I believe is a broader perspective that addresses these issues.
      The fourth amendment reads,
      The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
      The phrasing leaves no doubt that a reasonable search or seizure is possible and the people would have no right to be free from violation under such "reasonable cause". However there is no period rather a comma indicating that what defines "reasonable" is being addressed. Reasonable would according to a literal reading be defined by a court either finding probable cause and issuing a warrant or not finding cause and denying authority under color of law.
      What has been sold to us over a century of time is to ignore this plain text understanding that only a court has the jurisdiction to find probable cause and issue a warrant. This can hardly be argued as anything but an intentional separation of the powers between the executive/ law enforcement branch and the judicial branch. A check on the abuse of the authority law enforcement has under the law that might be abused if the law is incorrectly interpreted or applied.
      As noted by the narrator, cops usually have probable cause of a traffic violation, they actually witnessed the infraction. Under the law, an officer is limited in his arrest powers to when he personally witnesses a misdemeanor or has a credible corroborated statement from a witness in the case of a felony. Yet the courts have long held a stop may be conducted with RAS. Recently, 2019, Garver v Kansas, the court held that a license plate check, absent any suspicion or cause, that returned information regarding the registered owner, was sufficient RAS to stop a vehicle, without any reasonable belief that the registered owner and the current operator were the same person.
      I personally believe as has been case law for over a century, a person has the lawful right to defend themselves against an unlawful arrest, search, seizure or detention. Against any force under any symbol, uniform or advertised authority. Simply having a uniform does not give authority, does not make every order a lawful command. On one one hand, it does no good to argue law or argue your case with the officer on the road, his mind is already made up, the stop has already occurred. On the other hand, this should rile some hackles, I believe we are all sovereign citizens. Because the definition of sovereign is a prerequisite to freedom. The ultimate power and authority, the final determination. We are free, we choose to be citizen and give our consent to be governed under the constitution of the United States and the laws of the state in which we are. Consent must be freely given or it isn't consent. It must be given with fully informed knowledge as best as possible. A person cannot consent to what they have not been informed of.
      This said, requiring an officer to clearly state a person legal status and the cause upon which the officer is claiming authority seems ridiculously obvious in expectation. The alternative, and it is becoming this way, is that an officer because they claim to be, appear to and likely are real officer, have presumptive authority at their own discretion. In short if an officer says suck my D!≤k it is a lawful order because he's a cop.
      The reality is, courts do give officer this presumptive authority. A criminal dressed as a cop and claiming to be a cop would lawfully be able to commit any crime until it was proven unlawful. They get the presumption of innocence and authority, you and I a expected to submit to anyone identifying as a state agent regardless of law, rights etc, wait and deal with that in court is what we get told.
      Essentially RAS has a very simple definition. Something more than nothing but always improbable and whatever the officer decides.
      Courts cannot consistently define or determine when RAS exist or doesn't. But that doesn't even matter because no court, no judge, no magistrate or city attorney can rule on RAS, use RAS as grounds to give permission, grant authority or warrant action backed by lawful force. There is only one authority that can determine RAS, warrant lawful action and back that action with force under color of law. That one entity is every single individual who manages to get employed as law enforcement.
      It really doesn't matter what a judge later determines, especially not to people like Elijah McClain or Daniel Shaver. It does no good to find the officer was wrong when the harm has long since occurred.
      It's something of a fart in a windstorm to demand an officer articulate cause, charge or anything to a suspect. However I would suggest it is a constitutional right under due process if nothing else, that a person be clearly informed of the officers understanding regarding the citizens legal status.
      Over and over I've watched, witnessed and been party to officers refusing to clarify their position, their presumption of authority. Am I free to go? Am I under arrest? Is that a request or a lawful order? The difficulty in getting simple clarification on these basic questions should not exist, cannot exist within a society of free individuals with protected rights.
      This is the cost of freedom. You either surrender your rights just because you're told to or you risk additional charges and brutality for questioning. The current standards in the courts all but deny any right to resist even unlawful force, even deadly unlawful force a presumptively unlawful
      . You have the burden of showing why your defensive actions were justified by proving the lawful authority not only did not exist but couldn't be reasonable articulate subjective to the perspective of the officer.
      You are looking to the government to solve problems created by government. Suing requires you operate within the judicial branch of government to seek recompensation for acts committed by the same government. And any award you get will be paid by the same people who pay government, minus of course the administration, filing and recording fees the government makes. So yeah, it's a great business plan for them to encourage your suits, keeps them employed and brings in more money they can skim off. But it does nothing to address the root issues. Open transparency should be an obvious necessity of government in a free society. When government has "rights" that citizens don't, the citizen no longer has rights but maybe some privileges. Keep that in mind whenever you hear a person speak of an authority by calling it a right, address a privilege calling it a right. Cops don't have the right to.....they either have the authority or the privilege. Authority comes from law, privilege comes from position. Demanding identification is authority where the law applies, not wearing a seatbelt in violation of law is a privilege of office made as an exception in law.
      It's safest to assume the moment the lights come on that you are arrested and the officer is stating his authority under law. Even the term "lawful" command is deceptive. I can issue a command, it's not unlawful to do so therefore it is a lawful command it just has no lawful authority behind it, with exceptions of course. Anything the officer says or does it not unlawful is lawful, whether backed by lawful authority or not. Two different things really and the conflation of how we say things can leave a lot of ambiguity. How we know if an officer is acting on behalf of his own feelings and comprehensions of law or acting within the lawful constraints of law is impossible to determine. One practical solution is to eliminate the court constructed doctrines that give individuals authority without oversight. We don't need to eliminate human discretion on the individual level, in fact we would encourage that with the accompanying liability and accountability every individual must have. However we could simply eliminate RAS and at the very least significantly prohibit warrantless arrest. To me, an officer who witnesses an infraction doesn't have probable cause, he has reasonable cause based upon his own perspective. The officer has a purponderance of the evidence, first hand eye witness, dashcam, radar whatever. Honestly, not enforcing speed limits effectively is beneficial to policing in an investigatory policing state. It means the norm will be everyone speeds so there is always "cause" for pretextual investigatory stops searching for crime. Not that they can't find a reason to stop anyone anytime it's just a convenient excuse and keeps the revenue flowing. Imagine solving all crime and need for police, that would be perhaps the very worst thing to happen to government. It's almost like it is in the government's interest to perpetuate crime, increase crime, perpetrate crime or create crime. Perhaps by making more laws they actually create more crime and more need for more government and more laws. Maybe not.
