If you don’t take the sobriety test it’s an automatic misdemeanor in Minnesota and you lose your license for a year. You said it wasn’t required in Minnesota.

The only time qualified immunity matters is in egregious false arrest where there is bodily injury or property damage.

I don't get what cops think their job is, why does he think he should waste so much time "trying to get to the bottom" of why the guy "had an attitude". Surely it's not a part of their job to try to make themselves feel like the traffic stop, if you can even call it that, was right and just. Why would you want this cop fired? I agree with the driver that there was no need to be approached by the cop, but one less-than-stellar traffic stop hardly calls for the cop to be fired. Put a letter in his file; give him some remedial training. No need to go over the top.
The sheriff of Itasca knows all about retaliatory actions. The city settled a lawsuit on his behalf for over half a million dollars. Makes me think that retaliation is part of the Itasca Sheriff's Office training manual. Thanks for all you do in trying to keep people like them in check. Policing has a long history of retaliation across the world. It seems to be an ingrained attitude of the them and us attitude. I served for many years and found after front line in a really bad violent area I was getting to hardened. It was not my personality. It was also a badge of honour to be tough. I then deliberately moved to a different role and it went away. I eventually took up another career losing my pension etc as I saw to much and could do or say nothing. Retaliation could be life threatening. An excellent and brave service record means less than bashing and abuse. An ex police officer is not popular so you need to relocate far away. I am now a senior health professional which suit me better. Not all Police start off bad. But they are expected to conform. Plus this country did not have the terrible incentive system like USA for money via arrests etc.

This mentality can lead to a superiority complex in police officers, who see citizens as relying entirely on police officers to maintain order in their communities. This line of thought can lead to many negative interactions with police officers, especially younger ones who are fresh out of the academy and full of themselves.

My wife and I were driving back from buying our new truck. I was following her and got stopped because a cop couldn't read my temporary tags due to the red marker. She was pulled up in front of me well over 40ft. He asked who it was, and I told him. He was cool. And went on his way. Some of these guys are simply assholes

I'm not very knowledgeable on the law but I don't think that just because some dude has a warrant and drives a red truck, the police can pull over anyone in a red truck.
Me and my manager got pulled over in the white utility body truck because they were looking for a white utility body truck they said. That's the first time I kicked on my camera and kept it hidden, I was waiting for some BS. He asked my manager where we were coming from and he told him. Cop asks if we were coming from another area ,and my manager repeated what he said the first time. Cop looked back at his partner with a concerned look ,they were definitely hunting for someone. He cut us loose and they burned tire the other way. Whole thing took maybe 90 seconds. Didnt ask for id or anything, I was waiting for that one. I wager since they really were looking for someone, they didnt have time to mess around with the wrong guys (us) and need to drum up some charges.
Such an embarrassment for his department. All of this officer's colleagues, who take their duty seriously, have to fight the distrust that this behavior generates.
I'm allways in awe that in the USA a breathalizer is not the first thing used by a cop if he's suspicious of DUI. Here in Europe (at least in Spain) if they stop you to check if you are sober while driving the first thing they make you do is a breath test. If you pass it but you are obviously not in your best moment, they can proceed to field tests. If you fail the field tests (you must actually fail them, it's not like in the US, there's no quota to falsely fill and police is expected to have standards and professionalism,, as it's pretty difficult to get a job as a cop here: minimal bachelor studies required, a lot of academy studies and training, and after that only the best are given a job because of limitation of job opportunities as a cop; when the government announces new places to fill, every person interested to be a cop must pass a test and get higher marks than the rest to compete with everyone else for that job) they can force you to blood test. Of course, you can deny breath test, but in echange of performing a blood test instead. Usually when police checkpoints are stablished to stop drunken drivers they also carry with them an ambulance with the personal and equipment necessary to perform blood tests on the field.

He is a nightmare and he tried pushing away my rights from the moment of the traffic stop and then he proceeded to pull my buddy out of the car and ask him “does your buddy have any crack or dope on him” speaking about me becausey DL address showed North Mpls and that’s considered the bad area so they figured I must be running drugs up north.

I remember when a California police department or BMV entered one digit of my social incorrectly so I had a warrant on my license. I got pulled over 6 times leaving work before I could resolve the issue. It was harder for them to correct their mistake than it was for them to make it!

You've gotta consider how much of an inconvenience it is to be arrested. Not only the time spent in jail, but the potential ramifications. With the guilty until proven innocent mindset ingrained in society, simply being arrested is enough to be fired or denied employment opportunities among other important things. Considering all of this, it's really a shame that false arrest isn't taken as seriously as it is. We truly live in a police state.
Not only what you mentioned but the vehicle will be towed and impounded and your guilt or innocence will be determined by a corrupt prosecutor and judge because cops are sworn in and would never lie.
It helped in the end. I made the same comment. He kept the cop talking and the cop gave the “I feared for my life” lie. Feared for his life but decides to engage by giving a roadside in the absence of probable cause.

Departments need a civilian oversight committee that handles complaints and investigations. Having departments investigate themselves is beyond ridiculous. IA will nearly always side with police despite evidence against police. This needs to stop.
The city of Austin just voted for civilian oversight by an 80 to 20 percent margin, and the police union says that they'll just ignore the vote. Policing the US is corrupt from the top to the bottom.

I don't get what cops think their job is, why does he think he should waste so much time "trying to get to the bottom" of why the guy "had an attitude". Surely it's not a part of their job to try to make themselves feel like the traffic stop, if you can even call it that, was right and just. This is a job where you really need to remove emotion/ego from like a lot of others do, seems like cops just have a hard time over it because at the moment they don't have to as they get away with this kinda thing and they have too much power to just make up charges/reasons to breach a person's rights.

You can't sue the officer civilly. Qualified immunity, it is a plague on our entire country at the moment and MUST be reformed.
He won't even get a stern talking to. Cops can do anything they want, up to and including killing you in cold blood, and get away with it as long as their lies and paperwork are consistent.

Policing has a long history of retaliation across the world. It seems to be an ingrained attitude of the them and us attitude.
I served for many years and found after front line in a really bad violent area I was getting to hardened.
It was not my personality.
It was also a badge of honour to be tough.
I then deliberately moved to a different role and it went away.
I eventually took up another career losing my pension etc as I saw to much and could do or say nothing.

This deputy, just like many others, is used to people following his every unlawful demand either because they are scared or they are unaware of their rights. I recommend never telling them you're going to file a complaint! Don't give them a heads up! File your complaint from the top of the chain of command to the bottom. Less chance of cover-ups or adjustment to reports if they don't know in advance ones intention to file a complaint.
And never talk about "how long you've been sober" (as proud of that as you might be. You become an easy mark to have something planted.

My wife and I were driving back from buying our new truck. I was following her and got stopped because a cop couldn't read my temporary tags due to the red marker.
She was pulled up in front of me well over 40ft. He asked who it was, and I told him. He was cool. And went on his way. Some of these guys are simply assholes

Me and my manager got pulled over in the white utility body truck because they were looking for a white utility body truck they said.
That's the first time I kicked on my camera and kept it hidden, I was waiting for some BS.
He asked my manager where we were coming from and he told him.
Cop asks if we were coming from another area ,and my manager repeated what he said the first time.
Cop looked back at his partner with a concerned look ,they were definitely hunting for someone.
He cut us loose and they burned tire the other way.
Whole thing took maybe 90 seconds.
Didnt ask for id or anything, I was waiting for that one.

I'm allways in awe that in the USA a breathalizer is not the first thing used by a cop if he's suspicious of DUI. Here in Europe (at least in Spain) if they stop you to check if you are sober while driving the first thing they make you do is a breath test. If you pass it but you are obviously not in your best moment, they can proceed to field tests. If you fail the field tests (you must actually fail them, it's not like in the US, there's no quota to falsely fill and police is expected to have standards and professionalism,, as it's pretty difficult to get a job as a cop here: minimal bachelor studies required, a lot of academy studies and training, and after that only the best are given a job because of limitation of job opportunities as a cop; when the government announces new places to fill, every person interested to be a cop must pass a test and get higher marks than the rest to compete with everyone else for that job) they can force you to blood test. Of course, you can deny breath test, but in echange of performing a blood test instead. Usually when police checkpoints are stablished to stop drunken drivers they also carry with them an ambulance with the personal and equipment necessary to perform blood tests on the field.

Rule #1, keep your window rolled up and never talk to police but immediately record them the whole time. This officer like many others appears to think they can order ID from anyone at any time. This needs to be addressed with every law enforcement agency to properly train on when you can or cannot demand ID.

He is a nightmare and he tried pushing away my rights from the moment of the traffic stop and then he proceeded to pull my buddy out of the car and ask him “does your buddy have any crack or dope on him” speaking about me becausey DL address showed North Mpls and that’s considered the bad area so they figured I must be running drugs up north.

I remember when a California police department or BMV entered one digit of my social incorrectly so I had a warrant on my license. I got pulled over 6 times leaving work before I could resolve the issue. It was harder for them to correct their mistake than it was for them to make it!

@@siryizzur yehh try going thru tht IRL with jackass incompetent police vus ive too too many times had to an I'd have had my vids sent to one of these guys already if I was able get my phone running properly in sum instances and actually knew how to work a piece of technology properly cus I honestly never been too kucj into technology at all ik ik so dino of me but growing up with a pos mother who wouldnt even buy me a tablet pet alone phone unless I could pay for it myself yehh kinda just makes u resentful towards electronics considering u grew up seein everyone with one and u just had a book and yer thought's an entire police system in my opinion need be torn down an rebuilt from wut its oaths and all were meant to be stood at and do better with who they hire and if those people who wanna be a cop can deal with everyday citizens without letting their feelings or egos get beyond their jobs discription and fact their there to dissolve any situations and get to the bottom of wut is and isn't the issue of the situation and then problem solve how to thus corral the situation where both parties are happy or least not displeased with the outcome and can go on their way instead of tryna pull all this oh I'm a cop u do as I say no matter what cus my word is law when its not and just doesn't help shit like its fuked up lawyers take eight years of law school just to even get a chance to take their bar exam while cops take six bs months of bs academy training that's only set on brainwashing them into thinking tht every person they approach they immediately need to think that they are breaking sum sort of law or that person HAS to obey every word outta their mouth or around every corner is a threat waiting to take their lives from them its just like with dogs their not bad animals they just had shitty owners who didn't treat them right or teach them properly ik its a bad representation to this but I strongly feel tht police system and how their trained hella hella affects their thinking and how they go about their jobs just like it would affect a pit bull if it wasn't trains properly and only treated like crap and the such if tht makes much analogy sense to the cop part of it haha
In my opinion lackluster is better than ATA, I lost a lot of respect for ATA after his video about the lady that was just trying to eat her sandwich in front of a sign that said “Panera bread parking”. He took the side of a power tripping and douchey property owner, while he shat on cops that were generally concerned about harassing citizens over stupid stuff.

If the cop documents he gave a "verbal warning" for trailer lights and never gave the warning.. isn't he lying in an official document?

this deputy was a real prick and i would have a lot of fun with him. i hope he sues itasca county. if he lives near there he probably will be subjected to retaliation from these criminals in uniform.

Never submit!!! He lost that case before it ever started. You have to let them arrest you or they don't lose their qualified immunity.

You've gotta consider how much of an inconvenience it is to be arrested. Not only the time spent in jail, but the potential ramifications. With the guilty until proven innocent mindset ingrained in society, simply being arrested is enough to be fired or denied employment opportunities among other important things. Considering all of this, it's really a shame that false arrest isn't taken as seriously as it is. We truly live in a police state.
Not only what you mentioned but the vehicle will be towed and impounded and your guilt or innocence will be determined by a corrupt prosecutor and judge because cops are sworn in and would never lie.

He said he won't answer questions then proceeds to do a test and tell the pig he has been sober for 6 years.

It helped in the end. I made the same comment. He kept the cop talking and the cop gave the “I feared for my life” lie. Feared for his life but decides to engage by giving a roadside in the absence of probable cause.

ever notice, once you ask for a "business" card they start talking to you, almost like they're trying to get you upset so you forget to ask again. Because we all Know officers love citizens so much you need to ask multiple times.
